Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

        <section style="-uslm-dtd:section" identifier="/us/sComp/103/182/s1" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><heading style="-uslm-dtd:header">SHORT TITLE AND TABLE OF CONTENTS.<ref style="-uslm-dtd:footnote-ref" idref="IDA6BE8A9831294CEE8EF053AC32927700" class="footnoteRef">1</ref> </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/s1/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Short Title.—</heading><content style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">North American Free Trade Agreement Implementation Act'</shortTitle>”.</content>
            </subsection>

            <num style="-uslm-dtd:enum" value="II">TITLE II—</num><heading style="-uslm-dtd:header">CUSTOMS PROVISIONS </heading>
            <elided style="-uslm-dtd:omitted-text">* * * * * * *</elided>
            <section style="-uslm-dtd:section" identifier="/us/sComp/103/182/tII/s203" styleType="OLC">
                <num style="-uslm-dtd:enum" value="203">SEC. 203. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t19/s3333">19 U.S.C. 3333</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">DRAWBACK. </heading>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tII/s203/a" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Definition of a Good Subject to NAFTA Drawback.—</heading><chapeau style="-uslm-dtd:text">For purposes of this Act and the amendments made by subsection (b), the term “<quotedText style="-uslm-dtd:quote">good subject to NAFTA drawback</quotedText>” means any imported good other than the following:</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tII/s203/a/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">A good entered under bond for transportation and exportation to a NAFTA country.</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tII/s203/a/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">A good exported to a NAFTA country in the same condition as when imported into the United States. For purposes of this paragraph—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tII/s203/a/2/A" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">processes such as testing, cleaning, repacking, or inspecting a good, or preserving it in its same condition, shall not be considered to change the condition of the good, and</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tII/s203/a/2/B" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">except for a good referred to in paragraph 12 of section A of Annex 703.2 of the Agreement that is exported to Mexico, if a good described in the first sentence of this paragraph is commingled with fungible goods and exported in the same condition, the origin of the good may be determined on the basis of the inventory methods provided for in the regulations implementing this title.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tII/s203/a/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><chapeau style="-uslm-dtd:text">A good—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tII/s203/a/3/A" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><chapeau style="-uslm-dtd:text">that is—</chapeau>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/103/182/tII/s203/a/3/A/i" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">deemed to be exported from the United States,</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/103/182/tII/s203/a/3/A/ii" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">used as a material in the production of another good that is deemed to be exported to a NAFTA country, or</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/103/182/tII/s203/a/3/A/iii" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">substituted for by a good of the same kind and quality that is used as a material in the production of another good that is deemed to be exported to a NAFTA country, and</content>
                            </clause>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tII/s203/a/3/B" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">that is delivered—</chapeau>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/103/182/tII/s203/a/3/B/i" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">to a duty-free shop,</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/103/182/tII/s203/a/3/B/ii" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">for ship’s stores or supplies for ships or aircraft, or</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/103/182/tII/s203/a/3/B/iii" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">for use in a project undertaken jointly by the United States and a NAFTA country and destined to become the property of the United States.</content>
                            </clause>
                        </subparagraph>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tII/s203/a/4" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><chapeau style="-uslm-dtd:text">A good exported to a NAFTA country for which a refund of customs duties is granted by reason of—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tII/s203/a/4/A" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the failure of the good to conform to sample or specification, or</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tII/s203/a/4/B" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the shipment of the good without the consent of the consignee.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tII/s203/a/5" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><chapeau style="-uslm-dtd:text">A good that qualifies under the rules of origin set out in section 202 that is—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tII/s203/a/5/A" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">exported to a NAFTA country,</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tII/s203/a/5/B" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">used as a material in the production of another good that is exported to a NAFTA country, or</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tII/s203/a/5/C" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">substituted for by a good of the same kind and quality that is used as a material in the production of another good that is exported to a NAFTA country.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tII/s203/a/6" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="6">(6) </num><chapeau style="-uslm-dtd:text">A good provided for in subheading 1701.11.02 of the HTS that is—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tII/s203/a/6/A" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">used as a material, or</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tII/s203/a/6/B" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">substituted for by a good of the same kind and quality that is used as a material, in the production of a good provided for in existing Canadian tariff item 1701.99.00 or existing Mexican tariff item 1701.99.01 or 1701.99.99 (relating to refined sugar).</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tII/s203/a/7" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">A citrus product that is exported to Canada.</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tII/s203/a/8" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="8">(8) </num><chapeau style="-uslm-dtd:text">A good used as a material, or substituted for by a good of the same kind and quality that is used as a material, in the production of—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tII/s203/a/8/A" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">apparel, or</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tII/s203/a/8/B" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">a good provided for in subheading 6307.90.99 (insofar as it relates to furniture moving pads), 5811.00.20, or 5811.00.30 of the HTS,</content>
                        </subparagraph><continuation style="-uslm-dtd:continuation-text" role="paragraph">that is exported to Canada and that is subject to Canada’s most-favored-nation rate of duty upon importation into Canada.</continuation>
                    </paragraph><continuation style="-uslm-dtd:continuation-text" role="subsection">Where in paragraph (6) a good referred to by an item is described in parentheses following the item, the description is provided for purposes of reference only.
                    <elided style="-uslm-dtd:omitted-text">* * * * * * *</elided></continuation>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tII/s203/d" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Elimination of Drawback for Section 22 Fees.—</heading><chapeau style="-uslm-dtd:text">Notwithstanding any other provision of law, the Secretary of the Treasury may not, on condition of export, refund or reduce a fee applied pursuant to section 22 of the Agricultural Adjustment Act (7 U.S.C. 624) with respect to goods included under subsection (a) that are exported to—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tII/s203/d/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">Canada after December 31, 1995, for so long as it is a NAFTA country; or</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tII/s203/d/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">Mexico after December 31, 2000, for so long as it is a NAFTA country.</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tII/s203/e" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Inapplicability to Countervailing and Antidumping Duties.—</heading><content style="-uslm-dtd:text">Nothing in this section or the amendments made by it shall be considered to authorize the refund, waiver, or reduction of countervailing duties or antidumping duties imposed on an imported good.</content>

            <num style="-uslm-dtd:enum" value="III">TITLE III—</num><heading style="-uslm-dtd:header">APPLICATION OF AGREEMENT TO SECTORS AND SERVICES </heading>

                <num style="-uslm-dtd:enum" value="A">Subtitle A—</num><heading style="-uslm-dtd:header">Safeguards </heading>

                    <num style="-uslm-dtd:enum" value="2">PART 2—</num><heading style="-uslm-dtd:header">RELIEF FROM IMPORTS FROM ALL COUNTRIES </heading>
                    <section style="-uslm-dtd:section" identifier="/us/sComp/103/182/tIII/stA/pt2/s311" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="311">SEC. 311. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t19/s3371">19 U.S.C. 3371</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">NAFTA ARTICLE IMPACT IN IMPORT RELIEF CASES UNDER THE TRADE ACT OF 1974. </heading>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tIII/stA/pt2/s311/a" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><chapeau style="-uslm-dtd:text">If, in any investigation initiated under chapter 1 of title II of the Trade Act of 1974, the International Trade Commission makes an affirmative determination (or a determination which the President may treat as an affirmative determination under such chapter by reason of section 330(d) of the Tariff Act of 1930), the International Trade Commission shall also find (and report to the President at the time such injury determination is submitted to the President) whether—</chapeau>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIII/stA/pt2/s311/a/1" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">imports of the article from a NAFTA country, considered individually, account for a substantial share of total imports; and</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIII/stA/pt2/s311/a/2" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">imports of the article from a NAFTA country, considered individually or, in exceptional circumstances, imports from NAFTA countries considered collectively, contribute importantly to the serious injury, or threat thereof, caused by imports.</content>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tIII/stA/pt2/s311/b" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Factors.—</heading>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIII/stA/pt2/s311/b/1" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Substantial import share.—</heading><content style="-uslm-dtd:text">In determining whether imports from a NAFTA country, considered individually, account for a substantial share of total imports, such imports normally shall not be considered to account for a substantial share of total imports if that country is not among the top 5 suppliers of the article subject to the investigation, measured in terms of import share during the most recent 3-year period.</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIII/stA/pt2/s311/b/2" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Application of “<quotedText style="-uslm-dtd:quote">contribute importantly</quotedText>” standard.—</heading><content style="-uslm-dtd:text">In determining whether imports from a NAFTA country or countries contribute importantly to the serious injury, or threat thereof, the International Trade Commission shall consider such factors as the change in the import share of the NAFTA country or countries, and the level and change in the level of imports of such country or countries. In applying the preceding sentence, imports from a NAFTA country or countries normally shall not be considered to contribute importantly to serious injury, or the threat thereof, if the growth rate of imports from such country or countries during the period in which an injurious increase in imports occurred is appreciably lower than the growth rate of total imports from all sources over the same period.</content>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tIII/stA/pt2/s311/c" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Definition.—</heading><content style="-uslm-dtd:text">For purposes of this section and section 312(a), the term “<quotedText style="-uslm-dtd:quote">contribute importantly</quotedText>” refers to an important cause, but not necessarily the most important cause.</content>
