    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To provide an extension of Federal-aid highway, highway safety, and transit programs, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

        <section style="-uslm-dtd:section" identifier="/us/sComp/117/44/s1" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t23/s101">23 U.S.C. 101 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content style="-uslm-dtd:text" class="block">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Surface Transportation Extension Act of 2021</shortTitle>”.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/117/44/s2" styleType="OLC" role="definitions">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t23/s101">23 U.S.C. 101 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">DEFINITIONS. </heading>
            <chapeau style="-uslm-dtd:text" class="block">In this Act:</chapeau>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/117/44/s2/1" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Covered law.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">covered law</term>” means any of the following:</chapeau>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/117/44/s2/1/A" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">Titles I, II, III, IV, V, VI, VII, VIII, XI, and XXIV of the FAST Act (Public Law 114-94; 129 Stat. 1312).</content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/117/44/s2/1/B" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">Division A, division B, subtitle A of title I and title II of division C, and division E of MAP-21 (Public Law 112-141; 126 Stat. 405).</content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/117/44/s2/1/C" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">Titles I, II, and III of the SAFETEA-LU Technical Corrections Act of 2008 (Public Law 110-244; 122 Stat. 1572).</content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/117/44/s2/1/D" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">Titles I, II, III, IV, V, and VI of SAFETEA-LU (Public Law 109-59; 119 Stat. 1144).</content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/117/44/s2/1/E" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">Titles I, II, III, IV, and V of the Transportation Equity Act for the 21st Century (Public Law 105-178; 112 Stat. 107).</content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/117/44/s2/1/F" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">Titles II, III, and IV of the National Highway System Designation Act of 1995 (Public Law 104-59; 109 Stat. 568).</content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/117/44/s2/1/G" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="G">(G) </num><content style="-uslm-dtd:text">Titles I, II, III, IV, V, and VI of the Intermodal Surface Transportation Efficiency Act of 1991 (Public Law 102-240; 105 Stat. 1914).</content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/117/44/s2/1/H" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="H">(H) </num><content style="-uslm-dtd:text">Title 23, United States Code.</content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/117/44/s2/1/I" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">Sections 116, 117, 330, 5128, 5505, and 24905 and chapters 53, 139, 303, 311, 313, 701, and 702 of title 49, United States Code.</content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/117/44/s2/1/J" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="J">(J) </num><content style="-uslm-dtd:text">Division B of the Continuing Appropriations Act, 2021 and Other Extensions Act (Public Law 116-159; 134 Stat. 725).</content>
                </subparagraph>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/117/44/s2/2" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Extension end date.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">extension end date</term>” means December 3, 2021.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/117/44/s2/3" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Extension fraction.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">extension fraction</term>” means the quotient, expressed as a fraction, obtained by dividing—</chapeau>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/117/44/s2/3/A" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the number of days in the extension period; by</content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/117/44/s2/3/B" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">365.</content>
                </subparagraph>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/117/44/s2/4" styleType="OLC">
                <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Extension period.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">extension period</term>” means the period that begins on October 1, 2021, and ends on the extension end date.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/117/44/s2/5" styleType="OLC">
                <num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">Highway account.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">Highway Account</term>” means the portion of the Highway Trust Fund that is not the Mass Transit Account.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/117/44/s2/6" styleType="OLC">
                <num style="-uslm-dtd:enum" value="6">(6) </num><heading style="-uslm-dtd:header">Mass transit account.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">Mass Transit Account</term>” means the portion of the Highway Trust Fund established under section 9503(e)(1) of the Internal Revenue Code of 1986.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/117/44/s2/7" styleType="OLC">
