            <num style="-uslm-dtd:enum" value="III">TITLE III—</num><heading style="-uslm-dtd:header">INTERJURISDICTIONAL FISHERIES </heading>
            <section identifier="/us/sComp/99/659/tIII/s301" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="301">SEC. 301. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s4101">16 U.S.C. 4101 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
                <content class="block" style="-uslm-dtd:text">This title may be cited as the “<shortTitle style="-uslm-dtd:quote"><inline style="-uslm-dtd:short-title">Interjurisdictional Fisheries Act of 1986</inline></shortTitle>”.</content>

            <section identifier="/us/sComp/99/659/tIII/s302" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="302">SEC. 302. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s4101">16 U.S.C. 4101</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">PURPOSES. </heading>
                <subsection role="undesignated-level" style="-uslm-dtd:subsection" styleType="OLC"><chapeau style="-uslm-dtd:text">The purposes of this title are—</chapeau>
                    <paragraph identifier="/us/sComp/99/659/tIII/s302/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">to promote and encourage State activities in support of the management of interjurisdictional fishery resources;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/99/659/tIII/s302/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">to promote and encourage management of interjurisdictional fishery resources throughout their range; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/99/659/tIII/s302/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">to promote and encourage research in preparation for the implementation of the use of ecosystems and interspecies approaches to the conservation and management of interjurisdictional fishery resources throughout their range.</content>
                    </paragraph>
                </subsection>
            </section>
            <section identifier="/us/sComp/99/659/tIII/s303" role="definitions" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="303">SEC. 303. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s4102">16 U.S.C. 4102</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">DEFINITIONS. </heading>
                <subsection role="undesignated-level" style="-uslm-dtd:subsection" styleType="OLC"><chapeau style="-uslm-dtd:text">For the purposes of this title:</chapeau>
                    <paragraph identifier="/us/sComp/99/659/tIII/s303/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Federal fishery management plan</term>” means a plan developed under the Magnuson Fishery Conservation and Management Act (16 U.S.C. 1801 et seq.).<ref class="footnoteRef" idref="ID0AAC880E40BD4BD887B987244D930BC4" style="-uslm-dtd:footnote-ref">1</ref></content><footnote id="ID0AAC880E40BD4BD887B987244D930BC4" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">1</sup><p style="-uslm-dtd:para; margin-left:1em">Section 211 of the Department of Commerce and Related Agencies Appropriations Act, 1997 (Division A, title II of P.L. 104–208; 110 Stat. 3009–41) changed (by amendment) the short title of such Act to the Magnuson-Stevens Fishery and Conservation and Management Act and provided that “<term style="-uslm-dtd:quote">all references to the Magnuson Fishery Conservation and Management Act shall be redesignated as references to the Magnuson-Stevens Fishery Conservation and Management Act</term>”. Since such section did not actually amended each occurrence of the short title in law, the former short title appears here.</p></footnote>
                    </paragraph>
                    <paragraph identifier="/us/sComp/99/659/tIII/s303/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">fishery resource</term>” means finfish, mollusks, crustaceans, and any other form of marine animal or plant life, other than marine mammals and birds.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/99/659/tIII/s303/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">interjurisdictional fishery resource</term>” means—</chapeau>
                        <subparagraph identifier="/us/sComp/99/659/tIII/s303/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">a fishery resource for which a fishery occurs in waters under the jurisdiction of one or more States and the exclusive economic zone established by Proclamation Numbered 5030, dated March 10, 1983;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/99/659/tIII/s303/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">a fishery resource for which there exists an interstate fishery management plan; or</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/99/659/tIII/s303/3/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">a fishery resource which migrates between the waters under the jurisdiction of two or more States bordering on the Great Lakes.</content>
                        </subparagraph><continuation role="paragraph" style="-uslm-dtd:continuation-text">For purposes of applying section 305(a)(3) during fiscal year 1987, a Federal fishery management plan or an interstate fishery management plan for the fishery resource need not be in existence, but a plan of either kind for that resource must be in the development process during that year.</continuation>
                    </paragraph>
                    <paragraph identifier="/us/sComp/99/659/tIII/s303/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">interstate fishery management plan</term>” means a plan for managing fisheries developed and adopted by an interstate commission.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/99/659/tIII/s303/5" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">interstate commission</term>” means a commission or other administrative body established by an interstate compact.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/99/659/tIII/s303/6" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">interstate compact</term>” means a compact that has been entered into by two or more States, established for the purposes of conserving and managing interjurisdictional fishery resources throughout their range, and consented to and approved by Congress.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/99/659/tIII/s303/7" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">project</term>” means a program for research in support of the management of an interjurisdictional fishery resource or an interstate cooperative fishery management agreement.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/99/659/tIII/s303/8" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="8">(8) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Secretary</term>” means the Secretary of Commerce.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/99/659/tIII/s303/9" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="9">(9) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">State</term>” means any of the several States of the United States, the Commonwealth of Puerto Rico, American Samoa, the Virgin Islands, Guam, or the Northern Mariana Islands.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/99/659/tIII/s303/10" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="10">(10) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">State agency</term>” means any department, agency, commission, or official of a State authorized under the laws of the State to regulate commercial fisheries or enforce laws relating to commercial fisheries.</content>
