    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To authorize the Secretary of the Interior to cooperate with the States on the border with Mexico and other appropriate entities in conducting a hydrogeologic characterization, mapping, and modeling program for priority transboundary aquifers, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section identifier="/us/sComp/109/448/s1" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t42/s1962">42 U.S.C. 1962 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content class="block" style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">United States-Mexico Transboundary Aquifer Assessment Act</shortTitle>”.</content>
        </section>
        <section identifier="/us/sComp/109/448/s2" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t42/s1962">42 U.S.C. 1962 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">PURPOSE. </heading>
            <content class="block" style="-uslm-dtd:text">The purpose of this Act is to direct the Secretary of the Interior to establish a United States-Mexico transboundary aquifer assessment program to systematically assess priority transboundary aquifers.</content>
        </section>
        <section identifier="/us/sComp/109/448/s3" role="definitions" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t42/s1962">42 U.S.C. 1962 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">DEFINITIONS. </heading>
            <chapeau class="block" style="-uslm-dtd:text">In this Act:</chapeau>
            <paragraph identifier="/us/sComp/109/448/s3/1" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Aquifer.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">aquifer</term>” means a subsurface water-bearing geologic formation from which significant quantities of water may be extracted.</content>
            </paragraph>
            <paragraph identifier="/us/sComp/109/448/s3/2" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">IBWC.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">IBWC</term>” means the International Boundary and Water Commission, an agency of the Department of State.</content>
            </paragraph>
            <paragraph identifier="/us/sComp/109/448/s3/3" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Indian tribe.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Indian tribe</term>” means an Indian tribe, band, nation, or other organized group or community—</chapeau>
                <subparagraph identifier="/us/sComp/109/448/s3/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">that is recognized as eligible for the special programs and services provided by the United States to Indians because of their status as Indians; and</content>
                </subparagraph>
                <subparagraph identifier="/us/sComp/109/448/s3/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the reservation of which includes a transboundary aquifer within the exterior boundaries of the reservation.</content>
                </subparagraph>
            </paragraph>
            <paragraph identifier="/us/sComp/109/448/s3/4" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Participating state.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Participating State</term>” means each of the States of Arizona, New Mexico, and Texas.</content>
            </paragraph>
            <paragraph identifier="/us/sComp/109/448/s3/5" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">Priority transboundary aquifer.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">priority transboundary aquifer</term>” means a transboundary aquifer that has been designated for study and analysis under the program.</content>
            </paragraph>
            <paragraph identifier="/us/sComp/109/448/s3/6" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="6">(6) </num><heading style="-uslm-dtd:header">Program.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">program</term>” means the United States-Mexico transboundary aquifer assessment program established under section 4(a).</content>
            </paragraph>
            <paragraph identifier="/us/sComp/109/448/s3/7" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="7">(7) </num><heading style="-uslm-dtd:header">Reservation.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">reservation</term>” means land that has been set aside or that has been acknowledged as having been set aside by the United States for the use of an Indian  tribe, the exterior boundaries of which are more particularly defined in a final tribal treaty, agreement, executive order, Federal statute, secretarial order, or judicial determination.</content>
            </paragraph>
            <paragraph identifier="/us/sComp/109/448/s3/8" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="8">(8) </num><heading style="-uslm-dtd:header">Secretary.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Secretary</term>” means the Secretary of the Interior, acting through the Director of the United States Geological Survey.</content>
            </paragraph>
            <paragraph identifier="/us/sComp/109/448/s3/9" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="9">(9) </num><heading style="-uslm-dtd:header">Transboundary aquifer.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">transboundary aquifer</term>” means an aquifer that underlies the boundary between a Participating State and Mexico.</content>
            </paragraph>
            <paragraph identifier="/us/sComp/109/448/s3/10" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="10">(10) </num><heading style="-uslm-dtd:header">Tri-regional planning group.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Tri-Regional Planning Group</term>” means the binational planning group comprised of—</chapeau>
                <subparagraph identifier="/us/sComp/109/448/s3/10/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the Junta Municipal de Agua y Saneamiento de Ciudad Juarez;</content>
