    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To provide competitive grants for the operation, security, and maintenance of certain memorials to victims of the terrorist attacks of September 11, 2001.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section style="-uslm-dtd:section" identifier="/us/sComp/115/413/s1" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t54/s320301">54 U.S.C. 320301 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading><content style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">9/11 Memorial Act</shortTitle>”.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/115/413/s2" styleType="OLC" role="definitions">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">DEFINITIONS. </heading><chapeau style="-uslm-dtd:text">In this Act:</chapeau>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/413/s2/1" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Covered memorial.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">covered memorial</term>” means a memorial located in the United States established to commemorate the events of, and honor the victims of, the terrorist attacks on the World Trade Center and the Pentagon on September 11, 2001, at the site of the attacks.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/413/s2/2" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Eligible entity.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">eligible entity</term>” means the official organization, as in existence on the date of enactment of this Act—</chapeau>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/413/s2/2/A" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the focus of which is the operations and preservation of a covered memorial; and</content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/413/s2/2/B" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">which is an organization described in section 501(c)(3) of the Internal Revenue Code of 1986 and exempt from taxation under 501(a) of that Code.</content>
                </subparagraph>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/413/s2/3" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Secretary.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">Secretary</term>” means the Secretary of the Interior.</content>
            </paragraph>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/115/413/s3" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><heading style="-uslm-dtd:header">COMPETITIVE GRANTS FOR COVERED MEMORIALS. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/413/s3/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">Subject to the availability of appropriations, the Secretary shall award to eligible entities competitive grants of varying amounts, as determined by the Secretary, to be used by the eligible entity solely for the purposes described in subsection (b).</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/413/s3/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Purposes.—</heading><content style="-uslm-dtd:text">A grant awarded under subsection (a) shall be used by an eligible entity for the operation, security, and maintenance of a covered memorial.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/413/s3/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Deadline for Award.—</heading><content style="-uslm-dtd:text">If the Secretary, after review of an application from an eligible entity, determines to award a grant to the eligible entity, the Secretary shall award the grant not later than 60 days after the date of receipt of the completed application.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/413/s3/d" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Availability.—</heading><content style="-uslm-dtd:text">Grant funds made available under this section shall remain available until expended.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/413/s3/e" styleType="OLC">
                <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Criteria.—</heading><chapeau style="-uslm-dtd:text">In awarding grants under this section, the Secretary shall give greatest weight in the selection of eligible entities using the following criteria:</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/413/s3/e/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">The needs of the eligible entity, and ability and commitment of the eligible entity to use grant funds, with respect to ensuring the security and safety of visitors of the covered memorial.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/413/s3/e/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">The ability of the eligible entity to match the amount of the grant, on at least a 1-to-1 basis, with non-Federal assets from non-Federal sources, including cash or durable goods and materials fairly valued, as determined by the Secretary.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/413/s3/e/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">The greatest number of visitors that would benefit.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/413/s3/e/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><chapeau style="-uslm-dtd:text">The ability and commitment of an eligible entity to use grant funds—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/413/s3/e/4/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">to preserve the grounds at the covered memorial; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/413/s3/e/4/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">to educate future generations.</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/413/s3/e/5" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">The ability and commitment of an eligible entity to use grant funds to increase the numbers of economically disadvantaged visitors to the covered memorial.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/413/s3/f" styleType="OLC">
                <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Limitation.—</heading><chapeau style="-uslm-dtd:text">No grant shall be awarded under this section—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/413/s3/f/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">for use at a covered memorial that does not provide for—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/413/s3/f/1/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">free admission to all facilities and museums associated with the covered memorial for active and retired members of the military, registered first responders to the attacks of September 11, 2001, and family members of victims of the attacks of September 11, 2001; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/413/s3/f/1/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">dedicated free admission hours for the general public at least once a week; or</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/413/s3/f/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">to an eligible entity that does not allow for annual Federal audits of the financial statements of the eligible entity, including revenues associated with ticket sales, charitable donations, grants, and all expenditures on salaries and operations, which shall be subject to review by the Secretary and made available to the public.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/413/s3/g" styleType="OLC">
                <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Reports.—</heading><chapeau style="-uslm-dtd:text">Not later than 90 days after the end of each calendar year for which an eligible entity obligates or expends any amounts made available under a grant under this section, the eligible entity shall submit to the Secretary and the appropriate committees of Congress a report that—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/413/s3/g/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">specifies the amount of grant funds obligated or expended for the preceding fiscal year;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/413/s3/g/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">specifies any purposes for which the funds were obligated or expended; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/413/s3/g/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">includes any other information that the Secretary may require to more effectively administer the grant program under this section.</content>
                </paragraph>
            </subsection>
        </section>
