    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To authorize the Federal Trade Commission to collect fees for the implementation and enforcement of a "do-not-call" registry, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section identifier="/us/sComp/108/10/s1" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t15/s6151">15 U.S.C. 6151 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content class="block" style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote"><inline style="-uslm-dtd:short-title">Do-Not-Call Implementation Act</inline></shortTitle>”.</content>
        </section>
        <section identifier="/us/sComp/108/10/s2" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t15/s6152">15 U.S.C. 6152</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">TELEMARKETING SALES RULE; DO-NOT-CALL REGISTRY FEES. </heading>
            <subsection identifier="/us/sComp/108/10/s2/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">The Federal Trade Commission shall assess and collect an annual fee pursuant to this section in order to implement and enforce the “<quotedText style="-uslm-dtd:quote">do-not-call</quotedText>” registry as provided for in section 310.4(b)(1)(iii) of title 16, Code of Federal Regulations, or any other regulation issued by the Commission under section 3 of the Telemarketing and Consumer Fraud and Abuse Prevention Act (15 U.S.C. 6102).</content>
            </subsection>
            <subsection identifier="/us/sComp/108/10/s2/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Annual Fees.—</heading>
                <paragraph identifier="/us/sComp/108/10/s2/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">The Commission shall charge each person who accesses the “<quotedText style="-uslm-dtd:quote">do-not-call</quotedText>” registry an annual fee that is equal to the lesser of—</chapeau>
                    <subparagraph identifier="/us/sComp/108/10/s2/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">$54 for each area code of data accessed from the registry; or</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/108/10/s2/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">$14,850 for access to every area code of data contained in the registry.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/108/10/s2/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Exception.—</heading><chapeau style="-uslm-dtd:text">The Commission shall not charge a fee to any person—</chapeau>
                    <subparagraph identifier="/us/sComp/108/10/s2/b/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">for accessing the first 5 area codes of data; or</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/108/10/s2/b/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">for accessing area codes of data in the registry if the person is permitted to access, but is not required to access, the “<quotedText style="-uslm-dtd:quote">do-not-call</quotedText>” registry under section 310 of title 16, Code of Federal Regulations, section 64.1200 of title 47, Code of Federal Regulations, or any other Federal regulation or law.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/108/10/s2/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Duration of access.—</heading>
                    <subparagraph identifier="/us/sComp/108/10/s2/b/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Commission shall allow each person who pays the annual fee described in paragraph (1), each person excepted under paragraph (2) from paying the annual fee, and each person excepted from paying an annual fee under section 310.4(b)(1)(iii)(B) of title 16, Code of Federal Regulations, to access the area codes of data in the “<quotedText style="-uslm-dtd:quote">do-not-call</quotedText>” registry for which the person has paid during that person’s annual period.</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/108/10/s2/b/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Annual period.—</heading><content style="-uslm-dtd:text">In this paragraph, the term “<quotedText style="-uslm-dtd:quote">annual period</quotedText>” means the 12-month period beginning on the first day of the month in which a person pays the fee described in paragraph (1).</content>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/108/10/s2/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Additional Fees.—</heading>
                <paragraph identifier="/us/sComp/108/10/s2/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Commission shall charge a person required to pay an annual fee under subsection (b) an additional fee for each additional area code of data the person wishes to access during that person’s annual period.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/108/10/s2/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Rates.—</heading><chapeau style="-uslm-dtd:text">For each additional area code of data to be accessed during the person’s annual period, the Commission shall charge—</chapeau>
                    <subparagraph identifier="/us/sComp/108/10/s2/c/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">$54 for access to such data if access to the area code of data is first requested during the first 6 months of the person’s annual period; or</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/108/10/s2/c/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">$27 for access to such data if access to the area code of data is first requested after the first 6 months of the person’s annual period.</content>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/108/10/s2/d" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Adjustment of Fees.—</heading>
                <paragraph identifier="/us/sComp/108/10/s2/d/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading>
                    <subparagraph identifier="/us/sComp/108/10/s2/d/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Fiscal year 2009.—</heading><content style="-uslm-dtd:text">The dollar amount described in subsection (b) or (c) is the amount to be charged for fiscal year 2009.</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/108/10/s2/d/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Fiscal years after 2009.—</heading><chapeau style="-uslm-dtd:text">For each fiscal year beginning after fiscal year 2009, each dollar amount in subsection (b)(1) and (c)(2) shall be increased by an amount equal to—</chapeau>
                        <clause identifier="/us/sComp/108/10/s2/d/1/B/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the dollar amount in paragraph (b)(1) or (c)(2), whichever is applicable, multiplied by</content>
                        </clause>
                        <clause identifier="/us/sComp/108/10/s2/d/1/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the percentage (if any) by which the CPI for the most recently ended 12-month period ending on June 30 exceeds the baseline CPI.</content>
                        </clause>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/108/10/s2/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Rounding.—</heading><content style="-uslm-dtd:text">Any increase under subparagraph (B) shall be rounded to the nearest dollar.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/108/10/s2/d/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Changes less than 1 percent.—</heading><content style="-uslm-dtd:text">The Commission shall not adjust the fees under this section if the change in the CPI is less than 1 percent.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/108/10/s2/d/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Publication.—</heading><content style="-uslm-dtd:text">Not later than September 1 of each year the Commission shall publish in the Federal Register the adjustments to the applicable fees, if any, made under this subsection.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/108/10/s2/d/5" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">Definitions.—</heading><chapeau style="-uslm-dtd:text">In this subsection:</chapeau>
