    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To enhance the transparency and accelerate the impact of programs under the African Growth and Opportunity Act and the Millennium Challenge Corporation, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>

            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t19/s3701">19 U.S.C. 3701 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content style="-uslm-dtd:text" class="block">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">African Growth and Opportunity Act and Millennium Challenge Act Modernization Act</shortTitle>” or the “<shortTitle style="-uslm-dtd:quote">AGOA and MCA Modernization Act</shortTitle>”.</content>

            <num style="-uslm-dtd:enum" value="I">TITLE I—</num><heading style="-uslm-dtd:header">ENHANCEMENT OF THE AFRICAN GROWTH AND OPPORTUNITY ACT </heading>
            <section style="-uslm-dtd:section" identifier="/us/sComp/115/167/tI/s101" styleType="OLC">
                <num style="-uslm-dtd:enum" value="101">SEC. 101. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t19/s3701">19 U.S.C. 3701 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">STATEMENT OF POLICY. </heading>
                <chapeau style="-uslm-dtd:text" class="block">It is the policy of the United States to support efforts to—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tI/s101/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">improve the rule of law, promote free and fair elections, strengthen and expand the private sector, and fight corruption in sub-Saharan Africa; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tI/s101/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">promote the role of women in social, political, and economic development in sub-Saharan Africa.</content>
                </paragraph>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/115/167/tI/s102" styleType="OLC" role="definitions">
                <num style="-uslm-dtd:enum" value="102">SEC. 102. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t19/s3707">19 U.S.C. 3707 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">DEFINITIONS. </heading>
                <chapeau style="-uslm-dtd:text" class="block">In this title—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tI/s102/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">AGOA Website.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">AGOA Website</term>” means the website established pursuant to section 103(a).</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tI/s102/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Eligible sub-saharan african country.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">eligible sub-Saharan African country</term>” means a country that the President has determined meets the eligibility requirements set forth in section 104 of the African Growth and Opportunity Act (19 U.S.C. 3703).</content>
                </paragraph>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/115/167/tI/s103" styleType="OLC">
                <num style="-uslm-dtd:enum" value="103">SEC. 103. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t19/s3707">19 U.S.C. 3707</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">ACTIVITIES IN SUPPORT OF TRANSPARENCY. </heading>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/167/tI/s103/a" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Agoa website.—</heading>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tI/s103/a/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">The President shall establish a publicly available website for the collection and dissemination of information regarding the African Growth and Opportunity Act (19 U.S.C. 3701 et seq.).</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tI/s103/a/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Contents.—</heading><chapeau style="-uslm-dtd:text">The President shall publish on the AGOA Website the information described in paragraph (1), including—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/167/tI/s103/a/2/A" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">information and technical assistance provided at United States Agency for International Development regional trade hubs; and</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/167/tI/s103/a/2/B" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">a link to the websites of United States embassies located in eligible sub-Saharan African countries.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tI/s103/a/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Actions by united states embassies.—</heading><chapeau style="-uslm-dtd:text">The Secretary of State should direct United States embassies located in eligible sub-Saharan African countries to—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/167/tI/s103/a/3/A" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">encourage individuals and businesses in such countries to use the benefits available under the African Growth and Opportunity Act; and</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/167/tI/s103/a/3/B" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">include a link to the AGOA Website on the websites of such diplomatic missions.</content>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/167/tI/s103/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">AGOA Forum.—</heading><chapeau style="-uslm-dtd:text">After each meeting of the United States-Sub-Saharan Africa Trade and Economic Cooperation Forum, the President should publish on the AGOA Website the following:</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tI/s103/b/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">The outcomes of the meeting of the Forum, including any commitments made by member countries and the private sector.</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tI/s103/b/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">An assessment of progress made with respect to any commitments made by member countries and the private sector from the previous meeting of the Forum.</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/167/tI/s103/c" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Other Information.—</heading><content style="-uslm-dtd:text">The President should disseminate the information required under this section in a digital format to the public and publish such information on the AGOA Website.</content>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/115/167/tI/s104" styleType="OLC">
