    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To require the Secretary of the Treasury to mint a coin in commemoration of the 100th anniversary of the establishment of the Negro Leagues baseball.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/209/s1" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t31/s5112">31 U.S.C. 5112 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content style="-uslm-dtd:text" class="block">  This Act may be cited as the ““<shortTitle style="-uslm-dtd:quote">Negro Leagues Baseball Centennial Commemorative Coin Act</shortTitle>””. </content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/209/s2" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">FINDINGS. </heading>
            <chapeau style="-uslm-dtd:text" class="block">  The Congress finds the following: </chapeau>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/209/s2/1" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">The year 2020 marks the 100th anniversary of the establishment of the Negro National League, a professional baseball league formed in response to African-American players being banned from the major leagues. </content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/209/s2/2" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">On February 13, 1920, Andrew “Rube” Foster convened a meeting of 8 independent African-American baseball team owners at the Paseo YMCA in Kansas City, Missouri, to form a “league of their own,” establishing the Negro National League, the first successful, organized professional African-American baseball league in the United States. </content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/209/s2/3" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">Soon, additional leagues formed in eastern and southern States. </content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/209/s2/4" styleType="OLC">
                <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">The Negro Leagues would operate for 40 years until 1960. </content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/209/s2/5" styleType="OLC">
                <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">The story of the Negro Leagues is a story of strong-willed athletes who forged a glorious history in the midst of an inglorious era of segregation in the United States. </content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/209/s2/6" styleType="OLC">
                <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">The passion of the Negro Leagues players for the “National Pastime” would not only change the game, but also the United States. </content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/209/s2/7" styleType="OLC">
                <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">The creation of the Negro Leagues provided a playing field for more than 2,600 African-American and Hispanic baseball players to showcase their world-class baseball abilities. </content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/209/s2/8" styleType="OLC">
                <num style="-uslm-dtd:enum" value="8">(8) </num><content style="-uslm-dtd:text">The Negro Leagues introduced an exciting brand of baseball that was in stark contrast to Major League Baseball. </content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/209/s2/9" styleType="OLC">
                <num style="-uslm-dtd:enum" value="9">(9) </num><content style="-uslm-dtd:text">A fast, aggressive style of play attracted black and white fans who sat together to watch those games at a time when it was virtually unheard of to interact socially in such a way. </content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/209/s2/10" styleType="OLC">
                <num style="-uslm-dtd:enum" value="10">(10) </num><content style="-uslm-dtd:text">Negro Leagues baseball would become a catalyst for economic development across the United States in major urban centers such as Kansas City, St. Louis, New York, Memphis, Baltimore, Washington, DC, Chicago, and Atlanta.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/209/s2/11" styleType="OLC">
                <num style="-uslm-dtd:enum" value="11">(11) </num><content style="-uslm-dtd:text">The Negro Leagues pioneered “Night Baseball” in 1930, 5 years before Major League Baseball, and would introduce game-changing innovations such as shin guards and the batting helmet. </content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/209/s2/12" styleType="OLC">
                <num style="-uslm-dtd:enum" value="12">(12) </num><chapeau style="-uslm-dtd:text">The Negro Leagues helped make the National Pastime a global game as players from the Negro Leagues— </chapeau>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/209/s2/12/A" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">were the first people from the United States to play in many Spanish-speaking countries; and </content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/209/s2/12/B" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">introduced professional baseball to the Japanese in 1927. </content>
                </subparagraph>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/209/s2/13" styleType="OLC">
                <num style="-uslm-dtd:enum" value="13">(13) </num><content style="-uslm-dtd:text">Jackie Robinson, a military veteran and former member of the Negro Leagues’ Kansas City Monarchs, would break Major League Baseball’s color barrier on April 15, 1947, with the Brooklyn Dodgers, paving the way for other African-American and Hispanic baseball players. </content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/209/s2/14" styleType="OLC">
                <num style="-uslm-dtd:enum" value="14">(14) </num><content style="-uslm-dtd:text">The Negro Leagues were born out of segregation yet would become a driving force for social change in the United States. </content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/209/s2/15" styleType="OLC">
                <num style="-uslm-dtd:enum" value="15">(15) </num><content style="-uslm-dtd:text">The Negro Leagues produced future Major League Baseball stars, including Leroy “Satchel” Paige, Larry Doby, Willie Mays, Henry Aaron, Ernie Banks, and Roy Campanella. </content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/209/s2/16" styleType="OLC">
                <num style="-uslm-dtd:enum" value="16">(16) </num><chapeau style="-uslm-dtd:text">The Negro Leagues Baseball Museum was established in Kansas City, Missouri, in 1990— </chapeau>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/209/s2/16/A" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">to save from extinction a precious piece of Americana and baseball history; and </content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/209/s2/16/B" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">to use the many life lessons of the powerful story of triumph over adversity of Negro Leagues players to promote tolerance, diversity, and inclusion. </content>