                    </paragraph>
                </subsection>
            </section>
            <section identifier="/us/sComp/99/659/tIII/s304" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="304">SEC. 304. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s4103">16 U.S.C. 4103</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">APPORTIONMENT. </heading>
                <subsection identifier="/us/sComp/99/659/tIII/s304/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Time When Apportionments Made.—</heading><content style="-uslm-dtd:text">Funds appropriated under section 308(a) shall be apportioned by the Secretary among the States on October 1 of each fiscal year, or as soon thereafter as practicable.</content>
                </subsection>
                <subsection identifier="/us/sComp/99/659/tIII/s304/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Apportionment Formula.—</heading><content style="-uslm-dtd:text">The amount of funds apportioned to each State shall be determined by the Secretary as the ratio which the equally weighted average of the volume and value of fishery resources harvested by domestic commercial fishermen and received within such State during the 3 most recent calendar years for which data satisfactory to the Secretary are available bears to the total equally weighted average of the volume and value of all fishery resources harvested by domestic commercial fishermen received within all of the States during those calendar years.</content>
                </subsection>
                <subsection identifier="/us/sComp/99/659/tIII/s304/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Limitations.—</heading><paragraph class="inline" identifier="/us/sComp/99/659/tIII/s304/c/1" style="-uslm-dtd:paragraph" styleType="OLC"><num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">No State may receive an apportionment under subsection (b) for either fiscal year 1987 or fiscal year 1988 which is less than one-half of one percent of the total amount of funds available for that fiscal year.</content></paragraph>
                    <paragraph class="leftIndentDecrease1" identifier="/us/sComp/99/659/tIII/s304/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">For any fiscal year after fiscal year 1988, no State that, under the apportionment formula in subsection (b), has a ratio of one-third of one percent or higher may receive an apportionment for any fiscal year which is less than one percent of the total amount of funds available for that fiscal year.</content>
                    </paragraph>
                    <paragraph class="leftIndentDecrease1" identifier="/us/sComp/99/659/tIII/s304/c/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><chapeau style="-uslm-dtd:text">For any fiscal year after fiscal year 1988, no State may receive an apportionment under this section for any fiscal year if that State's ratio under the apportionment formula in subsection (b) is less than one-third of one percent, unless the State—</chapeau>
                        <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/99/659/tIII/s304/c/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">is signatory to an interstate fishery compact;</content>
                        </subparagraph>
                        <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/99/659/tIII/s304/c/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">has entered into an agreement with the Secretary or the Secretary of the Interior under which the personnel, services, and equipment of the State and the Federal agency concerned will be made mutually available for the enforcement of Federal and State laws pertaining to the protection of fishery resources which are managed under an interstate fishery management plan;</content>
                        </subparagraph>
                        <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/99/659/tIII/s304/c/3/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">borders one or more of the Great Lakes; or</content>
                        </subparagraph>
                        <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/99/659/tIII/s304/c/3/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">has entered into an interstate cooperative fishery management agreement and has in effect an interstate fisheries management or interstate fisheries research program.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph class="leftIndentDecrease1" identifier="/us/sComp/99/659/tIII/s304/c/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">No State that, under the apportionment formula in subsection (b), has a ratio of less than one-third of one percent and meets any of the requirements set forth in paragraph (1) (A), (B), (C), or (D) may receive an apportionment for any fiscal year which is less than one-half of one percent of the total amount of funds available for apportionment for such fiscal year.</content>
                    </paragraph>
                    <paragraph class="leftIndentDecrease1" identifier="/us/sComp/99/659/tIII/s304/c/5" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">No State may receive an apportionment for any fiscal year under this section which is more than 6 percent of the total amount of funds available for apportionment for such fiscal year.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/99/659/tIII/s304/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Unused Apportionments.—</heading><chapeau style="-uslm-dtd:text">Any part of an apportionment for any fiscal year to any State—</chapeau>
                    <paragraph identifier="/us/sComp/99/659/tIII/s304/d/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">that is not obligated during that year;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/99/659/tIII/s304/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">with respect to which the State notifies the Secretary that it does not wish to receive that part; or</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/99/659/tIII/s304/d/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">that is returned to the Secretary by the State,</content>
