    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To amend title 38, United States Code, to improve the method by which the Secretary of Veterans Affairs determines the effects of a closure or disapproval of an educational institution on individuals who do not transfer credits from such institution.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section identifier="/us/sComp/117/297/s1" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t38/s101">38 U.S.C. 101 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content class="block" style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Veterans Eligible to Transfer School (VETS) Credit Act</shortTitle>”.</content>
        </section>
        <section identifier="/us/sComp/117/297/s2" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">CHARGE TO ENTITLEMENT TO EDUCATIONAL ASSISTANCE FOR INDIVIDUALS WHO DO NOT TRANSFER CREDITS FROM CERTAIN CLOSED OR DISAPPROVED PROGRAMS OF EDUCATION. </heading>
            <chapeau class="block" style="-uslm-dtd:text">Section 3699(c)(2)(A) of title 38, United States Code, is amended—</chapeau>
            <paragraph identifier="/us/sComp/117/297/s2/1" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">An individual</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">(i) An individual</quotedText>”;</content>
            </paragraph>
            <paragraph identifier="/us/sComp/117/297/s2/2" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">by designating the second sentence as clause (iv) and indenting appropriately; and</content>
            </paragraph>
            <paragraph identifier="/us/sComp/117/297/s2/3" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">by inserting after clause (i), as designated by paragraph (1), the following new clauses:<quotedContent style="-uslm-dtd:quoted-block">
                <clause style="-uslm-dtd:clause" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="ii">“(ii) </num><chapeau style="-uslm-dtd:text">In carrying out clause (i), the Secretary shall—</chapeau>
                    <subclause style="-uslm-dtd:subclause" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="I">“(I) </num><content style="-uslm-dtd:text">require an individual to certify in writing that the individual has transferred fewer than 12 credits as described in such clause;</content>
                    </subclause>
                    <subclause style="-uslm-dtd:subclause" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="II">“(II) </num><chapeau style="-uslm-dtd:text">require an individual who makes a certification under subclause (I) to acknowledge in writing that if the individual transfers 12 or more credits as described in such clause (i)—</chapeau>
                        <item style="-uslm-dtd:item" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="aa">“(aa) </num><content style="-uslm-dtd:text">the individual may not be deemed under such clause to be an individual who did not receive such credits; and</content>
                        </item>
                        <item style="-uslm-dtd:item" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="bb">“(bb) </num><content style="-uslm-dtd:text">the Secretary shall rescind the certificate of eligibility provided under subclause (IV);</content>
                        </item>
                    </subclause>
                    <subclause style="-uslm-dtd:subclause" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="III">“(III) </num><content style="-uslm-dtd:text">accept a certification under subclause (I) as proof of the individual transferring fewer than 12 credits; and</content>
                    </subclause>
                    <subclause style="-uslm-dtd:subclause" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="IV">“(IV) </num><content style="-uslm-dtd:text">provide to the individual who makes a certification under subclause (I) and makes the acknowledgment under subclause (II) a certificate of eligibility that the individual may provide to an educational institution as proof of the individual being covered by this paragraph.</content>
                    </subclause>
                </clause>
                <clause style="-uslm-dtd:clause" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="iii">“(iii) </num><content style="-uslm-dtd:text">The Secretary shall notify individuals described in subparagraph (B) of being eligible to be covered by this paragraph.”</content>

            </paragraph>

        <section identifier="/us/sComp/117/297/s3" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><heading style="-uslm-dtd:header">ELIMINATION OF REQUIREMENT TO SPECIFY AN EFFECTIVE PERIOD OF A TRANSFER OF POST-9/11 EDUCATIONAL ASSISTANCE TO A DEPENDENT. </heading>
            <chapeau class="block" style="-uslm-dtd:text">Section 3319(e) of title 38, United States Code, is amended—</chapeau>
            <paragraph identifier="/us/sComp/117/297/s3/1" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">in paragraph (1), by adding “<quotedText style="-uslm-dtd:quote">and</quotedText>” after the semicolon;</content>
            </paragraph>
            <paragraph identifier="/us/sComp/117/297/s3/2" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">in paragraph (2), by striking “<quotedText style="-uslm-dtd:quote">; and</quotedText>” and inserting a period; and</content>
            </paragraph>
            <paragraph identifier="/us/sComp/117/297/s3/3" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">by striking paragraph (3).</content>
            </paragraph>
        </section>
        <section identifier="/us/sComp/117/297/s4" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="4">SEC. 4. </num><heading style="-uslm-dtd:header">DETERMINATION OF BUDGETARY EFFECTS. </heading>
            <content class="block" style="-uslm-dtd:text">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled “Budgetary Effects of PAYGO Legislation” for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</content>
