    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To assist the States of Connecticut, New Jersey, New York, and Pennsylvania in conserving priority lands and natural resources in the Highlands region, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section identifier="/us/sComp/108/421/s1" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content class="block" style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote"><inline style="-uslm-dtd:short-title">Highlands Conservation Act</inline></shortTitle>”.</content>
        </section>
        <section identifier="/us/sComp/108/421/s2" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">PURPOSES. </heading>
            <chapeau class="block" style="-uslm-dtd:text">The purposes of this Act are—</chapeau>
            <paragraph identifier="/us/sComp/108/421/s2/1" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">to recognize the importance of the water, forest, agricultural, wildlife, recreational, and cultural resources of the Highlands region, and the national significance of the Highlands region to the United States;</content>
            </paragraph>
            <paragraph identifier="/us/sComp/108/421/s2/2" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">to authorize the Secretary of the Interior to work in partnership with the Secretary of Agriculture to provide financial assistance to the Highlands States to preserve and protect high priority conservation land in the Highlands region; and</content>
            </paragraph>
            <paragraph identifier="/us/sComp/108/421/s2/3" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">to continue the ongoing Forest Service programs in the Highlands region to assist the Highlands States, local units of government, and private forest and farm landowners in the conservation of land and natural resources in the Highlands region.</content>
            </paragraph>
        </section>
        <section identifier="/us/sComp/108/421/s3" role="definitions" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><heading style="-uslm-dtd:header">DEFINITIONS. </heading>
            <chapeau class="block" style="-uslm-dtd:text">In this Act:</chapeau>
            <paragraph identifier="/us/sComp/108/421/s3/1" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Highlands region.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Highlands region</term>” means—</chapeau>
                <subparagraph identifier="/us/sComp/108/421/s3/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the area depicted on the map entitled “<term style="-uslm-dtd:quote">The Highlands Region</term>”, dated June 2004, updated after the date of enactment of this subparagraph to comprise each municipality included on the list of municipalities included in the Highlands region as of that date of enactment, and maintained in the headquarters of the Forest Service in Washington, District of Columbia; and</content>
                </subparagraph>
                <subparagraph identifier="/us/sComp/108/421/s3/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">a municipality approved by the Director of the United States Fish and Wildlife Service under section 4(e).</content>
                </subparagraph>
            </paragraph>
            <paragraph identifier="/us/sComp/108/421/s3/2" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Highlands state.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Highlands State</term>” means—</chapeau>
                <subparagraph identifier="/us/sComp/108/421/s3/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the State of Connecticut;</content>
                </subparagraph>
                <subparagraph identifier="/us/sComp/108/421/s3/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the State of New Jersey;</content>
                </subparagraph>
                <subparagraph identifier="/us/sComp/108/421/s3/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">the State of New York; and</content>
                </subparagraph>
                <subparagraph identifier="/us/sComp/108/421/s3/2/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">the State of Pennsylvania.</content>
                </subparagraph>
            </paragraph>
            <paragraph identifier="/us/sComp/108/421/s3/3" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Land conservation partnership project.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">land conservation partnership project</term>” means a land conservation project—</chapeau>
                <subparagraph identifier="/us/sComp/108/421/s3/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">located in the Highlands region;</content>
                </subparagraph>
                <subparagraph identifier="/us/sComp/108/421/s3/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">identified by a Highlands State as having high conservation value using the best available science and geographic information systems; and</content>
                </subparagraph>
                <subparagraph identifier="/us/sComp/108/421/s3/3/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">in which a non-Federal entity acquires land or an interest in land from a willing seller to permanently protect, conserve, or preserve the land through a partnership with the Federal Government.</content>
                </subparagraph>
            </paragraph>
            <paragraph identifier="/us/sComp/108/421/s3/4" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Non-federal entity.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">non-Federal entity</term>” means—</chapeau>
                <subparagraph identifier="/us/sComp/108/421/s3/4/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">any Highlands State, including a political subdivision thereof; or</content>
                </subparagraph>
                <subparagraph identifier="/us/sComp/108/421/s3/4/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">any agency or department of any Highlands State with authority to own and manage land for conservation purposes, including the Palisades Interstate Park Commission.</content>
                </subparagraph>
            </paragraph>
        </section>