                        </subsection>
                    </section>
                    <section style="-uslm-dtd:section" identifier="/us/sComp/103/182/tIII/stA/pt2/s312" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="312">SEC. 312. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t19/s3372">19 U.S.C. 3372</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">PRESIDENTIAL ACTION REGARDING NAFTA IMPORTS. </heading>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tIII/stA/pt2/s312/a" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><chapeau style="-uslm-dtd:text">In determining whether to take action under chapter 1 of title II of the Trade Act of 1974 with respect to imports from a NAFTA country, the President shall determine whether—</chapeau>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIII/stA/pt2/s312/a/1" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">imports from such country, considered individually, account for a substantial share of total imports; or</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIII/stA/pt2/s312/a/2" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">imports from a NAFTA country, considered individually, or in exceptional circumstances imports from NAFTA countries considered collectively, contribute importantly to the serious injury, or threat thereof, found by the International Trade Commission.</content>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tIII/stA/pt2/s312/b" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Exclusion of NAFTA Imports.—</heading><content style="-uslm-dtd:text">In determining the nature and extent of action to be taken under chapter 1 of title II of the Trade Act of 1974, the President shall exclude from such action imports from a NAFTA country if the President makes a negative determination under subsection (a) (1) or (2) with respect to imports from such country.</content>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tIII/stA/pt2/s312/c" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Action After Exclusion of NAFTA Country Imports.—</heading>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIII/stA/pt2/s312/c/1" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general </heading><chapeau style="-uslm-dtd:text">If the President, under subsection (b), excludes imports from a NAFTA country or countries from action under chapter 1 of title II of the Trade Act of 1974 but thereafter determines that a surge in imports from that country or countries is undermining the effectiveness of the action—</chapeau>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tIII/stA/pt2/s312/c/1/A" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the President may take appropriate action under such chapter 1 to include those imports in the action; and</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tIII/stA/pt2/s312/c/1/B" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">any entity that is representative of an industry for which such action is being taken may request the International Trade Commission to conduct an investigation of the surge in such imports.</content>
                                </subparagraph>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIII/stA/pt2/s312/c/2" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Investigation.—</heading><content style="-uslm-dtd:text">Upon receiving a request under paragraph (1)(B), the International Trade Commission shall conduct an investigation to determine whether a surge in such imports undermines the effectiveness of the action. The International Trade Commission shall submit the findings of its investigation to the President no later than 30 days after the request is received by the International Trade Commission.(3) Definition.—For purposes of this subsection, the term “<quotedText style="-uslm-dtd:quote">surge</quotedText>” means a significant increase in imports over the trend for a recent representative base period.</content>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tIII/stA/pt2/s312/d" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Condition Applicable to Quantitative Restrictions.—</heading><content style="-uslm-dtd:text">Any action taken under this section proclaiming a quantitative restriction shall permit the importation of a quantity or value of the article which is not less than the quantity or value of such article imported into the United States during the most recent period that is representative of imports of such article, with allowance for reasonable growth.

                <num style="-uslm-dtd:enum" value="D">Subtitle D—</num><heading style="-uslm-dtd:header">Temporary Entry of Business Persons </heading>
                <section style="-uslm-dtd:section" identifier="/us/sComp/103/182/tIII/stD/s341" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="341">SEC. 341. </num><heading style="-uslm-dtd:header">TEMPORARY ENTRY. </heading>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tIII/stD/s341/a" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Nonimmigrant Traders and Investors.—</heading><content style="-uslm-dtd:text">Upon a basis of reciprocity secured by the Agreement, an alien who is a citizen of Canada or Mexico, and the spouse and children of any such alien if accompanying or following to join such alien, may, if otherwise eligible for a visa and if otherwise admissible into the United States under the Immigration and Nationality Act (8 U.S.C. 1101 et seq.), be considered to be classifiable as a nonimmigrant under section 101(a)(15)(E) of such Act (8 U.S.C. 1101(a)(15)(E)) if entering solely for a purpose specified in Section B of Annex 1603 of the Agreement, but only if any such purpose shall have been specified in such Annex on the date of entry into force of the Agreement. For purposes of this section, the term “<quotedText style="-uslm-dtd:quote">citizen of Mexico</quotedText>” means “<quotedText style="-uslm-dtd:quote">citizen</quotedText>” as defined in Annex 1608 of the Agreement.

                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tIV/stA/s402/a" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Criteria for Selection of Individuals to Serve on Panels and Committees.—</heading>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s402/a/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">The selection of individuals under this section for—</chapeau>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tIV/stA/s402/a/1/A" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">placement on lists prepared by the interagency group under subsection (c)(2)(B) (i) and (ii);</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tIV/stA/s402/a/1/B" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">placement on preliminary candidate lists under subsection (c)(3)(A);</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tIV/stA/s402/a/1/C" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">placement on final candidate lists under subsection (c)(4)(A);</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tIV/stA/s402/a/1/D" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">placement by the Trade Representative on the rosters described in paragraph 1 of Annex 1901.2 and paragraph 1 of Annex 1904.13; and</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tIV/stA/s402/a/1/E" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">appointment by the Trade Representative for service on the panels and committees convened under chapter 19; shall be made on the basis of the criteria provided in paragraph 1 of Annex 1901.2 and paragraph 1 of Annex 1904.13 and shall be made without regard to political affiliation.</content>
                            </subparagraph>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s402/a/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Additional criteria for roster placements and appointments under paragraph 1 of annex 1901.2.—</heading><content style="-uslm-dtd:text">Rosters described in paragraph 1 of Annex 1901.2 shall include, to the fullest extent practicable, judges and former judges who meet the criteria referred to in paragraph (1). The Trade Representative shall, subject to subsection (b), appoint judges to binational panels convened under chapter 19, extraordinary challenge committees convened under chapter 19, and special committees established under article 1905, where such judges offer and are available to serve and such service is authorized by the chief judge of the court on which they sit.</content>
                        </paragraph>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tIV/stA/s402/b" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Selection of Certain Judges to Serve on Panels and Committees.—</heading>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s402/b/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Applicability.—</heading><content style="-uslm-dtd:text">This subsection applies only with respect to the selection of individuals for binational panels convened under chapter 19, extraordinary challenge committees convened under chapter 19, and special committees established under article 1905, who are judges of courts created under article III of the Constitution of the United States.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s402/b/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Consultation with chief judges.—</heading><content style="-uslm-dtd:text">The Trade Representative shall consult, from time to time, with the chief judges of the Federal judicial circuits regarding the interest in, and availability for, participation in binational panels, extraordinary challenge committees, and special committees, of judges within their respective circuits. If the chief judge of a Federal judicial circuit determines that it is appropriate for one or more judges within that circuit to be included on a roster described in subsection (a)(1)(D), the chief judge shall identify all such judges for the Chief Justice of the United States who may, upon his or her approval, submit the names of such judges to the Trade Representative. The Trade Representative shall include the names of such judges on the roster.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s402/b/3" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Submission of lists to congress.—</heading><content style="-uslm-dtd:text">The Trade Representative shall submit to the Committee on the Judiciary and the Committee on Ways and Means of the House of Representatives and to the Committee on Finance and the Committee on the Judiciary of the Senate a list of all judges included on a roster under paragraph (2). Such list shall be submitted at the same time as the final candidate lists are submitted under subsection (c)(4)(A) and the final forms of amendments are submitted under subsection (c)(4)(C)(iv).</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s402/b/4" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Appointment of judges to panels or committees.—</heading><content style="-uslm-dtd:text">At such time as the Trade Representative proposes to appoint a judge described in paragraph (1) to a binational panel, an extraordinary challenge committee, or a special committee, the Trade Representative shall consult with that judge in order to ascertain whether the judge is available for such appointment.</content>
                        </paragraph>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tIV/stA/s402/c" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Selection of Other Candidates.—</heading>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s402/c/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Applicability.—</heading><content style="-uslm-dtd:text">This subsection applies only with respect to the selection of individuals for binational panels convened under chapter 19, extraordinary challenge committees convened under chapter 19, and special committees established under article 1905, other than those individuals to whom subsection (b) applies.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s402/c/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Interagency group.—</heading>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tIV/stA/s402/c/2/A" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Establishment.—</heading><chapeau style="-uslm-dtd:text">There is established within the interagency organization established under section 242 of the Trade Expansion Act of 1962 (19 U.S.C. 1872) an interagency group which shall—</chapeau>
                                <clause style="-uslm-dtd:clause" identifier="/us/sComp/103/182/tIV/stA/s402/c/2/A/i" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">be chaired by the Trade Representative; and</content>
                                </clause>