                <num style="-uslm-dtd:enum" value="104">SEC. 104. </num><heading style="-uslm-dtd:header">ACTIVITIES IN SUPPORT OF TRADE CAPACITY BUILDING. </heading>
                <chapeau style="-uslm-dtd:text" class="block">The President should—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tI/s104/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">develop and implement policies that—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/167/tI/s104/1/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">encourage and facilitate cross-boundary cooperation among eligible sub-Saharan African countries in order to facilitate trade; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/167/tI/s104/1/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">encourage the provision of technical assistance to eligible sub-Saharan African countries to establish and sustain adequate trade capacity development;</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tI/s104/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">provide specific training for businesses in eligible sub-Saharan African countries and government trade officials of such countries on accessing the benefits under the African  Growth and Opportunity Act and other trade preference programs;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tI/s104/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">provide capacity building for African entrepreneurs and trade associations on production strategies, quality standards, formation of cooperatives, market research, and market development;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tI/s104/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">provide capacity building training to promote diversification of African products and value-added processing; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tI/s104/5" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">provide capacity building and technical assistance funding for African businesses and institutions to help such businesses and institutions comply with United States counterterrorism initiatives and policies.</content>
                </paragraph>
            </section>
        </title>
        <title style="-uslm-dtd:title" identifier="/us/sComp/115/167/tII" styleType="OLC">
            <num style="-uslm-dtd:enum" value="II">TITLE II—</num><heading style="-uslm-dtd:header">MODERNIZATION OF THE MILLENNIUM CHALLENGE CORPORATION </heading>
            <section style="-uslm-dtd:section" identifier="/us/sComp/115/167/tII/s201" styleType="OLC">
                <num style="-uslm-dtd:enum" value="201">SEC. 201. </num><heading style="-uslm-dtd:header">CANDIDACY STATUS. </heading>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/167/tII/s201/a" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Low Income Countries.—</heading><chapeau style="-uslm-dtd:text">Section 606(a) of the Millennium Challenge Act of 2003 (22 U.S.C. 7705(a)) is amended—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tII/s201/a/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">in paragraph (1)(B), by striking “<quotedText style="-uslm-dtd:quote">(3)</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">(4)</quotedText>”;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tII/s201/a/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">in paragraph (2)—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/167/tII/s201/a/2/A" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">by amending the paragraph heading to read as follows: “<quotedText style="-uslm-dtd:quote"><headingText style="-uslm-dtd:header-in-text">Fiscal years 2005 through 2012</headingText></quotedText>”; and</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/167/tII/s201/a/2/B" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">fiscal year 2005 or a subsequent fiscal year</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">each of fiscal years 2005 through 2012</quotedText>”;</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tII/s201/a/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">by redesignating paragraph (3) as paragraph (4); and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tII/s201/a/4" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">by inserting after paragraph (2) the following:<quotedContent style="-uslm-dtd:quoted-block">
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">“(3) </num><heading style="-uslm-dtd:header">Fiscal year 2013 and subsequent fiscal years.—</heading><chapeau style="-uslm-dtd:text">A country shall be a candidate country for purposes of eligibility for assistance for fiscal year 2013 or a subsequent fiscal year if the country—</chapeau>
