    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To provide authorizations for the Small Business Administration, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

            <num style="-uslm-dtd:enum" value="III">TITLE III—</num><heading style="-uslm-dtd:header">SMALL BUSINESS ECONOMIC POLICY </heading>
            <section identifier="/us/sComp/96/302/tIII/s301" style="-uslm-dtd:section" styleType="traditional">
                <heading style="-uslm-dtd:header">short title </heading>
                <num style="-uslm-dtd:enum" value="301">Sec. 301. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t15/s631">15 U.S.C. 631 note</ref><b>]</b> </editorialNote><content style="-uslm-dtd:text">This title may be cited as the “<shortTitle style="-uslm-dtd:quote">Small Business Economic
Policy Act of 1980</shortTitle>”.</content>

                <heading style="-uslm-dtd:header">declaration of small business economic policy </heading>
                <num style="-uslm-dtd:enum" value="302">Sec. 302. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t15/s631a">15 U.S.C. 631a</ref><b>]</b> </editorialNote><subsection class="inline leftIndentDecrease1" identifier="/us/sComp/96/302/tIII/s302/a" style="-uslm-dtd:subsection" styleType="OLC"><num style="-uslm-dtd:enum" value="a">(a) </num><content style="-uslm-dtd:text">For the purpose of preserving and promoting a competitive free enterprise economic system, Congress hereby declares that it is the continuing policy and responsibility of the Federal Government to use all practical means and to take such actions as are necessary, consistent with its needs and obligations and other essential considerations of national policy, to implement and coordinate all Federal department, agency, and instrumentality policies, programs, and activities in order to: foster the economic interests of small businesses; insure a competitive economic climate conducive to the development, growth and expansion of small businesses; establish incentives to assure that adequate capital and other resources at competitive prices are available to small businesses; reduce the concentration of economic resources and expand competition; and provide an opportunity for entrepreneurship, inventiveness, and the creation and growth of small businesses.</content></subsection>
                <subsection class="leftIndentDecrease1" identifier="/us/sComp/96/302/tIII/s302/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><content style="-uslm-dtd:text">Congress further declares that the Federal Government is committed to a policy of utilizing all reasonable means, consistent with the overall economic policy goals of the Nation and the preservation of the competitive free enterprise system of the Nation, to establish private sector incentives that will help assure that adequate capital at competitive prices is available to small businesses. To fulfill this policy, departments, agencies, and instrumentalities of the Federal Government shall use all reasonable means to coordinate, create, and sustain policies and programs which promote investment in small businesses, including those investments which expand employment opportunities and which foster the effective and efficient use of human and natural resources in the economy of the Nation.</content>
                </subsection>
            </section>
            <section identifier="/us/sComp/96/302/tIII/s303" style="-uslm-dtd:section" styleType="traditional">
                <heading style="-uslm-dtd:header">state of small business </heading>
                <num style="-uslm-dtd:enum" value="303">Sec. 303. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t15/s631b">15 U.S.C. 631b</ref><b>]</b> </editorialNote><subsection class="inline" identifier="/us/sComp/96/302/tIII/s303/a" style="-uslm-dtd:subsection" styleType="OLC"><num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">
 </heading><chapeau style="-uslm-dtd:text">The president shall transmit to the congress not later than January 20 of each year a report on small business and competition which shall—</chapeau>
                <paragraph identifier="/us/sComp/96/302/tIII/s303/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">examine the current role of small business in the economy on an industry-by-industry basis;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/96/302/tIII/s303/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">present current and historical data on production, employment, investment, population, job creation and retention, annual business failures, annual business startups, and
other economic variables for small business in the economy as a
whole and for small business in each sector of the economy, with, to the extent practicable, specific statistics divided as to
urban, suburban, and rural areas; </content>
                </paragraph>
                <paragraph identifier="/us/sComp/96/302/tIII/s303/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">identify economic trends which will or may affect the small business sector and the state of competition;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/96/302/tIII/s303/a/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">examine the effects on small business and competition of policies, programs, and activities, including, but not limited to the Internal Revenue Code, the Employee Retirement Income Security Act, the Securities Act of 1933, and the Securities Exchange Act of 1934, and regulations promulgated thereunder; identify problems generated by such policies, programs, and activities; and recommend legislative and administrative solutions to such problems; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/96/302/tIII/s303/a/5" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">recommend a program for carrying out the policy declared in section 302 of this Act, together with such recommendations for legislation as he may deem necessary or desirable.</content>
                </paragraph></subsection>
                <subsection identifier="/us/sComp/96/302/tIII/s303/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><content style="-uslm-dtd:text">The President also shall transmit simultaneously as an appendix to such annual report, a report, by agency and department, on the to total dollar value of all Federal contracts exceeding $10,000 in amount and the dollar amount (including the subcontracts thereunder in excess of $10,000) awarded to small, minority-owned , female-owned, and veteran-owned
businesses.</content>
                </subsection>
                <subsection identifier="/us/sComp/96/302/tIII/s303/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><content style="-uslm-dtd:text">The President may transmit from time to time to the Congress Supplementary reports supplementary to the Report on Small Business and Competition, each of which shall include such supplementary or revised, recommendations as he may deem necessary or desirable to achieve the policy declared in section 302 of this Act.</content>
                </subsection>
                <subsection identifier="/us/sComp/96/302/tIII/s303/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><content style="-uslm-dtd:text">The Report on Small Business and Competition and all supplementary reports transmitted under subsections (b) and (c) of this section shall, when transmitted to Congress, be referred to the Senate Select Committee on Small Business and the Committee on Small Business of the House of Representatives.</content>
                </subsection>
                <subsection identifier="/us/sComp/96/302/tIII/s303/e" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e)<ref class="footnoteRef" idref="ID7834F6109B0A4C368AB43BC67669923A" style="-uslm-dtd:footnote-ref">1</ref> </num><chapeau style="-uslm-dtd:text">The information and data required to be reported pursuant to
subsection (a) shall separately detail those portions of such information and data that are relevant to—</chapeau>
                    <paragraph identifier="/us/sComp/96/302/tIII/s303/e/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">small business concerns owned and controlled by socially and economically disadvantaged individuals, by gender, as defined pursuant to section 8(d) of the Small Business Act; </content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/96/302/tIII/s303/e/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">small business concerns owned and controlled by
women; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/96/302/tIII/s303/e/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3)<ref class="footnoteRef" idref="ID7D106ACF815340F2B3533B8BC930788B" style="-uslm-dtd:footnote-ref">2</ref> </num><content style="-uslm-dtd:text">qualified HUBZone small business concern (as defined
in section 3(p) of the Small Business Act).</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/96/302/tIII/s303/e/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">small business concerns owned and controlled by
veterans, as defined in section 3(q) of the Small Business Act
(15 U.S.C. 632(q)), and small business concerns owned and
controlled by service-disabled veterans, as defined in such section 3(q).</content>
