    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To require the disclosure of ownership of high-security space leased to accommodate a Federal agency, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/276/s1" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t40/s585">40 U.S.C. 585 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE; FINDINGS. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/276/s1/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Short Title.—</heading><content style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Secure Federal Leases from Espionage And Suspicious Entanglements Act</shortTitle>” or the “<shortTitle style="-uslm-dtd:quote">Secure Federal LEASEs Act</shortTitle>”.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/276/s1/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Findings.—</heading><chapeau style="-uslm-dtd:text">Congress finds that— </chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/276/s1/b/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the Government Accountability Office has reported that the Federal Government often leases high-security space from private sector landlords; </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/276/s1/b/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the General Services Administration collects highest- level and immediate ownership information through the System for Award Management, but it is not currently required to collect beneficial ownership information and lacks an adequate system for doing so; </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/276/s1/b/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">the General Services Administration and Federal agencies with leasing authority may not know if foreign owners have a stake in the buildings leased by the agencies, either through foreign-incorporated legal entities or through ownership in United States-incorporated legal entities, even when the leased space is used for classified operations or to store sensitive data; and </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/276/s1/b/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">according to a report of the Government Accountability Office, dated January 2017, that examined the risks of foreign ownership of Government-leased real estate, “leasing space in foreign-owned buildings could present security risks such as espionage and unauthorized cyber and physical access”. </content>
                </paragraph>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/276/s2" styleType="OLC" role="definitions">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">DEFINITIONS. </heading>
            <chapeau style="-uslm-dtd:text" class="block">  In this Act: </chapeau>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/276/s2/1" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Beneficial owner.—</heading>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/276/s2/1/A" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">Except as provided in subparagraph (B), the term “<term style="-uslm-dtd:quote">beneficial owner</term>” means, with respect to a covered entity, each natural person who, directly or indirectly, through any contract, arrangement, understanding, relationship, or otherwise—</chapeau>
                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/116/276/s2/1/A/i" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">exercises control over the covered entity; or </content>
                    </clause>
                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/116/276/s2/1/A/ii" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">has a substantial interest in or receives substantial economic benefits from the assets of the covered entity.</content>
                    </clause>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/276/s2/1/B" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Exceptions.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">beneficial owner</term>” does not include, with respect to a covered entity—</chapeau>
                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/116/276/s2/1/B/i" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">a minor child; </content>
                    </clause>
                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/116/276/s2/1/B/ii" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">a person acting as a nominee, intermediary, custodian, or agent on behalf of another person; </content>
                    </clause>
                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/116/276/s2/1/B/iii" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">a person acting solely as an employee of the covered entity and whose control over or economic benefits from the covered entity derives solely from the employment status of the person; </content>
                    </clause>
                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/116/276/s2/1/B/iv" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">a person whose only interest in the covered entity is through a right of inheritance, unless the person also meets the requirements of subparagraph (A); or </content>
                    </clause>
                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/116/276/s2/1/B/v" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="v">(v) </num><content style="-uslm-dtd:text">a creditor of the covered entity, unless the creditor also meets the requirements of subparagraph (A). </content>
                    </clause>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/276/s2/1/C" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Anti-abuse rule.—</heading><content style="-uslm-dtd:text">The exceptions under subparagraph (B) shall not apply if used for the purpose of evading, circumventing, or abusing the requirements of this Act. </content>
                </subparagraph>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/276/s2/2" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Control.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">control</term>” means, with respect to a covered entity—</chapeau>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/276/s2/2/A" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">having the authority or ability to determine how a covered entity is utilized; or </content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/276/s2/2/B" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">having some decision-making power for the use of a covered entity. </content>
                </subparagraph>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/276/s2/3" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Covered entity.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">covered entity</term>” means—</chapeau>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/276/s2/3/A" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">a person, corporation, company, business association, partnership, society, trust, or any other nongovernmental entity, organization, or group; or </content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/276/s2/3/B" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">any governmental entity or instrumentality of a government. </content>
                </subparagraph>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/276/s2/4" styleType="OLC">
                <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Executive agency.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">Executive agency</term>” has the meaning given the term in section 105 of title 5, United States Code.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/276/s2/5" styleType="OLC">
                <num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">Federal agency.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">Federal agency</term>” means any Executive agency or any establishment in the legislative or judicial branch of the Government.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/276/s2/6" styleType="OLC">