                            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">“(A) </num><content style="-uslm-dtd:text">has a per capita income not greater than the lower middle income country threshold established by the International Bank for Reconstruction and Development for such fiscal year;</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">“(B) </num><content style="-uslm-dtd:text">is among the 75 countries identified by the International Bank for Reconstruction and Development as having the lowest per capita income; and</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="C">“(C) </num><content style="-uslm-dtd:text">meets the requirements under paragraph (1)(B).”</content>
                            </subparagraph>
                        </paragraph></quotedContent>.</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/167/tII/s201/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Lower Middle Income Countries.—</heading><chapeau style="-uslm-dtd:text">Section 606(b) of the Millennium Challenge Act of 2003 (22 U.S.C. 7705(b)) is amended—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tII/s201/b/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">in paragraph (1)—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/167/tII/s201/b/1/A" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">by amending the paragraph heading to read as follows: “<quotedText style="-uslm-dtd:quote"><headingText style="-uslm-dtd:header-in-text">Fiscal years 2006 through 2012</headingText></quotedText>”; and</content>
                        </subparagraph>

                            <num style="-uslm-dtd:enum" value="2">“(2) </num><heading style="-uslm-dtd:header">Fiscal year 2013 and subsequent fiscal years.—</heading><chapeau style="-uslm-dtd:text">In addition to the countries described in subsection (a), a country shall be a candidate country for purposes of eligibility  for assistance for fiscal year 2013 or a subsequent fiscal year if the country—</chapeau>
                            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">“(A) </num><content style="-uslm-dtd:text">has a per capita income not greater than the lower middle income country threshold established by the International Bank for Reconstruction and Development for the fiscal year;</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">“(B) </num><content style="-uslm-dtd:text">is not among the 75 countries identified by the International Bank for Reconstruction and Development as having the lowest per capita income; and</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="C">“(C) </num><content style="-uslm-dtd:text">meets the requirements under subsection (a)(1)(B).”</content>
                            </subparagraph>
                        </paragraph></quotedContent>.</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/167/tII/s201/c" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Reclassification.—</heading><chapeau style="-uslm-dtd:text">Section 606 of the Millennium Challenge Act of 2003 (22 U.S.C. 7705) is amended—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tII/s201/c/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">by redesignating subsection (c) as subsection (d); and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tII/s201/c/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">by inserting after subsection (b) the following:<quotedContent style="-uslm-dtd:quoted-block">
                        <subsection style="-uslm-dtd:subsection" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="c">“(c) </num><heading style="-uslm-dtd:header">Treatment of Countries With Per Capita Income Changes.—</heading><content style="-uslm-dtd:text">A country qualifying for candidate status under this section with a per capita income that changes during the fiscal year such that the country would be reclassified from a low income country to a lower middle income country or from a lower middle income country to a low income country shall retain its candidacy status in its former income classification for such fiscal year and the 2 subsequent fiscal years.”</content>
                        </subsection></quotedContent>.</content>
                    </paragraph>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/115/167/tII/s202" styleType="OLC">
                <num style="-uslm-dtd:enum" value="202">SEC. 202. </num><heading style="-uslm-dtd:header">CARRYOVER AUTHORITY FOR PRIVATE-SECTOR MEMBERS OF BOARD OF DIRECTORS. </heading>
                <content style="-uslm-dtd:text" class="block">Section 604(c)(4)(B) of the Millennium Challenge Act of 2003 (22 U.S.C. 7703(c)(4)(B)) is amended to read as follows:<quotedContent style="-uslm-dtd:quoted-block">
                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">“(B) </num><heading style="-uslm-dtd:header">Other members.—</heading><chapeau style="-uslm-dtd:text">Each member of the Board described in paragraph (3)(B)—</chapeau>
                    <clause style="-uslm-dtd:clause" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="i">“(i) </num><content style="-uslm-dtd:text">shall be appointed for a term of 3 years;</content>
                    </clause>
                    <clause style="-uslm-dtd:clause" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="ii">“(ii) </num><content style="-uslm-dtd:text">may be reappointed for a term of an additional 2 years; and</content>
                    </clause>
                    <clause style="-uslm-dtd:clause" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="iii">“(iii) </num><chapeau style="-uslm-dtd:text">may continue to serve in each such appointment until the earlier of—</chapeau>
                        <subclause style="-uslm-dtd:subclause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="I">“(I) </num><content style="-uslm-dtd:text">the date on which his or her successor is appointed; or</content>