                                <clause style="-uslm-dtd:clause" identifier="/us/sComp/103/182/tIV/stA/s402/c/2/A/ii" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">consist of such officers (or the designees thereof) of the United States Government as the Trade Representative considers appropriate.</content>
                                </clause>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tIV/stA/s402/c/2/B" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Functions.—</heading><chapeau style="-uslm-dtd:text">The interagency group established under subparagraph (A) shall, in a manner consistent with chapter 19—</chapeau>
                                <clause style="-uslm-dtd:clause" identifier="/us/sComp/103/182/tIV/stA/s402/c/2/B/i" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="i">(i) </num><chapeau style="-uslm-dtd:text">prepare by January 3 of each calendar year—</chapeau>
                                    <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/103/182/tIV/stA/s402/c/2/B/i/I" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">a list of individuals who are qualified to serve as members of binational panels convened under chapter 19; and</content>
                                    </subclause>
                                    <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/103/182/tIV/stA/s402/c/2/B/i/II" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">a list of individuals who are qualified to serve on extraordinary challenge committees convened under chapter 19 and special committees established under article 1905;</content>
                                    </subclause>
                                </clause>
                                <clause style="-uslm-dtd:clause" identifier="/us/sComp/103/182/tIV/stA/s402/c/2/B/ii" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">if the Trade Representative makes a request under paragraph (4)(C)(i) with respect to a final candidate list during any calendar year, prepare by July 1 of such calendar year a list of those individuals who are qualified to be added to that final candidate list;</content>
                                </clause>
                                <clause style="-uslm-dtd:clause" identifier="/us/sComp/103/182/tIV/stA/s402/c/2/B/iii" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">exercise oversight of the administration of the United States Section that is authorized to be established under section 105; and</content>
                                </clause>
                                <clause style="-uslm-dtd:clause" identifier="/us/sComp/103/182/tIV/stA/s402/c/2/B/iv" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">make recommendations to the Trade Representative regarding the convening of extraordinary challenge committees and special committees under chapter 19.</content>
                                </clause>
                            </subparagraph>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s402/c/3" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Preliminary candidate lists.—</heading>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tIV/stA/s402/c/3/A" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">The Trade Representative shall select individuals from the respective lists prepared by the interagency group under paragraph (2)(B)(i) for placement on—</chapeau>
                                <clause style="-uslm-dtd:clause" identifier="/us/sComp/103/182/tIV/stA/s402/c/3/A/i" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">a preliminary candidate list of individuals eligible to serve as members of binational panels under Annex 1901.2; and</content>
                                </clause>
                                <clause style="-uslm-dtd:clause" identifier="/us/sComp/103/182/tIV/stA/s402/c/3/A/ii" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">a preliminary candidate list of individuals eligible for selection as members of extraordinary challenge committees under Annex 1904.13 and special committees under article 1905.</content>
                                </clause>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tIV/stA/s402/c/3/B" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Submission of lists to congressional committees.—</heading>
                                <clause style="-uslm-dtd:clause" identifier="/us/sComp/103/182/tIV/stA/s402/c/3/B/i" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">No later than January 3 of each calendar year, the Trade Representative shall submit to the Committee on Finance of the Senate and the Committee on Ways and Means of the House of Representatives (hereafter in this section referred to as the “<quotedText style="-uslm-dtd:quote">appropriate Congressional Committees</quotedText>”) the preliminary candidate lists of those individuals selected by the Trade Representative under subparagraph (A) to be candidates eligible to serve on panels or committees convened pursuant to chapter 19 during the 1-year period beginning on April 1 of such calendar year.</content>
                                </clause>
                                <clause style="-uslm-dtd:clause" identifier="/us/sComp/103/182/tIV/stA/s402/c/3/B/ii" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="ii">(ii) </num><heading style="-uslm-dtd:header">Additional information.—</heading><content style="-uslm-dtd:text">At the time the candidate lists are submitted under clause (i), the Trade Representative shall submit for each individual on the list a statement of professional qualifications.</content>
                                </clause>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tIV/stA/s402/c/3/C" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Consultation.—</heading><content style="-uslm-dtd:text">Upon submission of the preliminary candidate lists under subparagraph (B) to the appropriate Congressional Committees, the Trade Representative shall consult with such Committees with regard to the individuals included on the preliminary candidate lists.</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tIV/stA/s402/c/3/D" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="D">(D) </num><heading style="-uslm-dtd:header">Revision of lists.—</heading><content style="-uslm-dtd:text">The Trade Representative may add and delete individuals from the preliminary candidate lists submitted under subparagraph (B) after consultation with the appropriate Congressional Committees regarding the additions and deletions. The Trade Representative shall provide to the appropriate Congressional Committees written notice of any addition or deletion of an individual from the preliminary candidate lists, along with the information described in subparagraph (B)(ii) with respect to any proposed addition.</content>
                            </subparagraph>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s402/c/4" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Final candidate lists.—</heading>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tIV/stA/s402/c/4/A" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Submission of lists to congressional committees.—</heading><content style="-uslm-dtd:text">No later than March 31 of each calendar year, the Trade Representative shall submit to the appropriate Congressional Committees the final candidate lists of those individuals selected by the Trade Representative to be candidates eligible to serve on panels and committees convened under chapter 19 during the 1-year period beginning on April 1 of such calendar year. An individual may be included on a final candidate list only if such individual was included in the preliminary candidate list or if written notice of the addition of such individual to the preliminary candidate list was submitted to the appropriate Congressional Committees at least 15 days before the date on which that final candidate list is submitted to such Committees under this subparagraph.</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tIV/stA/s402/c/4/B" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Finality of lists.—</heading><content style="-uslm-dtd:text">Except as provided in subparagraph (C), no additions may be made to the final candidate lists after the final candidate lists are submitted to the appropriate Congressional Committees under subparagraph (A).</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tIV/stA/s402/c/4/C" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Amendment of lists.—</heading>
                                <clause style="-uslm-dtd:clause" identifier="/us/sComp/103/182/tIV/stA/s402/c/4/C/i" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">If, after the Trade Representative has submitted the final candidate lists to the appropriate Congressional Committees under subparagraph (A) for a calendar year and before July 1 of such calendar year, the Trade Representative determines that additional individuals need to be added to a final candidate list, the Trade Representative shall—</chapeau>
                                    <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/103/182/tIV/stA/s402/c/4/C/i/I" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">request the interagency group established under paragraph (2)(A) to prepare a list of individuals who are qualified to be added to such candidate list;</content>
                                    </subclause>
                                    <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/103/182/tIV/stA/s402/c/4/C/i/II" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">select individuals from the list prepared by the interagency group under paragraph (2)(B)(ii) to be included in a proposed amendment to such final candidate list; and</content>
                                    </subclause>
                                    <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/103/182/tIV/stA/s402/c/4/C/i/III" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="III">(III) </num><content style="-uslm-dtd:text">by no later than July 1 of such calendar year, submit to the appropriate Congressional Committees the proposed amendments to such final candidate list developed by the Trade Representative under subclause (II), along with the information described in paragraph (3)(B)(ii).</content>
                                    </subclause>
                                </clause>
                                <clause style="-uslm-dtd:clause" identifier="/us/sComp/103/182/tIV/stA/s402/c/4/C/ii" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="ii">(ii) </num><heading style="-uslm-dtd:header">Consultation with congressional committees.—</heading><content style="-uslm-dtd:text">Upon submission of a proposed amendment under clause (i)(III) to the appropriate Congressional Committees, the Trade Representative shall consult with the appropriate Congressional Committees with regard to the individuals included in the proposed amendment.</content>
                                </clause>
                                <clause style="-uslm-dtd:clause" identifier="/us/sComp/103/182/tIV/stA/s402/c/4/C/iii" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="iii">(iii) </num><heading style="-uslm-dtd:header">Adjustment of proposed amendment.—</heading><content style="-uslm-dtd:text">The Trade Representative may add and delete individuals from any proposed amendment submitted under clause (i)(III) after consulting with the appropriate Congressional Committees with regard to the additions and deletions. The Trade Representative shall provide to the appropriate Congressional Committees written notice of any addition or deletion of an individual from the proposed amendment.</content>
                                </clause>
                                <clause style="-uslm-dtd:clause" identifier="/us/sComp/103/182/tIV/stA/s402/c/4/C/iv" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="iv">(iv) </num><heading style="-uslm-dtd:header">Final amendment.—</heading>
                                    <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/103/182/tIV/stA/s402/c/4/C/iv/I" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="I">(I) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">If the Trade Representative submits under clause (i)(III) in any calendar year a proposed amendment to a final candidate list, the Trade Representative shall, no later than September 30 of such calendar year, submit to the appropriate Congressional Committees the final form of such amendment. On October 1 of such calendar year, such amendment shall take effect and, subject to subclause (II), the individuals included in the final form of such amendment shall be added to the final candidate list.</content>
                                    </subclause>
                                    <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/103/182/tIV/stA/s402/c/4/C/iv/II" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="II">(II) </num><heading style="-uslm-dtd:header">Inclusion of individuals.—</heading><content style="-uslm-dtd:text">An individual may be included in the final form of an amendment submitted under subclause (I) only if such individual was included in the proposed form of such amendment or if written notice of the addition of such individual to the proposed form of such amendment was submitted to the appropriate Congressional Committees at least 15 days before the date on which the final form of such amendment is submitted to such Committees under subclause (I).</content>
