    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To establish a Federal Advisory Council to Support Grandparents Raising Grandchildren.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
</enactingFormula>
        <section style="-uslm-dtd:section" identifier="/us/sComp/115/196/s1" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content style="-uslm-dtd:text" class="block">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Supporting Grandparents Raising Grandchildren Act</shortTitle>”.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/115/196/s2" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">FINDINGS. </heading><chapeau style="-uslm-dtd:text">Congress finds the following:</chapeau>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/196/s2/1" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">More than 2,500,000 grandparents in the United States are the primary caretaker of their grandchildren, and experts report that such numbers are increasing as the opioid epidemic expands.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/196/s2/2" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">Between 2009 and 2016, the incidence of parental alcohol or other drug use as a contributing factor for children’s out-of-home placement rose from 25.4 to 37.4 percent.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/196/s2/3" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">When children cannot remain safely with their parents, placement with relatives is preferred over placement in foster care with nonrelatives because placement with relatives provides stability for children and helps them maintain family connections.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/196/s2/4" styleType="OLC">
                <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">The number of foster children placed with a grandparent or other relative increased from 24 percent in 2006 to 32 percent in 2016, according to data from the Department of Health and Human Services.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/196/s2/5" styleType="OLC">
                <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">Grandparents’ lives are enhanced by caring for their grandchildren; the overwhelming majority of grandparents report experiencing significant benefits in serving as their grandchildren’s primary caregivers.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/196/s2/6" styleType="OLC">
                <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">Providing full-time care to their grandchildren may decrease grandparents’ ability to address their own physical and mental health needs and personal well-being.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/196/s2/7" styleType="OLC">
                <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">Grandparents would benefit from better coordination and dissemination of information and resources available to support them in their caregiving responsibilities.</content>
            </paragraph>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/115/196/s3" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><heading style="-uslm-dtd:header">ADVISORY COUNCIL TO SUPPORT GRANDPARENTS RAISING GRANDCHILDREN. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/196/s3/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Establishment.—</heading><content style="-uslm-dtd:text">There is established an Advisory Council to Support Grandparents Raising Grandchildren.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/196/s3/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Membership.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/196/s3/b/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">The Advisory Council shall be composed of the following members, or their designee:</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/196/s3/b/1/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">The Secretary of Health and Human Services.</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/196/s3/b/1/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">The Secretary of Education.</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/196/s3/b/1/C" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">The Administrator of the Administration for Community Living.</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/196/s3/b/1/D" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">The Director of the Centers for Disease Control and Prevention.</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/196/s3/b/1/E" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">The Assistant Secretary for Mental Health and Substance Use.</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/196/s3/b/1/F" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">The Assistant Secretary for the Administration for Children and Families.</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/196/s3/b/1/G" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="G">(G) </num><content style="-uslm-dtd:text">A grandparent raising a grandchild.</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/196/s3/b/1/H" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="H">(H) </num><content style="-uslm-dtd:text">An older relative caregiver of children.</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/196/s3/b/1/I" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">As appropriate, the head of other Federal departments, or agencies, identified by the Secretary of Health and Human Services as having responsibilities, or administering programs, relating to current issues affecting grandparents or other older relatives raising children.</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/196/s3/b/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Lead agency.—</heading><content style="-uslm-dtd:text">The Department of Health and Human Services shall be the lead agency for the Advisory Council.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/196/s3/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Duties.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/196/s3/c/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/196/s3/c/1/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Information.—</heading><chapeau style="-uslm-dtd:text">The Advisory Council shall identify, promote, coordinate, and disseminate to the public information, resources, and the best practices available to help grandparents and other older relatives—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/115/196/s3/c/1/A/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">meet the health, educational, nutritional, and other needs of the children in their care; and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/115/196/s3/c/1/A/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">maintain their own physical and mental health and emotional well-being.</content>