                    </paragraph><continuation role="subsection" style="-uslm-dtd:continuation-text">may not be considered to be apportioned to that State and shall be added to such funds as are appropriated pursuant to section 308(a) for the next fiscal year (and shall be treated as having been appropriated for such next year) for apportionment under subsection (a). Any notification or return of funds referred to in paragraph (2) or (3) by a State is irrevocable.</continuation>
                </subsection>
            </section>
            <section identifier="/us/sComp/99/659/tIII/s305" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="305">SEC. 305. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s4104">16 U.S.C. 4104</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">STATE PROJECTS. </heading>
                <subsection identifier="/us/sComp/99/659/tIII/s305/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><paragraph class="inline" identifier="/us/sComp/99/659/tIII/s305/a/1" style="-uslm-dtd:paragraph" styleType="OLC"><num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">Any State may, through its State agency or an interstate commission, submit to the Secretary a proposal for a project which includes full plans, specifications, and cost estimates for such project. The total cost of all items included for engineering, planning, inspection, and unforeseen contingencies in connection with any works to be constructed as part of such a proposed project shall not exceed 10 percent of the total cost of such works, and shall be paid by the State as a part of its contribution to the total cost of the works.</content></paragraph>
                    <paragraph class="leftIndentDecrease1" identifier="/us/sComp/99/659/tIII/s305/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">No part of any funds appropriated under any authorization contained in section 308 may be obligated with respect to any project until the proposal for such project has been submitted under paragraph (1) and approved by the Secretary. The Secretary, before approving any proposal for a project, must evaluate the proposal as to—</chapeau>
                        <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/99/659/tIII/s305/a/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the soundness of design;</content>
                        </subparagraph>
                        <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/99/659/tIII/s305/a/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the possibilities of securing productive results;</content>
                        </subparagraph>
                        <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/99/659/tIII/s305/a/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">the minimization of duplication with other research projects in support of the management of interjurisdictional fishery resources and carried out under this title or under any other law or regulation;</content>
                        </subparagraph>
                        <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/99/659/tIII/s305/a/2/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">the organization and management of the project;</content>
                        </subparagraph>
                        <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/99/659/tIII/s305/a/2/E" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">the methods proposed for monitoring and evaluating the success or failure of the project;</content>
                        </subparagraph>
                        <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/99/659/tIII/s305/a/2/F" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">the consistency of the project with the purposes of this title specified in section 302; and</content>
                        </subparagraph>
                        <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/99/659/tIII/s305/a/2/G" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="G">(G) </num><content style="-uslm-dtd:text">such other criteria as the Secretary may prescribe.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph class="leftIndentDecrease1" identifier="/us/sComp/99/659/tIII/s305/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><chapeau style="-uslm-dtd:text">The Federal share of the cost of any project conducted under this title shall not exceed 75 percent of the total estimated cost of the project, unless—</chapeau>
                        <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/99/659/tIII/s305/a/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the State has adopted an interstate fishery management plan for the resource to which the project applies; or</content>
                        </subparagraph>
                        <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/99/659/tIII/s305/a/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the State has adopted fishery regulations which the Secretary has determined are consistent with any Federal fishery management plan for the species to which the project applies;</content>
                        </subparagraph><continuation role="paragraph" style="-uslm-dtd:continuation-text">in which case the Federal share shall not exceed 90 percent of the total estimated cost of the project.</continuation>
                    </paragraph>
                    <paragraph class="leftIndentDecrease1" identifier="/us/sComp/99/659/tIII/s305/a/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4)</num><subparagraph class="inline" identifier="/us/sComp/99/659/tIII/s305/a/4/A" style="-uslm-dtd:subparagraph" styleType="OLC"><num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">If the Secretary approves or disapproves a proposal for a project, the Secretary shall promptly give written notification, including, if disapproved, a detailed explanation of the reasons for the disapproval, to the State agency submitting the proposal or, if the proposal is submitted through an interstate commission, such commission and the State.</content></subparagraph>
                        <subparagraph class="leftIndentDecrease2" identifier="/us/sComp/99/659/tIII/s305/a/4/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">For the purposes of this title, funds apportioned under this section to any State shall be treated as having been obligated with respect to a project during the fiscal year in which the written notification of approval required under subparagraph (A) for the project proposal is made.</content>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/99/659/tIII/s305/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Restriction.—</heading><content style="-uslm-dtd:text">The expenditure of funds under this title shall be applied only to projects for which a proposal has been approved under subsection (a), except that up to $25,000 each fiscal year may be obligated for a State to carry out an agreement with the Secretary or the Secretary of the Interior under which the personnel, services and equipment of the State and the Federal agency concerned will be made mutually available for the enforcement of Federal and State laws pertaining to the protection of fishery resources. If otherwise applied, such funds shall be replaced by the State before the State may receive any additional funds under this title.</content>
