    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To help prevent acts of genocide and other atrocity crimes, which threaten national and international security, by enhancing United States Government capacities to prevent, mitigate, and respond to such crises.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
</enactingFormula>
        <section identifier="/us/sComp/115/441/s1" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t22/s2651">22 U.S.C. 2651 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading><content style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Elie Wiesel Genocide and Atrocities Prevention Act of 2018</shortTitle>”.</content>
        </section>
        <section identifier="/us/sComp/115/441/s2" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">SENSE OF CONGRESS. </heading><chapeau style="-uslm-dtd:text">It is the sense of Congress that the United States Government’s efforts at atrocity prevention and response through interagency coordination, such as the Atrocities Prevention Board (referred to in this Act as the “Board”) or successor entity are critically important, and that appropriate officials of the United States Government should—</chapeau>
            <paragraph identifier="/us/sComp/115/441/s2/1" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">meet regularly to monitor developments throughout the world that heighten the risk of atrocities;</content>
            </paragraph>
            <paragraph identifier="/us/sComp/115/441/s2/2" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">identify any gaps in United States foreign policy concerning regions or particular countries related to atrocity prevention and response;</content>
            </paragraph>
            <paragraph identifier="/us/sComp/115/441/s2/3" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">facilitate the development and implementation of policies to enhance the capacity of the United States to prevent and respond to atrocities worldwide;</content>
            </paragraph>
            <paragraph identifier="/us/sComp/115/441/s2/4" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">provide the President and Congress with recommendations to improve policies, programs, resources, and tools related to atrocity prevention and response;</content>
            </paragraph>
            <paragraph identifier="/us/sComp/115/441/s2/5" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">conduct outreach, including consultations, not less frequently than biannually, with representatives of nongovernmental organizations and civil society dedicated to atrocity prevention and response;</content>
            </paragraph>
            <paragraph identifier="/us/sComp/115/441/s2/6" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">operate with regular consultation and participation of designated interagency representatives of relevant Federal agencies, executive departments, or offices; and</content>
            </paragraph>
            <paragraph identifier="/us/sComp/115/441/s2/7" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">ensure resources are made available for the policies, programs, and tools related to atrocity prevention and response.</content>
            </paragraph>
        </section>
        <section identifier="/us/sComp/115/441/s3" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t22/s2656">22 U.S.C. 2656 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">STATEMENT OF POLICY. </heading><chapeau style="-uslm-dtd:text">It shall be the policy of the United States to—</chapeau>
            <paragraph identifier="/us/sComp/115/441/s3/1" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">regard the prevention of atrocities as in its national interest;</content>
            </paragraph>
            <paragraph identifier="/us/sComp/115/441/s3/2" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">work with partners and allies, including to build their capacity, and enhance the capacity of the United States, to 
identify, prevent, and respond to the causes of atrocities, including insecurity, mass displacement, violent conflict, and other conditions that may lead to such atrocities; and</content>
            </paragraph>
            <paragraph identifier="/us/sComp/115/441/s3/3" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><chapeau style="-uslm-dtd:text">pursue a United States Government-wide strategy to identify, prevent, and respond to the risk of atrocities by—</chapeau>
                <subparagraph identifier="/us/sComp/115/441/s3/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">strengthening the diplomatic, risk analysis and monitoring, strategic planning, early warning, and response capacities of the Government;</content>
                </subparagraph>
                <subparagraph identifier="/us/sComp/115/441/s3/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">improving the use of foreign assistance to respond early, effectively, and urgently in order to address the causes of atrocities;</content>
                </subparagraph>
                <subparagraph identifier="/us/sComp/115/441/s3/3/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">strengthening diplomatic response and the effective use of foreign assistance to support appropriate transitional justice measures, including criminal accountability, for past atrocities;</content>
                </subparagraph>
                <subparagraph identifier="/us/sComp/115/441/s3/3/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">supporting and strengthening local civil society, including human rights defenders and others working to help prevent and respond to atrocities;</content>
                </subparagraph>