                </subparagraph>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/209/s2/17" styleType="OLC">
                <num style="-uslm-dtd:enum" value="17">(17) </num><content style="-uslm-dtd:text">In 2006, Congress granted National Designation to the Negro Leagues Baseball Museum, recognizing it as “America’s Home” for Negro Leagues baseball history. </content>
            </paragraph>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/209/s3" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><heading style="-uslm-dtd:header">COIN SPECIFICATIONS. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/209/s3/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Denominations.—</heading><chapeau style="-uslm-dtd:text">The Secretary of the Treasury (hereafter in this Act referred to as the “Secretary”) shall mint and issue the following coins: </chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/209/s3/a/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">$5 gold coins.—</heading><chapeau style="-uslm-dtd:text">Not more than 50,000 $5 coins, which shall— </chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/209/s3/a/1/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">weigh 8.359 grams; </content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/209/s3/a/1/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">have a diameter of 0.850 inches; and </content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/209/s3/a/1/C" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">contain not less than 90 percent gold. </content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/209/s3/a/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">$1 silver coins.—</heading><chapeau style="-uslm-dtd:text">Not more than 400,000 $1 coins, which shall— </chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/209/s3/a/2/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">weigh 26.73 grams; </content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/209/s3/a/2/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">have a diameter of 1.500 inches; and </content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/209/s3/a/2/C" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">contain not less than 90 percent silver. </content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/209/s3/a/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Half-dollar clad coins.—</heading><chapeau style="-uslm-dtd:text">Not more than 400,000 half-dollar coins which shall— </chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/209/s3/a/3/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">weigh 11.34 grams; </content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/209/s3/a/3/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">have a diameter of 1.205 inches; and </content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/209/s3/a/3/C" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">be minted to the specifications for half-dollar coins contained in section 5112(b) of title 31, United States Code.</content>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/209/s3/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Legal Tender.—</heading><content style="-uslm-dtd:text">The coins minted under this Act shall be legal tender, as provided in section 5103 of title 31, United States Code.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/209/s3/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Numismatic Items.—</heading><content style="-uslm-dtd:text">For purposes of section 5134 of title 31, United States Code, all coins minted under this Act shall be considered to be numismatic items.</content>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/209/s4" styleType="OLC">
            <num style="-uslm-dtd:enum" value="4">SEC. 4. </num><heading style="-uslm-dtd:header">DESIGNS OF COINS. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/209/s4/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Design Requirements.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/209/s4/a/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The designs of the coins minted under this Act shall be emblematic of the Negro Leagues Baseball Museum and its mission to promote tolerance, diversity, and inclusion. </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/209/s4/a/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Designation and inscriptions.—</heading><chapeau style="-uslm-dtd:text">On each coin minted under this Act there shall be— </chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/209/s4/a/2/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">a designation of the value of the coin; </content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/209/s4/a/2/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">an inscription of the year “2022”; and </content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/209/s4/a/2/C" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">inscriptions of the words “Liberty”, “In God We Trust”, “United States of America”, and “E Pluribus Unum”. </content>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/209/s4/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Selection.—</heading><chapeau style="-uslm-dtd:text">The designs for the coins minted under this Act shall be— </chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/209/s4/b/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">selected by the Secretary after consultation with the Negro Leagues Baseball Museum and the Commission of Fine Arts; and </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/209/s4/b/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">reviewed by the Citizens Coinage Advisory Committee. </content>
                </paragraph>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/209/s5" styleType="OLC">
            <num style="-uslm-dtd:enum" value="5">SEC. 5. </num><heading style="-uslm-dtd:header">ISSUANCE OF COINS. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/209/s5/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Quality of Coins.—</heading><content style="-uslm-dtd:text">Coins minted under this Act shall be issued in uncirculated and proof qualities. </content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/209/s5/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Mint Facilities.—</heading><content style="-uslm-dtd:text">Only 1 facility of the United States Mint may be used to strike any particular quality of the coins minted under this Act. </content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/209/s5/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Period for Issuance.—</heading><content style="-uslm-dtd:text">The Secretary may issue coins minted under this Act only during the 1-year period beginning on January 1, 2022. </content>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/209/s6" styleType="OLC">