                        </subclause>
                        <subclause style="-uslm-dtd:subclause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="II">“(II) </num><content style="-uslm-dtd:text">the date that is 1 year after the expiration of his or her appointment or reappointment, as the case may be.”</content>
                        </subclause>
                    </clause>
                </subparagraph></quotedContent>.</content>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/115/167/tII/s203" styleType="OLC">
                <num style="-uslm-dtd:enum" value="203">SEC. 203. </num><heading style="-uslm-dtd:header">ADDITIONAL REPORTING TO THE BOARD ON THE TREATMENT OF CIVIL SOCIETY IN AN ELIGIBLE COUNTRY. </heading>
                <chapeau style="-uslm-dtd:text" class="block">Section 607 of the Millennium Challenge Act of 2003 (22 U.S.C. 7706) is amended—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tII/s203/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">in subsection (a), by adding at the end the following: “<quotedText style="-uslm-dtd:quote">A determination whether a country is eligible for a subsequent, non-concurrent Millennium Challenge Compact shall also be based, to the extent practicable, on significantly improved performance across the criteria in subsection (b) that, at a minimum, are relevant to the preceding Compact, compared to the country’s performance with respect to such criteria when selected for such preceding Compact.</quotedText>”</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tII/s203/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">in subsection (b)(1)—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/167/tII/s203/2/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">in subparagraph (D), by striking “<quotedText style="-uslm-dtd:quote">and</quotedText>” at the end;</content>
                    </subparagraph>

                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tII/s203/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">by redesignating subsections (d) and (e) as subsections (e) and (f), respectively; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tII/s203/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">by inserting after subsection (c) the following:<quotedContent style="-uslm-dtd:quoted-block">
                    <subsection style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="d">“(d) </num><heading style="-uslm-dtd:header">Reporting on Treatment of Civil Society.—</heading><chapeau style="-uslm-dtd:text">For the 7-year period beginning on the date of the enactment of this subsection, before the Board selects an eligible country for a Compact under subsection (c), the Corporation shall provide information to the Board regarding the country’s treatment of civil society, including classified information, as appropriate. The information shall include an assessment and analysis of factors including—</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">“(1) </num><content style="-uslm-dtd:text">any relevant laws governing the formation or establishment of a civil society organization, particularly laws intended to curb the activities of foreign civil society organizations;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">“(2) </num><content style="-uslm-dtd:text">any relevant laws governing the operations of a civil society organization, particularly those laws seeking to define or otherwise regulate the actions of foreign civil society organizations;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">“(3) </num><content style="-uslm-dtd:text">laws relating to the legal status of civil society organizations, including laws which effectively discriminate against foreign civil society organizations as compared to similarly situated domestic organizations;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="4">“(4) </num><content style="-uslm-dtd:text">laws regulating the freedom of expression and peaceful assembly; and</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="5">“(5) </num><content style="-uslm-dtd:text">laws regulating the usage of the Internet, particularly by foreign civil society organizations.”</content>
                        </paragraph>
                    </subsection></quotedContent>.</content>
                </paragraph>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/115/167/tII/s204" styleType="OLC">
                <num style="-uslm-dtd:enum" value="204">SEC. 204. </num><heading style="-uslm-dtd:header">CONCURRENT COMPACTS UNDER THE MILLENNIUM CHALLENGE ACT OF 2003. </heading>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/167/tII/s204/a" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">Section 609 of the Millennium Challenge Act of 2003 (22 U.S.C. 7708) is amended—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tII/s204/a/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">by striking the first sentence of subsection (k);</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tII/s204/a/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">by redesignating subsection (k) (as so amended) as subsection (l); and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tII/s204/a/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">by inserting after subsection (j) the following:<quotedContent style="-uslm-dtd:quoted-block">