                <num style="-uslm-dtd:enum" value="7">(7) </num><heading style="-uslm-dtd:header">Secretary.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">Secretary</term>” means the Secretary of Transportation.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/117/44/s2/8" styleType="OLC">
                <num style="-uslm-dtd:enum" value="8">(8) </num><heading style="-uslm-dtd:header">State.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">State</term>” means the 50 States and the District of Columbia.</content>
            </paragraph>
        </section>
        <title style="-uslm-dtd:title" identifier="/us/sComp/117/44/tI" styleType="OLC">
            <num style="-uslm-dtd:enum" value="I">TITLE I—</num><heading style="-uslm-dtd:header">SURFACE TRANSPORTATION PROGRAMS </heading>
            <section style="-uslm-dtd:section" identifier="/us/sComp/117/44/tI/s101" styleType="OLC">
                <num style="-uslm-dtd:enum" value="101">SEC. 101. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t23/s101">23 U.S.C. 101 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">EXTENSION OF FEDERAL SURFACE TRANSPORTATION PROGRAMS. </heading>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/117/44/tI/s101/a" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">Except as otherwise provided in this Act, the requirements, authorities, conditions, eligibilities, limitations, and other provisions authorized under the covered laws, which would otherwise expire on or cease to apply after September 30, 2021, are incorporated by reference and shall continue in effect through the extension end date.</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/117/44/tI/s101/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Authorization of Appropriations.—</heading>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/117/44/tI/s101/b/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Highway trust fund.—</heading>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/117/44/tI/s101/b/1/A" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Highway account.—</heading><content style="-uslm-dtd:text">There is authorized to be appropriated from the Highway Account for fiscal year 2022, for each program with respect to which amounts are authorized to be appropriated from such account for fiscal year 2021, an amount equal to the extension fraction of the amount authorized for appropriation with respect to the program from such account under the covered laws for fiscal year 2021.</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/117/44/tI/s101/b/1/B" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Mass transit account.—</heading><content style="-uslm-dtd:text">There is authorized to be appropriated from the Mass Transit Account for fiscal year 2022, for each program with respect to which amounts are authorized to be appropriated from such account for fiscal year 2021, an amount equal to the extension fraction of the amount authorized for appropriation with respect to the program from such account under the covered laws for fiscal year 2021.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/117/44/tI/s101/b/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">General fund.—</heading><content style="-uslm-dtd:text">There is authorized to be appropriated for fiscal year 2022, for each program under the covered laws with respect to which amounts are authorized to be appropriated for fiscal year 2021 from an account other than the Highway Account or the Mass Transit Account, an amount that is not less than the extension fraction of the amount authorized for appropriation with respect to the program under the covered laws for fiscal year 2021.</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/117/44/tI/s101/c" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Use of Funds.—</heading>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/117/44/tI/s101/c/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Except as described in paragraph (2), amounts authorized to be appropriated for fiscal year 2022 with respect to a program under subsection (b) shall be distributed, administered, limited, and made available for obligation in the same manner as amounts authorized to be appropriated with respect to the program for fiscal year 2021 under the covered laws.</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/117/44/tI/s101/c/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Apportionment to states.—</heading>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/117/44/tI/s101/c/2/A" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">Notwithstanding subsections (c)(2) or (e)(1) of section 104 of title 23, United States Code, the Secretary—</chapeau>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/117/44/tI/s101/c/2/A/i" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">shall not apportion on October 1, 2021, amounts authorized to be appropriated for fiscal year 2022 under subsection (b)(1)(A) with a respect to a program described in subparagraph (B); and</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/117/44/tI/s101/c/2/A/ii" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">shall not apportion such amounts before October 15, 2021.</content>
                            </clause>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/117/44/tI/s101/c/2/B" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Programs described.—</heading><chapeau style="-uslm-dtd:text">A program referred to in subparagraph (A)(i) is a program—</chapeau>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/117/44/tI/s101/c/2/B/i" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">for which amounts are authorized to be appropriated under subsection (b)(1)(A); and</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/117/44/tI/s101/c/2/B/ii" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">under which amounts described in clause (i) will be apportioned to States as described in section 104 of title 23, United States Code.</content>