            <num style="-uslm-dtd:enum" value="6">SEC. 6. </num><heading style="-uslm-dtd:header">SALE OF COINS. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/209/s6/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Sale Price.—</heading><chapeau style="-uslm-dtd:text">The coins issued under this Act shall be sold by the Secretary at a price equal to the sum of— </chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/209/s6/a/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the face value of the coins; </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/209/s6/a/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the surcharge provided in section 7(a) with respect to such coins; and </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/209/s6/a/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">the cost of designing and issuing the coins (including labor, materials, dies, use of machinery, overhead expenses, marketing, and shipping). </content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/209/s6/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Bulk Sales.—</heading><content style="-uslm-dtd:text">The Secretary shall make bulk sales of the coins issued under this Act at a reasonable discount. </content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/209/s6/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Prepaid Orders.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/209/s6/c/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Secretary shall accept prepaid orders for the coins minted under this Act before the issuance of such coins. </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/209/s6/c/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Discount.—</heading><content style="-uslm-dtd:text">Sale prices with respect to prepaid orders under paragraph (1) shall be at a reasonable discount. </content>
                </paragraph>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/209/s7" styleType="OLC">
            <num style="-uslm-dtd:enum" value="7">SEC. 7. </num><heading style="-uslm-dtd:header">SURCHARGES. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/209/s7/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><chapeau style="-uslm-dtd:text">All sales of coins issued under this Act shall include a surcharge of— </chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/209/s7/a/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">$35 per coin for the $5 coin; </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/209/s7/a/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">$10 per coin for the $1 coin; and </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/209/s7/a/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">$5 per coin for the half-dollar coin.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/209/s7/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Distribution.—</heading><content style="-uslm-dtd:text">Subject to section 5134(f)(1) of title 31, United States Code, all surcharges received by the Secretary from the sale of coins issued under this Act shall be promptly paid by the Secretary to the Negro Leagues Baseball Museum for educational and outreach programs and exhibits.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/209/s7/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Audits.—</heading><content style="-uslm-dtd:text">The Negro Leagues Baseball Museum shall be subject to the audit requirements of section 5134(f)(2) of title 31, United States Code, with regard to the amounts received under subsection (b).</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/209/s7/d" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Limitation.—</heading><content style="-uslm-dtd:text">Notwithstanding subsection (a), no surcharge may be included with respect to the issuance under this Act of any coin during a calendar year if, as of the time of such issuance, the issuance of such coin would result in the number of commemorative coin programs issued during such year to exceed the annual 2 commemorative coin program issuance limitation under section 5112(m)(1) of title 31, United States Code (as in effect on the date of the enactment of this Act). The Secretary of the Treasury may issue guidance to carry out this subsection.</content>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/209/s8" styleType="OLC">
            <num style="-uslm-dtd:enum" value="8">SEC. 8. </num><heading style="-uslm-dtd:header">FINANCIAL ASSURANCES. </heading>
            <chapeau style="-uslm-dtd:text" class="block">  The Secretary shall take such actions as may be necessary to ensure that— </chapeau>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/209/s8/1" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">minting and issuing coins under this Act will not result in any net cost to the United States Government; and </content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/209/s8/2" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">no funds, including applicable surcharges, are disbursed to any recipient designated in section 7 until the total cost of designing and issuing all of the coins authorized by this Act (including labor, materials, dies, use of machinery, overhead expenses, marketing, and shipping) is recovered by the United States Treasury, consistent with sections 5112(m) and 5134(f) of title 31, United States Code.</content>
            </paragraph>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/209/s9" styleType="OLC">
            <num style="-uslm-dtd:enum" value="9">SEC. 9. </num><heading style="-uslm-dtd:header">MARKETING AND EDUCATIONAL CAMPAIGN. </heading>
            <content style="-uslm-dtd:text" class="block">  The Secretary shall develop and execute a marketing, advertising, promotional, and educational program to promote the collecting of the coins authorized under this subsection. </content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/209/s10" styleType="OLC">
            <num style="-uslm-dtd:enum" value="10">SEC. 10. </num><heading style="-uslm-dtd:header">DETERMINATION OF BUDGETARY EFFECTS. </heading>
            <content style="-uslm-dtd:text" class="block">  The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled “Budgetary Effects of PAYGO Legislation” for this Act, submitted for printing in the   Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage. </content>
