    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To amend title 17, United States Code, to implement the Marrakesh Treaty, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section style="-uslm-dtd:section" identifier="/us/sComp/115/261/s1" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t17/s101">17 U.S.C. 101 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading><content style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Marrakesh Treaty Implementation Act</shortTitle>”.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/115/261/s2" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">IMPLEMENTATION AMENDMENTS. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/261/s2/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><chapeau style="-uslm-dtd:text">Chapter 1 of title 17, United States Code, is amended—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/261/s2/a/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">in section 121—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/261/s2/a/1/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><chapeau style="-uslm-dtd:text">in subsection (a)—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/115/261/s2/a/1/A/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">by inserting “<quotedText style="-uslm-dtd:quote">in the United States</quotedText>” after  “<quotedText style="-uslm-dtd:quote">distribute</quotedText>”;</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/115/261/s2/a/1/A/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">, nondramatic</quotedText>”;</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/115/261/s2/a/1/A/iii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">by inserting “<quotedText style="-uslm-dtd:quote">or of a previously published musical work that has been fixed in the form of text or notation</quotedText>” after  “<quotedText style="-uslm-dtd:quote">literary work</quotedText>”;</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/115/261/s2/a/1/A/iv" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">specialized formats</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">accessible formats</quotedText>”; and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/115/261/s2/a/1/A/v" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="v">(v) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">blind or other persons with disabilities</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">eligible persons</quotedText>”;</content>
                        </clause>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/261/s2/a/1/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">in subsection (b)(1)—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/115/261/s2/a/1/B/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><chapeau style="-uslm-dtd:text">in subparagraph (A)—</chapeau>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/115/261/s2/a/1/B/i/I" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">by inserting “<quotedText style="-uslm-dtd:quote">in the United States</quotedText>” after  “<quotedText style="-uslm-dtd:quote">distributed</quotedText>”;</content>
                            </subclause>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/115/261/s2/a/1/B/i/II" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">a specialized format</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">an accessible format</quotedText>”; and</content>
                            </subclause>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/115/261/s2/a/1/B/i/III" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="III">(III) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">blind or other persons with disabilities</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">eligible persons</quotedText>”; and</content>
                            </subclause>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/115/261/s2/a/1/B/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">in subparagraph (B), by striking “<quotedText style="-uslm-dtd:quote">a specialized format</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">an accessible format</quotedText>”;</content>
                        </clause>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/261/s2/a/1/C" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">in subsection (c)(3), by striking “<quotedText style="-uslm-dtd:quote">specialized formats</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">accessible formats</quotedText>”; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/261/s2/a/1/D" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><chapeau style="-uslm-dtd:text">in subsection (d)—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/115/261/s2/a/1/D/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">by striking paragraphs (2) and (4);</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/115/261/s2/a/1/D/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">by redesignating paragraph (1) as paragraph (2);</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/115/261/s2/a/1/D/iii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">by redesignating paragraph (3) as paragraph (4);</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/115/261/s2/a/1/D/iv" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">by inserting before paragraph (2), as so redesignated, the following:<quotedContent style="-uslm-dtd:quoted-block">
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">“(1) </num><content style="-uslm-dtd:text">
‘<quotedText style="-uslm-dtd:quote">accessible format</quotedText>’ means an alternative manner or form that gives an eligible person access to the work when the copy or phonorecord in the accessible format is used exclusively by the eligible person to permit him or her to have access as feasibly and comfortably as a person without such disability as described in paragraph (3);”</content>
                            </paragraph></quotedContent>;</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/115/261/s2/a/1/D/v" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="v">(v) </num><content style="-uslm-dtd:text">by inserting after paragraph (2), as so redesignated, the following:<quotedContent style="-uslm-dtd:quoted-block">
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="3">“(3) </num><chapeau style="-uslm-dtd:text">
‘<quotedText style="-uslm-dtd:quote">eligible person</quotedText>’ means an individual who, regardless of any other disability—</chapeau>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">“(A) </num><content style="-uslm-dtd:text">is blind;</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">“(B) </num><content style="-uslm-dtd:text">has a visual impairment or perceptual or reading disability that cannot be improved to give visual function substantially equivalent to that of a person who has no such impairment or disability and so is unable to read printed works to substantially the same degree as a person without an impairment or disability; or</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="C">“(C) </num><content style="-uslm-dtd:text">is otherwise unable, through physical disability, to hold or manipulate a book or to focus or move the eyes to the extent that would be normally acceptable for reading; and”</content>