        <section identifier="/us/sComp/108/421/s4" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="4">SEC. 4. </num><heading style="-uslm-dtd:header">LAND CONSERVATION PARTNERSHIP PROJECTS IN THE HIGHLANDS REGION. </heading>
            <subsection identifier="/us/sComp/108/421/s4/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Submission of Proposed Projects.—</heading><chapeau style="-uslm-dtd:text">Each year, the governors of the Highlands States, with input from pertinent units of local government and the public, may—</chapeau>
                <paragraph identifier="/us/sComp/108/421/s4/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">jointly identify land conservation partnership projects in the Highlands region from land identified as having high conservation values using the best available science and geographic information systems; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/108/421/s4/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">submit a list of those projects to the Secretary of the Interior.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/108/421/s4/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Consideration of Projects.—</heading><content style="-uslm-dtd:text">Each year, the Secretary of the Interior, in consultation with the Secretary of Agriculture, shall submit to Congress a list of the land conservation partnership projects submitted under subsection (a)(2) that are eligible to receive financial assistance under this section.</content>
            </subsection>
            <subsection identifier="/us/sComp/108/421/s4/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Eligibility Conditions.—</heading><chapeau style="-uslm-dtd:text">To be eligible for financial assistance under this section for a land conservation partnership project, a non-Federal entity shall enter into an agreement with the Secretary of the Interior that—</chapeau>
                <paragraph identifier="/us/sComp/108/421/s4/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">identifies the non-Federal entity that shall own or hold and manage the land or interest in land;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/108/421/s4/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">identifies the source of funds to provide the non-Federal share under subsection (d);</content>
                </paragraph>
                <paragraph identifier="/us/sComp/108/421/s4/c/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">describes the management objectives for the land that will ensure permanent protection and use of the land for the purpose for which the assistance will be provided;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/108/421/s4/c/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><chapeau style="-uslm-dtd:text">provides that, if the non-Federal entity converts, uses, or disposes of the land conservation partnership project for a purpose inconsistent with the purpose for which the assistance was provided, as determined by the Secretary of the Interior, the United States—</chapeau>
                    <subparagraph identifier="/us/sComp/108/421/s4/c/4/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">may seek specific performance of the conditions of financial assistance in accordance with paragraph (3) in Federal court; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/108/421/s4/c/4/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">shall be entitled to reimbursement from the non-Federal entity in an amount that is, as determined at the time of conversion, use, or disposal, the greater of—</chapeau>
                        <clause identifier="/us/sComp/108/421/s4/c/4/B/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the total amount of the financial assistance provided for the project by the Federal Government under this section; or</content>
                        </clause>
                        <clause identifier="/us/sComp/108/421/s4/c/4/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the amount by which the financial assistance increased the value of the land or interest in land; and</content>
                        </clause>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/108/421/s4/c/5" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">provides that land conservation partnership projects will be consistent with areas identified as having high conservation value in accordance with the purposes described in section 2 in the Highlands region.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/108/421/s4/d" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Non-Federal Share Requirement.—</heading><content style="-uslm-dtd:text">The Federal share of the cost of carrying out a land conservation partnership project under this section shall not exceed 50 percent of the total cost of the land conservation partnership project.</content>
            </subsection>
            <subsection identifier="/us/sComp/108/421/s4/e" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Request for Inclusion of Additional Municipality.—</heading><content style="-uslm-dtd:text">The Director of the United States Fish and Wildlife Service may, at the request of a Highlands State, with the concurrence of the municipality, approve the inclusion of a municipality within the State as part of the Highlands region.</content>
            </subsection>
            <subsection identifier="/us/sComp/108/421/s4/f" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Limitation on Administrative Expenses.—</heading>
                <paragraph identifier="/us/sComp/108/421/s4/f/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Federal administration </heading><content style="-uslm-dtd:text">The Secretary of the Interior may not expend more than $300,000 for the administration of this Act in each fiscal year.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/108/421/s4/f/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">State administration </heading><content style="-uslm-dtd:text">A State that receives funds under this section for a land conservation partnership project may not use more than 5 percent of the funds to administer the land conservation partnership project.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/108/421/s4/g" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Authorization of Appropriations.—</heading><content style="-uslm-dtd:text">There is authorized to be appropriated to the Secretary of the Interior $10,000,000 for each of fiscal years 2023 through 2029, to remain available until expended.</content>
