    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To temporarily increase the cost share authority for aqueous film forming foam input-based testing equipment, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section identifier="/us/sComp/117/254/s1" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t49/s40101">49 U.S.C. 40101 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content class="block" style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Preventing PFAS Runoff at Airports Act</shortTitle>”.</content>
        </section>
        <section identifier="/us/sComp/117/254/s2" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">TEMPORARY INCREASED COST SHARE AUTHORITY FOR AQUEOUS FILM FORMING FOAM INPUT-BASED TESTING EQUIPMENT. </heading>
            <subsection identifier="/us/sComp/117/254/s2/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">Section 47109 of title 49, United States Code, is amended by adding at the end the following new subsection:<quotedContent style="-uslm-dtd:quoted-block">
                <subsection style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="g">“(g) </num><heading style="-uslm-dtd:header">Special Rule for Covered Equipment.—</heading>
                    <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">“(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Government’s share of allowable project costs for covered equipment and its installation shall be 100 percent.</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">“(2) </num><heading style="-uslm-dtd:header">Definition of covered equipment.—</heading><content style="-uslm-dtd:text">For purposes of this subsection, the term ‘<quotedText style="-uslm-dtd:quote">covered equipment</quotedText>’ means aqueous film forming foam input-based testing equipment that is eligible for Airport Improvement Program funding based on Federal Aviation Administration PGL 21-01, titled ‘Extension of Eligibility for stand-alone acquisition of input-based testing equipment and truck modification’, dated October 5, 2021 (or any other successor program guidance letter).</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">“(3) </num><heading style="-uslm-dtd:header">Sunset.—</heading><chapeau style="-uslm-dtd:text">The higher cost share authority established in this subsection shall terminate on the earlier of—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">“(A) </num><content style="-uslm-dtd:text">180 days after the date on which the eligibility of covered equipment for Airport Improvement Program funding under the authority described in paragraph (2) terminates or is discontinued by the Administrator; or</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">“(B) </num><content style="-uslm-dtd:text">5 years after the date of enactment of this subsection.”</content>
                        </subparagraph>
                    </paragraph>
                </subsection></quotedContent>.</content>
            </subsection>
            <subsection identifier="/us/sComp/117/254/s2/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t49/s47109">49 U.S.C. 47109 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Outreach Efforts.—</heading><content style="-uslm-dtd:text">Not later than 90 days after the date of enactment of this Act, the Administrator of the Federal Aviation Administration shall conduct an outreach effort to make airports aware of the higher cost share authority established in section 47109(g) of title 49, United States Code, as added by subsection (a).</content>
            </subsection>
            <subsection identifier="/us/sComp/117/254/s2/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Forward-looking Airport Reimbursements.—</heading><chapeau style="-uslm-dtd:text">Not later than 18 months after the date of enactment of this Act, the Administrator of the Federal Aviation Administration shall provide a  
briefing to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives that reviews—</chapeau>
                <paragraph identifier="/us/sComp/117/254/s2/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">potential options for Congress to reimburse airports that—</chapeau>
                    <subparagraph identifier="/us/sComp/117/254/s2/c/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">are certificated under part 139 of title 14, Code of Federal Regulations; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/117/254/s2/c/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">acquired covered equipment (as defined in section 47109(g) of title 49, United States Code) as added by subsection (a)—</chapeau>
                        <clause identifier="/us/sComp/117/254/s2/c/1/B/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">with Federal funding but with a Government’s share less than 100 percent; or</content>
                        </clause>
                        <clause identifier="/us/sComp/117/254/s2/c/1/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">without Federal funding;</content>
                        </clause>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/117/254/s2/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">information relevant to estimating the potential cost of providing such reimbursement;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/117/254/s2/c/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">the status of the Federal Aviation Administration’s outreach efforts as required under subsection (b); and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/117/254/s2/c/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">any additional information the Administrator of the Federal Aviation Administration considers appropriate.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/117/254/s2/d" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t49/s47109">49 U.S.C. 47109 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Authorization of Appropriations.—</heading><content style="-uslm-dtd:text">The amendments made by this Act shall apply to amounts that first become available in fiscal year 2023 or thereafter.</content>
            </subsection>
