    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To enhance citizen access to Government information and services by establishing that Government documents issued to the public must be written clearly, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section style="-uslm-dtd:section" identifier="/us/sComp/111/274/s1" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t5/s301">5 U.S.C. 301 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content style="-uslm-dtd:text" class="block">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Plain Writing Act of 2010</shortTitle>”.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/111/274/s2" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t5/s301">5 U.S.C. 301 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">PURPOSE. </heading>
            <content style="-uslm-dtd:text" class="block">The purpose of this Act is to improve the effectiveness and accountability of Federal agencies to the public by promoting clear Government communication that the public can understand and use.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/111/274/s3" styleType="OLC" role="definitions">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><heading style="-uslm-dtd:header">DEFINITIONS. </heading>
            <chapeau style="-uslm-dtd:text" class="block">In this Act:</chapeau>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/111/274/s3/1" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Agency.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">agency</term>” means an Executive agency, as defined under section 105 of title 5, United States Code.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/111/274/s3/2" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Covered document.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">covered document</term>”—</chapeau>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/111/274/s3/2/A" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><chapeau style="-uslm-dtd:text">means any document that—</chapeau>
                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/111/274/s3/2/A/i" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">is necessary for obtaining any Federal Government benefit or service or filing taxes;</content>
                    </clause>
                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/111/274/s3/2/A/ii" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">provides information about any Federal Government benefit or service; or</content>
                    </clause>
                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/111/274/s3/2/A/iii" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">explains to the public how to comply with a requirement the Federal Government administers or enforces;</content>
                    </clause>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/111/274/s3/2/B" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">includes (whether in paper or electronic form) a letter, publication, form, notice, or instruction; and</content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/111/274/s3/2/C" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">does not include a regulation.</content>
                </subparagraph>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/111/274/s3/3" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Plain writing.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">plain writing</term>” means writing that is clear, concise, well-organized, and follows other best practices appropriate to the subject or field and intended audience.</content>
            </paragraph>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/111/274/s4" styleType="OLC">
            <num style="-uslm-dtd:enum" value="4">SEC. 4. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t5/s301">5 U.S.C. 301 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">RESPONSIBILITIES OF FEDERAL AGENCIES. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/111/274/s4/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Preparation for Implementation of Plain Writing Requirements.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/111/274/s4/a/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">Not later than 9 months after the date of enactment of this Act, the head of each agency shall—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/111/274/s4/a/1/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">designate 1 or more senior officials within the agency to oversee the agency implementation of this Act;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/111/274/s4/a/1/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">communicate the requirements of this Act to the employees of the agency;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/111/274/s4/a/1/C" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">train employees of the agency in plain writing;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/111/274/s4/a/1/D" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">establish a process for overseeing the ongoing compliance of the agency with the requirements of this Act;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/111/274/s4/a/1/E" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">create and maintain a plain writing section of the agency’s website as required under paragraph (2) that is accessible from the homepage of the agency’s website; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/111/274/s4/a/1/F" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="F">(F) </num><chapeau style="-uslm-dtd:text">designate 1 or more agency points-of-contact to receive and respond to public input on—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/111/274/s4/a/1/F/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">agency implementation of this Act; and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/111/274/s4/a/1/F/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the agency reports required under section 5.</content>
                        </clause>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/111/274/s4/a/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Website.—</heading><chapeau style="-uslm-dtd:text">The plain writing section described under paragraph (1)(E) shall—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/111/274/s4/a/2/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">inform the public of agency compliance with the requirements of this Act; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/111/274/s4/a/2/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">provide a mechanism for the agency to receive and respond to public input on—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/111/274/s4/a/2/B/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">agency implementation of this Act; and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/111/274/s4/a/2/B/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the agency reports required under section 5.</content>
                        </clause>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/111/274/s4/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Requirement to Use Plain Writing in New Documents.—</heading><content style="-uslm-dtd:text">Beginning not later than 1 year after the date of enactment of this Act, each agency shall use plain writing in every covered document of the agency that the agency issues or substantially revises.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/111/274/s4/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Guidance.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/111/274/s4/c/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Not later than 6 months after the date of enactment of this Act, the Director of the Office of Management and Budget shall develop and issue guidance on implementing the requirements of this section. The Director may designate a lead agency, and may use interagency working groups to assist in developing and issuing the guidance.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/111/274/s4/c/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Interim guidance.—</heading><chapeau style="-uslm-dtd:text">Before the issuance of guidance under paragraph (1), agencies may follow the guidance of—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/111/274/s4/c/2/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the writing guidelines developed by the Plain Language Action and Information Network; or</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/111/274/s4/c/2/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">guidance provided by the head of the agency that is consistent with the guidelines referred to in subparagraph (A).</content>
                    </subparagraph>
                </paragraph>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/111/274/s5" styleType="OLC">
            <num style="-uslm-dtd:enum" value="5">SEC. 5. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t5/s301">5 U.S.C. 301 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">REPORTS TO CONGRESS. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/111/274/s5/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Initial Report.—</heading><content style="-uslm-dtd:text">Not later than 9 months after the date of enactment of this Act, the head of each agency shall publish on the plain writing section of the agency’s website a report that describes the agency plan for compliance with the requirements of this Act.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/111/274/s5/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Annual Compliance Report.—</heading><content style="-uslm-dtd:text">Not later than 18 months after the date of enactment of this Act, and annually thereafter, the head of each agency shall publish on the plain writing section of the agency’s website a report on agency compliance with the requirements of this Act.</content>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/111/274/s6" styleType="OLC">
            <num style="-uslm-dtd:enum" value="6">SEC. 6. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t5/s301">5 U.S.C. 301 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">JUDICIAL REVIEW AND ENFORCEABILITY. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/111/274/s6/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Judicial Review.—</heading><content style="-uslm-dtd:text">There shall be no judicial review of compliance or noncompliance with any provision of this Act.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/111/274/s6/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Enforceability.—</heading><content style="-uslm-dtd:text">No provision of this Act shall be construed to create any right or benefit, substantive or procedural, enforceable by any administrative or judicial action.</content>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/111/274/s7" styleType="OLC">
            <num style="-uslm-dtd:enum" value="7">SEC. 7. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t5/s301">5 U.S.C. 301 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">BUDGETARY EFFECTS OF PAYGO LEGISLATION FOR THIS ACT. </heading>
            <content style="-uslm-dtd:text" class="block">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled “<quotedText style="-uslm-dtd:quote">Budgetary Effects of PAYGO Legislation</quotedText>” for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</content>
