    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To provide for certain extensions with respect to the Medicaid program under title XIX of the Social Security Act, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/39/s1" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t42/s1305">42 U.S.C. 1305 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading><content style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Sustaining Excellence in Medicaid Act of 2019</shortTitle>”.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/39/s2" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">EXTENSION OF THE COMMUNITY MENTAL HEALTH SERVICES DEMONSTRATION PROGRAM. </heading><content style="-uslm-dtd:text">Section 223(d)(3) of the Protecting Access to Medicare Act of 2014 (42 U.S.C. 1396a note), as amended by Public Law 116-29, is amended by striking “<quotedText style="-uslm-dtd:quote">July 14, 2019</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">September 13, 2019</quotedText>”.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/39/s3" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><heading style="-uslm-dtd:header">EXTENSION OF PROTECTION FOR MEDICAID RECIPIENTS OF HOME AND COMMUNITY-BASED SERVICES AGAINST SPOUSAL IMPOVERISHMENT. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/39/s3/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">Section 2404 of Public Law 111-148 (42 U.S.C. 1396r-5 note) is amended by striking “<quotedText style="-uslm-dtd:quote">September 30, 2019</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">December 31, 2019</quotedText>”.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/116/39/s3/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t42/s1396a">42 U.S.C. 1396a note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Rule of Construction.—</heading><chapeau style="-uslm-dtd:text">Nothing in section 2404 of Public Law 111-148 (42 U.S.C. 1396r-5 note) or section 1902(a)(17) or 1924 of the Social Security Act (42 U.S.C. 1396a(a)(17), 1396r-5) shall be construed as prohibiting a State from applying an income or resource disregard under a methodology authorized under section 1902(r)(2) of such Act (42 U.S.C. 1396a(r)(2))—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/39/s3/b/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">to the income or resources of an individual described in section 1902(a)(10)(A)(ii)(VI) of such Act (42 U.S.C. 1396a(a)(10)(A)(ii)(VI)) (including a disregard of the income or resources of such individual’s spouse); or</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/39/s3/b/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">on the basis of an individual’s need for home and community-based services authorized under subsection (c), (d), (i), or (k) of section 1915 of such Act (42 U.S.C. 1396n) or under section 1115 of such Act (42 U.S.C. 1315).</content>
                </paragraph>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/39/s4" styleType="OLC">
            <num style="-uslm-dtd:enum" value="4">SEC. 4. </num><heading style="-uslm-dtd:header">EXTENSION OF MONEY FOLLOWS THE PERSON REBALANCING DEMONSTRATION. </heading><content style="-uslm-dtd:text">Section 6071(h)(1)(F) of the Deficit Reduction Act of 2005 (42 U.S.C. 1396a note) is amended by striking “<quotedText style="-uslm-dtd:quote">$132,000,000</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">$254,500,000</quotedText>”.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/39/s5" styleType="OLC">
            <num style="-uslm-dtd:enum" value="5">SEC. 5. </num><heading style="-uslm-dtd:header">EXTENSION FOR FAMILY-TO-FAMILY HEALTH INFORMATION CENTERS. </heading><chapeau style="-uslm-dtd:text">Section 501(c) of the Social Security Act (42 U.S.C. 701(c)) is amended—</chapeau>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/39/s5/1" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">in paragraph (1)(A)(vii), by striking “<quotedText style="-uslm-dtd:quote">and 2019</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">through 2024</quotedText>”; and</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/116/39/s5/2" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">in paragraph (3)(C), by striking “<quotedText style="-uslm-dtd:quote">fiscal years 2018 and 2019</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">fiscal year 2018 and each fiscal year thereafter</quotedText>”.</content>
            </paragraph>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/116/39/s6" styleType="OLC">
            <num style="-uslm-dtd:enum" value="6">SEC. 6. </num><heading style="-uslm-dtd:header">REDUCED WHOLESALE ACQUISITION COST (WAC)-BASED PAYMENTS FOR NEW DRUGS AND BIOLOGICALS. </heading><content style="-uslm-dtd:text">Section 1847A(c)(4) of the Social Security Act (42 U.S.C. 1395w-3a(c)(4)) is amended by striking “<quotedText style="-uslm-dtd:quote">payable under this section for the drug or biological based on—</quotedText>” and all that follows through the period at the end and inserting the following: <quotedContent style="-uslm-dtd:quoted-block"><chapeau style="-uslm-dtd:text">“payable under this section—</chapeau>
            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="A">“(A) </num><chapeau style="-uslm-dtd:text">in the case of a drug or biological furnished prior to January 1, 2019, based on—</chapeau>
                <clause style="-uslm-dtd:clause" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="i">“(i) </num><content style="-uslm-dtd:text">the wholesale acquisition cost; or</content>
                </clause>
                <clause style="-uslm-dtd:clause" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="ii">“(ii) </num><content style="-uslm-dtd:text">the methodologies in effect under this part on November 1, 2003, to determine payment amounts for drugs or biologicals; and</content>
                </clause>
            </subparagraph>
            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="B">“(B) </num><chapeau style="-uslm-dtd:text">in the case of a drug or biological furnished on or after January 1, 2019—</chapeau>
                <clause style="-uslm-dtd:clause" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="i">“(i) </num><content style="-uslm-dtd:text">at an amount not to exceed 103 percent of the wholesale acquisition cost; or</content>
                </clause>
                <clause style="-uslm-dtd:clause" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="ii">“(ii) </num><content style="-uslm-dtd:text">based on the methodologies in effect under this part on November 1, 2003, to determine payment amounts for drugs or biologicals.”</content>
