    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To impose criminal sanctions on certain persons involved in international doping fraud conspiracies, to provide restitution for victims of such conspiracies, and to require sharing of information with the United States Anti-Doping Agency to assist its fight against doping, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/206/s1" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t21/s2401">21 U.S.C. 2401 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content style="-uslm-dtd:text" class="block">  This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Rodchenkov Anti-Doping Act of 2019</shortTitle>”. </content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/206/s2" styleType="OLC" role="definitions">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t21/s2401">21 U.S.C. 2401</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">DEFINITIONS. </heading>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/206/s2/1" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Anti-doping organization.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">anti-doping organization</term>” has the meaning given the term in Article 2 of the Convention. </content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/206/s2/2" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Athlete.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">athlete</term>” has the meaning given the term in Article 2 of the Convention. </content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/206/s2/3" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Code.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">Code</term>” means the World Anti-Doping Code most recently adopted by WADA on March 5, 2003. </content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/206/s2/4" styleType="OLC">
                <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Convention.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">Convention</term>” means the United Nations Educational, Scientific, and Cultural Organization International Convention Against Doping in Sport done at Paris October 19, 2005, and ratified by the United States in 2008. </content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/206/s2/5" styleType="OLC">
                <num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">Major international sport competition.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">Major International Sport Competition</term>”— </chapeau>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/206/s2/5/A" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><chapeau style="-uslm-dtd:text">means a competition— </chapeau>
                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/116/206/s2/5/A/i" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">in which one or more United States athletes and three or more athletes from other countries participate; </content>
                    </clause>
                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/116/206/s2/5/A/ii" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">that is governed by the anti-doping rules and principles of the Code; and </content>
                    </clause>
                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/116/206/s2/5/A/iii" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="iii">(iii) </num><chapeau style="-uslm-dtd:text">in which— </chapeau>
                        <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/116/206/s2/5/A/iii/I" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">the competition organizer or sanctioning body receives sponsorship or other financial support from an organization doing business in the United States; or </content>
                        </subclause>
                        <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/116/206/s2/5/A/iii/II" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">the competition organizer or sanctioning body receives compensation for the right to broadcast the competition in the United States; and </content>
                        </subclause>
                    </clause>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/206/s2/5/B" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">includes a competition that is a single event or a competition that consists of a series of events held at different times which, when combined, qualify an athlete or team for an award or other recognition.</content>
                </subparagraph>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/206/s2/6" styleType="OLC">
                <num style="-uslm-dtd:enum" value="6">(6) </num><heading style="-uslm-dtd:header">Person.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">person</term>” means any individual, partnership, corporation, association, or other entity. </content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/206/s2/7" styleType="OLC">
                <num style="-uslm-dtd:enum" value="7">(7) </num><heading style="-uslm-dtd:header">Prohibited method.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">prohibited method</term>” has the meaning given the term in Article 2 of the Convention. </content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/206/s2/8" styleType="OLC">
                <num style="-uslm-dtd:enum" value="8">(8) </num><heading style="-uslm-dtd:header">Prohibited substance.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">prohibited substance</term>” has the meaning given the term in Article 2 of the Convention. </content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/206/s2/9" styleType="OLC">
                <num style="-uslm-dtd:enum" value="9">(9) </num><heading style="-uslm-dtd:header">Scheme in commerce.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">scheme in commerce</term>” means any scheme effectuated in whole or in part through the use in interstate or foreign commerce of any facility for transportation or communication. </content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/206/s2/10" styleType="OLC">
                <num style="-uslm-dtd:enum" value="10">(10) </num><heading style="-uslm-dtd:header">USADA.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">USADA</term>” means the United States Anti-Doping Agency. </content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/206/s2/11" styleType="OLC">
                <num style="-uslm-dtd:enum" value="11">(11) </num><heading style="-uslm-dtd:header">WADA.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">WADA</term>” means the World Anti-Doping Agency. </content>
