    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To amend the Zimbabwe Democracy and Economic Recovery Act of 2001.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section style="-uslm-dtd:section" identifier="/us/sComp/115/231/s1" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t22/s2151">22 U.S.C. 2151 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading><content style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Zimbabwe Democracy and Economic Recovery Amendment Act of 2018</shortTitle>”.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/115/231/s2" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t22/s2151">22 U.S.C. 2151 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">RECONSTRUCTION AND REBUILDING OF ZIMBABWE. </heading><content style="-uslm-dtd:text">Section 2 of the Zimbabwe Democracy and Economic Recovery Act of 2001 (22 U.S.C. 2151 note; Public Law 107-99) is amended by striking “<quotedText style="-uslm-dtd:quote">and restore the rule of law</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">restore the rule of law, reconstruct and rebuild Zimbabwe, and come to terms with the past through a process of genuine reconciliation that acknowledges past human rights abuses and orders inquiries into disappearances, including the disappearance of human rights activists, such as Patrick Nabanyama, Itai Dzamara, and Paul Chizuze</quotedText>”.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/115/231/s3" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t22/s2151">22 U.S.C. 2151 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">FINDINGS. </heading><chapeau style="-uslm-dtd:text">Section 4(a) of the Zimbabwe Democracy and Economic Recovery Act of 2001is amended—</chapeau>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/231/s3/1" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">in paragraph (1), by striking “<quotedText style="-uslm-dtd:quote">costly deployment of troops to the Democratic Republic of the Congo</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">private appropriation of public assets</quotedText>”; and</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/231/s3/2" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">by adding at the end the following:<quotedContent style="-uslm-dtd:quoted-block">
                <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="6">“(6) </num><content style="-uslm-dtd:text">In October 2016, the Government of Zimbabwe cleared a small hurdle in its longstanding public sector arrears with the IMF.”</content>
                </paragraph></quotedContent>.</content>
            </paragraph>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/115/231/s4" styleType="OLC">
            <num style="-uslm-dtd:enum" value="4">SEC. 4. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t22/s2151">22 U.S.C. 2151 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">PROVISIONS RELATED TO MULTILATERAL DEBT RELIEF AND OTHER FINANCIAL ASSISTANCE. </heading><chapeau style="-uslm-dtd:text">Section 4(b)(2) of the Zimbabwe Democracy and Economic Recovery Act of 2001is amended—</chapeau>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/231/s4/1" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">in subparagraph (A), by striking “<quotedText style="-uslm-dtd:quote">to propose that the bank should undertake a review of the feasibility of restructuring, rescheduling, or eliminating the sovereign debt of Zimbabwe held by that bank</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">to support efforts to reevaluate plans to restructure, rebuild, reschedule, or eliminate Zimbabwe’s sovereign debt held by that bank and provide an analysis based on reasonable financial options to achieve those goals</quotedText>”; and</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/231/s4/2" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">in subparagraph (B), by striking “<quotedText style="-uslm-dtd:quote">dollar</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">currency</quotedText>”.</content>
            </paragraph>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/115/231/s5" styleType="OLC">
            <num style="-uslm-dtd:enum" value="5">SEC. 5. </num><heading style="-uslm-dtd:header">SENSE OF CONGRESS ON THE UNITED STATES-ZIMBABWE BILATERAL RELATIONSHIP. </heading><chapeau style="-uslm-dtd:text">It is the sense of Congress that the United States should seek to forge a stronger bilateral relationship with Zimbabwe, including in the areas of trade and investment, if the following conditions are satisfied:</chapeau>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/231/s5/1" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">The Government of Zimbabwe takes the concrete, tangible steps outlined in paragraphs (1) through (4) of section 4(d) of the Zimbabwe Democracy and Economic Recovery Act of 2001, as amended by section 6 of this Act.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/231/s5/2" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">The Government of Zimbabwe takes concrete, tangible steps towards—</chapeau>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/231/s5/2/A" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">good governance, including respect for the opposition, rule of law, and human rights;</content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/231/s5/2/B" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">economic reforms that promote growth, address unemployment and underdevelopment, restore livelihoods, ensure respect for contracts and private property rights, and promote significant progress toward monetary policy reforms, particularly with the Reserve Bank of Zimbabwe, and currency exchange reforms; and</content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/231/s5/2/C" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">identification and recovery of stolen private and public assets within Zimbabwe and in other countries.</content>
                </subparagraph>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/231/s5/3" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><chapeau style="-uslm-dtd:text">The Government of Zimbabwe holds an election that is widely accepted as free and fair, based on the following pre- and post-election criteria or conditions:</chapeau>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/231/s5/3/A" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">Establishment and public release, without cost, of a provisional and a final voter registration roll.</content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/231/s5/3/B" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">The Zimbabwe Electoral Commission is permitted to entirely carry out the functions assigned to it under section 239 of Zimbabwe’s 2013 Constitution in an independent manner, and the chairperson meets and consults regularly with representatives of political parties represented in the parliament of Zimbabwe and the parties contesting the elections.</content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/231/s5/3/C" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="C">(C) </num><chapeau style="-uslm-dtd:text">Consistent with Zimbabwe’s 2013 Constitution, the Defence Forces of Zimbabwe—</chapeau>
                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/115/231/s5/3/C/i" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">are neither permitted to actively participate in campaigning for any candidate nor to intimidate voters;</content>
                    </clause>
                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/115/231/s5/3/C/ii" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">are required to verifiably and credibly uphold their constitutionally-mandated duty to respect the fundamental rights and freedoms of all persons and to be nonpartisan in character; and</content>
