    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To strengthen the capacity and competitiveness of historically Black colleges and universities through robust public-sector, private-sector, and community partnerships and engagement, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/270/s1" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s1001">20 U.S.C. 1001 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content style="-uslm-dtd:text" class="block">  This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">HBCU Propelling Agency Relationships Towards a New Era of Results for Students Act</shortTitle>” or the “<shortTitle style="-uslm-dtd:quote">HBCU PARTNERS Act</shortTitle>”.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/270/s2" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s1063d">20 U.S.C. 1063d note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">FINDINGS AND PURPOSES. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/270/s2/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Findings.—</heading><chapeau style="-uslm-dtd:text">Congress finds the following: </chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s2/a/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">As many colleges and universities across the country kept their doors closed to African American applicants, historically Black colleges and universities (referred to in this section as “HBCUs”) played a central role in ensuring that African Americans could attain an excellent education. </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s2/a/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">Today, HBCUs continue to play a critical role in ensuring that African Americans, and those of all races, can access high-quality educational opportunities. </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s2/a/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">HBCUs enroll nearly 300,000 students, an estimated 70 percent of whom come from low-income backgrounds and 80 percent of whom are African American. </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s2/a/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">According to the National Association For Equal Opportunity In Higher Education (referred to in this section as “NAFEO”), HBCUs make up just 3 percent of American institutions of higher education but serve more than a fifth of African American college students. </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s2/a/5" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">According to the Thurgood Marshall College Fund (referred to in this section as “TMCF”), approximately 9 percent of all African American college students attend HBCUs. </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s2/a/6" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">A March 2017 report from the Education Trust concluded that HBCUs have higher completion rates for African American students than other institutions serving similar student populations. </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s2/a/7" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">According to TMCF, 40 percent of African American Members of Congress, 50 percent of African American lawyers, and 80 percent of African American judges are graduates of HBCUs. </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s2/a/8" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="8">(8) </num><content style="-uslm-dtd:text">According to NAFEO, HBCUs graduate approximately 50 percent of African American public school teaching professionals.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s2/a/9" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="9">(9) </num><content style="-uslm-dtd:text">According to the United Negro College Fund (referred to in this section as “UNCF”), African American graduates of HBCUs are almost twice as likely as African Americans who graduated from other institutions to report that their university prepared them well for life. </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s2/a/10" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="10">(10) </num><content style="-uslm-dtd:text">According to a study commissioned by UNCF, in 2014, HBCUs generated a total direct economic impact of $14,800,000,000 and created more than 134,000 jobs. </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s2/a/11" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="11">(11) </num><content style="-uslm-dtd:text">According to a 2019 report produced by the American Council on Education and UNCF, despite efforts to counter a historical legacy of inequitable funding and notable investments by the Federal Government and many State governments, resource inequities continue to plague HBCUs. </content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/270/s2/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Purposes.—</heading><chapeau style="-uslm-dtd:text">The purposes of this Act are— </chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s2/b/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">to strengthen the capacity and competitiveness of HBCUs to fulfill their principal mission of equalizing educational opportunity, as described in section 301(b) of the Higher Education Act of 1965 (20 U.S.C. 1051(b)); </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s2/b/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">to align HBCUs with the educational and economic competitiveness priorities of the United States; </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s2/b/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">to provide students enrolled at HBCUs with the highest quality educational and economic opportunities; </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s2/b/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">to bolster and facilitate productive interactions between HBCUs and Federal agencies; and </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s2/b/5" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">to encourage HBCU participation in and benefit from Federal programs, grants, contracts, and cooperative agreements. </content>
                </paragraph>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/270/s3" styleType="OLC" role="definitions">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s1063d">20 U.S.C. 1063d note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">DEFINITIONS. </heading>
            <chapeau style="-uslm-dtd:text" class="block">  In this Act: </chapeau>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s3/1" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Applicable agency.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">applicable agency</term>” means—</chapeau>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/270/s3/1/A" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the Department of Agriculture; </content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/270/s3/1/B" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the Department of Commerce; </content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/270/s3/1/C" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">the Department of Defense; </content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/270/s3/1/D" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">the Department of Education; </content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/270/s3/1/E" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">the Department of Energy; </content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/270/s3/1/F" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">the Department of Health and Human Services; </content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/270/s3/1/G" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="G">(G) </num><content style="-uslm-dtd:text">the Department of Homeland Security; </content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/270/s3/1/H" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="H">(H) </num><content style="-uslm-dtd:text">the Department of Housing and Urban Development; </content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/270/s3/1/I" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">the Department of the Interior; </content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/270/s3/1/J" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="J">(J) </num><content style="-uslm-dtd:text">the Department of