                </subparagraph>
                <subparagraph identifier="/us/sComp/109/448/s3/10/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the El Paso Water Utilities Public Service Board; and</content>
                </subparagraph>
                <subparagraph identifier="/us/sComp/109/448/s3/10/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">the Lower Rio Grande Water Users Organization.</content>
                </subparagraph>
            </paragraph>
            <paragraph identifier="/us/sComp/109/448/s3/11" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="11">(11) </num><heading style="-uslm-dtd:header">Water resources research institutes.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">water resources research institutes</term>” means the institutes within the Participating States established under section 104 of the Water Resources Research Act of 1984 (42 U.S.C. 10303).</content>
            </paragraph>
        </section>
        <section identifier="/us/sComp/109/448/s4" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="4">SEC. 4. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t42/s1962">42 U.S.C. 1962 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">ESTABLISHMENT OF PROGRAM. </heading>
            <subsection identifier="/us/sComp/109/448/s4/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">The Secretary, in consultation and cooperation with the Participating States, the water resources research institutes, Sandia National Laboratories, and other appropriate entities in the United States and Mexico, and the IBWC, as appropriate, shall carry out the United States-Mexico transboundary aquifer assessment program to characterize, map, and model priority transboundary aquifers along the United States-Mexico border at a level of detail determined to be appropriate for the particular aquifer.</content>
            </subsection>
            <subsection identifier="/us/sComp/109/448/s4/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Objectives.—</heading><chapeau style="-uslm-dtd:text">The objectives of the program are to—</chapeau>
                <paragraph identifier="/us/sComp/109/448/s4/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">develop and implement an integrated scientific approach to identify and assess priority transboundary aquifers, including—</chapeau>
                    <subparagraph identifier="/us/sComp/109/448/s4/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><chapeau style="-uslm-dtd:text">for purposes of subsection (c)(2), specifying priority transboundary aquifers for further analysis by assessing—</chapeau>
                        <clause identifier="/us/sComp/109/448/s4/b/1/A/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the proximity of a proposed priority transboundary aquifer to areas of high population density;</content>
                        </clause>
                        <clause identifier="/us/sComp/109/448/s4/b/1/A/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the extent to which a proposed priority transboundary aquifer would be used;</content>
                        </clause>
                        <clause identifier="/us/sComp/109/448/s4/b/1/A/iii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">the susceptibility of a proposed priority transboundary aquifer to contamination; and</content>
                        </clause>
                        <clause identifier="/us/sComp/109/448/s4/b/1/A/iv" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">any other relevant criteria;</content>
                        </clause>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/109/448/s4/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">evaluating all available data and publications as part of the development of study plans for each priority transboundary aquifer;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/109/448/s4/b/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">creating a new, or enhancing an existing, geographic information system database to characterize the spatial and temporal aspects of each priority transboundary aquifer; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/109/448/s4/b/1/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><chapeau style="-uslm-dtd:text">using field studies, including support for and expansion of ongoing monitoring and metering efforts, to develop—</chapeau>
                        <clause identifier="/us/sComp/109/448/s4/b/1/D/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the additional data necessary to adequately define aquifer characteristics; and</content>
                        </clause>
                        <clause identifier="/us/sComp/109/448/s4/b/1/D/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">scientifically sound groundwater flow models to assist with State and local water management and administration, including modeling of relevant groundwater and surface water interactions;</content>
                        </clause>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/109/448/s4/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">consider the expansion or modification of existing agreements, as appropriate, between the United States Geological Survey, the Participating States, the water resources research institutes, and appropriate authorities in the United States and Mexico, to—</chapeau>
                    <subparagraph identifier="/us/sComp/109/448/s4/b/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">conduct joint scientific investigations;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/109/448/s4/b/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">archive and share relevant data; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/109/448/s4/b/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">carry out any other activities consistent with the program; and</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/109/448/s4/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><chapeau style="-uslm-dtd:text">produce scientific products for each priority transboundary aquifer that—</chapeau>