                        <subsection style="-uslm-dtd:subsection" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="k">“(k) </num><heading style="-uslm-dtd:header">Concurrent Compacts.—</heading><chapeau style="-uslm-dtd:text">An eligible country that has entered into and has in effect a Compact under this section may enter into and have in effect at the same time not more than one additional Compact in accordance with the requirements of this title if—</chapeau>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">“(1) </num><content style="-uslm-dtd:text">one or both of the Compacts are or will be for purposes of regional economic integration, increased regional trade, or cross-border collaborations; and</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">“(2) </num><content style="-uslm-dtd:text">the Board determines that the country is making considerable and demonstrable progress in implementing the terms of the existing Compact and supplementary agreements thereto.”</content>
                            </paragraph>
                        </subsection></quotedContent>.</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/167/tII/s204/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Conforming Amendment.—</heading><content style="-uslm-dtd:text">Section 613(b)(2)(A) of such Act (22 U.S.C. 7712(b)(2)(A)) is amended by striking “<quotedText style="-uslm-dtd:quote">the</quotedText>” before “<quotedText style="-uslm-dtd:quote">Compact</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">any</quotedText>”.</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/167/tII/s204/c" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t22/s7708">22 U.S.C. 7708 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Applicability.—</heading><content style="-uslm-dtd:text">The amendments made by this section apply with respect to Compacts entered into between the United States and an eligible country under the Millennium Challenge Act of 2003 before, on, or after the date of the enactment of this Act.</content>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/115/167/tII/s205" styleType="OLC">
                <num style="-uslm-dtd:enum" value="205">SEC. 205. </num><heading style="-uslm-dtd:header">PUBLIC NOTIFICATION OF ENTERING INTO A COMPACT. </heading>
                <content style="-uslm-dtd:text" class="block">Section 610 of the Millennium Challenge Act of 2003 (22 U.S.C. 7709) is amended to read as follows:<quotedContent style="-uslm-dtd:quoted-block">
                <section style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="610">“SEC. 610. </num><heading style="-uslm-dtd:header">CONGRESSIONAL AND PUBLIC NOTIFICATION </heading>
                    <subsection style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">“(a) </num><heading style="-uslm-dtd:header">Congressional Consultations and Notifications.—</heading>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">“(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Board, acting through the Chief Executive Officer, shall consult with and notify the appropriate congressional committees not later than 15 days before taking any of the actions described in paragraph (2).</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">“(2) </num><heading style="-uslm-dtd:header">Actions described.—</heading><chapeau style="-uslm-dtd:text">The actions described in this paragraph are—</chapeau>
                            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">“(A) </num><content style="-uslm-dtd:text">providing assistance for an eligible country under section 609(g);</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">“(B) </num><chapeau style="-uslm-dtd:text">commencing negotiations with an eligible country to provide assistance for—</chapeau>
                                <clause style="-uslm-dtd:clause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="i">“(i) </num><content style="-uslm-dtd:text">a Compact under section 605; or</content>
                                </clause>
                                <clause style="-uslm-dtd:clause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="ii">“(ii) </num><content style="-uslm-dtd:text">an agreement under section 616;</content>
                                </clause>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="C">“(C) </num><content style="-uslm-dtd:text">signing such a Compact or agreement; and</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="D">“(D) </num><content style="-uslm-dtd:text">terminating assistance under such a Compact or agreement.</content>
                            </subparagraph>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">“(3) </num><heading style="-uslm-dtd:header">Economic justification.—</heading><chapeau style="-uslm-dtd:text">Any notification relating to the intent to negotiate or sign a Compact shall include a report describing the projected economic justification for the Compact, including, as applicable—</chapeau>
                            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">“(A) </num><content style="-uslm-dtd:text">the expected economic rate of return of the Compact;</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">“(B) </num><content style="-uslm-dtd:text">a cost-benefit analysis of the Compact;</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="C">“(C) </num><content style="-uslm-dtd:text">a description of the impact on beneficiary populations;</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="D">“(D) </num><content style="-uslm-dtd:text">the likelihood that the investment will catalyze private sector investments; and</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="E">“(E) </num><content style="-uslm-dtd:text">any other applicable economic factors that justify each project to be funded under such a Compact to the extent practicable and appropriate.</content>
