                <content class="block" style="-uslm-dtd:text">This part may be cited as the “<shortTitle style="-uslm-dtd:quote"><inline style="-uslm-dtd:short-title">Symms National Recreational Trails Act of 1991</inline></shortTitle>”.</content>

                <num style="-uslm-dtd:enum" value="1302">SEC. 1302. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s1261">16 U.S.C. 1261</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">NATIONAL RECREATIONAL TRAILS FUNDING PROGRAM. </heading>

                <num style="-uslm-dtd:enum" value="1303">SEC. 1303. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s1262">16 U.S.C. 1262</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">NATIONAL RECREATIONAL TRAILS ADVISORY COMMITTEE. </heading>
                <subsection identifier="/us/sComp/102/240/ptB/s1303/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Establishment.—</heading><content style="-uslm-dtd:text">There is established the National Recreational Trails Advisory Committee.</content>
                </subsection>
                <subsection identifier="/us/sComp/102/240/ptB/s1303/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Members.—</heading><chapeau style="-uslm-dtd:text">There shall be 12 members of the advisory committee, consisting of—</chapeau>
                    <paragraph identifier="/us/sComp/102/240/ptB/s1303/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">8 members appointed by the Secretary from nominations submitted by recreational trail user organizations, one each representing the following recreational trail uses:</chapeau>
                        <subparagraph identifier="/us/sComp/102/240/ptB/s1303/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">hiking,</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/102/240/ptB/s1303/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">cross-country skiing,</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/102/240/ptB/s1303/b/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">off-highway motorcycling,</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/102/240/ptB/s1303/b/1/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">snowmobiling,</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/102/240/ptB/s1303/b/1/E" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">horseback riding,</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/102/240/ptB/s1303/b/1/F" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">all-terrain vehicle riding,</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/102/240/ptB/s1303/b/1/G" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="G">(G) </num><content style="-uslm-dtd:text">bicycling, and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/102/240/ptB/s1303/b/1/H" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="H">(H) </num><content style="-uslm-dtd:text">four-wheel driving;</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/102/240/ptB/s1303/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">1 member appointed by the Secretary representing individuals with disabilities;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/102/240/ptB/s1303/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">an appropriate official of government with a background in science or natural resources management, including any official of State or local government, designated by the Secretary;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/102/240/ptB/s1303/b/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">1 member appointed by the Secretary from nominations submitted by water trail user organizations; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/102/240/ptB/s1303/b/5" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">1 member appointed by the Secretary from nominations submitted by hunting and fishing enthusiast organizations.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/102/240/ptB/s1303/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Chairman.—</heading><content style="-uslm-dtd:text">The Chair of the advisory committee shall be the government official referenced in subsection (b)(3), who shall serve as a non-voting member.</content>
                </subsection>
                <subsection identifier="/us/sComp/102/240/ptB/s1303/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Support for Committee Action.—</heading><content style="-uslm-dtd:text">Any action, recommendation, or policy of the advisory committee must be supported by at least five of the members appointed under subsection (b)(1).</content>
                </subsection>
                <subsection identifier="/us/sComp/102/240/ptB/s1303/e" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Terms.—</heading><content style="-uslm-dtd:text">Members of the advisory committee appointed by the Secretary shall be appointed for terms of three years, except that the members filling five of the eleven positions shall be initially appointed for terms of two years, with subsequent appointments to those positions extending for terms of three years.</content>
                </subsection>
                <subsection identifier="/us/sComp/102/240/ptB/s1303/f" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Duties.—</heading><chapeau style="-uslm-dtd:text">The advisory committee shall meet at least twice annually to—</chapeau>
                    <paragraph identifier="/us/sComp/102/240/ptB/s1303/f/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">review utilization of allocated moneys by States;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/102/240/ptB/s1303/f/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">establish and review criteria for trail-side and trail-head facilities that qualify for funding under this part; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/102/240/ptB/s1303/f/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">make recommendations to the Secretary for changes in Federal policy to advance the purposes of this part.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/102/240/ptB/s1303/g" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Annual Report.—</heading><content style="-uslm-dtd:text">The advisory committee shall present to the Secretary an annual report on its activities.</content>
                </subsection>
                <subsection identifier="/us/sComp/102/240/ptB/s1303/h" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="h">(h) </num><heading style="-uslm-dtd:header">Reimbursement for Expenses.—</heading><content style="-uslm-dtd:text">Nongovernmental members of the advisory committee shall serve without pay, but, to the extent funds are available pursuant to section 1302(d)(1)(B), shall be entitled to reimbursement for travel, subsistence, and other necessary expenses incurred in the performance of their duties.</content>
                </subsection>
                <subsection identifier="/us/sComp/102/240/ptB/s1303/i" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">Report to Congress.—</heading><content style="-uslm-dtd:text">Not later than 4 years after the date of the enactment of this Act, the Secretary shall prepare and submit to the Committee on Environment and Public Works of the Senate, and the Committee on Transportation and Infrastructure of the House of Representatives, a study which summarizes the annual reports of the National Recreational Trails Advisory Committee, describes the allocation and utilization of moneys under this part, and contains recommendations for changes in Federal policy to advance the purposes of this part.</content>
                </subsection>
                <subsection identifier="/us/sComp/102/240/ptB/s1303/j" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="j">(j) </num><heading style="-uslm-dtd:header">Termination.—</heading><content style="-uslm-dtd:text">The advisory committee established by this section shall terminate on September 30, 2000.</content>
                </subsection>