                                    </subclause>
                                    <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/103/182/tIV/stA/s402/c/4/C/iv/III" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="III">(III) </num><heading style="-uslm-dtd:header">Eligibility for service.—</heading><content style="-uslm-dtd:text">Individuals added to a final candidate list under subclause (I) shall be eligible to serve on panels or committees convened under chapter 19 during the 6-month period beginning on October 1 of the calendar year in which such addition occurs.</content>
                                    </subclause>
                                    <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/103/182/tIV/stA/s402/c/4/C/iv/IV" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="IV">(IV) </num><heading style="-uslm-dtd:header">Finality of amendment.—</heading><content style="-uslm-dtd:text">No additions may be made to the final form of an amendment described in subclause (I) after the final form of such amendment is submitted to the appropriate Congressional Committees under subclause (I).</content>
                                    </subclause>
                                </clause>
                            </subparagraph>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s402/c/5" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">Treatment of responses.—</heading><content style="-uslm-dtd:text">For purposes of applying section 1001 of title 18, United States Code, the written or oral responses of individuals to inquiries of the interagency group established under paragraph (2)(A) or of the Trade Representative regarding their personal and professional qualifications, and financial and other relevant interests, that bear on their suitability for the placements and appointments described in subsection (a)(1), shall be treated as matters within the jurisdiction of an agency of the United States.</content>
                        </paragraph>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tIV/stA/s402/d" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Selection and Appointment.—</heading>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s402/d/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Authority of trade representative.—</heading><chapeau style="-uslm-dtd:text">The Trade Representative is the only officer of the United States Government authorized to act on behalf of the United States Government in making any selection or appointment of an individual to—</chapeau>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tIV/stA/s402/d/1/A" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the rosters described in paragraph 1 of Annex 1901.2 and paragraph 1 of Annex 1904.13; or</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tIV/stA/s402/d/1/B" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the panels or committees convened under chapter 19; that is to be made solely or jointly by the United States Government under the terms of the Agreement.</content>
                            </subparagraph>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s402/d/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Restrictions on selection and appointment.—</heading><chapeau style="-uslm-dtd:text">Except as provided in paragraph (3)—</chapeau>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tIV/stA/s402/d/2/A" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><chapeau style="-uslm-dtd:text">the Trade Representative may—</chapeau>
                                <clause style="-uslm-dtd:clause" identifier="/us/sComp/103/182/tIV/stA/s402/d/2/A/i" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">select an individual for placement on the rosters described in paragraph 1 of Annex 1901.2 and paragraph 1 of Annex 1904.13 during the 1-year period beginning on April 1 of any calendar year;</content>
                                </clause>
                                <clause style="-uslm-dtd:clause" identifier="/us/sComp/103/182/tIV/stA/s402/d/2/A/ii" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">appoint an individual to serve as one of those members of any panel or committee convened under chapter 19 during such 1-year period who, under the terms of the Agreement, are to be appointed solely by the United States Government; or</content>
                                </clause>
                                <clause style="-uslm-dtd:clause" identifier="/us/sComp/103/182/tIV/stA/s402/d/2/A/iii" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">act to make a joint appointment with the Government of a NAFTA country, under the terms of the Agreement, of any individual who is a citizen or national of the United States to serve as any other member of such a panel or committee; only if such individual is on the appropriate final candidate list that was submitted to the appropriate Congressional Committees under subsection (c)(4)(A) during such calendar year or on such list as it may be amended under subsection (c)(4)(C)(iv)(I), or on the list submitted under subsection (b)(3) to the Congressional Committees referred to in such subsection; and</content>
                                </clause>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tIV/stA/s402/d/2/B" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">no individual may—</chapeau>
                                <clause style="-uslm-dtd:clause" identifier="/us/sComp/103/182/tIV/stA/s402/d/2/B/i" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">be selected by the United States Government for placement on the rosters described in paragraph 1 of Annex 1901.2 and paragraph 1 of Annex 1904.13; or</content>
                                </clause>
                                <clause style="-uslm-dtd:clause" identifier="/us/sComp/103/182/tIV/stA/s402/d/2/B/ii" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">be appointed solely or jointly by the United States Government to serve as a member of a panel or committee convened under chapter 19; during the 1-year period beginning on April 1 of any calendar year for which the Trade Representative has not met the requirements of subsection (a), and of subsection (b) or (c) (as the case may be).</content>
                                </clause>
                            </subparagraph>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s402/d/3" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Exceptions.—</heading><chapeau style="-uslm-dtd:text">Notwithstanding subsection (c)(3) (other than subparagraph (B)), subsection (c)(4), or paragraph (2)(A) of this subsection, individuals included on the preliminary candidate lists submitted to the appropriate Congressional Committees under subsection (c)(3)(B) may—</chapeau>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tIV/stA/s402/d/3/A" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">be selected by the Trade Representative for placement on the rosters described in paragraph 1 of Annex 1901.2 and paragraph 1 of Annex 1904.13 during the 3-month period beginning on the date on which the Agreement enters into force with respect to the United States; and</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tIV/stA/s402/d/3/B" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">be appointed solely or jointly by the Trade Representative under the terms of the Agreement to serve as members of panels or committees that are convened under chapter 19 during such 3-month period.</content>
                            </subparagraph>
                        </paragraph>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tIV/stA/s402/e" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Transition.—</heading><chapeau style="-uslm-dtd:text">If the Agreement enters into force between the United States and a NAFTA country after January 3, 1994, the provisions of subsection (c) shall be applied with respect to the calendar year in which such entering into force occurs—</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s402/e/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">by substituting “<quotedText style="-uslm-dtd:quote">the date that is 30 days after the date on which the Agreement enters into force with respect to the United States</quotedText>” for “<quotedText style="-uslm-dtd:quote">January 3 of each calendar year</quotedText>” in subsections (c)(2)(B)(i) and (c)(3)(B)(i); and</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s402/e/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">by substituting “<quotedText style="-uslm-dtd:quote">the date that is 3 months after the date on which the Agreement enters into force with respect to the United States</quotedText>” for “<quotedText style="-uslm-dtd:quote">March 31 of each calendar year</quotedText>” in subsection (c)(4)(A).</content>
                        </paragraph>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tIV/stA/s402/f" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Immunity.—</heading><content style="-uslm-dtd:text">With the exception of acts described in section 777(f)(3) of the Tariff Act of 1930 (19 U.S.C. 1677f(f)(3)), individuals serving on panels or committees convened pursuant to chapter 19, and individuals designated to assist the individuals serving on such panels or committees, shall be immune from suit and legal process relating to acts performed by such individuals in their official capacity and within the scope of their functions as such panelists or committee members or assistants to such panelists or committee members.</content>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tIV/stA/s402/g" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Regulations.—</heading><content style="-uslm-dtd:text">The administering authority under title VII of the Tariff Act of 1930, the International Trade Commission, and the Trade Representative may promulgate such regulations as are necessary or appropriate to carry out actions in order to implement their respective responsibilities under chapter 19. Initial regulations to carry out such functions shall be issued before the date on which the Agreement enters into force with respect to the United States.</content>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tIV/stA/s402/h" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="h">(h) </num><heading style="-uslm-dtd:header">Report to Congress.—</heading><content style="-uslm-dtd:text">At such time as the final candidate lists are submitted under subsection (c)(4)(A) and the final forms of amendments are submitted under subsection (c)(4)(C)(iv), the Trade Representative shall submit to the Committee on the Judiciary and the Committee on Ways and Means of the House of Representatives, and to the Committee on Finance and the Committee on the Judiciary of the Senate, a report regarding the efforts made to secure the participation of judges and former judges on binational panels, extraordinary challenge committees, and special committees established under chapter 19.</content>
                    </subsection>
                </section>
                <section style="-uslm-dtd:section" identifier="/us/sComp/103/182/tIV/stA/s403" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="403">SEC. 403. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t19/s3433">19 U.S.C. 3433</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">TESTIMONY AND PRODUCTION OF PAPERS IN EXTRAORDINARY CHALLENGES. </heading>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tIV/stA/s403/a" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Authority of Extraordinary Challenge Committee to Obtain Information.—</heading><chapeau style="-uslm-dtd:text">If an extraordinary challenge committee (hereafter in this section referred to as the “<quotedText style="-uslm-dtd:quote">committee</quotedText>”) is convened under paragraph 13 of article 1904, and the allegations before the committee include a matter referred to in paragraph 13(a)(i) of article 1904, for the purposes of carrying out its functions and duties under Annex 1904.13, the committee—</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s403/a/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">shall have access to, and the right to copy, any document, paper, or record pertinent to the subject matter under consideration, in the possession of any individual, partnership, corporation, association, organization, or other entity;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s403/a/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">may summon witnesses, take testimony, and administer oaths;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s403/a/3" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">may require any individual, partnership, corporation, association, organization, or other entity to produce documents, books, or records relating to the matter in question; and</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s403/a/4" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">may require any individual, partnership, corporation, association, organization, or other entity to furnish in writing, in such detail and in such form as the committee may prescribe, information in its possession pertaining to the matter.</content>
