    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To express United States support for Taiwan’s diplomatic alliances around the world.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
</enactingFormula>
        <section identifier="/us/sComp/116/135/s1" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><heading style="-uslm-dtd:header">SHORT TITLE. </heading><content style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Taiwan Allies International Protection and Enhancement Initiative (TAIPEI) Act of 2019</shortTitle>”.</content>
        </section>
        <section identifier="/us/sComp/116/135/s2" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">DIPLOMATIC RELATIONS WITH TAIWAN. </heading>
            <subsection identifier="/us/sComp/116/135/s2/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Findings.—</heading><chapeau style="-uslm-dtd:text">Congress makes the following findings:</chapeau>
                <paragraph identifier="/us/sComp/116/135/s2/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">The Taiwan Relations Act of 1979 (Public Law 96-8) states that it is the policy of the United States “to preserve and promote extensive, close, and friendly commercial, cultural, and other relations between the people of the United States and the people on Taiwan”.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/116/135/s2/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">The Taiwan Relations Act of 1979 states that it is the policy of the United States “to maintain the capacity of the United States to resist any resort to force or other forms of coercion that would jeopardize the security, or the social or economic system, of the people on Taiwan”.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/116/135/s2/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">Taiwan is a free, democratic, and prosperous nation of 23,000,000 people and an important contributor to peace and stability around the world.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/116/135/s2/a/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">Since the election of President Tsai Ing-wen as President of Taiwan in 2016, the Government of the People’s Republic of China has intensified its efforts to pressure Taiwan.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/116/135/s2/a/5" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">Since 2016, the Gambia, Sao Tome and Principe, Panama, the Dominican Republic, Burkina Faso, El Salvador, the Solomon Islands, Kiribati, and Nicaragua, have severed diplomatic relations with Taiwan in favor of diplomatic relations with China.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/116/135/s2/a/6" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">Taiwan currently maintains full diplomatic relations with 15 nations around the world.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/116/135/s2/a/7" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">Taiwan’s unique relationship with the United States, Australia, India, Japan, and other countries are of significant benefit in strengthening Taiwan’s economy and preserving its international space.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/116/135/s2/a/8" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="8">(8) </num><content style="-uslm-dtd:text">According to President Tsai Ing-wen, the severance of diplomatic ties with Taiwan in favor of diplomatic relations with China is “part of a series of diplomatic and military acts of coercion” by China.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/116/135/s2/a/9" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="9">(9) </num><chapeau style="-uslm-dtd:text">The Asia Reassurance Initiative Act of 2018 (Public Law 115-409) states that—</chapeau>
                    <subparagraph identifier="/us/sComp/116/135/s2/a/9/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">it is United States policy “to support the close economic, political, and security relationship between Taiwan and the United States”; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/116/135/s2/a/9/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">the President should—</chapeau>
                        <clause identifier="/us/sComp/116/135/s2/a/9/B/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">“conduct regular transfers of defense articles to Taiwan that are tailored to meet the existing and likely future threats from the People’s Republic of China, including supporting the efforts of Taiwan to develop and integrate asymmetric capabilities, as appropriate, including mobile, survivable, and cost-effective capabilities, into its military forces”; and</content>
                        </clause>
                        <clause identifier="/us/sComp/116/135/s2/a/9/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">“encourage the travel of high-level United States officials to Taiwan, in accordance with the Taiwan Travel Act”.</content>
                        </clause>
                    </subparagraph>
                </paragraph>
            </subsection>
        </section>
        <section identifier="/us/sComp/116/135/s3" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><heading style="-uslm-dtd:header">SENSE OF CONGRESS ON TRADE AND ECONOMIC RELATIONS WITH TAIWAN. </heading>
            <chapeau class="block" style="-uslm-dtd:text">It is the sense of Congress that—</chapeau>
            <paragraph identifier="/us/sComp/116/135/s3/1" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the United States and Taiwan have built a strong economic partnership, with the United States now Taiwan’s second largest trading partner and with Taiwan the 11th largest trading partner of the United States and a key destination for United States agricultural exports;</content>
            </paragraph>
            <paragraph identifier="/us/sComp/116/135/s3/2" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">strong United States-Taiwan economic relations have been a positive factor in stimulating economic growth and job creation for the people of both the United States and Taiwan; and</content>
            </paragraph>
            <paragraph identifier="/us/sComp/116/135/s3/3" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">the United States Trade Representative should consult with Congress on opportunities for further strengthening bilateral trade and economic relations between the United States and Taiwan.</content>