                            </subparagraph>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="4">“(4) </num><heading style="-uslm-dtd:header">Risk management plan.—</heading><chapeau style="-uslm-dtd:text">Not later than 60 days before signing each concurrent Compact, as authorized under section 609, the Board, acting through the Chief Executive Officer, shall consult with and provide to the appropriate congressional committees—</chapeau>
                            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">“(A) </num><chapeau style="-uslm-dtd:text">an assessment and, as appropriate, the identification of potential measures to mitigate risks, of—</chapeau>
                                <clause style="-uslm-dtd:clause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="i">“(i) </num><content style="-uslm-dtd:text">the countries’ commitment to regional integration and cross-border cooperation and capacity to carry out commitments;</content>
                                </clause>
                                <clause style="-uslm-dtd:clause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="ii">“(ii) </num><content style="-uslm-dtd:text">political and policy risks, including risks that could affect country eligibility;</content>
                                </clause>
                                <clause style="-uslm-dtd:clause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="iii">“(iii) </num><content style="-uslm-dtd:text">risks associated with realizing economic returns;</content>
                                </clause>
                                <clause style="-uslm-dtd:clause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="iv">“(iv) </num><content style="-uslm-dtd:text">time and completion risks; and</content>
                                </clause>
                                <clause style="-uslm-dtd:clause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="v">“(v) </num><content style="-uslm-dtd:text">cost and financial risks; and</content>
                                </clause>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">“(B) </num><chapeau style="-uslm-dtd:text">an assessment of measures to be taken to mitigate any identified risks, including—</chapeau>
                                <clause style="-uslm-dtd:clause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="i">“(i) </num><content style="-uslm-dtd:text">securing other potential donors to finance projects or parts of projects as needed; and</content>
                                </clause>
                                <clause style="-uslm-dtd:clause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="ii">“(ii) </num><content style="-uslm-dtd:text">partnering with regional organizations to support and oversee effective cross-border cooperation.</content>
                                </clause>
                            </subparagraph>
                        </paragraph>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">“(b) </num><heading style="-uslm-dtd:header">Congressional and Public Notification After Entering Into a Compact.—</heading><chapeau style="-uslm-dtd:text">Not later than 10 days after entering into a Compact with an eligible country, the Board, acting through the Chief Executive Officer, shall—</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">“(1) </num><content style="-uslm-dtd:text">publish the text of the Compact on the website of the Corporation;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">“(2) </num><content style="-uslm-dtd:text">provide the appropriate congressional committees with a detailed summary of the Compact and, upon request, the text of the Compact; and</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">“(3) </num><content style="-uslm-dtd:text">publish in the Federal Register a detailed summary of the Compact and a notice of availability of the text of the Compact on the website of the Corporation.”</content>
                        </paragraph>
                    </subsection>

            <section style="-uslm-dtd:section" identifier="/us/sComp/115/167/tII/s206" styleType="OLC">
                <num style="-uslm-dtd:enum" value="206">SEC. 206. </num><heading style="-uslm-dtd:header">DISCLOSURE. </heading>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/167/tII/s206/a" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Requirement for Timely Disclosure.—</heading><chapeau style="-uslm-dtd:text">Section 612(a) of the Millennium Challenge Act of 2003 (22 U.S.C. 7711(a)) is amended—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tII/s206/a/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">in the subsection heading, by inserting “<quotedText style="-uslm-dtd:quote"><headingText style="-uslm-dtd:header-in-text">Timely</headingText></quotedText>” before “<quotedText style="-uslm-dtd:quote"><headingText style="-uslm-dtd:header-in-text">Disclosure</headingText></quotedText>”; and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tII/s206/a/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">in the matter preceding paragraph (1)—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/167/tII/s206/a/2/A" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">The Corporation</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">Not later than 90 days after the last day of each fiscal quarter, the Corporation</quotedText>”; and</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/167/tII/s206/a/2/B" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">on at least a quarterly basis,</quotedText>”.</content>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/167/tII/s206/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Dissemination.—</heading><content style="-uslm-dtd:text">Section 612(b) of the Millennium Challenge Act of 2003 (22 U.S.C. 7711(b)) is amended to read as follows:<quotedContent style="-uslm-dtd:quoted-block">