                        </paragraph><continuation style="-uslm-dtd:continuation-text" role="subsection">Any member of the committee may sign subpoenas, and members of the committee, when authorized by the committee, may administer oaths and affirmations, examine witnesses, take testimony, and receive evidence.</continuation>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tIV/stA/s403/b" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Witnesses and Evidence.—</heading><content style="-uslm-dtd:text">The attendance of witnesses who are authorized to be summoned, and the production of documentary evidence authorized to be ordered, under subsection (a) may be required from any place in the United States at any designated place of hearing. In the case of disobedience to a subpoena authorized under subsection (a), the committee may request the Attorney General of the United States to invoke the aid of any district or territorial court of the United States in requiring the attendance and testimony of witnesses and the production of documentary evidence. Such court, within the jurisdiction of which such inquiry is carried on, may, in case of contumacy or refusal to obey a subpoena issued to any individual, partnership, corporation, association, organization, or other entity, issue an order requiring such individual or entity to appear before the committee, or to produce documentary evidence if so ordered or to give evidence concerning the matter in question. Any failure to obey such order of the court may be punished by such court as a contempt thereof.</content>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tIV/stA/s403/c" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Mandamus.—</heading><content style="-uslm-dtd:text">Any court referred to in subsection (b) shall have jurisdiction to issue writs of mandamus commanding compliance with the provisions of this section or any order of the committee made in pursuance thereof.</content>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tIV/stA/s403/d" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Depositions.—</heading><content style="-uslm-dtd:text">The committee may order testimony to be taken by deposition at any stage of the committee review. Such deposition may be taken before any person designated by the committee and having power to administer oaths. Such testimony shall be reduced to writing by the person taking the deposition, or under the direction of such person, and shall then be subscribed by the deponent. Any individual, partnership, corporation, association, organization, or other entity may be compelled to appear and be deposed and to produce documentary evidence in the same manner as witnesses may be compelled to appear and testify and produce documentary evidence before the committee, as provided in this section.</content>
                    </subsection>
                </section>
                <section style="-uslm-dtd:section" identifier="/us/sComp/103/182/tIV/stA/s404" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="404">SEC. 404. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t19/s3434">19 U.S.C. 3434</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">REQUESTS FOR REVIEW OF DETERMINATIONS BY COMPETENT INVESTIGATING AUTHORITIES OF NAFTA COUNTRIES. </heading>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tIV/stA/s404/a" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Definitions.—</heading><chapeau style="-uslm-dtd:text">As used in this section:</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s404/a/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Competent investigating authority.—</heading><content style="-uslm-dtd:text">The term “<quotedText style="-uslm-dtd:quote">competent investigating authority</quotedText>” means the competent investigating authority, as defined in article 1911, of a NAFTA country.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s404/a/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">United states secretary.—</heading><content style="-uslm-dtd:text">The term “<quotedText style="-uslm-dtd:quote">United States Secretary</quotedText>” means that officer of the United States referred to in article 1908.</content>
                        </paragraph>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tIV/stA/s404/b" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Requests for Review by the United States.—</heading><content style="-uslm-dtd:text">In the case of a final determination of a competent investigating authority, requests by the United States for binational panel review of such determination under article 1904 shall be made by the United States Secretary.</content>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tIV/stA/s404/c" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Requests for Review by a Person.—</heading><content style="-uslm-dtd:text">In the case of a final determination of a competent investigating authority, a person, within the meaning of paragraph 5 of article 1904, may request a binational panel review of such determination by filing such a request with the United States Secretary within the time limit provided for in paragraph 4 of article 1904. The receipt of such request by the United States Secretary shall be deemed to be a request for binational panel review within the meaning of article 1904. The request for such panel review shall be without prejudice to any challenge before a binational panel of the basis for a particular request for review.</content>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tIV/stA/s404/d" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Service of Request for Review.—</heading><content style="-uslm-dtd:text">Whenever binational panel review of a final determination made by a competent investigating authority is requested under this section, the United States Secretary shall serve a copy of the request on all persons who would otherwise be entitled under the law of the importing country to commence proceedings for judicial review of the determination.</content>
                    </subsection>
                </section>
                <section style="-uslm-dtd:section" identifier="/us/sComp/103/182/tIV/stA/s405" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="405">SEC. 405. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t19/s3435">19 U.S.C. 3435</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">RULES OF PROCEDURE FOR PANELS AND COMMITTEES. </heading>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tIV/stA/s405/a" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Rules of Procedure for Binational Panels.—</heading><chapeau style="-uslm-dtd:text">The administering authority shall prescribe rules, negotiated in accordance with paragraph 14 of article 1904, governing, with respect to binational panel reviews—</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s405/a/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">requests for such reviews, complaints, other pleadings, and other papers;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s405/a/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the amendment, filing, and service of such pleadings and papers;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s405/a/3" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">the joinder, suspension, and termination of such reviews; and</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s405/a/4" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">other appropriate procedural matters.</content>
                        </paragraph>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tIV/stA/s405/b" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Rules of Procedure for Extraordinary Challenge Committees.—</heading><content style="-uslm-dtd:text">The administering authority shall prescribe rules, negotiated in accordance with paragraph 2 of Annex 1904.13, governing the procedures for reviews by extraordinary challenge committees.</content>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tIV/stA/s405/c" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Rules of Procedure for Safeguarding the Panel Review System.—</heading><content style="-uslm-dtd:text">The administering authority shall prescribe rules, negotiated in accordance with Annex 1905.6, governing the procedures for special committees described in such Annex.</content>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tIV/stA/s405/d" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Publication of Rules.—</heading><content style="-uslm-dtd:text">The rules prescribed under subsections (a), (b), and (c) shall be published in the Federal Register.</content>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tIV/stA/s405/e" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Administering Authority.—</heading><content style="-uslm-dtd:text">As used in this section, the term “<quotedText style="-uslm-dtd:quote">administering authority</quotedText>” has the meaning given such term in section 771(1) of the Tariff Act of 1930 (19 U.S.C. 1677(1)).</content>
                    </subsection>
                </section>
                <section style="-uslm-dtd:section" identifier="/us/sComp/103/182/tIV/stA/s406" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="406">SEC. 406. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t19/s3436">19 U.S.C. 3436</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SUBSIDY NEGOTIATIONS. </heading>
                    <chapeau style="-uslm-dtd:text" class="block">In the case of any trade agreement which may be entered into by the President with a NAFTA country, the negotiating objectives of the United States with respect to subsidies shall include—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s406/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">achievement of increased discipline on domestic subsidies provided by a foreign government, including—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tIV/stA/s406/1/A" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the provision of capital, loans, or loan guarantees on terms inconsistent with commercial considerations;</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tIV/stA/s406/1/B" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the provision of goods or services at preferential rates;</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tIV/stA/s406/1/C" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">the granting of funds or forgiveness of debt to cover operating losses sustained by a specific industry; and</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tIV/stA/s406/1/D" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">the assumption of any costs or expenses of manufacture, production, or distribution;</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s406/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">achievement of increased discipline on export subsidies provided by a foreign government, particularly with respect to agricultural products; and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s406/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">maintenance of effective remedies against subsidized imports, including, where appropriate, countervailing duties.</content>
                    </paragraph>
                </section>
                <section style="-uslm-dtd:section" identifier="/us/sComp/103/182/tIV/stA/s407" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="407">SEC. 407. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t19/s3437">19 U.S.C. 3437</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">IDENTIFICATION OF INDUSTRIES FACING SUBSIDIZED IMPORTS. </heading>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tIV/stA/s407/a" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Petitions.—</heading><chapeau style="-uslm-dtd:text">Any entity, including a trade association, firm, certified or recognized union, or group of workers, that is representative of a United States industry and has reason to believe—</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s407/a/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">that—</chapeau>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tIV/stA/s407/a/1/A" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">as a result of implementation of provisions of the Agreement, the industry is likely to face increased competition from subsidized imports, from a NAFTA country, with which it directly competes; or</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tIV/stA/s407/a/1/B" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the industry is likely to face increased competition from subsidized imports with which it directly competes from any other country designated by the President, following consultations with the Congress, as benefiting from a reduction of tariffs or other trade barriers under a trade agreement that enters into force with respect to the United States after January 1, 1994; and</content>
                            </subparagraph>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s407/a/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">that the industry is likely to experience a deterioration of its competitive position before more effective rules and disciplines relating to the use of government subsidies have been developed with respect to the country concerned;</content>