            </paragraph>
        </section>
        <section identifier="/us/sComp/116/135/s4" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="4">SEC. 4. </num><heading style="-uslm-dtd:header">POLICY OF THE UNITED STATES WITH REGARD TO TAIWAN’S PARTICIPATION IN INTERNATIONAL ORGANIZATIONS. </heading>
            <chapeau class="block" style="-uslm-dtd:text">It is the policy of the United States—</chapeau>
            <paragraph identifier="/us/sComp/116/135/s4/1" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">to advocate, as appropriate—</chapeau>
                <subparagraph identifier="/us/sComp/116/135/s4/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">for Taiwan’s membership in all international organizations in which statehood is not a requirement and in which the United States is also a participant; and</content>
                </subparagraph>
                <subparagraph identifier="/us/sComp/116/135/s4/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">for Taiwan to be granted observer status in other appropriate international organizations;</content>
                </subparagraph>
            </paragraph>
            <paragraph identifier="/us/sComp/116/135/s4/2" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">to instruct, as appropriate, representatives of the United States Government in all organizations described in paragraph (1) to use the voice, vote, and influence of the United States to advocate for Taiwan’s membership or observer status in such organizations; </content>
            </paragraph>
            <paragraph identifier="/us/sComp/116/135/s4/3" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">for the President or the President’s designees to advocate, as appropriate, for Taiwan’s membership or observer status in all organizations described in paragraph (1) as part of any relevant bilateral engagements between the United States and the People’s Republic of China, including leader summits and the U.S.-China Comprehensive Economic Dialogue; and</content>
            </paragraph>
            <paragraph identifier="/us/sComp/116/135/s4/4" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">to support Taiwan’s diplomatic relations with governments and countries</content>
            </paragraph>
        </section>
        <section identifier="/us/sComp/116/135/s5" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="5">SEC. 5. </num><heading style="-uslm-dtd:header">STRENGTHENING OF TIES WITH TAIWAN. </heading>
            <subsection identifier="/us/sComp/116/135/s5/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Sense of Congress.—</heading><chapeau style="-uslm-dtd:text">It is the sense of Congress that the United States Government should—</chapeau>
                <paragraph identifier="/us/sComp/116/135/s5/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">support Taiwan in strengthening its official diplomatic relationships as well as other partnerships with countries in the Indo-Pacific region and around the world;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/116/135/s5/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">consider, in certain cases as appropriate and in alignment with United States interests, increasing its economic, security, and diplomatic engagement with nations that have demonstrably strengthened, enhanced, or upgraded relations with Taiwan; </content>
                </paragraph>
                <paragraph identifier="/us/sComp/116/135/s5/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">consider, in certain cases as appropriate, in alignment with United States foreign policy interests and in consultation with Congress, altering its economic, security, and diplomatic engagement with nations that take serious or significant actions to undermine the security or prosperity of Taiwan; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/116/135/s5/a/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">identify why governments and countries have altered their diplomatic status vis-a-vis Taiwan and make recommendations to mitigate further deterioration in Taiwan’s diplomatic relations with governments and countries.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/116/135/s5/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Report.—</heading><content style="-uslm-dtd:text">Not later than 90 days after the date of the enactment of the Taiwan Enhanced Resilience Act, and annually thereafter for the following 7 years, the Secretary of State shall submit an unclassified report, with a classified annex, to the appropriate congressional committees on the steps taken in accordance with subsection (a).</content>
            </subsection>
            <subsection identifier="/us/sComp/116/135/s5/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Briefings.—</heading><content style="-uslm-dtd:text">Not later than 90 days after the date of the enactment of the Taiwan Enhanced Resilience Act, and annually thereafter for the following 7 years, the Secretary of State shall provide briefings to the appropriate congressional committees on the steps taken in accordance with section (a). The briefings required under this subsection shall take place in an unclassified setting, but may be accompanied by an additional classified briefing.</content>
            </subsection>
            <subsection identifier="/us/sComp/116/135/s5/d" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Appropriate Congressional Committees Defined.—</heading><chapeau style="-uslm-dtd:text">In this section, the term “<quotedText style="-uslm-dtd:quote">appropriate congressional committees</quotedText>” means—</chapeau>
                <paragraph identifier="/us/sComp/116/135/s5/d/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the Committee on Foreign Relations, the Committee on Appropriations, and the Committee on Finance of the Senate; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/116/135/s5/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the Committee on Foreign Affairs, the Committee on Appropriations, and the Committee on Ways and Means of the House of Representatives.</content>

            </subsection>