                            </clause>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/117/44/tI/s101/c/2/C" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Notice to states.—</heading><content style="-uslm-dtd:text">Section 104(e)(2) of title 23, United States Code, shall not apply for fiscal year 2022.</content>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/117/44/tI/s101/d" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Obligation Limitation.—</heading>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/117/44/tI/s101/d/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Subject to paragraph (2), a program for which amounts are authorized to be appropriated under subsection (b)(1) shall be subject to a limitation on obligations for fiscal year 2022 in an amount equal to the extension fraction of the limitation on obligations for the program for fiscal year 2021 and in the same manner as the limitation applicable with respect to the program for fiscal year 2021.</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/117/44/tI/s101/d/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Federal-aid highways.—</heading>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/117/44/tI/s101/d/2/A" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">In distributing a limitation on obligations for Federal-aid highways for qualifying programs, the Secretary—</chapeau>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/117/44/tI/s101/d/2/A/i" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">shall reserve, for qualifying programs, an amount of the limitation on obligations for Federal-aid highways equal to the amount calculated for the extension period for qualifying programs in effect on the date of enactment of this Act; and</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/117/44/tI/s101/d/2/A/ii" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">if H.R. 3684 (117th Congress) is enacted, may distribute the amount determined under clause (i) among qualifying programs (including any qualifying programs established pursuant to such H.R. 3684) in a manner determined to be appropriate by the Secretary.</content>
                            </clause>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/117/44/tI/s101/d/2/B" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Calculation.—</heading><content style="-uslm-dtd:text">Notwithstanding the enactment of H.R. 3684 (117th Congress), the Secretary shall calculate the amount under subparagraph (A)(i) in the manner described in section 120(a)(4) of division L of the Consolidated Appropriations Act, 2021 (Public Law 116-260).</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/117/44/tI/s101/d/2/C" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Definition of qualifying program.—</heading><chapeau style="-uslm-dtd:text">In this paragraph, the term “<quotedText style="-uslm-dtd:quote">qualifying program</quotedText>” means a program for Federal-aid highways that is—</chapeau>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/117/44/tI/s101/d/2/C/i" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><chapeau style="-uslm-dtd:text">allocated by the Secretary under—</chapeau>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/117/44/tI/s101/d/2/C/i/I" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">title 23, United States Code;</content>
                                </subclause>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/117/44/tI/s101/d/2/C/i/II" styleType="OLC">

            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/117/44/tI/s102" styleType="OLC">
                <num style="-uslm-dtd:enum" value="102">SEC. 102. </num><heading style="-uslm-dtd:header">NATIONALLY SIGNIFICANT FREIGHT AND HIGHWAY PROJECTS. </heading>
                <chapeau style="-uslm-dtd:text" class="block">During the extension period, until H.R. 3684 (117th Congress) is enacted, the matter preceding clause (i) in section 117(d)(2)(A) of title 23, United States Code, shall be applied—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/117/44/tI/s102/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">by substituting “$700,000,000” for “$600,000,000”; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/117/44/tI/s102/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">by substituting “2022” for “2021”.</content>
                </paragraph>

            <section style="-uslm-dtd:section" identifier="/us/sComp/117/44/tI/s103" styleType="OLC">
                <num style="-uslm-dtd:enum" value="103">SEC. 103. </num><heading style="-uslm-dtd:header">HIGHWAY SAFETY RESEARCH AND DEVELOPMENT. </heading>
                <chapeau style="-uslm-dtd:text" class="block">During the extension period, until H.R. 3684 (117th Congress) is enacted, section 403(h)(2) of title 23, United States Code, shall be applied—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/117/44/tI/s103/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">by substituting “2022” for “2021”; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/117/44/tI/s103/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">by substituting “$31,872,000” for “$26,560,000”.</content>
                </paragraph>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/117/44/tI/s104" styleType="OLC">