                    <subparagraph identifier="/us/sComp/108/10/s2/d/5/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">CPI.—</heading><content style="-uslm-dtd:text">The term “<quotedText style="-uslm-dtd:quote">CPI</quotedText>” means the average of the monthly consumer price index (for all urban consumers published by the Department of Labor).</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/108/10/s2/d/5/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Baseline CPI.—</heading><content style="-uslm-dtd:text">The term “<quotedText style="-uslm-dtd:quote">baseline CPI</quotedText>” means the CPI for the 12-month period ending June 30, 2008.</content>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/108/10/s2/e" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Prohibition Against Fee Sharing.—</heading><content style="-uslm-dtd:text">No person may enter into or participate in an arrangement (as such term is used in section 310.8(c) of the Commission’s regulations (16 C.F.R. 310.8(c))) to share any fee required by subsection (b) or (c), including any arrangement to divide the costs to access the registry among various clients of a telemarketer or service provider.</content>
            </subsection>
            <subsection identifier="/us/sComp/108/10/s2/f" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Handling of Fees.—</heading>
                <paragraph identifier="/us/sComp/108/10/s2/f/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Commission shall deposit and credit as offsetting collections any fee collected under this section in the account “<quotedText style="-uslm-dtd:quote">Federal Trade Commission—Salaries and Expenses</quotedText>”, and such sums shall remain available until expended.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/108/10/s2/f/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Limitation.—</heading><content style="-uslm-dtd:text">No amount shall be collected as a fee under this section for any fiscal year except to the extent provided in advance by appropriations Acts.</content>
                </paragraph>
            </subsection>
        </section>
        <section identifier="/us/sComp/108/10/s3" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t15/s6153">15 U.S.C. 6153</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">FEDERAL COMMUNICATIONS COMMISSION DO-NOT-CALL REGULATIONS. </heading>
            <content class="block" style="-uslm-dtd:text">Not later than 180 days after the date of enactment of this Act, the Federal Communications Commission shall issue a final rule pursuant to the rulemaking proceeding that it began on September 18, 2002, under the Telephone Consumer Protection Act (47 U.S.C. 227 et seq.). In issuing such rule, the Federal Communications Commission shall consult and coordinate with the Federal Trade Commission to maximize consistency with the rule promulgated by the Federal Trade Commission (16 CFR 310.4(b)).</content>
        </section>
        <section identifier="/us/sComp/108/10/s4" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="4">SEC. 4. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t15/s6154">15 U.S.C. 6154</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">REPORTING REQUIREMENTS. </heading>
            <subsection identifier="/us/sComp/108/10/s4/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Biennial Reports.—</heading><chapeau style="-uslm-dtd:text">Not later than December 31, 2009, and biennially thereafter, the Federal Trade Commission, in consultation with the Federal Communications Commission, shall transmit a report to the Senate Committee on Commerce, Science, and Transportation and the House of Representatives Committee on Energy and Commerce that includes—</chapeau>
                <paragraph identifier="/us/sComp/108/10/s4/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the number of consumers who have placed their telephone numbers on the registry;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/108/10/s4/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the number of persons paying fees for access to the registry and the amount of such fees;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/108/10/s4/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><chapeau style="-uslm-dtd:text">the impact on the “<quotedText style="-uslm-dtd:quote">do-not-call</quotedText>” registry of—</chapeau>
                    <subparagraph identifier="/us/sComp/108/10/s4/a/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the 5-year reregistration requirement;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/108/10/s4/a/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">new telecommunications technology; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/108/10/s4/a/3/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">number portability and abandoned telephone numbers; and</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/108/10/s4/a/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">the impact of the established business relationship exception on businesses and consumers.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/108/10/s4/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Additional Report.—</heading><chapeau style="-uslm-dtd:text">Not later than December 31, 2009, the Federal Trade Commission, in consultation with the Federal Communications Commission, shall transmit a report to the Senate Committee on Commerce, Science, and Transportation and the House of Representatives Committee on Energy and Commerce that includes—</chapeau>
                <paragraph identifier="/us/sComp/108/10/s4/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the effectiveness of do-not-call outreach and enforcement efforts with regard to senior citizens and immigrant communities;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/108/10/s4/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the impact of the exceptions to the do-not-call registry on businesses and consumers, including an analysis of the effectiveness of the registry and consumer perceptions of the registry’s effectiveness; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/108/10/s4/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">the impact of abandoned calls made by predictive dialing devices on do-not-call enforcement.</content>
                </paragraph>
            </subsection>
        </section>
        <section identifier="/us/sComp/108/10/s5" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="5">SEC. 5. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t15/s6155">15 U.S.C. 6155</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">PROHIBITION OF EXPIRATION DATE. </heading>
            <subsection identifier="/us/sComp/108/10/s5/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">No Automatic Removal of Numbers.—</heading><content style="-uslm-dtd:text">Telephone numbers registered on the national “<quotedText style="-uslm-dtd:quote">do-not-call</quotedText>” registry of the Telemarketing Sales Rule (16 CFR 310.4(b)(1)(iii)) since the establishment of the registry and telephone numbers registered on such registry after the date of enactment of this Act, shall not be removed from such registry except as provided for in subsection (b) or upon the request of the individual to whom the telephone number is assigned.</content>
            </subsection>
            <subsection identifier="/us/sComp/108/10/s5/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Removal of Invalid, Disconnected, and Reassigned Telephone Numbers.—</heading><content style="-uslm-dtd:text">The Federal Trade Commission shall periodically check telephone numbers registered on the national “<quotedText style="-uslm-dtd:quote">do-not-call</quotedText>” registry against national or other appropriate databases and shall remove from such registry those telephone numbers that have been disconnected and reassigned. Nothing in this section prohibits the Federal Trade Commission from removing invalid telephone numbers from the registry at any time.</content>
