    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To amend the Families First Coronavirus Response Act to extend child nutrition waiver authority, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section identifier="/us/sComp/117/158/s1" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t42/s1751">42 U.S.C. 1751 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content class="block" style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Keep Kids Fed Act of 2022</shortTitle>”.</content>
        </section>
        <section identifier="/us/sComp/117/158/s2" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">SUPPORT FOR CHILD NUTRITION PROGRAMS. </heading>
            <subsection identifier="/us/sComp/117/158/s2/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t42/s1753">42 U.S.C. 1753 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">In General.—</heading>
                <paragraph identifier="/us/sComp/117/158/s2/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Temporary lunch reimbursement.—</heading><content style="-uslm-dtd:text">Each lunch served under the school lunch program authorized under the Richard B. Russell National School Lunch Act (42 U.S.C. 1751 et seq.) shall receive additional reimbursement in the amount of 40 cents.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/117/158/s2/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Temporary breakfast reimbursement.—</heading><content style="-uslm-dtd:text">Each breakfast served under the school breakfast program established by section 4 of the Child Nutrition Act of 1966 (42 U.S.C. 1773) shall receive additional reimbursement in the amount of 15 cents.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/117/158/s2/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Limitation.—</heading><content style="-uslm-dtd:text">The additional reimbursement amounts authorized under this subsection shall only be available for the school year beginning July 2022.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/117/158/s2/a/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Appropriations.—</heading>
                    <subparagraph identifier="/us/sComp/117/158/s2/a/4/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">There is appropriated, out of any funds in the Treasury not otherwise appropriated, such sums as are necessary to carry out this subsection.</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/117/158/s2/a/4/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Disbursement.—</heading><content style="-uslm-dtd:text">A State agency shall disburse funds made available under subparagraph (A) to school food authorities participating in the school meal programs described in paragraphs (1) and (2).</content>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/117/158/s2/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Extension of Waivers.—</heading><chapeau style="-uslm-dtd:text">Section 2202 of the Families First Coronavirus Response Act (42 U.S.C. 1760 note; Public Law 116-127) is amended—</chapeau>
                <paragraph identifier="/us/sComp/117/158/s2/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">in subsection (a)(1)—</chapeau>
                    <subparagraph identifier="/us/sComp/117/158/s2/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">in the matter preceding subparagraph (A), by inserting “<quotedText style="-uslm-dtd:quote">due to the COVID-19 pandemic</quotedText>” after  “<quotedText style="-uslm-dtd:quote">(42 U.S.C. 1760(l))</quotedText>”;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/117/158/s2/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">in subparagraph (A), by striking “<quotedText style="-uslm-dtd:quote">and</quotedText>” after the semicolon and inserting “<quotedText style="-uslm-dtd:quote">or</quotedText>”; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/117/158/s2/b/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">by striking subparagraph (B) and inserting the following:<quotedContent style="-uslm-dtd:quoted-block">
                        <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">“(B) </num><content style="-uslm-dtd:text">ensuring continuity of program operation under a qualified program.”</content>
                        </subparagraph></quotedContent>;</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/117/158/s2/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">in subsection (d)—</chapeau>
                    <subparagraph identifier="/us/sComp/117/158/s2/b/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">by striking paragraph (2); and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/117/158/s2/b/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">the following:</quotedText>” in the matter preceding paragraph (1) and all that follows through  “<quotedText style="-uslm-dtd:quote">A summary</quotedText>” in paragraph (1) and inserting “<quotedText style="-uslm-dtd:quote">a summary</quotedText>”; and</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/117/158/s2/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">by striking subsection (e) and inserting the following:<quotedContent style="-uslm-dtd:quoted-block">