                <num style="-uslm-dtd:enum" value="6">(6) </num><heading style="-uslm-dtd:header">Federal lessee.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">Federal lessee</term>”—</chapeau>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/276/s2/6/A" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">means the Administrator of General Services, the Architect of the Capitol, or the head of any Federal agency, other than the Department of Defense, that has independent statutory leasing authority; and </content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/276/s2/6/B" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">does not include the head of an element of the intelligence community. </content>
                </subparagraph>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/276/s2/7" styleType="OLC">
                <num style="-uslm-dtd:enum" value="7">(7) </num><heading style="-uslm-dtd:header">Federal tenant.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">Federal tenant</term>”—</chapeau>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/276/s2/7/A" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">means a Federal agency that is occupying or will occupy a high-security leased space for which a lease agreement has been secured on behalf of the Federal agency; and </content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/276/s2/7/B" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">does not include an element of the intelligence community. </content>
                </subparagraph>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/276/s2/8" styleType="OLC">
                <num style="-uslm-dtd:enum" value="8">(8) </num><heading style="-uslm-dtd:header">Foreign entity.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">foreign entity</term>” means a covered entity that is headquartered or incorporated in a country that is not the United States.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/276/s2/9" styleType="OLC">
                <num style="-uslm-dtd:enum" value="9">(9) </num><heading style="-uslm-dtd:header">Foreign person.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">foreign person</term>” means an individual who is not a United States person.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/276/s2/10" styleType="OLC">
                <num style="-uslm-dtd:enum" value="10">(10) </num><heading style="-uslm-dtd:header">High-security leased space.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">high-security leased space</term>” means a space leased by a Federal lessee that—</chapeau>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/276/s2/10/A" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">will be occupied by Federal employees for nonmilitary activities; and </content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/276/s2/10/B" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">has a facility security level of III, IV, or V, as determined by the Federal tenant in consultation with the Interagency Security Committee, the Department of Homeland Security, and the General Services Administration. </content>
                </subparagraph>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/276/s2/11" styleType="OLC">
                <num style="-uslm-dtd:enum" value="11">(11) </num><heading style="-uslm-dtd:header">Highest-level owner.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">highest-level owner</term>” means the entity that owns or controls an immediate owner of the offeror of a lease, or that owns or controls 1 or more entities that control an immediate owner of the offeror.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/276/s2/12" styleType="OLC">
                <num style="-uslm-dtd:enum" value="12">(12) </num><heading style="-uslm-dtd:header">Immediate owner.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">immediate owner</term>” means an entity, other than the offeror of a lease, that has direct control of the offeror, including ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/276/s2/13" styleType="OLC">
                <num style="-uslm-dtd:enum" value="13">(13) </num><heading style="-uslm-dtd:header">Intelligence community.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">intelligence community</term>” has the meaning given the term in section 3 of the National Security Act of 1947 (50 U.S.C. 3003).</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/276/s2/14" styleType="OLC">
                <num style="-uslm-dtd:enum" value="14">(14) </num><heading style="-uslm-dtd:header">Substantial economic benefits.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">substantial economic benefits</term>” means, with respect to a natural person described in paragraph (1)(A)(ii), having an entitlement to the funds or assets of a covered entity that, as a practical matter, enables the person, directly or indirectly, to control, manage, or direct the covered entity.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/276/s2/15" styleType="OLC">
                <num style="-uslm-dtd:enum" value="15">(15) </num><heading style="-uslm-dtd:header">United states person.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">United States person</term>” means an individual who—</chapeau>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/276/s2/15/A" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">is a citizen of the United States; or </content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/276/s2/15/B" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">is an alien lawfully admitted for permanent residence in the United States. </content>
                </subparagraph>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/276/s2/16" styleType="OLC">
                <num style="-uslm-dtd:enum" value="16">(16) </num><heading style="-uslm-dtd:header">Widely held.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">widely held</term>” means a fund that has not less than 100 natural persons as direct or indirect investors.</content>
            </paragraph>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/276/s3" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><heading style="-uslm-dtd:header">DISCLOSURE OF OWNERSHIP OF HIGH-SECURITY SPACE LEASED FOR FEDERAL AGENCIES. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/276/s3/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Required Disclosures.—</heading><content style="-uslm-dtd:text">Before entering into a lease agreement with a covered entity or approving a novation agreement with a covered entity involving a change of ownership under a lease that will be used for high-security leased space, a Federal lessee shall require the covered entity to identify and disclose whether the immediate or highest-level owner of the leased space, including an entity involved in the financing thereof, is a foreign person or a foreign entity, including the country associated with the ownership entity. </content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/276/s3/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Notification.—</heading><content style="-uslm-dtd:text">If a disclosure is made under subsection (a), the Federal lessee shall notify the Federal tenant of the building or other improvement that will be used for high-security space in writing, and consult with the Federal tenant, regarding security concerns and necessary mitigation measures, if any, prior to award of the lease or approval of the novation agreement.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/276/s3/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Timing.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/276/s3/c/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">A Federal lessee shall require a covered entity to provide the information described in subsection (a) when first submitting a proposal in response to a solicitation for offers issued by the Federal lessee. </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/276/s3/c/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Updates.—</heading><chapeau style="-uslm-dtd:text">A Federal lessee shall require a covered entity to submit an update of the information described in subsection (a) annually, beginning on the date that is 1 year after the date on which the Federal tenant began occupancy, with information including— </chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/276/s3/c/2/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the list of immediate or highest-level owners of the covered entity during the preceding 1-year period of Federal occupancy; or </content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/276/s3/c/2/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the information required to be provided relating to each such immediate or highest-level owner. </content>