                <subparagraph identifier="/us/sComp/115/441/s3/3/E" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">promoting financial transparency and enhancing anti-corruption initiatives as part of addressing causes of conditions that may lead to atrocities; and</content>
                </subparagraph>
                <subparagraph identifier="/us/sComp/115/441/s3/3/F" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="F">(F) </num><chapeau style="-uslm-dtd:text">employing a variety of unilateral, bilateral, and multilateral means to prevent and respond to atrocities by—</chapeau>
                    <clause identifier="/us/sComp/115/441/s3/3/F/i" style="-uslm-dtd:clause" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">placing a high priority on timely, preventive diplomatic efforts; and</content>
                    </clause>
                    <clause identifier="/us/sComp/115/441/s3/3/F/ii" style="-uslm-dtd:clause" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">exercising leadership in promoting international efforts to prevent atrocities.</content>
                    </clause>
                </subparagraph>
            </paragraph>
        </section>
        <section identifier="/us/sComp/115/441/s4" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="4">SEC. 4. </num><heading style="-uslm-dtd:header">TRAINING OF FOREIGN SERVICE OFFICERS IN CONFLICT AND ATROCITIES PREVENTION. </heading><chapeau style="-uslm-dtd:text">Section 708 of the Foreign Service Act of 1980 (22 U.S.C. 4028) is amended in subsection (a)(1)—</chapeau>
            <paragraph identifier="/us/sComp/115/441/s4/1" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">in subparagraph (B), by striking “<quotedText style="-uslm-dtd:quote">and</quotedText>” at the end;</content>
            </paragraph>
            <paragraph identifier="/us/sComp/115/441/s4/2" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">in subparagraph (C), by striking the period at the end and inserting “<quotedText style="-uslm-dtd:quote">; and</quotedText>”; and</content>
            </paragraph>
            <paragraph identifier="/us/sComp/115/441/s4/3" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">by adding at the end the following new subparagraph:<quotedContent style="-uslm-dtd:quoted-block">
                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="D">“(D) </num><content style="-uslm-dtd:text">for Foreign Service Officers who will be assigned to a country experiencing or at risk of mass atrocities, as determined by the Secretary of State, in consultation with the Director of National Intelligence and relevant civil society organizations, instruction on recognizing patterns of escalation and early warning signs of potential atrocities, and methods of preventing and responding to atrocities, including conflict assessment methods, peacebuilding, mediation for prevention, early action and response, and appropriate transitional justice measures to address atrocities.”</content>
                </subparagraph></quotedContent>.</content>
            </paragraph>
        </section>
        <section identifier="/us/sComp/115/441/s5" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="5">SEC. 5. </num><heading style="-uslm-dtd:header">REPORTS. </heading>
            <subsection identifier="/us/sComp/115/441/s5/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><chapeau style="-uslm-dtd:text">Not later than 180 days after the date of the enactment of this Act and annually thereafter for the following 12 years, the President shall transmit to the Committee on Foreign Affairs and the Committee on Appropriations of the House of Representatives and the Committee on Foreign Relations and the Committee on Appropriations of the Senate a report, with a classified annex if necessary, that includes—</chapeau>
                <paragraph identifier="/us/sComp/115/441/s5/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">a review, in consultation with appropriate interagency representatives, including the Board, consisting of a detailed description of—</chapeau>
                    <subparagraph identifier="/us/sComp/115/441/s5/a/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">current efforts to prevent and respond to atrocities, based on United States and locally identified indicators, including an analysis of capacities and constraints for interagency detection, early warning and response, information-sharing, contingency planning, and coordination;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/115/441/s5/a/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">recommendations to further strengthen United States capabilities described in subparagraph (A);</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/115/441/s5/a/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">funding expended by relevant Federal departments and agencies on atrocities prevention activities, including appropriate transitional justice measures and the legal, procedural, and resource constraints faced by the Department of State and the United States Agency for International Development throughout respective budgeting, strategic planning, and management cycles regarding support for atrocity prevention activities;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/115/441/s5/a/1/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">a global assessment of ongoing atrocities, including the findings of such assessment and, where relevant, the efficacy of any steps taken by the Board or relevant Federal agency to respond to such atrocities;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/115/441/s5/a/1/E" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">countries and regions at risk of atrocities, including a description of specific risk factors, at-risk groups, and likely scenarios in which atrocities would occur; and</content>