                    </clause>
                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/115/231/s5/3/C/iii" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">are not permitted to print, transfer, or control ballots or transmit the results of elections.</content>
                    </clause>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/231/s5/3/D" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="D">(D) </num><chapeau style="-uslm-dtd:text">International observers, including observers from the United States, the African Union, the Southern African Development Community, and the European Union—</chapeau>
                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/115/231/s5/3/D/i" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">are permitted to observe the entire electoral process prior to, on, and following voting day, including by monitoring polling stations and tabulation centers; and</content>
                    </clause>
                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/115/231/s5/3/D/ii" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">are able to independently access and analyze vote tallying tabulation and the transmission and content of voting results.</content>
                    </clause>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/231/s5/3/E" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">Candidates are allowed access to public broadcasting media during the election period, consistent with Zimbabwe’s Electoral Act and are able to campaign in an environment that is free from intimidation and violence.</content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/231/s5/3/F" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">Civil society organizations are able to freely and independently carry out voter and civic education and monitor the entire electoral process, including by observing, recording, and transmitting publicly-posted or announced voting results at the ward, constituency, and all higher levels of the vote tallying process.</content>
                </subparagraph>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/231/s5/4" styleType="OLC">
                <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">Laws enacted prior to the passage of Zimbabwe’s March 2013 Constitution that are inconsistent with the new Constitution are amended, repealed, or subjected to a formal process for review and correction so that such laws are consistent with the new Constitution.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/231/s5/5" styleType="OLC">
                <num style="-uslm-dtd:enum" value="5">(5) </num><chapeau style="-uslm-dtd:text">The Government of Zimbabwe—</chapeau>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/231/s5/5/A" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">has made significant progress on the implementation of all elements of the new Constitution; and</content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/231/s5/5/B" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">has demonstrated its commitment to sustain such efforts in achieving full implementation of the new Constitution.</content>
                </subparagraph>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/231/s5/6" styleType="OLC">
                <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">Traditional leaders of Zimbabwe observe section 281 of the 2013 Constitution and are not using humanitarian assistance provided by outside donor organizations or countries in a politicized manner to intimidate or pressure voters during the campaign period.</content>
            </paragraph>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/115/231/s6" styleType="OLC">
            <num style="-uslm-dtd:enum" value="6">SEC. 6. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t22/s2151">22 U.S.C. 2151 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">CERTIFICATION REQUIREMENTS. </heading><chapeau style="-uslm-dtd:text">Section 4(d) of the Zimbabwe Democracy and Economic Recovery Act of 2001is amended—</chapeau>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/231/s6/1" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">in paragraph (3), by striking “<quotedText style="-uslm-dtd:quote">consistent with</quotedText>” and all that follows through  “<quotedText style="-uslm-dtd:quote">September 1998</quotedText>”;</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/231/s6/2" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">by striking paragraph (4); and</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/231/s6/3" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">by redesignating paragraph (5) as paragraph (4).</content>
            </paragraph>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/115/231/s7" styleType="OLC">
            <num style="-uslm-dtd:enum" value="7">SEC. 7. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t22/s2151">22 U.S.C. 2151 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">REMOVAL OF AUTHORITY TO PAY LAND ACQUISITION COSTS. </heading><chapeau style="-uslm-dtd:text">Section 5(a) of the Zimbabwe Democracy and Economic Recovery Act of 2001is amended—</chapeau>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/231/s7/1" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">in paragraph (2), by striking “<quotedText style="-uslm-dtd:quote">, including the payment of costs</quotedText>” and all that follows through  “<quotedText style="-uslm-dtd:quote">thereto; and</quotedText>” and inserting a semicolon;</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/231/s7/2" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">in paragraph (3), by striking the period at the end and inserting “<quotedText style="-uslm-dtd:quote">; and</quotedText>”; and</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/231/s7/3" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">by adding at the end the following:<quotedContent style="-uslm-dtd:quoted-block">
                <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">“(4) </num><content style="-uslm-dtd:text">identify and recover stolen public assets.”</content>
                </paragraph></quotedContent>.</content>
            </paragraph>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/115/231/s8" styleType="OLC">
            <num style="-uslm-dtd:enum" value="8">SEC. 8. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t22/s2151">22 U.S.C. 2151 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">INCLUSION OF AUSTRALIA, THE UNITED KINGDOM, THE AFRICAN UNION, AND THE SOUTHERN AFRICAN DEVELOPMENT COMMUNITY IN CONSULTATIONS ABOUT ZIMBABWE. </heading><content style="-uslm-dtd:text">Section 6 of the Zimbabwe Democracy and Economic Recovery Act of 2001is amended by inserting “<quotedText style="-uslm-dtd:quote">Australia, the United Kingdom, the African Union, the Southern African Development Community,</quotedText>” after  “<quotedText style="-uslm-dtd:quote">Canada,</quotedText>”.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/115/231/s9" styleType="OLC">
            <num style="-uslm-dtd:enum" value="9">SEC. 9. </num><heading style="-uslm-dtd:header">SENSE OF CONGRESS ON ENFORCEMENT OF SOUTHERN AFRICAN DEVELOPMENT COMMUNITY TRIBUNAL RULINGS. </heading><content style="-uslm-dtd:text">It is the sense of Congress that the Government of Zimbabwe and the Southern African Development Community (referred to in this section as “SADC”) should enforce the SADC tribunal rulings issued between 2007 to 2010, including 18 disputes involving  employment, commercial, and human rights cases surrounding dispossessed Zimbabwean commercial farmers and agricultural companies.</content>
        </section>