Justice; </content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/270/s3/1/K" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="K">(K) </num><content style="-uslm-dtd:text">the Department of Labor; </content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/270/s3/1/L" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="L">(L) </num><content style="-uslm-dtd:text">the Department of State; </content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/270/s3/1/M" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="M">(M) </num><content style="-uslm-dtd:text">the Department of Transportation; </content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/270/s3/1/N" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="N">(N) </num><content style="-uslm-dtd:text">the Department of Treasury; </content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/270/s3/1/O" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="O">(O) </num><content style="-uslm-dtd:text">the Department of Veterans Affairs; </content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/270/s3/1/P" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="P">(P) </num><content style="-uslm-dtd:text">the National Aeronautics and Space Administration; </content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/270/s3/1/Q" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="Q">(Q) </num><content style="-uslm-dtd:text">the National Oceanic and Atmospheric Administration; </content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/270/s3/1/R" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="R">(R) </num><content style="-uslm-dtd:text">the National Science Foundation; </content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/270/s3/1/S" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="S">(S) </num><content style="-uslm-dtd:text">the Small Business Administration; and </content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/270/s3/1/T" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="T">(T) </num><content style="-uslm-dtd:text">any other Federal agency designated as an applicable agency under section 4.</content>
                </subparagraph>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s3/2" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Executive director.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">Executive Director</term>” means—</chapeau>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/270/s3/2/A" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the Executive Director of the White House Initiative on Historically Black Colleges and Universities, as designated by the President; or </content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/270/s3/2/B" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">if no such Executive Director is designated, such person as the President may designate to lead the White House Initiative on Historically Black Colleges and Universities. </content>
                </subparagraph>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s3/3" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">HBCU.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">HBCU</term>” means a historically Black college or university.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s3/4" styleType="OLC">
                <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Historically black college or university.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">historically Black college or university</term>” has the meaning given the term “<term style="-uslm-dtd:quote">part B institution</term>” under section 322 of the Higher Education Act of 1965 (20 U.S.C. 1061).</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s3/5" styleType="OLC">
                <num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">President’s board of advisors.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">President’s Board of Advisors</term>” means the President’s Board of Advisors on historically Black colleges and universities.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s3/6" styleType="OLC">
                <num style="-uslm-dtd:enum" value="6">(6) </num><heading style="-uslm-dtd:header">Secretary.—</heading><content style="-uslm-dtd:text">Except as otherwise provided, the term “<term style="-uslm-dtd:quote">Secretary</term>” means the Secretary of Education.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s3/7" styleType="OLC">
                <num style="-uslm-dtd:enum" value="7">(7) </num><heading style="-uslm-dtd:header">White house initiative.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">White House Initiative</term>” means the White House Initiative on historically Black colleges and universities.</content>
            </paragraph>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/270/s4" styleType="OLC">
            <num style="-uslm-dtd:enum" value="4">SEC. 4. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s1063d">20 U.S.C. 1063d</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">STRENGTHENING HBCUS THROUGH FEDERAL AGENCY PLANS. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/270/s4/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Designating Applicable Agencies.—</heading><chapeau style="-uslm-dtd:text">The Secretary, in consultation with the Executive Director, shall— </chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s4/a/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">identify each Federal agency with which an HBCU— </chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/270/s4/a/1/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">has entered into a grant, contract, or cooperative agreement; or </content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/270/s4/a/1/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">is eligible to participate in the programs and initiatives under the jurisdiction of such Federal agency; and </content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s4/a/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">designate each Federal agency so identified as an applicable agency. </content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/270/s4/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Submitting Agency Plans.—</heading><content style="-uslm-dtd:text">Not later than February 1 of each year, the head of each applicable agency shall submit to the Secretary, the Executive Director, the Committee on Health, Education, Labor, and Pensions of the Senate, the Committee on Education and Labor of the House of Representatives, and the President’s Board of Advisors an annual Agency Plan describing efforts to strengthen the capacity of HBCUs to participate or be eligible to participate in the programs and initiatives under the jurisdiction of such applicable agency as described in subsection (a)(1)(B). </content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/270/s4/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Further Requirements for Submission and Accessibility.—</heading><content style="-uslm-dtd:text">The Executive Director shall make all annual Agency Plan submissions publicly available online in a user-friendly format. </content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/270/s4/d" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Agency Plan Content.—</heading><chapeau style="-uslm-dtd:text">Where appropriate, each Agency Plan shall include—  </chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s4/d/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">a description of how the applicable agency intends to increase the capacity of HBCUs to compete effectively for grants, contracts, or cooperative agreements; </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s4/d/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">an identification of Federal programs and initiatives under the jurisdiction of the applicable agency in which HBCUs are underrepresented; </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s4/d/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">an outline of proposed efforts to improve HBCUs’ participation in such programs and initiatives;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s4/d/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">a description of any progress made towards advancing or achieving goals and efforts from previous Agency Plans submitted under this section by such applicable agency; </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s4/d/5" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">a description of how the applicable agency plans to encourage public-sector, private-sector, and community involvement to improve the capacity of HBCUs to compete effectively for grants, contracts, or cooperative agreements, and to participate in programs and initiatives under the jurisdiction of such agency; </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s4/d/6" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">an identification of programs and initiatives not listed in a previous Agency Plan in which an HBCU may participate; </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s4/d/7" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">any other information the applicable agency determines is relevant to promoting opportunities to fund, partner, contract, or otherwise interact with HBCUs; and </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s4/d/8" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="8">(8) </num><content style="-uslm-dtd:text">any additional criteria established by the Secretary or the White House Initiative. </content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/270/s4/e" styleType="OLC">