                    <subsection style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="e">“(e) </num><heading style="-uslm-dtd:header">Sunset.—</heading>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">“(1) </num><heading style="-uslm-dtd:header">Nationwide waivers.—</heading><content style="-uslm-dtd:text">The authority of the Secretary to establish or grant a waiver under subsection (a) shall expire on September 30, 2022.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">“(2) </num><heading style="-uslm-dtd:header">Waiver restriction.—</heading><chapeau style="-uslm-dtd:text">After June 30, 2022, a waiver established or granted under subsection (a) shall only apply to schools or summer food service program food service sites—</chapeau>
                            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">“(A) </num><chapeau style="-uslm-dtd:text">operating—</chapeau>
                                <clause style="-uslm-dtd:clause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="i">“(i) </num><content style="-uslm-dtd:text">the qualified program described in subsection (f)(1)(D); or</content>
                                </clause>
                                <clause style="-uslm-dtd:clause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="ii">“(ii) </num><content style="-uslm-dtd:text">the option described in section 13(a)(8) of the Richard B. Russell National School Lunch Act (42 U.S.C. 1761(a)(8)); and</content>
                                </clause>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">“(B) </num><content style="-uslm-dtd:text">not operating the qualified program described in subsection (f)(1)(A).</content>
                            </subparagraph>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">“(3) </num><heading style="-uslm-dtd:header">Other waivers.—</heading>
                            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">“(A) </num><heading style="-uslm-dtd:header">Child and adult care food program waiver.—</heading><content style="-uslm-dtd:text">The authority of the Secretary to establish or grant a waiver under subsection (b) shall expire on June 30, 2022.</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">“(B) </num><heading style="-uslm-dtd:header">Meal pattern waiver.—</heading><content style="-uslm-dtd:text">The authority of the Secretary to establish or grant a waiver under subsection (c) shall expire on June 30, 2023.</content>
                            </subparagraph>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="4">“(4) </num><heading style="-uslm-dtd:header">Limitations.—</heading><content style="-uslm-dtd:text">A waiver authorized by the Secretary under this section shall not be in effect after the date on which the authority of the Secretary to establish or grant that waiver under this subsection expires.”</content>
                        </paragraph>
                    </subsection></quotedContent>.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/117/158/s2/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Appropriation.—</heading><chapeau style="-uslm-dtd:text">There are appropriated, out of any funds in the Treasury not otherwise appropriated, such sums as are necessary to provide waivers under section 2202(a) of the Families First Coronavirus Response Act (42 U.S.C. 1760 note; Public Law 116-127) that apply—</chapeau>
                <paragraph identifier="/us/sComp/117/158/s2/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">only during the months of May through September in 2022; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/117/158/s2/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">to—</chapeau>
                    <subparagraph identifier="/us/sComp/117/158/s2/c/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the summer food service program for children under section 13 of the Richard B. Russell National School Lunch Act (42 U.S.C. 1761); or</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/117/158/s2/c/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the option described in section 13(a)(8) of that Act (42 U.S.C. 1761(a)(8)).</content>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/117/158/s2/d" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t42/s1760">42 U.S.C. 1760 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Nationwide Waiver for School Year 2022-2023.—</heading>
                <paragraph identifier="/us/sComp/117/158/s2/d/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">For purposes of school year 2022-2023, the Secretary of Agriculture may establish waivers under section 12(l) of the Richard B. Russell National School Lunch Act (42 U.S.C. 1760(l))—</chapeau>
                    <subparagraph identifier="/us/sComp/117/158/s2/d/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">on a nationwide basis; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/117/158/s2/d/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">without regard to the requirements under paragraphs (1), (2), and (3) of such section that a State or eligible service provider shall submit an application for a waiver request.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/117/158/s2/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Sunset.—</heading><content style="-uslm-dtd:text">A nationwide waiver established by the Secretary of Agriculture under section 12(l) of the Richard B.  