            </subsection>
        </section>
        <section identifier="/us/sComp/108/421/s5" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="5">SEC. 5. </num><heading style="-uslm-dtd:header">FOREST SERVICE AND USDA PROGRAMS IN THE HIGHLANDS REGION. </heading>
            <subsection identifier="/us/sComp/108/421/s5/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">To meet the land resource goals of, and the scientific and conservation challenges identified in, the Highlands region, the Secretary of Agriculture, acting through the Chief of the Forest Service and in consultation with the Chief of the National Resources Conservation Service, shall continue to assist the Highlands States, local units of government, and private forest and farm landowners in the conservation of land and natural resources in the Highlands region.</content>
            </subsection>
            <subsection identifier="/us/sComp/108/421/s5/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Duties.—</heading><chapeau style="-uslm-dtd:text">The Forest Service shall—</chapeau>
                <paragraph identifier="/us/sComp/108/421/s5/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">in consultation with the Highlands States, undertake other studies and research in the Highlands region consistent with the purposes of this Act;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/108/421/s5/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">communicate with stakeholders regarding implementation of the program; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/108/421/s5/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">assist the Highland States, local units of government, individual landowners, and private organizations in identifying and using Forest Service and other technical and financial assistance programs of the Department of Agriculture.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/108/421/s5/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Authorization of Appropriations.—</heading><content style="-uslm-dtd:text">There is authorized to be appropriated to the Secretary of Agriculture to carry out this section $1,000,000 for each of fiscal years 2023 through 2029.</content>
            </subsection>
        </section>
        <section identifier="/us/sComp/108/421/s6" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="6">SEC. 6. </num><heading style="-uslm-dtd:header">PRIVATE PROPERTY PROTECTION AND LACK OF REGULATORY EFFECT. </heading>
            <subsection identifier="/us/sComp/108/421/s6/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Access to Private Property.—</heading><chapeau style="-uslm-dtd:text">Nothing in this Act—</chapeau>
                <paragraph identifier="/us/sComp/108/421/s6/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">requires a private property owner to permit public access (including Federal, State, or local government access) to private property; or</content>
                </paragraph>
                <paragraph identifier="/us/sComp/108/421/s6/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">modifies any provision of Federal, State, or local law with regard to public access to, or use of, private land.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/108/421/s6/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Liability.—</heading><content style="-uslm-dtd:text">Nothing in this Act creates any liability, or has any effect on liability under any other law, of a private property owner with respect to any persons injured on the private property.</content>
            </subsection>
            <subsection identifier="/us/sComp/108/421/s6/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Recognition of Authority To Control Land Use.—</heading><content style="-uslm-dtd:text">Nothing in this Act modifies any authority of Federal, State, or local governments to regulate land use.</content>
            </subsection>
            <subsection identifier="/us/sComp/108/421/s6/d" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Participation of Private Property Owners.—</heading><content style="-uslm-dtd:text">Nothing in this Act requires the owner of any private property located in the Highlands region to participate in the land conservation, financial, or technical assistance or any other programs established under this Act.</content>
            </subsection>
            <subsection identifier="/us/sComp/108/421/s6/e" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Purchase of Land or Interests in Land From Willing Sellers Only.—</heading><content style="-uslm-dtd:text">Funds appropriated to carry out this Act shall be used to purchase land or interests in land only from willing sellers.</content>
            </subsection>
            <subsection identifier="/us/sComp/108/421/s6/f" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Appraisal Methodology.—</heading>
                <paragraph identifier="/us/sComp/108/421/s6/f/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general </heading><content style="-uslm-dtd:text">With respect to an appraisal related to a land acquisition carried out under this Act, a Highlands State shall use an appraisal methodology approved by the Secretary of the Interior.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/108/421/s6/f/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Alternative appraisal methodology.—</heading><chapeau style="-uslm-dtd:text">A Highlands State may petition the Secretary of the Interior to consider an alternative appraisal methodology when there is a conflict, in any Highlands State, between—</chapeau>
                    <subparagraph identifier="/us/sComp/108/421/s6/f/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">an appraisal methodology approved by the Secretary of the Interior under paragraph (1); and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/108/421/s6/f/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">applicable State law.</content>
                    </subparagraph>