                    <subsection style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">“(b) </num><heading style="-uslm-dtd:header">Dissemination.—</heading><chapeau style="-uslm-dtd:text">The Board, acting through the Chief Executive Officer, shall make the information required to be disclosed under subsection (a) available to the public—</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">“(1) </num><content style="-uslm-dtd:text">by publishing it on the website of the Corporation;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">“(2) </num><content style="-uslm-dtd:text">by providing notice of the availability of such information in the Federal Register; and</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">“(3) </num><content style="-uslm-dtd:text">by any other methods that the Board determines to be appropriate.”</content>
                        </paragraph>
                    </subsection></quotedContent>.</content>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/115/167/tII/s207" styleType="OLC">
                <num style="-uslm-dtd:enum" value="207">SEC. 207. </num><heading style="-uslm-dtd:header">RESTRICTION ON THE USE OF ASSISTANCE UNDER SECTION 616. </heading>
                <content style="-uslm-dtd:text" class="block">Section 616(d) of the Millennium Challenge Act of 2003 (22 U.S.C. 7715(d)) is amended to read as follows:<quotedContent style="-uslm-dtd:quoted-block">
                <subsection style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">“(d) </num><heading style="-uslm-dtd:header">Funding.—</heading>
                    <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">“(1) </num><heading style="-uslm-dtd:header">Limitation.—</heading><content style="-uslm-dtd:text">Not more than 10 percent of the amounts made available to carry out this Act for a fiscal year may be made available to carry out this section.</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">“(2) </num><heading style="-uslm-dtd:header">Restriction relating to assistance.—</heading><content style="-uslm-dtd:text">None of the funds authorized to carry out the purposes of this Act shall be available for assistance under this section to a country that does not qualify as a candidate country under section 606 for the fiscal year during which such assistance is provided.”</content>
                    </paragraph>

            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/115/167/tII/s208" styleType="OLC">
                <num style="-uslm-dtd:enum" value="208">SEC. 208. </num><heading style="-uslm-dtd:header">STUDY ON SUBNATIONAL COMPACTS. </heading>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/167/tII/s208/a" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">Not later than 180 days after the date of the enactment of this Act, the Board of the Millennium Challenge Corporation, acting through the Chief Executive Officer, shall submit a study to the appropriate congressional committees that assesses the feasibility and desirability of developing partnerships at the subnational level within candidate countries that would be complementary to, and, as applicable, concurrent with, any    Millennium Challenge Corporation national-level or regional investments.</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/167/tII/s208/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Content.—</heading><chapeau style="-uslm-dtd:text">The study required under subsection (a) shall examine—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tII/s208/b/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the extent to which targeting investments at the subnational level might provide new opportunities for reducing poverty through economic growth;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tII/s208/b/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the extent to which traditional approaches to defining poverty may not adequately capture the nature of poverty within a country;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tII/s208/b/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">the types of subnational entities that might be appropriate partners for subnational Millennium Challenge Corporation compacts;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tII/s208/b/4" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">how candidates for subnational partners might best be identified; and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tII/s208/b/5" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">what role each national government should play in creating or implementing a subnational partnership.</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/167/tII/s208/c" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Appropriate Congressional Committees.—</heading><chapeau style="-uslm-dtd:text">In this subsection, the term “<quotedText style="-uslm-dtd:quote">appropriate congressional committees</quotedText>” means—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tII/s208/c/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the Committee on Foreign Relations of the Senate;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tII/s208/c/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the Committee on Appropriations of the Senate;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tII/s208/c/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">the Committee on Foreign Affairs of the House of Representatives; and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/167/tII/s208/c/4" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">the Committee on Appropriations of the House of Representatives.</content>
                    </paragraph>
