    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To require coordinated National Institute of Standards and Technology science and research activities regarding illicit drugs containing xylazine, novel synthetic opioids, and other substances of concern, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section identifier="/us/sComp/118/23/s1" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t15/s271">15 U.S.C. 271 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content class="block" style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Testing, Rapid Analysis, and Narcotic Quality Research Act of 2023</shortTitle>” or the “<shortTitle style="-uslm-dtd:quote">TRANQ Research Act of 2023</shortTitle>”.</content>
        </section>
        <section identifier="/us/sComp/118/23/s2" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t15/s278u">15 U.S.C. 278u</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">XYLAZINE DETECTION AND ANALYSIS. </heading>
            <subsection identifier="/us/sComp/118/23/s2/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Definitions.—</heading><chapeau style="-uslm-dtd:text">In this section:</chapeau>
                <paragraph identifier="/us/sComp/118/23/s2/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Director.—</heading><content style="-uslm-dtd:text">The term “<quotedText style="-uslm-dtd:quote">Director</quotedText>” means the Director of the National Institute of Standards and Technology.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/118/23/s2/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Federal laboratory.—</heading><content style="-uslm-dtd:text">The term “<quotedText style="-uslm-dtd:quote">Federal laboratory</quotedText>” has the meaning given such term in section 4 of the Stevenson-Wydler Technology Innovation Act of 1980 (15 U.S.C. 3703).</content>
                </paragraph>
                <paragraph identifier="/us/sComp/118/23/s2/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Institute.—</heading><content style="-uslm-dtd:text">The term “<quotedText style="-uslm-dtd:quote">Institute</quotedText>” means the National Institute of Standards and Technology.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/118/23/s2/a/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Institution of higher education.—</heading><content style="-uslm-dtd:text">The term “<quotedText style="-uslm-dtd:quote">institution of higher education</quotedText>” has the meaning given such term in section 101 of the Higher Education Act of 1965 (19 U.S.C. 1001).</content>
                </paragraph>
                <paragraph identifier="/us/sComp/118/23/s2/a/5" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">Nonprofit organization.—</heading><content style="-uslm-dtd:text">The term “<quotedText style="-uslm-dtd:quote">nonprofit organization</quotedText>” means an organization described in section 501(c)(3) of the Internal Revenue Code of 1986 and exempt from tax under section 501(a) of such code.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/118/23/s2/a/6" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="6">(6) </num><heading style="-uslm-dtd:header">Xylazine.—</heading><content style="-uslm-dtd:text">The term “<quotedText style="-uslm-dtd:quote">xylazine</quotedText>” means the nonopioid tranquilizer methyl benzene compound frequently used in veterinary medicine as an emetic and sedative with analgesic and muscle relaxant properties.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/118/23/s2/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">In General.—</heading><chapeau style="-uslm-dtd:text">The Director shall—</chapeau>
                <paragraph identifier="/us/sComp/118/23/s2/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">support intramural basic measurement science and research of the Institute to advance—</chapeau>
                    <subparagraph identifier="/us/sComp/118/23/s2/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">analytical methods to identify, understand, differentiate, and categorize substances containing xylazine, novel synthetic opioids, or other new psychoactive substances;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/23/s2/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">measurement technologies to shorten analysis timelines and enhance narcotic and opioid detection and analysis capabilities;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/23/s2/b/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">new data tools, techniques, and processes to identify and publicly disclose relevant information concerning 
substances containing xylazine, novel synthetic opioids, or other new psychoactive substances; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/23/s2/b/1/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">such other areas as the Director determines to be critical to the development and deployment of technologies to measure and analyze the presence of xylazine, novel synthetic opioids, and other new psychoactive substances;</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/118/23/s2/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">support activities to inform and expand the development of near-real time spectrometry capabilities regarding xylazine, novel synthetic opioids, and other new psychoactive substances;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/118/23/s2/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><chapeau style="-uslm-dtd:text">convene and consult with organizations engaged in the analysis of new psychoactive substances to develop coordinated strategies and voluntary best practices for the safe handling, transport, data-sharing, and analysis of substances containing xylazine, novel synthetic opioids, or other new psychoactive substances, including—</chapeau>