                    <subparagraph identifier="/us/sComp/109/448/s4/b/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">are capable of being broadly distributed; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/109/448/s4/b/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">provide the scientific information needed by water managers and natural resource agencies on both sides of the United States-Mexico border to effectively accomplish the missions of the managers and agencies.</content>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/109/448/s4/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Designation of Priority Transboundary Aquifers.—</heading>
                <paragraph identifier="/us/sComp/109/448/s4/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In General.—</heading><chapeau style="-uslm-dtd:text">For purposes of the program, the Secretary shall designate as priority transboundary aquifers—</chapeau>
                    <subparagraph identifier="/us/sComp/109/448/s4/c/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the Hueco Bolson and Mesilla aquifers underlying parts of Texas, New Mexico, and Mexico;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/109/448/s4/c/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the Santa Cruz River Valley aquifers underlying Arizona and Sonora, Mexico; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/109/448/s4/c/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">the San Pedro aquifers underlying Arizona and Sonora, Mexico.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/109/448/s4/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Additional aquifers.—</heading><content style="-uslm-dtd:text">The Secretary may, using the criteria under subsection (b)(1)(A), evaluate and designate additional priority transboundary aquifers which underlie New Mexico or Texas.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/109/448/s4/d" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Cooperation With Mexico.—</heading><content style="-uslm-dtd:text">To ensure a comprehensive assessment of priority transboundary aquifers, the Secretary shall, to the maximum extent practicable, work with appropriate Federal agencies and other organizations to develop partnerships with, and receive input from, relevant organizations in Mexico to carry out the program.</content>
            </subsection>
            <subsection identifier="/us/sComp/109/448/s4/e" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Grants and Cooperative Agreements.—</heading><content style="-uslm-dtd:text">The Secretary may provide grants or enter into cooperative agreements and other agreements with the water resources research institutes and other Participating State entities to carry out the program.</content>
            </subsection>
        </section>
        <section identifier="/us/sComp/109/448/s5" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="5">SEC. 5. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t42/s1962">42 U.S.C. 1962 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">IMPLEMENTATION OF PROGRAM. </heading>
            <subsection identifier="/us/sComp/109/448/s5/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Coordination With States, Tribes, and Other Entities.—</heading><chapeau style="-uslm-dtd:text">The Secretary shall coordinate the activities carried out under the program with—</chapeau>
                <paragraph identifier="/us/sComp/109/448/s5/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the appropriate water resource agencies in the Participating States;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/109/448/s5/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">any affected Indian tribes;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/109/448/s5/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">any other appropriate entities that are conducting monitoring and metering activity with respect to a priority transboundary aquifer; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/109/448/s5/a/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">the IBWC, as appropriate.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/109/448/s5/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">New Activity.—</heading><content style="-uslm-dtd:text">After the date of enactment of this Act, the Secretary shall not initiate any new field studies or analyses under the program before consulting with, and coordinating the activity with, any Participating State water resource agencies that have jurisdiction over the aquifer.</content>
            </subsection>
            <subsection identifier="/us/sComp/109/448/s5/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Study Plans; Cost Estimates.—</heading>
                <paragraph identifier="/us/sComp/109/448/s5/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Secretary shall work closely with appropriate Participating State water resource agencies, water resources research institutes, and other relevant entities to develop a study plan, timeline, and cost estimate for each priority transboundary aquifer to be studied under the program.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/109/448/s5/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Requirements.—</heading><chapeau style="-uslm-dtd:text">A study plan developed under paragraph (1) shall, to the maximum extent practicable—</chapeau>
