AN ACTTo authorize appropriations for fiscal year 1985 for intelligence and intelligence-related activities of the United States Government, the Intelligence Community Staff, and the Central Intelligence Agency Retirement and Disability System, and for other purposes.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
That this Act may be cited as the “Intelligence Authorization Act for fiscal year 1985”.

<num style="-uslm-dtd:enum" value="VI">TITLE VI—</num><heading style="-uslm-dtd:header">COUNTERINTELLIGENCE AND OFFICIAL REPRESENTATION </heading>
<section identifier="/us/sComp/98/618/tVI/s601" style="-uslm-dtd:section" styleType="traditional">
<heading style="-uslm-dtd:header">policy toward certain agents of foreign governments </heading>
<num style="-uslm-dtd:enum" value="601">Sec. 601. </num><subsection class="inline" identifier="/us/sComp/98/618/tVI/s601/a" style="-uslm-dtd:subsection" styleType="OLC"><num style="-uslm-dtd:enum" value="a">(a) </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t22/s254c–1">22 U.S.C. 254c–1</ref><b>]</b> </editorialNote><content style="-uslm-dtd:text">It is the sense of the Congress that the numbers, status, privileges and immunities, travel, accommodations, and facilities within the United States of official representatives to the United States of any foreign government that engages in intelligence activities within the United States harmful to the national security of the United States should not exceed the respective numbers, status, privileges and immunities, travel accommodations, and facilities within such country of official representatives of the United States to such country.</content></subsection>
<subsection identifier="/us/sComp/98/618/tVI/s601/b" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="b">(b) </num><content style="-uslm-dtd:text">The Secretary of State, in negotiating agreements with foreign governments regarding reciprocal privileges and immunities of United States diplomatic personnel, shall consult with the Director of the Federal Bureau of Investigation and the Director of National Intelligence in achieving the sense of Congress in subsection (a).</content>
</subsection>
<subsection identifier="/us/sComp/98/618/tVI/s601/c" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="c">(c) </num><chapeau style="-uslm-dtd:text">Not later than 90 days after the date of the enactment of this subsection, and annually thereafter for 5 years, the Secretary of State, the Director of the Federal Bureau of Investigation, and the Director of National Intelligence shall submit to the Select Committee on Intelligence, the Committee on Foreign Relations, the Committee on the Judiciary, and the Committee on Appropriations of the Senate and the Permanent Select Committee on Intelligence, the Committee on Foreign Affairs, the Committee on the Judiciary, and the Committee on Appropriations of the House of Representatives a report on each foreign government that—</chapeau>
<paragraph identifier="/us/sComp/98/618/tVI/s601/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">engages in intelligence activities within the United States harmful to the national security of the United States; and</content>
</paragraph>
<paragraph identifier="/us/sComp/98/618/tVI/s601/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">possesses numbers, status, privileges and immunities, travel accommodations, or facilities within the United States of official representatives to the United States that exceed the respective numbers, status, privileges and immunities, travel accommodations, or facilities within such country of official representatives of the United States to such country.</content>

</subsection>
<subsection identifier="/us/sComp/98/618/tVI/s601/d" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="d">(d) </num><chapeau style="-uslm-dtd:text">Section 203 of the State Department Basic Authorities Act of 1956 (22 U.S.C. 4303) is amended—</chapeau>
<paragraph identifier="/us/sComp/98/618/tVI/s601/d/1" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">in subsection (a) by striking out the fifth sentence; and</content>
</paragraph>
<paragraph identifier="/us/sComp/98/618/tVI/s601/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">by amending subsection (b) to read as follows:<quotedContent style="-uslm-dtd:quoted-block">
<subsection style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="b">“(b) </num><content style="-uslm-dtd:text">There shall also be a Deputy Director of the Office of Foreign Missions. Either the Director or the Deputy Director of such Office shall be an individual who has served in the United States Foreign Service, while the other of the two shall be an individual who has served in the United States Intelligence Community.”</content>

</subsection>
<subsection identifier="/us/sComp/98/618/tVI/s601/e" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="e">(e) </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t22/s4303">22 U.S.C. 4303</ref> nt<b>]</b> </editorialNote><content style="-uslm-dtd:text">The amendments made by subsection (d) shall apply only with respect to any appointment of a Director or Deputy Director of the Office of Foreign Missions, as the case may be, after the date of enactment of this section.</content>