Russell National School Lunch Act (42 U.S.C. 1760(l)) pursuant to paragraph (1) shall not be in effect after June 30, 2023.</content>
                </paragraph>
            </subsection>
        </section>
        <section identifier="/us/sComp/117/158/s3" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t42/s1766">42 U.S.C. 1766 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">CHILD AND ADULT CARE FOOD PROGRAM. </heading>
            <subsection identifier="/us/sComp/117/158/s3/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading>
                <paragraph identifier="/us/sComp/117/158/s3/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Temporary additional reimbursement for 2022-2023 school year.—</heading><content style="-uslm-dtd:text">Each meal and supplement served under the program authorized by section 17 of the Richard B. Russell National School Lunch Act (42 U.S.C. 1766) shall receive additional reimbursement in the amount of 10 cents.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/117/158/s3/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Limitation.—</heading><content style="-uslm-dtd:text">The additional reimbursement amount authorized under paragraph (1) shall only be available for the school year beginning July 2022.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/117/158/s3/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Tier Determinations for 2022-2023 School Year.—</heading><content style="-uslm-dtd:text">For the school year beginning July 2022, a tier II family or group day care home described in subsection (f)(3)(A)(iii) of section 17 of the Richard B. Russell National School Lunch Act (42 U.S.C. 1766) shall be considered a tier I family or group day care home for purposes of the program authorized under that section.</content>
            </subsection>
            <subsection identifier="/us/sComp/117/158/s3/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Appropriations.—</heading><content style="-uslm-dtd:text">There are appropriated, out of any funds in the Treasury not otherwise appropriated, such sums as are necessary to carry out this section.</content>
            </subsection>
        </section>
        <section identifier="/us/sComp/117/158/s4" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="4">SEC. 4. </num><heading style="-uslm-dtd:header">RESCISSIONS AND SUNSET. </heading>
            <subsection identifier="/us/sComp/117/158/s4/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Rescissions.—</heading>
                <paragraph identifier="/us/sComp/117/158/s4/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">USDA.—</heading>
                    <subparagraph identifier="/us/sComp/117/158/s4/a/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">Of the unobligated balances from amounts made available to the Department of Agriculture in section 1001(a) of the American Rescue Plan Act of 2021 (7 U.S.C. 7501 note; Public Law 117-2), $1,000,000,000 are hereby permanently rescinded.</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/117/158/s4/a/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">Of the unobligated balances from amounts made available to the Department of Agriculture in section 751 of division N of the Consolidated Appropriations Act, 2021 (Public Law 116-260; 134 Stat. 2105), $400,000,000 are hereby permanently rescinded.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/117/158/s4/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Department of education.—</heading><content style="-uslm-dtd:text">Of the unobligated balances from amounts made available to the Department of Education in section 2003 of title II of the American Rescue Plan Act of 2021 (Public Law 117-2; 135 Stat. 23) and allocated to institutions of higher education as defined in section 102(b) of the Higher Education Act of 1965 (20 U.S.C. 1002(b)), $400,000,000 are hereby permanently rescinded.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/117/158/s4/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">SBA.—</heading><content style="-uslm-dtd:text">Of the unobligated balances from amounts made available to the Small Business Administration in section 5005 of the American Rescue Plan Act of 2021 (Public Law 117-2; 135 Stat. 91) and in section 323(d)(1)(H) of division N of the Consolidated Appropriations Act, 2021 (Public Law 116-260; 134 Stat. 2021) to carry out section 324 of such division of such Act (15 U.S.C. 9009a), $1,200,000,000 are hereby permanently rescinded.</content>

                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Additional Rescission.—</heading><content style="-uslm-dtd:text">Of the unobligated balances from amounts made available to the Department of Agriculture under the heading “<headingText style="-uslm-dtd:header-in-text">Agricultural Programs—Office of the Secretary</headingText>” in title I of division B of the Coronavirus Aid, Relief, and Economic Security Act (Public Law 116-136; 134 Stat. 505), $600,000,000 are hereby permanently rescinded.</content>
            </subsection>
            <subsection identifier="/us/sComp/117/158/s4/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Sunset.—</heading><content style="-uslm-dtd:text">Section 756 of division N of the Consolidated Appropriations Act, 2021 (7 U.S.C. 2254c), is amended by striking “<quotedText style="-uslm-dtd:quote">for fiscal year</quotedText>” and all that follows through  “<quotedText style="-uslm-dtd:quote">thereafter</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">for each of fiscal years 2021 and 2022</quotedText>”.</content>

            <num style="-uslm-dtd:enum" value="5">SEC. 5. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t42/s1760">42 U.S.C. 1760 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">OPERATIONALLY READY. </heading>
            <content class="block" style="-uslm-dtd:text">The Secretary of Agriculture shall ensure that technical assistance is made available to States and school food authorities for purposes of assisting parents and school leaders with respect to the transition of operating school meal programs not pursuant to a waiver under section 2(d) or section 2202 of the Families First Coronavirus Response Act (42 U.S.C. 1760 note; Public Law 116-127).</content>