                        </paragraph><continuation style="-uslm-dtd:continuation-text" role="subsection">may file with the Trade Representative a petition that such industry be identified under this section.</continuation>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tIV/stA/s407/b" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Identification of Industry.—</heading><content style="-uslm-dtd:text">Within 90 days after receipt of a petition under subsection (a), the Trade Representative, in consultation with the Secretary of Commerce, shall decide whether to identify the industry on the basis that there is a reasonable likelihood that the industry may face both the subsidization described in subsection (a)(1) and the deterioration described in subsection (a)(2).</content>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tIV/stA/s407/c" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Action After Identification.—</heading><chapeau style="-uslm-dtd:text">At the request of an entity that is representative of an industry identified under subsection (b), the Trade Representative shall—</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s407/c/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">compile and make available to the industry information under section 308 of the Trade Act of 1974;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s407/c/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">recommend to the President that an investigation by the International Trade Commission be requested under section 332 of the Tariff Act of 1930; or</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s407/c/3" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">take actions described in both paragraphs (1) and (2).</content>
                        </paragraph><continuation style="-uslm-dtd:continuation-text" role="subsection">The industry may request the Trade Representative to take appropriate action to update (as often as annually) any information obtained under paragraph (1) or (2), or both, as the case may be, until an agreement on more effective rules and disciplines relating to government subsidies is reached between the United States and the NAFTA countries.</continuation>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tIV/stA/s407/d" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Initiation of Action Under Other Law.—</heading>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s407/d/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general </heading><chapeau style="-uslm-dtd:text">The Trade Representative and the Secretary of Commerce shall review information obtained under subsection (c) and consult with the industry identified under subsection (b) with a view to deciding whether any action is appropriate—</chapeau>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tIV/stA/s407/d/1/A" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">under section 301 of the Trade Act of 1974, including the initiation of an investigation under section 302(c) of that Act (in the case of the Trade Representative); or</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tIV/stA/s407/d/1/B" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">under subtitle A of title VII of the Tariff Act of 1930, including the initiation of an investigation under section 702(a) of that Act (in the case of the Secretary of Commerce).</content>
                            </subparagraph>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s407/d/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Criteria for initiation.—</heading><chapeau style="-uslm-dtd:text">In determining whether to initiate any investigation under section 301 of the Trade Act of 1974 or any other trade law, other than title VII of the Tariff Act of 1930, the Trade Representative, after consultation with the Secretary of Commerce—</chapeau>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tIV/stA/s407/d/2/A" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">shall seek the advice of the advisory committees established under section 135 of the Trade Act of 1974;</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tIV/stA/s407/d/2/B" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">shall consult with the Committee on Finance of the Senate and the Committee on Ways and Means of the House of Representatives;</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tIV/stA/s407/d/2/C" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">shall coordinate with the interagency organization established under section 242 of the Trade Expansion Act of 1962; and</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tIV/stA/s407/d/2/D" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">may ask the President to request advice from the International Trade Commission.</content>
                            </subparagraph>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s407/d/3" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Title iii actions.—</heading><content style="-uslm-dtd:text">In the event an investigation is initiated under section 302(c) of the Trade Act of 1974 as a result of a review under this subsection and the Trade Representative, following such investigation (including any applicable dispute settlement proceedings under the Agreement or any other trade agreement), determines to take action under section 301(a) of such Act, the Trade Representative shall give preference to actions that most directly affect the products that benefit from governmental subsidies and were the subject of the investigation, unless there are no significant imports of such products or the Trade Representative otherwise determines that application of the action to other products would be more effective.</content>
                        </paragraph>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tIV/stA/s407/e" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Effect of Decisions.—</heading><chapeau style="-uslm-dtd:text">Any decision, whether positive or negative, or any action by the Trade Representative or the Secretary of Commerce under this section shall not in any way—</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s407/e/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">prejudice the right of any industry to file a petition under any trade law;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s407/e/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">prejudice, affect, or substitute for, any proceeding, investigation, determination, or action by the Secretary of Commerce, the International Trade Commission, or the Trade Representative pursuant to such a petition; or</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s407/e/3" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">prejudice, affect, substitute for, or obviate any proceeding, investigation, or determination under section 301 of the Trade Act of 1974, title VII of the Tariff Act of 1930, or any other trade law.</content>
                        </paragraph>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tIV/stA/s407/f" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Standing.—</heading><content style="-uslm-dtd:text">Nothing in this section may be construed to alter in any manner the requirements in effect before the date of the enactment of this Act for standing under any law of the United States or to add any additional requirements for standing under any law of the United States.</content>
                    </subsection>
                </section>
                <section style="-uslm-dtd:section" identifier="/us/sComp/103/182/tIV/stA/s408" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="408">SEC. 408. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t19/s3438">19 U.S.C. 3438</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">TREATMENT OF AMENDMENTS TO ANTIDUMPING AND COUNTERVAILING DUTY LAW. </heading>
                    <chapeau style="-uslm-dtd:text" class="block">Any amendment enacted after the Agreement enters into force with respect to the United States that is made to—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tIV/stA/s408/1" styleType="OLC">

                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tV/stD/pt2/s541/a" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Acceptance of Membership.—</heading><content style="-uslm-dtd:text">The President is hereby authorized to accept membership for the United States in the North American Development Bank (hereafter in this part referred to as the “<quotedText style="-uslm-dtd:quote">Bank</quotedText>”) provided for in Chapter II of the Border Environment Cooperation Agreement (hereafter in this part referred to as the “<quotedText style="-uslm-dtd:quote">Cooperation Agreement</quotedText>”).</content>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tV/stD/pt2/s541/b" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Subscription of Stock.—</heading>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tV/stD/pt2/s541/b/1" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Subscription authority.—</heading>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tV/stD/pt2/s541/b/1/A" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Secretary of the Treasury may subscribe on behalf of the United States up to 150,000 shares of the capital stock of the Bank.</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tV/stD/pt2/s541/b/1/B" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Effectiveness of subscription.—</heading><content style="-uslm-dtd:text">Except as provided in paragraph (3), any such subscription shall be effective only to such extent or in such amounts as are provided in advance in appropriations Acts.</content>
                                </subparagraph>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tV/stD/pt2/s541/b/2" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Limitations on authorization of appropriations.—</heading><content style="-uslm-dtd:text">For payment by the Secretary of the Treasury of the subscription of the United States for shares described in paragraph (1), there are authorized to be appropriated $1,500,000,000 ($225,000,000 of which may be used for paid-in capital and $1,275,000,000 of which may be used for callable capital) without fiscal year limitation.</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tV/stD/pt2/s541/b/3" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Funding; limitation on callable capital subscriptions.—</heading>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tV/stD/pt2/s541/b/3/A" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Funding.—</heading><content style="-uslm-dtd:text">For fiscal year 1995, the Secretary of the Treasury shall pay to the Bank out of any sums in the Treasury not otherwise appropriated the sum of $56,250,000 for the paid-in portion of the United States share of the capital stock of the Bank, 10 percent of which may be transferred by the Bank to the President pursuant to section 543 to pay for the cost of direct and guaranteed Federal loans.</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tV/stD/pt2/s541/b/3/B" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Limitation on callable capital subscriptions.—</heading><content style="-uslm-dtd:text">For fiscal year 1995, the Secretary of the Treasury shall subscribe to the callable capital portion of the United States share of the capital stock of the Bank in an amount not to exceed $318,750,000.</content>