                </subsection>
                <subsection identifier="/us/sComp/99/659/tIII/s305/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Payment.—</heading><content style="-uslm-dtd:text">When the Secretary determines that a project carried out under a proposal approved by the Secretary has been completed, or where the Secretary otherwise deems it appropriate, the Secretary shall cause to be paid to the proper authority of the State, or to the official or depository designated by the interstate commission if the State agency specifies that payment is to be made to the interstate commission, the Federal share of the project. Any payment made to an interstate commission shall be charged against the apportionment of the State concerned.</content>
                </subsection>
            </section>
            <section identifier="/us/sComp/99/659/tIII/s306" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="306">SEC. 306. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s4105">16 U.S.C. 4105</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">PROPERTY. </heading>
                <subsection identifier="/us/sComp/99/659/tIII/s306/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Application of Federal and State Laws.—</heading><content style="-uslm-dtd:text">All work, including the furnishing of labor and materials, needed to complete any project approved by the Secretary shall be performed in accordance with applicable Federal and State laws under the direct supervision of the State agency, and in accordance with regulations as the Secretary may prescribe.</content>
                </subsection>
                <subsection identifier="/us/sComp/99/659/tIII/s306/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Title.—</heading><content style="-uslm-dtd:text">Title to all property, real and personal, acquired for the purposes of completing any project approved by the Secretary vests in the State.</content>
                </subsection>
                <subsection identifier="/us/sComp/99/659/tIII/s306/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Disposal.—</heading><content style="-uslm-dtd:text">If a State disposes of any real or personal property acquired under this title, the State shall pay into the Treasury of the United States the amount of any proceeds resulting from the property disposed to the extent of and in the same ratio that funds provided under this title were used in the acquisition of the property. In no case shall the amount paid into the Treasury of the United States under this section exceed the amount of funds provided by this chapter for the acquisition of the property involved.</content>
                </subsection>
            </section>
            <section identifier="/us/sComp/99/659/tIII/s307" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="307">SEC. 307. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s4106">16 U.S.C. 4106</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">REPORTS. </heading>
                <subsection role="undesignated-level" style="-uslm-dtd:subsection" styleType="OLC"><chapeau style="-uslm-dtd:text">After consultation with the States receiving funds under this title and with any interstate commission involved in carrying out a project under this title, the Secretary shall submit to the Committee on Merchant Marine and Fisheries<ref class="footnoteRef" idref="ID21F0F36175F1453798E5B61E6D1DE7B1" style="-uslm-dtd:footnote-ref">1</ref> of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate not later than 90 days after the end of the fiscal year 1988, and each second fiscal year occurring after that fiscal year, a report which contains—</chapeau><footnote id="ID21F0F36175F1453798E5B61E6D1DE7B1" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">1</sup><p style="-uslm-dtd:para; margin-left:1em">The Committee on Merchant Marine and Fisheries of the House of Representatives was abolished by House Resolution No. 6, One Hundred Fourth Congress, Jan. 4, 1995. The former jurisdiction of such committee is divided among the Committee on Resources, the  Committee on Transportation and Infrastructure, and the Committee on Armed Services of the House of Representatives.</p></footnote>
                    <paragraph identifier="/us/sComp/99/659/tIII/s307/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">a description of each project and law enforcement effort receiving funds under this title during the last 2 fiscal years ending before such report is submitted;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/99/659/tIII/s307/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">a specification of the total amount of funds from the Federal Government and the total amount of funds from each State spent on each project and a law enforcement effort receiving funds under this title during the last 2 fiscal years ending before such report is submitted;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/99/659/tIII/s307/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">an assessment of each project and law enforcement effort receiving funds under this title during the last 2 fiscal years ending before such report is submitted to determine whether such project is furthering the purposes of this title; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/99/659/tIII/s307/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">a statement specifying all funds which have been apportioned pursuant to section 305(a) and are available for obligation by a State or the Secretary but which have not been obligated.</content>
                    </paragraph>
                </subsection>
            </section>
            <section identifier="/us/sComp/99/659/tIII/s309" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="309">SEC. 309. </num><heading style="-uslm-dtd:header">REPEAL. </heading>
                <content class="block" style="-uslm-dtd:text">The Commercial Fisheries Research and Development Act of 1964 (16 U.S.C. 779 et seq.) is repealed.</content>
            </section>
            <section identifier="/us/sComp/99/659/tIII/s310" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="310">SEC. 310. </num><heading style="-uslm-dtd:header">EFFECTIVE DATE. </heading>
                <content class="block" style="-uslm-dtd:text">This title takes effect October 1, 1987.</content>