                    </subparagraph><editorialNote style="-uslm-dtd:legis-comment"><b>[</b>Note: The amendment made by paragraph (1) of section 1210D(c) of Public Law 116-283 shall take effect and apply beginning with the first report required under section 5 of the Elie Wiesel Genocide and Atrocities Prevention Act of 2018 after the date of the enactment [January 1, 2021] of this Act. Upon such date, subparagraph (E) is amended to read as follows:<b>]</b> </editorialNote>
                    <subparagraph identifier="/us/sComp/115/441/s5/a/1/E" inEffect="false" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">countries and regions at risk of atrocities, including covered foreign countries, and a description of specific risk factors, at risk groups, likely scenarios in which atrocities would occur, and efforts taken by the Board or relevant Federal agencies to prevent such atrocities; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/115/441/s5/a/1/F" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">the atrocities prevention training for Foreign Service officers authorized under subparagraph (D) of section 708(a)(1) of the Foreign Service Act of 1980, as added by section 4;</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/115/441/s5/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">recommendations to ensure shared responsibility by—</chapeau>
                    <subparagraph identifier="/us/sComp/115/441/s5/a/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">enhancing multilateral mechanisms for preventing atrocities, including strengthening the role of international organizations and international financial institutions in conflict prevention, mitigation, and response; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/115/441/s5/a/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">strengthening relevant regional organizations;</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/115/441/s5/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">the implementation status of the recommendations contained in the previous review required by this section; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/115/441/s5/a/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">identification of the Federal agencies and civil society, academic, and nongovernmental organizations and institutions consulted for preparation of such report.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/115/441/s5/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Consideration of Recommendations.—</heading><content style="-uslm-dtd:text">The preparation of the report required by subsection (a) shall include a consideration of analysis, reporting, and policy recommendations to prevent and respond to atrocities produced by civil society, academic, and other nongovernmental organizations and institutions.</content>
            </subsection>
            <subsection identifier="/us/sComp/115/441/s5/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Availability to Congress.—</heading><content style="-uslm-dtd:text">The report required by subsection (a) shall be made available to all members of Congress.</content>
            </subsection>
            <subsection identifier="/us/sComp/115/441/s5/d" inEffect="false" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d)<ref class="footnoteRef" idref="ID5CC5DB62935F4F25AB68D623491E13DC" style="-uslm-dtd:footnote-ref">1</ref> </num><heading style="-uslm-dtd:header">Covered Foreign Country Defined.—</heading><content style="-uslm-dtd:text">The term “<quotedText style="-uslm-dtd:quote">covered foreign country</quotedText>” means a foreign country that is not listed as a priority country under section 505 of the Global Fragility Act of 2019 (22 U.S.C. 9804) but remains among the top 30 most at risk countries for new onset of mass killing, according to the Department of State’s internal assessments, and in consultation with the Committee on Foreign Affairs and the Committee on Armed Services of the House of Representatives and the Committee on Foreign Relations and the Committee on Armed Services of the Senate.</content><footnote id="ID5CC5DB62935F4F25AB68D623491E13DC" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">1</sup><p style="-uslm-dtd:para; margin-left:1em">Section 1210D(c)(1)(B) of Public Law 116–283 inserts a new subsection (d) at the end of section 5.The amendment made by paragraph (1) of section 1210D(c) of Public Law 116-283 shall take effect and apply beginning with the first report required under section 5 of the Elie Wiesel Genocide and Atrocities Prevention Act of 2018 after the date of the enactment [January 1, 2021] of this Act.</p></footnote>
            </subsection>
        </section>
        <section identifier="/us/sComp/115/441/s6" role="definitions" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="6">SEC. 6. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t22/s2656">22 U.S.C. 2656 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">DEFINITIONS. </heading><chapeau style="-uslm-dtd:text">In this Act—</chapeau>
            <paragraph identifier="/us/sComp/115/441/s6/1" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:quote">genocide</term>” means an offense under subsection (a) of section 1091 of title 18, United States Code;</content>
            </paragraph>
            <paragraph identifier="/us/sComp/115/441/s6/2" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:quote">atrocities</term>” means war crimes, crimes against humanity, and genocide;</content>
            </paragraph>
            <paragraph identifier="/us/sComp/115/441/s6/3" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:quote">transitional justice</term>” means the range of judicial, nonjudicial, formal, informal, retributive, and restorative measures employed by countries transitioning out of armed 
conflict or repressive regimes to redress legacies of atrocities and to promote long-term, sustainable peace; and</content>
