    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To transfer administrative jurisdiction over certain Bureau of Land Management land from the Secretary of the Interior to the Secretary of Veterans Affairs for inclusion in the Black Hills National Cemetery, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section identifier="/us/sComp/115/175/s1" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content class="block" style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Black Hills National Cemetery Boundary Expansion Act</shortTitle>”.</content>
        </section>
        <section identifier="/us/sComp/115/175/s2" role="definitions" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">DEFINITIONS. </heading>
            <chapeau class="block" style="-uslm-dtd:text">In this Act:</chapeau>
            <paragraph identifier="/us/sComp/115/175/s2/1" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Cemetery.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">Cemetery</term>” means the Black Hills National Cemetery in Sturgis, South Dakota.</content>
            </paragraph>
            <paragraph identifier="/us/sComp/115/175/s2/2" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Federal land.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">Federal land</term>” means the approximately 200 acres of Bureau of Land Management land adjacent to the Cemetery, generally depicted as “Proposed National Cemetery Expansion” on the map entitled “Proposed Expansion of Black Hills National Cemetery-South Dakota” and dated June 16, 2016.</content>
            </paragraph>
            <paragraph identifier="/us/sComp/115/175/s2/3" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Secretary.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">Secretary</term>” means the Secretary of the Interior.</content>
            </paragraph>
        </section>
        <section identifier="/us/sComp/115/175/s3" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><heading style="-uslm-dtd:header">TRANSFER AND WITHDRAWAL OF BUREAU OF LAND MANAGEMENT LAND FOR CEMETERY USE. </heading>
            <subsection identifier="/us/sComp/115/175/s3/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Conduct of Due Diligence Activities by the Secretary of Veterans Affairs.—</heading>
                <paragraph identifier="/us/sComp/115/175/s3/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Before the transfer of administrative jurisdiction and withdrawal of the Federal land under subsections (b) and (c), respectively, and subject to paragraph (2), the Secretary of Veterans Affairs shall complete any appropriate environmental, cultural resource, and other due diligence activities on the Federal land that would enable the Secretary of Veterans Affairs to confirm that the Federal land is suitable for cemetery purposes.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/115/175/s3/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Notice; required coordination.—</heading><chapeau style="-uslm-dtd:text">The Secretary of Veterans Affairs shall—</chapeau>
                    <subparagraph identifier="/us/sComp/115/175/s3/a/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">before conducting any due diligence activities under paragraph (1), notify the Secretary of the activities to be conducted;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/115/175/s3/a/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">as the Secretary of Veterans Affairs determines to be necessary in the conduct of the due diligence activities under paragraph (1), coordinate the activities with the Secretary; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/115/175/s3/a/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">if the Secretary of Veterans Affairs determines, on completion of the due diligence activities under paragraph (1), that the Federal land is suitable for cemetery purposes, submit written notice of the determination to the Secretary.</content>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/115/175/s3/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Transfer of Administrative Jurisdiction.—</heading>
                <paragraph identifier="/us/sComp/115/175/s3/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Transfer.—</heading>
                    <subparagraph identifier="/us/sComp/115/175/s3/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">On receipt by the Secretary of written notice of a determination that the Federal land is suitable for cemetery purposes under subsection (a)(2)(C), except as provided in subparagraph (B), and subject to valid existing rights, administrative jurisdiction over the Federal land is transferred from the Secretary to the Secretary of Veterans Affairs for use as a national cemetery in accordance with chapter 24 of title 38, United States Code.</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/115/175/s3/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Exclusion.—</heading><content style="-uslm-dtd:text">The transfer of administrative jurisdiction over the Federal land under subparagraph (A) shall not include the land located within 100 feet of the center of the Centennial Trail, as generally depicted on the map entitled “Proposed Expansion of Black Hills National Cemetery-South Dakota” and dated June 16, 2016.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/115/175/s3/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Legal descriptions.—</heading>
                    <subparagraph identifier="/us/sComp/115/175/s3/b/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">As soon as practicable after the date of enactment of this Act, the Secretary shall publish in the Federal Register a notice containing a legal description of the Federal land.</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/115/175/s3/b/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Effect.—</heading><content style="-uslm-dtd:text">A legal description published under subparagraph (A) shall have the same force and effect as if included in this Act, except that the Secretary may correct any clerical and typographical errors in the legal description.</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/115/175/s3/b/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Availability.—</heading><chapeau style="-uslm-dtd:text">Copies of the legal description published under subparagraph (A) shall be available for public inspection in the appropriate offices of—</chapeau>
                        <clause identifier="/us/sComp/115/175/s3/b/2/C/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the Bureau of Land Management; and</content>
                        </clause>
                        <clause identifier="/us/sComp/115/175/s3/b/2/C/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the National Cemetery Administration.</content>
                        </clause>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/115/175/s3/b/2/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><heading style="-uslm-dtd:header">Costs.—</heading><content style="-uslm-dtd:text">The Secretary of Veterans Affairs shall reimburse the Secretary for the costs incurred by the Secretary in carrying out this paragraph, including the costs of any surveys and other reasonable costs.</content>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/115/175/s3/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Withdrawal.—</heading><chapeau style="-uslm-dtd:text">On receipt by the Secretary of written notice of a determination that the Federal land is suitable for cemetery purposes under subsection (a)(2)(C) and subject to valid existing rights, the Federal land—</chapeau>
                <paragraph identifier="/us/sComp/115/175/s3/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">is withdrawn from all forms of appropriation under the public land laws, including the mining laws, the mineral leasing laws, and the geothermal leasing laws; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/115/175/s3/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">shall be treated as property as defined under section 102(9) of title 40, United States Code.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/115/175/s3/d" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Boundary Modification.—</heading><content style="-uslm-dtd:text">The boundary of the Cemetery is modified to include the Federal land.</content>
            </subsection>
            <subsection identifier="/us/sComp/115/175/s3/e" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Modification of Public Land Order.—</heading><content style="-uslm-dtd:text">Public Land Order 2112, dated June 6, 1960 (25 Fed. Reg. 5243), is modified to exclude the Federal land.</content>
            </subsection>
        </section>
    </main>