                                </subparagraph>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tV/stD/pt2/s541/b/4" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Disposition of net income distributed by the facility.—</heading><content style="-uslm-dtd:text">Any payment made to the United States by the Bank as a distribution of net income shall be covered into the Treasury as a miscellaneous receipt.</content>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tV/stD/pt2/s541/c" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Compensation of Board Members.—</heading><content style="-uslm-dtd:text">No person shall be entitled to receive any salary or other compensation from the Bank or the United States for services as a Board member.</content>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tV/stD/pt2/s541/d" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Applicability of Bretton Woods Agreements Act.—</heading><content style="-uslm-dtd:text">The provisions of section 4 of the Bretton Woods Agreements Act shall apply with respect to the Bank to the same extent as with respect to the International Bank for Reconstruction and Development and the International Monetary Fund.</content>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tV/stD/pt2/s541/e" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Restrictions.—</heading><chapeau style="-uslm-dtd:text">Unless authorized by law, neither the President nor any person or agency shall, on behalf of the United States—</chapeau>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tV/stD/pt2/s541/e/1" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">subscribe to additional shares of stock of the Bank;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tV/stD/pt2/s541/e/2" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">vote for or agree to any amendment of the Cooperation Agreement which increases the obligations of the United States, or which changes the purpose or functions of the Bank; or</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tV/stD/pt2/s541/e/3" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">make a loan or provide other financing to the Bank.</content>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tV/stD/pt2/s541/f" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Federal Reserve Banks as Depositories.—</heading><content style="-uslm-dtd:text">Any Federal Reserve bank that is requested to do so by the Bank shall act as its depository or as its fiscal agent, and the Board of Governors of the Federal Reserve System shall supervise and direct the carrying out of these functions by the Federal Reserve banks.</content>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tV/stD/pt2/s541/g" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Jurisdiction of United States Courts and Enforcement of Arbitral Awards.—</heading><content style="-uslm-dtd:text">For the purpose of any civil action which may be brought within the United States, its territories or possessions, or the Commonwealth of Puerto Rico, by or against the Bank in accordance with the Cooperation Agreement, including an action brought to enforce an arbitral award against the Bank, the Bank shall be deemed to be an inhabitant of the Federal judicial district in which its principal office within the United States or its agency appointed for the purpose of accepting service or notice of service is located, and any such action to which the Bank shall be a party shall be deemed to arise under the laws of the United States, and the district courts of the United States, including the courts enumerated in section 460 of title 28, United States Code, shall have original jurisdiction of any such action. When the Bank is a defendant in any action in a State court, it may at any time before trial remove the action into the appropriate district court of the United States by following the procedure for removal provided in section 1446 of title 28, United States Code.</content>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tV/stD/pt2/s541/h" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="h">(h) </num><heading style="-uslm-dtd:header">Exemption from Securities Laws for Certain Securities Issued by the Bank; Reports Required.—</heading>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tV/stD/pt2/s541/h/1" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Exemptions from limitations and restrictions on the power of national banking associations to deal in and underwrite investment securities of the bank.—</heading><content style="-uslm-dtd:text">The seventh sentence of the seventh undesignated paragraph of section 5136 of the Revised Statutes of the United States (12 U.S.C. 24), is amended by inserting “<quotedText style="-uslm-dtd:quote">the North American Development Bank,</quotedText>” after “<quotedText style="-uslm-dtd:quote">Inter-American Development Bank,</quotedText>”.</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tV/stD/pt2/s541/h/2" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Exemption from securities laws for certain securities issued by the bank; reports required.—</heading><content style="-uslm-dtd:text">Any securities issued by the Bank (including any guarantee by the Bank, whether or not limited in scope) in connection with the raising of funds for inclusion in the Bank’s capital resources as defined in Section 4 of Article II of Chapter II of the Cooperation Agreement, and any securities guaranteed by the Bank as to both the principal and interest to which the commitment in Section 3(d) of Article II of Chapter II of the Cooperation Agreement is expressly applicable, shall be deemed to be exempted securities within the meaning of section 3(a)(2) of the Securities Act of 1933 (15 U.S.C. 77c), and section 3(a)(12) of the Securities Exchange Act of 1934 (15 U.S.C. 78c). The Bank shall file with the Securities and Exchange Commission such annual and other reports with regard to such securities as the Commission shall determine to be appropriate in view of the special character of the Bank and its operations and necessary in the public interest or for the protection of investors.</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tV/stD/pt2/s541/h/3" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Authority of securities and exchange commission to suspend exemption; reports to the congress.—</heading><content style="-uslm-dtd:text">The Securities and Exchange Commission, acting in consultation with the National Advisory Council on International Monetary and Financial Problems, is authorized to suspend the provisions of paragraph (2) at any time as to any or all securities issued or guaranteed by the Bank during the period of such suspension. The Commission shall include in its annual reports to Congress such information as it shall deem advisable with regard to the operations and effect of this subsection and in connection therewith shall include any views submitted for such purpose by any association of dealers registered with the Commission.</content>
                            </paragraph>
                        </subsection>
                    </section>
                    <section style="-uslm-dtd:section" identifier="/us/sComp/103/182/tV/stD/pt2/s542" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="542">SEC. 542. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t22/s290m–1">22 U.S.C. 290m–1</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">STATUS, IMMUNITIES, AND PRIVILEGES. </heading>
                        <content style="-uslm-dtd:text" class="block">Article VIII of Chapter II of the Cooperation Agreement shall have full force and effect in the United States, its territories and possessions, and the Commonwealth of Puerto Rico, upon entry into force of the Cooperation Agreement.</content>
                    </section>
                    <section style="-uslm-dtd:section" identifier="/us/sComp/103/182/tV/stD/pt2/s543" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="543">SEC. 543. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t22/s290m–2">22 U.S.C. 290m–2</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">COMMUNITY ADJUSTMENT AND INVESTMENT PROGRAM. </heading>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tV/stD/pt2/s543/a" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">The President.—</heading><paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tV/stD/pt2/s543/a/1" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">The President may enter into an agreement with the Bank that facilitates implementation by the President of a program for community adjustment and investment in support of the Agreement pursuant to chapter II of the Cooperation Agreement (hereafter in this section referred to as the “<quotedText style="-uslm-dtd:quote">community adjustment and investment program</quotedText>”).</content></paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tV/stD/pt2/s543/a/2" styleType="OLC" class="leftIndentDecrease1">
                                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">The President may receive from the Bank 10 percent of the paid-in capital actually paid to the Bank by the United States for the President to carry out, without further appropriations, through Federal agencies and their loan and loan guarantee programs, the community adjustment and investment program, pursuant to an agreement between the President and the Bank.</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tV/stD/pt2/s543/a/3" styleType="OLC" class="leftIndentDecrease1">
                                <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">The President may select one or more Federal agencies that make loans or guarantee the repayment of loans to assist in carrying out the community adjustment and investment program, and may transfer the funds received from the Bank to such agency or agencies for the purpose of assisting in carrying out the community adjustment and investment program.</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tV/stD/pt2/s543/a/4" styleType="OLC" class="leftIndentDecrease1">
                                <num style="-uslm-dtd:enum" value="4">(4)</num><subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tV/stD/pt2/s543/a/4/A" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">Each Federal agency selected by the President to assist in carrying out the community adjustment and investment program shall use the funds transferred to it by the President from the Bank to pay for the costs of direct and guaranteed loans, as defined in section 502 of the Congressional Budget Act of 1974, and, as appropriate, other costs associated with such loans, all subject to the restrictions and limitations that apply to such agency’s existing loan or loan guarantee program.</content></subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tV/stD/pt2/s543/a/4/B" styleType="OLC" class="leftIndentDecrease2">
                                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">Funds transferred to an agency under subparagraph (A) shall be in addition to the amount of funds authorized in any appropriations Act to be expended by that agency for its loan or loan guarantee program.</content>
                                </subparagraph>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tV/stD/pt2/s543/a/5" styleType="OLC" class="leftIndentDecrease1">
                                <num style="-uslm-dtd:enum" value="5">(5) </num><chapeau style="-uslm-dtd:text">The President shall—</chapeau>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tV/stD/pt2/s543/a/5/A" styleType="OLC" class="leftIndentDecrease1">
                                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">establish guidelines for the loans and loan guarantees to be made under the community adjustment and investment program;</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tV/stD/pt2/s543/a/5/B" styleType="OLC" class="leftIndentDecrease1">
                                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">endorse the grants made by the Bank for the community adjustment and investment program, as provided in Article I, section 1(b), and Article III, section 11(a), of Chapter II of the Cooperation Agreement; and</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tV/stD/pt2/s543/a/5/C" styleType="OLC" class="leftIndentDecrease1">
                                    <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">endorse any loans or guarantees made by the Bank for the community adjustment and investment program, as provided in Article I, section 1(b), and Article III, section 6 (a) and (c) of Chapter II of the Cooperation Agreement.</content>
                                </subparagraph>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tV/stD/pt2/s543/b" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Advisory Committee.—</heading>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tV/stD/pt2/s543/b/1" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Establishment.—</heading><content style="-uslm-dtd:text">The President shall establish an advisory committee to be known as the Community Adjustment and Investment Program Advisory Committee (in this section referred to as the “<quotedText style="-uslm-dtd:quote">Advisory Committee</quotedText>”) in accordance with the provisions of the Federal Advisory Committee Act.</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tV/stD/pt2/s543/b/2" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Membership.—</heading>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tV/stD/pt2/s543/b/2/A" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">The Advisory Committee shall consist of 9 members of the public, appointed by the President, who, collectively, represent—</chapeau>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/103/182/tV/stD/pt2/s543/b/2/A/i" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">community groups whose constituencies include low-income families;</content>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/103/182/tV/stD/pt2/s543/b/2/A/ii" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">any scientific, professional, business, nonprofit, or public interest organization or association which is neither affiliated with, nor under the direction of, a government;</content>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/103/182/tV/stD/pt2/s543/b/2/A/iii" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">for-profit business interests; and</content>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/103/182/tV/stD/pt2/s543/b/2/A/iv" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">other appropriate entities with relevant expertise.</content>
                                    </clause>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tV/stD/pt2/s543/b/2/B" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Representation.—</heading><content style="-uslm-dtd:text">Each of the categories described in clauses (i) through (iv) of subparagraph (A) shall be represented by no fewer than 1 and no more than 3 members of the Advisory Committee.</content>