                    </subparagraph>
                </paragraph>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/276/s4" styleType="OLC">
            <num style="-uslm-dtd:enum" value="4">SEC. 4. </num><heading style="-uslm-dtd:header">IMMEDIATE, HIGHEST-LEVEL, AND BENEFICIAL OWNERS. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/276/s4/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Plan.—</heading><content style="-uslm-dtd:text">The General Services Administration, in coordination with the Office of Management and Budget, shall develop a Government-wide plan for agencies (as such term is defined in section 551 of title 5, United States Code) for identifying all immediate, highest-level, or beneficial owners of high-security leased spaces before entering into a lease agreement with a covered entity for the accommodation of a Federal tenant in a high-security leased space.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/276/s4/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Requirements.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/276/s4/b/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Contents.—</heading><chapeau style="-uslm-dtd:text">The plan described in subsection (a) shall include a process for collecting and utilizing the following information on each immediate, highest-level, or beneficial owner of a high-security leased space: </chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/276/s4/b/1/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">Name. </content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/276/s4/b/1/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">Current residential or business street address. </content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/276/s4/b/1/C" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">An identifying number or document that verifies identity as a United States person, foreign person, or foreign entity. </content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/276/s4/b/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Disclosures and notifications.—</heading><chapeau style="-uslm-dtd:text">The plan described in subsection (a) shall— </chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/276/s4/b/2/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">require the disclosure of any immediate, highest-level, or beneficial owner that is a foreign person; </content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/276/s4/b/2/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">require that, if the Federal lessee is assigning the building or other improvement that will be used for high-security space to a Federal tenant, the Federal tenant shall be notified of the disclosure described in subparagraph (A); and </content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/276/s4/b/2/C" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">exclude collecting ownership information on widely held pooled-investment vehicles, mutual funds, trusts, or other pooled-investment vehicles. </content>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/276/s4/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Report and Implementation.—</heading><chapeau style="-uslm-dtd:text">The General Services Administration shall— </chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/276/s4/c/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">not later than 1 year after the date of enactment of this Act, submit the plan described in subsection (a) to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives; </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/276/s4/c/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">not later than 2 years after the date of enactment of this Act, implement the plan described in subsection (a); and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/276/s4/c/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">not later than 1 year after the implementation of the plan described in subsection (a), and each year thereafter for 9 years, submit a report to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives on the status of the implementation of the plan, including the number of disclosures made under subsection (b)(2). </content>
                </paragraph>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/276/s5" styleType="OLC">
            <num style="-uslm-dtd:enum" value="5">SEC. 5. </num><heading style="-uslm-dtd:header">OTHER SECURITY AGREEMENTS FOR LEASED SPACE. </heading>
            <chapeau style="-uslm-dtd:text" class="block">  A lease agreement between a Federal lessee and a covered entity for the accommodation of a Federal agency in a building or other improvement that will be used for high-security leased space shall include language that provides that— </chapeau>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/276/s5/1" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">the covered entity and any member of the property management company who may be responsible for oversight or maintenance of the high-security leased space shall not— </chapeau>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/276/s5/1/A" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">maintain access to the high-security leased space; or </content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/276/s5/1/B" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">have access to the high-security leased space without prior approval from the Federal tenant; </content>
                </subparagraph>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/276/s5/2" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">access to the high-security leased space or any property or information located within that space will only be granted by the Federal tenant if the Federal tenant determines that the access is clearly consistent with the mission and responsibilities of the Federal tenant; and </content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/276/s5/3" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">the Federal lessee shall have written procedures in place, signed by the Federal lessee and the covered entity, governing access to the high-security leased space in case of emergencies that may damage the leased property. </content>
            </paragraph>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/276/s6" styleType="OLC">
            <num style="-uslm-dtd:enum" value="6">SEC. 6. </num><heading style="-uslm-dtd:header">AGENCY NOTIFICATIONS. </heading>
            <content style="-uslm-dtd:text" class="block">  Not later than 60 days after the date of enactment of this Act, the Administrator of General Services, in consultation with the Office of Management and Budget, shall provide notification to relevant Executive branch agencies with independent leasing authorities of the requirements of this Act.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/276/s7" styleType="OLC">
            <num style="-uslm-dtd:enum" value="7">SEC. 7. </num><heading style="-uslm-dtd:header">APPLICABILITY. </heading>
            <content style="-uslm-dtd:text" class="block">  Except where otherwise provided, this Act shall apply with respect to any lease or novation agreement entered into on or after the date that is 6 months after the date of enactment of this Act.  </content>