                <num style="-uslm-dtd:enum" value="104">SEC. 104. </num><heading style="-uslm-dtd:header">RAIL-RELATED PROVISIONS. </heading>
                <content style="-uslm-dtd:text" class="block">During the extension period, until H.R. 3684 (117th Congress) is enacted, section 502(b)(3) of the Railroad Revitalization and Regulatory Reform Act of 1976 (45 U.S.C. 822(b)(3)) shall be applied by substituting the extension end date for “September 30, 2021”.</content>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/117/44/tI/s105" styleType="OLC">
                <num style="-uslm-dtd:enum" value="105">SEC. 105. </num><heading style="-uslm-dtd:header">PROHIBITION ON USE OF FUNDS. </heading>
                <content style="-uslm-dtd:text" class="block">None of the funds authorized in this Act or any other Act may be used to adjust apportionments for the Mass Transit Account or withhold funds from apportionments for the Mass Transit Account pursuant to section 9503(e)(4) of the Internal Revenue Code of 1986 in fiscal year 2022.</content>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/117/44/tI/s106" styleType="OLC">
                <num style="-uslm-dtd:enum" value="106">SEC. 106. </num><heading style="-uslm-dtd:header">APPALACHIAN REGIONAL COMMISSION. </heading>
                <chapeau style="-uslm-dtd:text" class="block">During the extension period, until H.R. 3684 (117th Congress) is enacted—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/117/44/tI/s106/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">section 14703 of title 40, United States Code, shall be applied—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/117/44/tI/s106/1/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">in subsection (a)(5), by substituting “2022” for “2021”; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/117/44/tI/s106/1/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">in subsection (c), by substituting “2022” for “2021”; and</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/117/44/tI/s106/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">section 14704 of title 40, United States Code, shall be applied by substituting “2022” for “2021”.</content>
                </paragraph>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/117/44/tI/s107" styleType="OLC">
                <num style="-uslm-dtd:enum" value="107">SEC. 107. </num><heading style="-uslm-dtd:header">SPORT FISHING. </heading>
                <chapeau style="-uslm-dtd:text" class="block">During the extension period, until H.R. 3684 (117th Congress) is enacted, section 4 of the Dingell-Johnson Sport Fish Restoration Act (16 U.S.C. 777c) shall be applied by substituting—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/117/44/tI/s107/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">“fiscal year 2022” for “fiscal year 2021” in subsections (a) and (b)(1)(A); and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/117/44/tI/s107/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">“fiscal years 2016 through 2022” for “fiscal years 2016 through 2021” in subsection (b)(2)(A).</content>
                </paragraph>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/117/44/tI/s108" styleType="OLC">
                <num style="-uslm-dtd:enum" value="108">SEC. 108. </num><heading style="-uslm-dtd:header">FEDERAL EMPLOYEE COMPENSATION FOLLOWING HIGHWAY TRUST FUND EXPIRATION. </heading>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/117/44/tI/s108/a" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t23/s101">23 U.S.C. 101 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">Each employee of the United States Government furloughed as a result of a covered lapse in Highway Trust Fund expenditure authority shall be paid for the period of the covered lapse, and each excepted employee who is required to perform work during a covered lapse shall be paid for such work, at the employee’s standard rate of pay, at the earliest date possible after the covered lapse ends, regardless of scheduled pay dates, and subject to availability of funds.</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/117/44/tI/s108/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Covered Lapse.—</heading><chapeau style="-uslm-dtd:text">In this section, the term “<quotedText style="-uslm-dtd:quote">covered lapse in Highway Trust Fund expenditure authority</quotedText>” means any lapse in authority to make expenditures from the Highway Trust Fund that begins on—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/117/44/tI/s108/b/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">October 1, 2021, and ends on or before the date of enactment of this Act; or</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/117/44/tI/s108/b/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">November 1, 2021, and ends on or before the date of enactment of the <inline style="-uslm-dtd:short-title">Further Surface Transportation Extension Act of 2021</inline>.</content>
                    </paragraph>
                </subsection>
            </section>
        </title>
        <title style="-uslm-dtd:title" identifier="/us/sComp/117/44/tII" styleType="OLC">
            <num style="-uslm-dtd:enum" value="II">TITLE II—</num><heading style="-uslm-dtd:header">TRUST FUNDS </heading>
            <section style="-uslm-dtd:section" identifier="/us/sComp/117/44/tII/s201" styleType="OLC">