                    <subparagraph identifier="/us/sComp/118/23/s2/b/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the Drug Enforcement Administration;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/23/s2/b/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the Centers for Disease Control and Prevention;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/23/s2/b/3/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">the National Institute on Drug Abuse;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/23/s2/b/3/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">Federal laboratories;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/23/s2/b/3/E" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">States and territories;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/23/s2/b/3/F" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">State fusion centers;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/23/s2/b/3/G" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="G">(G) </num><content style="-uslm-dtd:text">the private sector;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/23/s2/b/3/H" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="H">(H) </num><content style="-uslm-dtd:text">intergovernmental organizations;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/23/s2/b/3/I" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">institutions of higher education, and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/23/s2/b/3/J" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="J">(J) </num><content style="-uslm-dtd:text">nonprofit organizations;</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/118/23/s2/b/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">establish or expand collaborative partnerships or consortia with other government agencies and persons engaged in related research and development, such as institutions of higher education, Federal laboratories, public health agencies, intergovernmental organizations, and the private sector, to enhance narcotic and opioid detection and analysis capabilities regarding xylazine, novel synthetic opioids, and other new psychoactive substances; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/118/23/s2/b/5" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">encourage graduate and post-graduate research to include detection and identification of xylazine and other new psychoactive substances in relevant course studies when practicable.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/118/23/s2/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Controls.—</heading><content style="-uslm-dtd:text">In carrying out activities under this section, the Director shall ensure proper security controls are implemented to protect sensitive information, as the Director considers appropriate and consistent with applicable provisions of law.</content>
            </subsection>
            <subsection identifier="/us/sComp/118/23/s2/d" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Report.—</heading><content style="-uslm-dtd:text">Not later than 1 year after the date of the enactment of this Act, the Director shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Science, Space, and Technology of the House of Representatives a report on the implementation of this section. Such report may include recommendations for legislative action to improve the ability of the Director to carry out this section.</content>
            </subsection>
        </section>
        <section identifier="/us/sComp/118/23/s3" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><heading style="-uslm-dtd:header">STUDY ON UNITED STATES GOVERNMENT TECHNOLOGIES AND ANALYTICAL METHODS TO DETECT AND IDENTIFY NEW PSYCHOACTIVE SUBSTANCES. </heading>
            <subsection identifier="/us/sComp/118/23/s3/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Study.—</heading>
                <paragraph identifier="/us/sComp/118/23/s3/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Comptroller General of the United States shall conduct a study of the capabilities of the Federal 
Government to respond to the threats of new psychoactive substances such as xylazine.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/118/23/s3/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Matters evaluated.—</heading><chapeau style="-uslm-dtd:text">The study conducted pursuant to paragraph (1) shall include an evaluation of the following:</chapeau>
                    <subparagraph identifier="/us/sComp/118/23/s3/a/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">The capabilities, including technologies and analytical methods, of Federal, State, and local agencies to detect and identify new psychoactive substances such as xylazine.</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/23/s3/a/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">An analysis of timeframes for identification and development of technologies and methods to identify new psychoactive substances by Federal, State, and local agencies.</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/23/s3/a/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">Facilities, including laboratories, used by Federal, State, and local agencies for the identification of new psychoactive substances such as xylazine.</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/23/s3/a/2/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">Federal grant programs to fund new technology development to detect and identify new psychoactive substances.</content>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/118/23/s3/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Report.—</heading><content style="-uslm-dtd:text">Not later than 2 years after the date of the enactment of this Act, the Comptroller General shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Science, Space, and Technology of the House of Representatives a report containing the findings of the Comptroller General with respect to the study conducted pursuant to subsection (a).</content>
            </subsection>
        </section>
    </main>