            </paragraph>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/206/s3" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t21/s2402">21 U.S.C. 2402</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">MAJOR INTERNATIONAL DOPING FRAUD CONSPIRACIES. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/206/s3/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">It shall be unlawful for any person, other than an athlete, to knowingly carry into effect, attempt to carry into effect, or conspire with any other person to carry into effect a scheme in commerce to influence by use of a prohibited substance or prohibited method any major international sports competition. </content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/206/s3/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Extraterritorial Jurisdiction.—</heading><content style="-uslm-dtd:text">There is extraterritorial Federal jurisdiction over an offense under this section. </content>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/206/s4" styleType="OLC">
            <num style="-uslm-dtd:enum" value="4">SEC. 4. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t21/s2403">21 U.S.C. 2403</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">CRIMINAL PENALTIES AND STATUTE OF LIMITATIONS. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/206/s4/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/206/s4/a/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Criminal penalty.—</heading><content style="-uslm-dtd:text">Whoever violates section 3 shall be sentenced to a term of imprisonment for not more than 10 years, fined $250,000 if the person is an individual or $1,000,000 if the defendant is other than an individual, or both. </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/206/s4/a/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Forfeiture.—</heading><chapeau style="-uslm-dtd:text">Any property real or personal, tangible or intangible, may be seized and criminally forfeited to the United States if that property— </chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/206/s4/a/2/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">is used or intended to be used, in any manner, to commit or facilitate a violation of section 3; or </content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/206/s4/a/2/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">constitutes or is traceable to the proceeds taken, obtained, or retained in connection with or as a result of a violation of section 3. </content>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/206/s4/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Limitation on Prosecution.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/206/s4/b/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">No person shall be prosecuted, tried, or punished for violation of section 3 unless the indictment is returned or the information is filed within 10 years after the date on which the offense was completed. </content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/206/s4/b/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Tolling.—</heading><content style="-uslm-dtd:text">Upon application in the United States, filed before a return of an indictment, indicating that evidence of an offense under this chapter is in a foreign country, the district court before which a grand jury is impaneled to investigate the offense shall suspend the running of this statute of limitation for the offense if the court finds by a preponderance of the evidence that an official request has been made for such evidence and that it reasonably appears, or reasonably appeared at the time the request was made, that such evidence is, or was, in such foreign country.</content>
                </paragraph>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/206/s5" styleType="OLC">
            <num style="-uslm-dtd:enum" value="5">SEC. 5. </num><heading style="-uslm-dtd:header">RESTITUTION. </heading>
            <chapeau style="-uslm-dtd:text" class="block">Section 3663A of title 18, United States Code, is amended in subsection (c)—</chapeau>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/206/s5/1" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">in paragraph (1)(A)— </chapeau>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/206/s5/1/A" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">by redesignating clauses (iii) and (iv) as clauses (iv) and (v), respectively; and </content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/116/206/s5/1/B" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">by inserting after clause (ii) the following: <quotedContent style="-uslm-dtd:quoted-block">
                    <subsection style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="iii">“(iii) </num><content style="-uslm-dtd:text">an offense described in section 3 of the Rodchenkov Anti-Doping Act of 2019; ”</content>
                    </subsection></quotedContent>; and</content>
                </subparagraph>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/206/s5/2" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">in paragraph (3), in the matter preceding subparagraph (A), by inserting “<quotedText style="-uslm-dtd:quote">or (iii)</quotedText>” after “<quotedText style="-uslm-dtd:quote">paragraph (1)(A)(ii)</quotedText>”. </content>
            </paragraph>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/206/s6" styleType="OLC">
            <num style="-uslm-dtd:enum" value="6">SEC. 6. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t21/s2404">21 U.S.C. 2404</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">COORDINATION AND SHARING OF INFORMATION WITH USADA. </heading>
            <content style="-uslm-dtd:text" class="block">  Except as otherwise prohibited by law and except in cases in which the integrity of a criminal investigation would be affected, in furtherance of the obligation of the United States under Article 7 of the Convention, the Department of Justice, the Department of Homeland Security, and the Food and Drug Administration shall coordinate with USADA with regard to any investigation related to a potential violation of section 3 of this Act, to include sharing with USADA all information in the possession of the Department of Justice, the Department of Homeland Security, or the Food and Drug Administration which may be relevant to any such potential violation. </content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/206/s7" styleType="OLC">
            <num style="-uslm-dtd:enum" value="7">SEC. 7. </num><heading style="-uslm-dtd:header">DETERMINATION OF BUDGETARY EFFECTS. </heading>
            <content style="-uslm-dtd:text" class="block">  The budgetary effects of this Act, and the amendments made by this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled “<quotedText style="-uslm-dtd:quote">Budgetary Effects of PAYGO Legislation</quotedText>” for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage. </content>
        </section>
    </main>