                        </clause>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/196/s3/c/1/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Opioids.—</heading><content style="-uslm-dtd:text">In carrying out the duties described in subparagraph (A), the Advisory Council shall consider the needs of those affected by the opioid crisis.</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/196/s3/c/1/C" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Native americans.—</heading><content style="-uslm-dtd:text">In carrying out the duties described in subparagraph (A), the Advisory Council shall consider the needs of members of Native American tribes.</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/196/s3/c/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Report.—</heading>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/196/s3/c/2/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">Not later than 180 days after the date of enactment of this Act, the Advisory Council shall submit a report to—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/115/196/s3/c/2/A/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the appropriate committees;</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/115/196/s3/c/2/A/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the State agencies that are responsible for carrying out family caregiver programs; and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/115/196/s3/c/2/A/iii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">the public online in an accessible format.</content>
                        </clause>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/196/s3/c/2/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Report format.—</heading><chapeau style="-uslm-dtd:text">The report shall include—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/115/196/s3/c/2/B/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">best practices, resources, and other useful information for grandparents and other older relatives raising children identified under paragraph (1)(A) including, if applicable, any information related to the needs of children who have been impacted by the opioid epidemic;</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/115/196/s3/c/2/B/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">an identification of any gaps in items under clause (i); and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/115/196/s3/c/2/B/iii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">where applicable, identification of any additional Federal legislative authority necessary to implement the activities described in clause (i) and (ii).</content>
                        </clause>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/196/s3/c/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Follow-up report.—</heading><chapeau style="-uslm-dtd:text">Not later than 2 years after the date on which the report required under paragraph (2)(A) is submitted, the Advisory Council shall submit a follow-up report that includes the information identified in paragraph (2)(B) to—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/196/s3/c/3/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the appropriate committees;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/196/s3/c/3/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the State agencies that are responsible for carrying out family caregiver programs; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/196/s3/c/3/C" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">the public online in an accessible format.</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/196/s3/c/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Public input.—</heading>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/196/s3/c/4/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">The Advisory Council shall establish a process for public input to inform the development of, and provide updates to, the best practices, resources, and other information described in paragraph (1) that shall include—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/115/196/s3/c/4/A/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">outreach to States, local entities, and organizations that provide information to, or support for, grandparents or other older relatives raising children; and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/115/196/s3/c/4/A/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">outreach to grandparents and other older relatives with experience raising children.</content>
                        </clause>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/196/s3/c/4/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Nature of outreach.—</heading><chapeau style="-uslm-dtd:text">Such outreach shall ask individuals to provide input on—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/115/196/s3/c/4/B/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">information, resources, and best practices available, including identification of any gaps and unmet needs; and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/115/196/s3/c/4/B/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">recommendations that would help grandparents and other older relatives better meet the health, educational, nutritional, and other needs of the children in their care, as well as maintain their own physical and mental health and emotional well-being.</content>
                        </clause>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/196/s3/d" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">FACA.—</heading><content style="-uslm-dtd:text">The Advisory Council shall be exempt from the requirements of the Federal Advisory Committee Act (5 U.S.C. App.).</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/196/s3/e" styleType="OLC">
                <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Funding.—</heading><content style="-uslm-dtd:text">No additional funds are authorized to be appropriated to carry out this Act.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/196/s3/f" styleType="OLC">
                <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Sunset.—</heading><content style="-uslm-dtd:text">The Advisory Council shall terminate on the date that is 4 years after the date of enactment of this Act.</content>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/115/196/s4" styleType="OLC" role="definitions">
            <num style="-uslm-dtd:enum" value="4">SEC. 4. </num><heading style="-uslm-dtd:header">DEFINITIONS. </heading><chapeau style="-uslm-dtd:text">In this Act:</chapeau>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/196/s4/1" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Advisory council.—</heading><content style="-uslm-dtd:text">In this Act, the term “<term style="-uslm-dtd:quote">Advisory Council</term>” means the Advisory Council to Support Grandparents Raising Grandchildren that is established under section 3.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/196/s4/2" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Appropriate committees.—</heading><chapeau style="-uslm-dtd:text">In this Act, the term “<term style="-uslm-dtd:quote">appropriate committees</term>” means the following:</chapeau>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/196/s4/2/A" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">The Special Committee on Aging of the Senate.</content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/196/s4/2/B" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">The Committee on Health, Education, Labor, and Pensions of the Senate.</content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/196/s4/2/C" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">The Committee on Education and the Workforce of the House of Representatives.</content>
                </subparagraph>
