    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To direct the Under Secretary of Commerce for Intellectual Property and Director of the United States Patent and Trademark Office, in consultation with the Administrator of the Small Business Administration, to study and provide rec-ommendations to promote the participation of women, minorities, and veterans in entrepreneurship activities and the patent system, to extend by 8 years the Patent and Trademark Office’s authority to set the amounts for the fees it charges, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section style="-uslm-dtd:section" identifier="/us/sComp/115/273/s1" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t15/s1">15 U.S.C. 1 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading><content style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Study of Underrepresented Classes Chasing Engineering and Science Success Act of 2018’</shortTitle>” or the “<shortTitle style="-uslm-dtd:quote">SUCCESS Act</shortTitle>”.</content>

        <section style="-uslm-dtd:section" identifier="/us/sComp/115/273/s2" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">FINDINGS; SENSE OF CONGRESS. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/273/s2/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Findings.—</heading><chapeau style="-uslm-dtd:text">Congress finds the following:</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/273/s2/a/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">Patents and other forms of intellectual property are important engines of innovation, invention, and economic growth.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/273/s2/a/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">Many innovative small businesses, which create over 20 percent of the total number of new jobs created in the United States each year, depend on patent protections to commercialize new technologies.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/273/s2/a/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">Universities and their industry partners also rely on patent protections to transfer innovative new technologies from the laboratory or classroom to commercial use.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/273/s2/a/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">Recent studies have shown that there is a significant gap in the number of patents applied for and obtained by women and minorities.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/273/s2/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Sense of Congress.—</heading><content style="-uslm-dtd:text">It is the sense of Congress that the United States has the responsibility to work with the private sector to close the gap in the number of patents applied for and obtained by women and minorities to harness the maximum innova-tive potential and continue to promote United States leadership in the global economy.</content>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/115/273/s3" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><heading style="-uslm-dtd:header">REPORT. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/273/s3/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Study.—</heading><chapeau style="-uslm-dtd:text">The Director, in consultation with the Adminis-trator and any other head of an appropriate agency, shall conduct a study that—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/273/s3/a/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">identifies publicly available data on the number of patents annually applied for and obtained by, and the benefits of increasing the number of patents applied for and obtained by women, minorities, and veterans and small businesses owned
 by women, minorities, and veterans; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/273/s3/a/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">provides legislative recommendations for how to—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/273/s3/a/2/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">promote the participation of women, minorities, and veterans in entrepreneurship activities; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/273/s3/a/2/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">increase the number of women, minorities, and veterans who apply for and obtain patents.</content>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/273/s3/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Report.—</heading><content style="-uslm-dtd:text">Not later than 1 year after the date of the enact-ment of this Act, the Director shall submit to the Committees on the Judiciary and Small Business of the House of Representa-tives and the Committees on the Judiciary and Small Business and Entrepreneurship of the Senate a report on the results of the study conducted under subsection (a).</content>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/115/273/s4" styleType="OLC">
            <num style="-uslm-dtd:enum" value="4">SEC. 4. </num><heading style="-uslm-dtd:header">EXTENSION OF FEE-SETTING AUTHORITY. </heading><content style="-uslm-dtd:text">Section 10(i)(2) of the Leahy-Smith America Invents Act (Public Law 112–29; 125 Stat. 319; 35 U.S.C. 41 note) is amended by striking “<quotedText style="-uslm-dtd:quote">7-year</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">15-year</quotedText>”.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/115/273/s5" styleType="OLC" role="definitions">
            <num style="-uslm-dtd:enum" value="5">SEC. 5. </num><heading style="-uslm-dtd:header">DEFINITIONS. </heading><chapeau style="-uslm-dtd:text">In this Act:</chapeau>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/273/s5/1" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Administrator.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">Administrator</term>” means the Administrator of the Small Business Administration.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/273/s5/2" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Agency </heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">agency</term>” means a department, agency, or instrumentality of the United States Government.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/273/s5/3" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Director </heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">Director</term>” means the Under Sec-retary of Commerce for Intellectual Property and Director of the United States Patent and Trademark Office.</content>