                                </subparagraph>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tV/stD/pt2/s543/b/3" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Function.—</heading><chapeau style="-uslm-dtd:text">It shall be the function of the Advisory Committee—</chapeau>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tV/stD/pt2/s543/b/3/A" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">to provide advice to the President regarding the implementation of the community adjustment and investment program, including advice on the guidelines to be established by the President for the loans and loan guarantees to be made pursuant to subsection (a)(4), advice on identifying the needs for adjustment assistance and investment in support of the goals and objectives of the Agreement, taking into account economic and geographic considerations, and advice on such other matters as may be requested by the President; and</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tV/stD/pt2/s543/b/3/B" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">to review on a regular basis the operation of the community adjustment and investment program and provide the President with the conclusions of its review.</content>
                                </subparagraph>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tV/stD/pt2/s543/b/4" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Terms of members.—</heading>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tV/stD/pt2/s543/b/4/A" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Each member of the Advisory Committee shall serve at the pleasure of the President.</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tV/stD/pt2/s543/b/4/B" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Chairperson.—</heading><content style="-uslm-dtd:text">The President shall appoint a chairperson from among the members of the Advisory Committee.</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tV/stD/pt2/s543/b/4/C" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Meetings.—</heading><content style="-uslm-dtd:text">The Advisory Committee shall meet at least annually and at such other times as requested by the President or the chairperson. A majority of the members of the Advisory Committee shall constitute a quorum.</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tV/stD/pt2/s543/b/4/D" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="D">(D) </num><heading style="-uslm-dtd:header">Reimbursement for expenses.—</heading><content style="-uslm-dtd:text">The members of the Advisory Committee may receive reimbursement for travel, per diem, and other necessary expenses incurred in the performance of their duties, in accordance with the Federal Advisory Committee Act.</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tV/stD/pt2/s543/b/4/E" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="E">(E) </num><heading style="-uslm-dtd:header">Staff and facilities.—</heading><content style="-uslm-dtd:text">The Advisory Committee may utilize the facilities and services of employees of any Federal agency without cost to the Advisory Committee, and any such agency is authorized to provide services as requested by the Committee.</content>
                                </subparagraph>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tV/stD/pt2/s543/c" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Ombudsman.—</heading><chapeau style="-uslm-dtd:text">The President shall appoint an ombudsman to provide the public with an opportunity to participate in the carrying out of the community adjustment and investment program.</chapeau>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tV/stD/pt2/s543/c/1" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Function.—</heading><chapeau style="-uslm-dtd:text">It shall be the function of the ombudsman—</chapeau>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tV/stD/pt2/s543/c/1/A" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">to establish procedures for receiving comments from the general public on the operation of the community adjustment and investment program, to receive such comments, and to provide the President with summaries of the public comments; and</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tV/stD/pt2/s543/c/1/B" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">to perform an independent inspection and programmatic audit of the operation of the community adjustment and investment program and to provide the President with the conclusions of its investigation and audit.</content>
                                </subparagraph>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tV/stD/pt2/s543/c/2" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Authorization of appropriations.—</heading><content style="-uslm-dtd:text">There are authorized to be appropriated to the President, or such agency as the President may designate, $25,000 for fiscal year 1995 and for each fiscal year thereafter, for the costs of the ombudsman.</content>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tV/stD/pt2/s543/d" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Reporting Requirement.—</heading><content style="-uslm-dtd:text">The President shall submit to the appropriate congressional committees an annual report on the community adjustment and investment program (if any) that is carried out pursuant to this section. Each report shall state the amount of the loans made or guaranteed during the 12-month period ending on the day before the date of the report.</content>
                        </subsection>
                    </section>
                    <section style="-uslm-dtd:section" identifier="/us/sComp/103/182/tV/stD/pt2/s544" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="544">SEC. 544. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t22/s290m–3">22 U.S.C. 290m–3</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">DEFINITION. </heading>
                        <content style="-uslm-dtd:text" class="block">For purposes of this part, the term “<quotedText style="-uslm-dtd:quote">Border Environment Cooperation Agreement</quotedText>” (referred to in this part as the “<quotedText style="-uslm-dtd:quote">Cooperation Agreement</quotedText>”) means the November 1993 Agreement Between the Government of the United States of America and the Government of the United Mexican States Concerning the Establishment of a Border Environment Cooperation Commission and a North American Development Bank.</content>
                    </section>
                    <section style="-uslm-dtd:section" identifier="/us/sComp/103/182/tV/stD/pt2/s545" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="545">SEC. 545. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t22/s290m–4">22 U.S.C. 290m–4</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">AUTHORITY TO AGREE TO CERTAIN AMENDMENTS TO THE BORDER ENVIRONMENT COOPERATION AGREEMENT. </heading>
                        <chapeau style="-uslm-dtd:text" class="block">The President may agree to amendments to the Cooperation Agreement that—</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tV/stD/pt2/s545/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">enable the Bank to make grants and nonmarket rate loans out of its paid-in capital resources with the approval of its Board; and</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tV/stD/pt2/s545/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">amend the definition of “<quotedText style="-uslm-dtd:quote">border region</quotedText>” to include the area in the United States that is within 100 kilometers of the international boundary between the United States and Mexico, and the area in Mexico that is within 300 kilometers of the international boundary between the United States and Mexico.</content>
                        </paragraph>
                    </section>
                    <section style="-uslm-dtd:section" identifier="/us/sComp/103/182/tV/stD/pt2/s546" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="546">SEC. 546. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t22/s290m–5">22 U.S.C. 290m–5</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">GRANTS OUT OF PAID-IN CAPITAL RESOURCES </heading>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tV/stD/pt2/s546/a" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><chapeau style="-uslm-dtd:text">The President shall instruct the United States Federal Government representatives on the Board of Directors of the North American Development Bank to oppose any proposal where grants out of the Bank’s paid-in capital resources, except for grants from paid-in capital authorized for the community adjustment and investment program under the Bank’s charter of 1993, would—</chapeau>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tV/stD/pt2/s546/a/1" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">be made to a project that is not being financed, in part, by loans; or</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tV/stD/pt2/s546/a/2" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">account for more than 50 percent of the financing of any individual project.</content>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tV/stD/pt2/s546/b" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Exception.—</heading>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tV/stD/pt2/s546/b/1" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">General rule.—</heading><chapeau style="-uslm-dtd:text">The requirements of subsection (a) shall not apply in cases where—</chapeau>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tV/stD/pt2/s546/b/1/A" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the President determines there are exceptional economic circumstances for making the grant and consults with the Committee on Foreign Relations of the Senate and the Committee on Financial Services of the House of Representatives; or</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tV/stD/pt2/s546/b/1/B" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">(B)</num><clause style="-uslm-dtd:clause" identifier="/us/sComp/103/182/tV/stD/pt2/s546/b/1/B/i" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the grant is being made for a project that is so small that obtaining a loan is impractical; and</content></clause>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/103/182/tV/stD/pt2/s546/b/1/B/ii" styleType="OLC" class="leftIndentDecrease1">
                                        <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the grant does not exceed $250,000.</content>
                                    </clause>
                                </subparagraph>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tV/stD/pt2/s546/b/2" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Limitation.—</heading><content style="-uslm-dtd:text">Not more than an aggregate of $5,000,000 in grants may be made under this subsection.</content>
                            </paragraph>
                        </subsection>
                    </section>
                    <section style="-uslm-dtd:section" identifier="/us/sComp/103/182/tV/stD/pt2/s547" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="547">SEC. 547. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t19/s290m–7">19 U.S.C. 290m–7</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">FIRST CAPITAL INCREASE. </heading>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tV/stD/pt2/s547/a" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Subscription Authorized.—</heading>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tV/stD/pt2/s547/a/1" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Secretary of the Treasury is authorized to subscribe on behalf of the United States to, and make payment for, 150,000 additional shares of the capital stock of the Bank.</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tV/stD/pt2/s547/a/2" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Limitation.—</heading><content style="-uslm-dtd:text">Any subscription by the United States to the capital stock of the Bank shall be effective only to such extent and in such amounts as are provided in advance in appropriations Acts.</content>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/182/tV/stD/pt2/s547/b" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Limitations on Authorization of Appropriations.—</heading>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tV/stD/pt2/s547/b/1" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">In order to pay for the increase in the United States subscription to the Bank under subsection (a), there are authorized to be appropriated, without fiscal year limitation, $1,500,000,000 for payment by the Secretary of the Treasury.</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/182/tV/stD/pt2/s547/b/2" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Allocation of funds.—</heading><chapeau style="-uslm-dtd:text">Of the amount authorized to be appropriated under paragraph (1)—</chapeau>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tV/stD/pt2/s547/b/2/A" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">$225,000,000 shall be for paid in shares of the Bank; and</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/182/tV/stD/pt2/s547/b/2/B" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">$1,275,000,000 shall be for callable shares of the Bank.</content>
                                </subparagraph>
                            </paragraph>
