        <section style="-uslm-dtd:section" identifier="/us/sComp/106/299/s1" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content style="-uslm-dtd:text" class="block">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote"><inline style="-uslm-dtd:short-title">Wekiva Wild and Scenic River Act of 2000</inline></shortTitle>”.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/106/299/s2" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">FINDINGS. </heading>
            <subsection style="-uslm-dtd:subsection" styleType="OLC" role="undesignated-level"><chapeau style="-uslm-dtd:text">The Congress finds the following:</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s2/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">Public Law 104–311 (110 Stat. 3818) amended section 5 of the Wild and Scenic Rivers Act (16 U.S.C. 1276) to require the study of the Wekiva River and its tributaries of Rock Springs Run and Seminole Creek for potential inclusion in the national wild and scenic rivers system.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s2/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">The study determined that the Wekiva River, Wekiwa Springs Run, Rock Springs Run, and Black Water Creek are eligible for inclusion in the national wild and scenic rivers system.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s2/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">The State of Florida has demonstrated its commitment to protecting these rivers and streams by the enactment of the Wekiva River Protection Act (Florida Statute chapter 369), by the establishment of a riparian wildlife protection zone and water quality protection zone by the St. Johns River Water Management District, and by the acquisition of lands adjacent to these rivers and streams for conservation purposes.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s2/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">The Florida counties of Lake, Seminole, and Orange have demonstrated their commitment to protect these rivers and streams in their comprehensive land use plans and land development regulations.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s2/5" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">The desire for designation of these rivers and streams as components of the national wild and scenic rivers system has been demonstrated through strong public support, State and local agency support, and the endorsement of designation by the Wekiva River Basin Ecosystem Working Group, which represents a broad cross section of State and local agencies, landowners, environmentalists, nonprofit organizations, and recreational users.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s2/6" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">The entire lengths of the Wekiva River, Rock Springs Run, and Black Water Creek are held in public ownership or conservation easements or are defined as waters of the State of Florida.</content>
                </paragraph>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/106/299/s3" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><heading style="-uslm-dtd:header">DESIGNATION OF WEKIVA RIVER AND TRIBUTARIES, FLORIDA, AS COMPONENTS OF NATIONAL WILD AND SCENIC RIVERS SYSTEM. </heading><editorialNote style="-uslm-dtd:legis-comment"><b>[</b>Added a new paragraph at the end of section 3(a) of the Wild and Scenic Rivers Act (16 U.S.C. 1274(a)).<b>]</b> </editorialNote>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/106/299/s4" styleType="OLC">
            <num style="-uslm-dtd:enum" value="4">SEC. 4. </num><heading style="-uslm-dtd:header">SPECIAL REQUIREMENTS APPLICABLE TO WEKIVA RIVER AND TRIBUTARIES. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/299/s4/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Definitions.—</heading><chapeau style="-uslm-dtd:text">In this section and section 5:</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s4/a/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Wekiva river system.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Wekiva River system</term>” means the segments of the Wekiva River, Wekiwa Springs Run, Rock Springs Run, and Black Water Creek in the State of Florida designated as components of the national wild and scenic rivers system by paragraph (161) of section 3(a) of the Wild and Scenic Rivers Act (16 U.S.C. 1274(a)), as added by this Act.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s4/a/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Committee.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Committee</term>” means the Wekiva River System Advisory Management Committee established pursuant to section 5.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s4/a/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Comprehensive management plan.—</heading><content style="-uslm-dtd:text">The terms “<term style="-uslm-dtd:term">comprehensive management plan</term>” and “<quotedText style="-uslm-dtd:quote">plan</quotedText>” mean the comprehensive management plan to be developed pursuant to section 3(d) of the Wild and Scenic Rivers Act (16 U.S.C. 1274(d)).</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s4/a/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Secretary.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Secretary</term>” means the Secretary of the Interior.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/299/s4/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Cooperative Agreements.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s4/b/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Use authorized.—</heading><content style="-uslm-dtd:text">In order to provide for the long-term protection, preservation, and enhancement of the Wekiva River system, the Secretary shall offer to enter into cooperative agreements pursuant to sections 10(e) and 11(b)(1) of the Wild and Scenic Rivers Act (16 U.S.C. 1281(e), 1282(b)(1)) with the State of Florida, appropriate local political jurisdictions of the State, namely the counties of Lake, Orange, and Seminole, and appropriate local planning and environmental organizations.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s4/b/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Effect of agreement.—</heading><content style="-uslm-dtd:text">Administration by the Secretary of the Wekiva River system through the use of cooperative agreements shall not constitute National Park Service administration of the Wekiva River system for purposes of section 10(c) of such Act (10 U.S.C. 1281(c)) and shall not cause the Wekiva River system to be considered as being a unit of the National Park System. Publicly owned lands within the boundaries of the Wekiva River system shall continue to be managed by the agency having jurisdiction over the lands, in accordance with the statutory authority and mission of the agency.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/299/s4/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Compliance Review.—</heading><content style="-uslm-dtd:text">After completion of the comprehensive management plan, the Secretary shall biennially review compliance with the plan and shall promptly report to the Committee on Resources of the House of Representatives and the Committee on Energy and Natural Resources of the Senate any deviation from the plan that could result in any diminution of the values for which the Wekiva River system was designated as a component of the national wild and scenic rivers system.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/299/s4/d" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Technical Assistance and Other Support.—</heading><content style="-uslm-dtd:text">The Secretary may provide technical assistance, staff support, and funding to assist in the development and implementation of the comprehensive management plan.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/299/s4/e" styleType="OLC">