                    <subparagraph identifier="/us/sComp/109/448/s5/c/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">integrate existing data collection and analyses conducted with respect to the priority transboundary aquifer;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/109/448/s5/c/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">if applicable, improve and strengthen existing groundwater flow models developed for the priority transboundary aquifer; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/109/448/s5/c/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">be consistent with appropriate State guidelines and goals.</content>
                    </subparagraph>
                </paragraph>
            </subsection>
        </section>
        <section identifier="/us/sComp/109/448/s6" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="6">SEC. 6. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t42/s1962">42 U.S.C. 1962 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">EFFECT. </heading>
            <subsection identifier="/us/sComp/109/448/s6/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><chapeau style="-uslm-dtd:text">Nothing in this Act affects—</chapeau>
                <paragraph identifier="/us/sComp/109/448/s6/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the jurisdiction or responsibility of a Participating State with respect to managing surface or groundwater resources in the Participating State;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/109/448/s6/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the water rights of any person or entity using water from a transboundary aquifer; or</content>
                </paragraph>
                <paragraph identifier="/us/sComp/109/448/s6/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">State water law, or an interstate compact or international treaty governing water.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/109/448/s6/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Treaty.—</heading><content style="-uslm-dtd:text">Nothing in this Act shall delay or alter the implementation or operation of any works constructed, modified, acquired, or used within the territorial limits of the United States relating to the waters governed by the Treaty Between the United States and Mexico Regarding Utilization of Waters of the Colorado and Tijuana Rivers and of the Rio Grande, Treaty Series 994 (59 Stat. 1219).</content>
            </subsection>
        </section>
        <section identifier="/us/sComp/109/448/s7" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="7">SEC. 7. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t42/s1962">42 U.S.C. 1962 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">REPORTS. </heading>
            <chapeau class="block" style="-uslm-dtd:text">Not later than 5 years after the date of enactment of this Act, and on completion of the program in fiscal year 2016, the Secretary shall submit to the appropriate water resource agency in the Participating States, an interim and final report, respectively, that describes—</chapeau>
            <paragraph identifier="/us/sComp/109/448/s7/1" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">any activities carried out under the program;</content>
            </paragraph>
            <paragraph identifier="/us/sComp/109/448/s7/2" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">any conclusions of the Secretary relating to the status of priority transboundary aquifers; and</content>
            </paragraph>
            <paragraph identifier="/us/sComp/109/448/s7/3" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">the level of participation in the program of entities in Mexico.</content>
            </paragraph>
        </section>
        <section identifier="/us/sComp/109/448/s8" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="8">SEC. 8. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t42/s1962">42 U.S.C. 1962 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">AUTHORIZATION OF APPROPRIATIONS. </heading>
            <subsection identifier="/us/sComp/109/448/s8/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">There are authorized to be appropriated to carry out this Act $50,000,000 for the period of fiscal years 2007 through 2016.</content>
            </subsection>
            <subsection identifier="/us/sComp/109/448/s8/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Distribution of Funds.—</heading><content style="-uslm-dtd:text">Of the amounts made available under subsection (a), 50 percent shall be made available to the water resources research institutes to provide funding to appropriate entities in the Participating States (including Sandia  National Laboratories, State agencies, universities, the Tri-Regional Planning Group, and other relevant organizations) and to implement cooperative agreements entered into with appropriate entities in Mexico to conduct specific authorized activities in furtherance of the program, including the binational collection and exchange of scientific data.</content>
            </subsection>
            <subsection identifier="/us/sComp/109/448/s8/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Criteria.—</heading><content style="-uslm-dtd:text">Funding provided to an appropriate entity in Mexico pursuant to subsection (b) shall be contingent on that entity providing 50 percent of the necessary resources (including in-kind services) to further assist in carrying out the authorized activity.</content>
            </subsection>
        </section>
        <section identifier="/us/sComp/109/448/s9" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="9">SEC. 9. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t42/s1962">42 U.S.C. 1962 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SUNSET OF AUTHORITY. </heading>
            <content class="block" style="-uslm-dtd:text">The authority of the Secretary to carry out any provisions of this Act shall terminate 10 years after the date of enactment of this Act.</content>
