    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To identify and refer members of the Armed Forces with a health care occupation who are separating from the Armed Forces for potential employment with the Department of Veterans Affairs, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section style="-uslm-dtd:section" identifier="/us/sComp/117/67/s1" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t38/s101">38 U.S.C. 101 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content style="-uslm-dtd:text" class="block">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Hire Veteran Health Heroes Act of 2021</shortTitle>”.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/117/67/s2" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">IDENTIFICATION AND REFERRAL OF MEMBERS OF THE ARMED FORCES WITH A HEALTH CARE OCCUPATION FOR POTENTIAL EMPLOYMENT WITH THE DEPARTMENT OF VETERANS AFFAIRS DURING SEPARATION FROM THE ARMED FORCES. </heading>
            <content style="-uslm-dtd:text" class="block">Section 207 of the VA Choice and Quality Employment Act of 2017 (Public Law 115-46; 38 U.S.C. 7401 note) is amended to read as follows:<quotedContent style="-uslm-dtd:quoted-block">
            <section style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="207">“SEC. 207. </num><heading style="-uslm-dtd:header">IDENTIFICATION AND REFERRAL OF MEMBERS OF THE ARMED FORCES WITH A HEALTH CARE OCCUPATION FOR POTENTIAL EMPLOYMENT WITH THE DEPARTMENT OF VETERANS AFFAIRS DURING SEPARATION FROM THE ARMED FORCES </heading>
                <subsection style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">“(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">The Secretary of Veterans Affairs, in consultation with the Secretary of Defense, shall establish a program to identify and refer members of the Armed Forces with a health care occupation for employment with the Department of Veterans Affairs during the separation of such members from the Armed Forces.</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">“(b) </num><heading style="-uslm-dtd:header">Referral of Interested Individuals.—</heading>
                    <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">“(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">If a member of the Armed Forces identified under subsection (a) expresses an interest in working in a health care occupation within the Department of Veterans Affairs, the Secretary of Veterans Affairs shall refer the member to a recruiter of the Department for consideration of open positions in the specialty and geography of interest to the member.</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">“(2) </num><heading style="-uslm-dtd:header">Timing.—</heading><content style="-uslm-dtd:text">Any referral of a member of the Armed Forces conducted under paragraph (1) shall be made not earlier than one year before the separation of the member from the Armed Forces.</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">“(c) </num><heading style="-uslm-dtd:header">Rule of Construction.—</heading><content style="-uslm-dtd:text">Any identification of a member of the Armed Forces under subsection (a) or referral of such member under subsection (b) shall not be construed as a guarantee of  employment of such member with the Department of Veterans Affairs.</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">“(d) </num><heading style="-uslm-dtd:header">Reports.—</heading><content style="-uslm-dtd:text">Not later than each of one year and two years after the date of the enactment of the Hire Veteran Health Heroes Act of 2021, the Secretary of Veterans Affairs shall submit to the appropriate committees of Congress a report on the program established under subsection (a).</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">“(e) </num><heading style="-uslm-dtd:header">Definitions.—</heading><chapeau style="-uslm-dtd:text">In this section:</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">“(1) </num><heading style="-uslm-dtd:header">Appropriate committees of congress.—</heading><chapeau style="-uslm-dtd:text">The term ‘<quotedText style="-uslm-dtd:quote">appropriate committees of Congress</quotedText>’ means—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">“(A) </num><content style="-uslm-dtd:text">the Committee on Armed Services and the Committee on Veterans’ Affairs of the Senate; and</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">“(B) </num><content style="-uslm-dtd:text">the Committee on Armed Services and the Committee on Veterans’ Affairs of the House of Representatives.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">“(2) </num><heading style="-uslm-dtd:header">Health care occupation.—</heading><content style="-uslm-dtd:text">The term ‘<quotedText style="-uslm-dtd:quote">health care occupation</quotedText>’ means an occupation for which an individual may be appointed for employment with the Department of Veterans Affairs under section 7401 of title 38, United States Code.”</content>
