    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To amend title 35, United States Code, to establish a competition to award certificates that can be redeemed to accelerate certain matters at the Patent and Trademark Office, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section identifier="/us/sComp/117/245/s1" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t35/s1">35 U.S.C. 1 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content class="block" style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Patents for Humanity Act of 2022</shortTitle>”.</content>
        </section>
        <section identifier="/us/sComp/117/245/s2" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">AWARD OF CERTIFICATES TO ACCELERATE CERTAIN MATTERS AT THE PATENT AND TRADEMARK OFFICE. </heading>
            <subsection identifier="/us/sComp/117/245/s2/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Award.—</heading><content style="-uslm-dtd:text">Chapter 2 of title 35, United States Code, is amended by adding at the end the following:<quotedContent style="-uslm-dtd:quoted-block">
                <section style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="28">“SEC. 28. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t35/s28">35 U.S.C. 28</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header"> Award of certificates to accelerate certain matters at the Patent and Trademark Office </heading>
                    <subsection style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">“(a) </num><heading style="-uslm-dtd:header">Definition.—</heading><chapeau style="-uslm-dtd:text">In this section, the term ‘<quotedText style="-uslm-dtd:quote">eligible entity</quotedText>’ means an entity that—</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">“(1) </num><content style="-uslm-dtd:text">submits an application under subsection (d) for a patent that addresses a humanitarian issue; and</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">“(2) </num><content style="-uslm-dtd:text">meets the requirements specified by the Director.</content>
                        </paragraph>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">“(b) </num><heading style="-uslm-dtd:header">Establishment.—</heading><chapeau style="-uslm-dtd:text">There is established a competition, to be held not less frequently than biennially, to award eligible entities certificates that can be redeemed to accelerate one of the following matters:</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">“(1) </num><content style="-uslm-dtd:text">An ex parte reexamination proceeding, including 1 appeal to the Patent Trial and Appeal Board from that proceeding.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">“(2) </num><content style="-uslm-dtd:text">An application for a patent, including 1 appeal to the Patent Trial and Appeal Board from that application.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">“(3) </num><content style="-uslm-dtd:text">An appeal to the Patent Trial and Appeal Board of a claim twice rejected in a patent application or reissue application or finally rejected in an ex parte reexamination, without accelerating the underlying matter that generated the appeal.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="4">“(4) </num><content style="-uslm-dtd:text">A matter identified by the Director.</content>
                        </paragraph>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">“(c) </num><heading style="-uslm-dtd:header">Administration.—</heading><content style="-uslm-dtd:text">The Director shall administer the competition established under subsection (b).</content>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="d">“(d) </num><heading style="-uslm-dtd:header">Application.—</heading><content style="-uslm-dtd:text">An entity seeking an award under subsection (b) shall submit to the Director an application at such time, in such manner, and containing such information as the Director may require.</content>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="e">“(e) </num><heading style="-uslm-dtd:header">Promotion of Competition.—</heading><content style="-uslm-dtd:text">The Director shall promote the competition established under subsection (b) through the satellite offices established pursuant to section 1.</content>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="f">“(f) </num><heading style="-uslm-dtd:header">Treatment as Successor.—</heading><content style="-uslm-dtd:text">The competition established under subsection (b) shall be treated as a successor to the Patents for Humanity Program (established in the notice entitled ‘Humanitarian Awards Pilot Program’, published at 77 Fed. Reg. 6544 (February 8, 2012)).”</content>

            <subsection identifier="/us/sComp/117/245/s2/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t35/s28">35 U.S.C. 28 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Rule of Construction.—</heading><content style="-uslm-dtd:text">Nothing in this section, or the amendments made by this section, may be construed as affecting any action taken by the Under Secretary of Commerce for Intellectual Property and Director of the United States Patent and Trademark Office before the date of enactment of this Act with respect to the administration of the Patents for Humanity Program established in the notice entitled “Humanitarian Awards Pilot Program”, published at 77 Fed. Reg. 6544 (February 8, 2012).</content>
            </subsection>
            <subsection identifier="/us/sComp/117/245/s2/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t35/s21">35 U.S.C. 21</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Technical and Conforming Amendment.—</heading><content style="-uslm-dtd:text">The table of sections for chapter 2 of title 35, United States Code, is amended by adding at the end the following:<quotedContent style="-uslm-dtd:quoted-block">