                <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Agency Engagement.—</heading><chapeau style="-uslm-dtd:text">To help fulfill the objectives of the Agency Plans, the head of each applicable agency— </chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s4/e/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">shall provide, as appropriate, technical assistance and information to the Executive Director to enhance communication with HBCUs concerning the applicable agency’s— </chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/270/s4/e/1/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">programs and initiatives described in subsection (d)(2); and </content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/270/s4/e/1/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the preparation of applications or proposals for grants, contracts, or cooperative agreements; and </content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s4/e/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">shall appoint a senior official to report directly to the agency head on the applicable agency’s progress under this section. </content>
                </paragraph>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/270/s5" styleType="OLC">
            <num style="-uslm-dtd:enum" value="5">SEC. 5. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s1063e">20 U.S.C. 1063e</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">PRESIDENT’S BOARD OF ADVISORS ON HBCUS. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/270/s5/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Administration.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s5/a/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">There is established the President’s Board of Advisors on historically Black colleges and universities in the Department of Education or, if the President so elects, within the Executive Office of the President. </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s5/a/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Funding from ed.—</heading><content style="-uslm-dtd:text">Except as provided in paragraph (3), the Secretary shall provide funding and administrative support for the President’s Board of Advisors, subject to the availability of appropriations. </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s5/a/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Funding from the executive office of the president.—</heading><content style="-uslm-dtd:text">If the President elects to locate the President’s Board of Advisors within the Executive Office of the President, the Executive Office of the President shall provide funding and administrative support for the President’s Board of Advisors, subject to the availability of appropriations. </content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/270/s5/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Membership.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s5/b/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The President shall appoint not more than 23 members to the President’s Board of Advisors, and the Secretary and Executive Director or their designees shall serve as ex officio members. </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s5/b/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Chair.—</heading>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/270/s5/b/2/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Designation.—</heading><content style="-uslm-dtd:text">The President shall designate one member of the President’s Board of Advisors to serve as its Chair, who shall help direct the Board’s work in coordination with the Secretary and in consultation with the Executive Director.</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/270/s5/b/2/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Consultation.—</heading><content style="-uslm-dtd:text">The Chair shall also consult with the Executive Director regarding the time and location of meetings of the President’s Board of Advisors, which shall take place not less frequently than once every 6 months. </content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/270/s5/b/2/C" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Performance.—</heading><content style="-uslm-dtd:text">Insofar as the Federal Advisory Committee Act (5 U.S.C. App.) may apply to the President’s Board of Advisors, any functions of the President under such Act, except for those of reporting to the Congress, shall be performed by the Chair, in accordance with guidelines issued by the Administrator of General Services. </content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s5/b/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Compensation.—</heading><content style="-uslm-dtd:text">Members of the President’s Board of Advisors shall serve without compensation, but shall be reimbursed for travel expenses, including per diem in lieu of subsistence, as authorized by law. </content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/270/s5/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Mission and Functions.—</heading><chapeau style="-uslm-dtd:text">The President’s Board of Advisors shall advise the President, through the White House Initiative, on all matters pertaining to strengthening the educational capacity of HBCUs, which shall include the following: </chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s5/c/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">Improving the identity, visibility, distinctive capabilities, and overall competitiveness of HBCUs. </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s5/c/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">Engaging the philanthropic, business, government, military, homeland-security, and education communities in a national dialogue regarding new HBCU programs and initiatives. </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s5/c/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">Improving the ability of HBCUs to remain fiscally secure institutions that can assist the Nation in achieving its educational goals and in advancing the interests of all Americans. </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s5/c/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">Elevating the public awareness of, and fostering appreciation of, HBCUs. </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s5/c/5" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">Encouraging public-private investments in HBCUs. </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/270/s5/c/6" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">Improving government-wide strategic planning related to HBCU competitiveness to align Federal resources and provide the context for decisions about HBCU partnerships, investments, performance goals, priorities, human capital development, and budget planning.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/270/s5/d" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Report.—</heading><content style="-uslm-dtd:text">The President’s Board of Advisors shall report annually to the President on the Board’s progress in carrying out its duties under this section. </content>
            </subsection>