                                </subparagraph>
                            </paragraph></quotedContent>; and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/115/261/s2/a/1/D/vi" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="vi">(vi) </num><content style="-uslm-dtd:text">in paragraph (4), as so redesignated, by striking “<quotedText style="-uslm-dtd:quote">; and</quotedText>” at the end and inserting a period; and</content>
                        </clause>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/261/s2/a/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">by inserting after section 121 the following:<quotedContent style="-uslm-dtd:quoted-block">
                    <section style="-uslm-dtd:section" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="121A">“SEC. 121A. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t17/s121A">17 U.S.C. 121A</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Limitations on exclusive rights: reproduction for blind or other people with disabilities in Marrakesh Treaty countries </heading>
                        <subsection style="-uslm-dtd:subsection" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="a">“(a) </num><chapeau style="-uslm-dtd:text">Notwithstanding the provisions of sections 106 and 602, it is not an infringement of copyright for an authorized entity, acting pursuant to this section, to export copies or phonorecords of a previously published literary work or of a previously published musical work that has been fixed in the form of text or notation in accessible formats to another country when the exportation is made either to—</chapeau>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">“(1) </num><content style="-uslm-dtd:text">an authorized entity located in a country that is a Party to the Marrakesh Treaty; or</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">“(2) </num><content style="-uslm-dtd:text">an eligible person in a country that is a Party to the Marrakesh Treaty,</content>
                            </paragraph><continuation style="-uslm-dtd:continuation-text">if prior to the exportation of such copies or phonorecords, the authorized entity engaged in the exportation did not know or have reasonable grounds to know that the copies or phonorecords would be used other than by eligible persons.</continuation>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="b">“(b) </num><content style="-uslm-dtd:text">Notwithstanding the provisions of sections 106 and 602, it is not an infringement of copyright for an authorized entity or an eligible person, or someone acting on behalf of an eligible person, acting pursuant to this section, to import copies or phonorecords of a previously published literary work or of a previously published musical work that has been fixed in the form of text or notation in accessible formats.</content>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="c">“(c) </num><chapeau style="-uslm-dtd:text">In conducting activities under subsection (a) or (b), an authorized entity shall establish and follow its own practices, in keeping with its particular circumstances, to—</chapeau>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">“(1) </num><content style="-uslm-dtd:text">establish that the persons the authorized entity serves are eligible persons;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">“(2) </num><content style="-uslm-dtd:text">limit to eligible persons and authorized entities the distribution of accessible format copies by the authorized entity;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="3">“(3) </num><content style="-uslm-dtd:text">discourage the reproduction and distribution of unauthorized copies;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="4">“(4) </num><content style="-uslm-dtd:text">maintain due care in, and records of, the handling of copies of works by the authorized entity, while respecting the privacy of eligible persons on an equal basis with others; and</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="5">“(5) </num><chapeau style="-uslm-dtd:text">facilitate effective cross-border exchange of accessible format copies by making publicly available—</chapeau>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">“(A) </num><content style="-uslm-dtd:text">the titles of works for which the authorized entity has accessible format copies or phonorecords and the specific accessible formats in which they are available; and</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">“(B) </num><content style="-uslm-dtd:text">information on the policies, practices, and authorized entity partners of the authorized entity for the cross-border exchange of accessible format copies.</content>
                                </subparagraph>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="d">“(d) </num><chapeau style="-uslm-dtd:text">Nothing in this section shall be construed to establish—</chapeau>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">“(1) </num><content style="-uslm-dtd:text">a cause of action under this title; or</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">“(2) </num><content style="-uslm-dtd:text">a basis for regulation by any Federal agency.</content>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="e">“(e) </num><content style="-uslm-dtd:text">Nothing in this section shall be construed to limit the ability to engage in any activity otherwise permitted under this title.</content>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="f">“(f) </num><chapeau style="-uslm-dtd:text">For purposes of this section—</chapeau>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">“(1) </num><content style="-uslm-dtd:text">the terms ‘<quotedText style="-uslm-dtd:quote">accessible format</quotedText>’, ‘<quotedText style="-uslm-dtd:quote">authorized entity</quotedText>’, and ‘<quotedText style="-uslm-dtd:quote">eligible person</quotedText>’ have the meanings given those terms in section 121; and</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">“(2) </num><content style="-uslm-dtd:text">the term ‘<quotedText style="-uslm-dtd:quote">Marrakesh Treaty</quotedText>’ means the Marrakesh Treaty to Facilitate Access to Published Works by Visually Impaired Persons and Persons with Print Disabilities concluded at Marrakesh, Morocco, on June 28, 2013.”</content>
                            </paragraph>
                        </subsection>
                    </section></quotedContent>.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/261/s2/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t17/s101">17 U.S.C. 101</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Table of Sections Amendment.—</heading><content style="-uslm-dtd:text">The table of sections for chapter 1 of title 17, United States Code,is amended by inserting after the item relating to section 121 the following:<quotedContent style="-uslm-dtd:quoted-block">