                <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Limitation on Federal Support.—</heading><content style="-uslm-dtd:text">Nothing in this section shall be construed to authorize funding for land acquisition, facility development, or operations.</content>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/106/299/s5" styleType="OLC">
            <num style="-uslm-dtd:enum" value="5">SEC. 5. </num><heading style="-uslm-dtd:header">WEKIVA RIVER SYSTEM ADVISORY MANAGEMENT COMMITTEE. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/299/s5/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Establishment.—</heading><content style="-uslm-dtd:text">The Secretary shall establish an advisory committee, to be known as the Wekiva River System Advisory Management Committee, to assist in the development of the comprehensive management plan for the Wekiva River system.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/299/s5/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Membership.—</heading><chapeau style="-uslm-dtd:text">The Committee shall be composed of a representative of each of the following agencies and organizations:</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s5/b/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">The Department of the Interior, represented by the Director of the National Park Service or the Director's designee.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s5/b/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">The East Central Florida Regional Planning Council.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s5/b/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">The Florida Department of Environmental Protection, Division of Recreation and Parks.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s5/b/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">The Florida Department of Environmental Protection, Wekiva River Aquatic Preserve.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s5/b/5" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">The Florida Department of Agriculture and Consumer Services, Division of Forestry, Seminole State Forest.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s5/b/6" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">The Florida Audubon Society.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s5/b/7" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">The nonprofit organization known as the Friends of the Wekiva.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s5/b/8" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="8">(8) </num><content style="-uslm-dtd:text">The Lake County Water Authority.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s5/b/9" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="9">(9) </num><content style="-uslm-dtd:text">The Lake County Planning Department.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s5/b/10" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="10">(10) </num><content style="-uslm-dtd:text">The Orange County Parks and Recreation Department, Kelly Park.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s5/b/11" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="11">(11) </num><content style="-uslm-dtd:text">The Seminole County Planning Department.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s5/b/12" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="12">(12) </num><content style="-uslm-dtd:text">The St. Johns River Water Management District.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s5/b/13" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="13">(13) </num><content style="-uslm-dtd:text">The Florida Fish and Wildlife Conservation Commission.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s5/b/14" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="14">(14) </num><content style="-uslm-dtd:text">The City of Altamonte Springs.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s5/b/15" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="15">(15) </num><content style="-uslm-dtd:text">The City of Longwood.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s5/b/16" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="16">(16) </num><content style="-uslm-dtd:text">The City of Apopka.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s5/b/17" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="17">(17) </num><content style="-uslm-dtd:text">The Florida Farm Bureau Federation.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s5/b/18" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="18">(18) </num><content style="-uslm-dtd:text">The Florida Forestry Association.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/299/s5/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Additional Members.—</heading><content style="-uslm-dtd:text">Other interested parties may be added to the Committee by request to the Secretary and unanimous consent of the existing members.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/299/s5/d" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Appointment.—</heading><chapeau style="-uslm-dtd:text">Representatives and alternates to the Committee shall be appointed as follows:</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s5/d/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">State agency representatives, by the head of the agency.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s5/d/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">County representatives, by the Boards of County Commissioners.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s5/d/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">Water management district, by the Governing Board.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s5/d/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">Department of the Interior representative, by the Southeast Regional Director, National Park Service.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s5/d/5" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">East Central Florida Regional Planning Council, by Governing Board.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/299/s5/d/6" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">Other organizations, by the Southeast Regional Director, National Park Service.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/299/s5/e" styleType="OLC">
                <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Role of Committee.—</heading><content style="-uslm-dtd:text">The Committee shall assist in the development of the comprehensive management plan for the Wekiva River system and provide advice to the Secretary in carrying out the management responsibilities of the Secretary under this Act. The Committee shall have an advisory role only, it will not have regulatory or land acquisition authority.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/299/s5/f" styleType="OLC">
                <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Voting and Committee Procedures.—</heading><content style="-uslm-dtd:text">Each member agency, agency division, or organization referred to in subsection (b) shall have one vote and provide one member and one alternate. Committee decisions and actions will be made with consent of three-fourths of all voting members. Additional necessary Committee procedures shall be developed as part of the comprehensive management plan.</content>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/106/299/s6" styleType="OLC">
            <num style="-uslm-dtd:enum" value="6">SEC. 6. </num><heading style="-uslm-dtd:header">AUTHORIZATION OF APPROPRIATIONS. </heading>
            <content style="-uslm-dtd:text" class="block">There are authorized to be appropriated such sums as may be necessary to carry out this Act and paragraph (161) of section 3(a) of the Wild and Scenic Rivers Act (16 U.S.C. 1274(a)), as added by this Act.</content>
        </section>