                <num style="-uslm-dtd:enum" value="201">SEC. 201. </num><heading style="-uslm-dtd:header">EXTENSION OF EXPENDITURE AUTHORITY FOR HIGHWAY TRUST FUND, SPORT FISH RESTORATION AND BOATING TRUST FUND, AND LEAKING UNDERGROUND STORAGE TANK TRUST FUND.<ref style="-uslm-dtd:footnote-ref" idref="IDA65A81F0F6F542B7B8CD6E1EEB60AE30" class="footnoteRef">1</ref> </heading>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/117/44/tII/s201/a" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t26/s9503">26 U.S.C. 9503</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Highway Trust Fund.—</heading><chapeau style="-uslm-dtd:text">Section 9503 of the Internal Revenue Code of 1986 is amended—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/117/44/tII/s201/a/1" styleType="OLC">

                    <num style="-uslm-dtd:enum" value="b">(b) </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t26/s9504">26 U.S.C. 9504</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Sport Fish Restoration and Boating Trust Fund.—</heading><chapeau style="-uslm-dtd:text">Section 9504 of such Code is amended—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/117/44/tII/s201/b/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">Continuing Appropriations Act, 2021 and Other Extensions Act</quotedText>” each place it appears in subsection (b)(2) and inserting “<quotedText style="-uslm-dtd:quote">Surface Transportation Extension Act of 2021</quotedText>”, and</content>

                    <num style="-uslm-dtd:enum" value="c">(c) </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t26/s9508">26 U.S.C. 9508</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Leaking Underground Storage Tank Trust Fund.—</heading><content style="-uslm-dtd:text">Section 9508(e)(2) of such Code is amended by striking “<quotedText style="-uslm-dtd:quote">October 1, 2021</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">November 1, 2021</quotedText>”.</content>

        <title style="-uslm-dtd:title" identifier="/us/sComp/117/44/tIII" styleType="OLC">
            <num style="-uslm-dtd:enum" value="III">TITLE III—</num><heading style="-uslm-dtd:header">REPLACEMENT AUTHORIZATION </heading>
            <section style="-uslm-dtd:section" identifier="/us/sComp/117/44/tIII/s301" styleType="OLC">
                <num style="-uslm-dtd:enum" value="301">SEC. 301. </num><heading style="-uslm-dtd:header">RESCISSION OF DUPLICATIVE CONTRACT AUTHORITY. </heading>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/117/44/tIII/s301/a" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">Upon enactment of H.R. 3684 (117th Congress), subject to subsections (c) and (d), for each program described in subsection (b), there is permanently rescinded an amount of contract authority equal to the contract authority made available for that program under section 101.</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/117/44/tIII/s301/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Programs Described.—</heading><content style="-uslm-dtd:text">A program referred to in subsection (a) is a program for which contract authority was made available for fiscal year 2022 under both section 101 and H.R. 3684 (117th Congress).</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/117/44/tIII/s301/c" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Implementation.—</heading>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/117/44/tIII/s301/c/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Application of rescission among certain programs.—</heading><content style="-uslm-dtd:text">The amount of contract authority rescinded under subsection (a) shall be applied among States for apportioned programs in the same amounts that contract authority would be apportioned to such States and distributed for such apportioned programs under section 101.</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/117/44/tIII/s301/c/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Substantially similar and successor programs.—</heading><chapeau style="-uslm-dtd:text">The Secretary may implement subsection (a) in a manner that, as determined appropriate by the Secretary, accommodates a circumstance in which—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/117/44/tIII/s301/c/2/A" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">section 101 makes available contract authority for fiscal year 2022 for a program; and</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/117/44/tIII/s301/c/2/B" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">H.R. 3684 (117th Congress) makes available contract authority for fiscal year 2022 for a program that is, in the judgment of the Secretary, substantially similar or a successor to the program referred to in subparagraph (A).</content>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/117/44/tIII/s301/d" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Deadline.—</heading><content style="-uslm-dtd:text">The Secretary shall implement the rescission under subsection (a) not later than September 30, 2022.</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/117/44/tIII/s301/e" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Apportionment Exception.—</heading><content style="-uslm-dtd:text">Notwithstanding subsection (c)(2) or (e)(1) of section 104 of title 23, United States Code, or section 101(c)(2), the Secretary shall not be required to apportion any amounts of contract authority that are rescinded pursuant to this section.</content>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/117/44/tIII/s302" styleType="OLC">
                <num style="-uslm-dtd:enum" value="302">SEC. 302. </num><heading style="-uslm-dtd:header">PRIOR ENACTED AUTHORIZATION. </heading>
                <content style="-uslm-dtd:text" class="block">If H.R. 3684 (117th Congress) is enacted before the date of enactment of this Act, this Act shall not take effect and the provisions of this Act shall not be executed.</content>
