    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To provide for business development and trade promotion for Native Americans, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
</enactingFormula>
        <section style="-uslm-dtd:section" identifier="/us/sComp/106/464/s1" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t25/s4301">25 U.S.C. 4301 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content style="-uslm-dtd:text" class="block">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote"><inline style="-uslm-dtd:short-title">Native American Business Development, Trade Promotion, and Tourism Act of 2000</inline></shortTitle>”.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/106/464/s2" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t25/s4301">25 U.S.C. 4301</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">FINDINGS; PURPOSES. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/464/s2/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Findings.—</heading><chapeau style="-uslm-dtd:text">Congress finds that—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s2/a/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">clause 3 of section 8 of article I of the United States Constitution recognizes the special relationship between the United States and Indian Tribes;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s2/a/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">beginning in 1970, with the inauguration by the Nixon Administration of the Indian self-determination era, each President has reaffirmed the special government-to-government relationship between Indian Tribes and the United States;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s2/a/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">in 1994, President Clinton issued an Executive memorandum to the heads of departments and agencies that obligated all Federal departments and agencies, particularly those that have an impact on economic development, to evaluate the potential impacts of their actions on Indian Tribes;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s2/a/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">consistent with the principles of inherent Tribal sovereignty and the special relationship between Indian Tribes and the United States, Indian Tribes retain the right to enter into contracts and agreements to trade freely, and seek enforcement of treaty and trade rights;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s2/a/5" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">Congress has carried out the responsibility of the United States for the protection and preservation of Indian Tribes and the resources of Indian Tribes through the endorsement of treaties, and the enactment of other laws, including laws that provide for the exercise of administrative authorities;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s2/a/6" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">the United States has an obligation to guard and preserve the sovereignty of Indian Tribes in order to foster strong Tribal governments, Indian self-determination, and economic self-sufficiency among Indian Tribes;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s2/a/7" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">the capacity of Indian Tribes to build strong Tribal governments and vigorous economies is hindered by the inability of Indian Tribes to engage communities that surround Indian lands and outside investors in economic activities on Indian lands;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s2/a/8" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="8">(8) </num><content style="-uslm-dtd:text">despite the availability of abundant natural resources on Indian lands and a rich cultural legacy that accords great  value to self-determination, self-reliance, and independence, Native Americans suffer higher rates of unemployment, poverty, poor health, substandard housing, and associated social ills than those of any other group in the United States;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s2/a/9" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="9">(9) </num><chapeau style="-uslm-dtd:text">the United States has an obligation to assist Indian Tribes with the creation of appropriate economic and political conditions with respect to Indian lands to—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s2/a/9/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">encourage investment from outside sources that do not originate with the Tribes; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s2/a/9/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">facilitate economic ventures with outside entities that are not Tribal entities;</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s2/a/10" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="10">(10) </num><content style="-uslm-dtd:text">the economic success and material well-being of Native American communities depends on the combined efforts of the Federal Government, Tribal governments, the private sector, and individuals;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s2/a/11" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="11">(11) </num><chapeau style="-uslm-dtd:text">the lack of employment and entrepreneurial opportunities in the communities referred to in paragraph (7) has resulted in a multigenerational dependence on Federal assistance that is—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s2/a/11/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">insufficient to address the magnitude of needs; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s2/a/11/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">unreliable in availability; and</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s2/a/12" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="12">(12) </num><chapeau style="-uslm-dtd:text">the twin goals of economic self-sufficiency and political self-determination for Native Americans can best be served by making available to address the challenges faced by those groups—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s2/a/12/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the resources of the private market;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s2/a/12/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">adequate capital; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s2/a/12/C" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">technical expertise.</content>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/464/s2/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Purposes.—</heading><chapeau style="-uslm-dtd:text">The purposes of this Act are as follows:</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s2/b/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">To revitalize economically and physically distressed Native American economies by—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s2/b/1/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">encouraging the formation of new businesses by eligible entities, and the expansion of existing businesses; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s2/b/1/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">facilitating the movement of goods to and from Indian lands and the provision of services by Indians.</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s2/b/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">To promote private investment in the economies of Indian Tribes and to encourage the sustainable development of resources of Indian Tribes and Indian-owned businesses.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s2/b/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">To promote the long-range sustained growth of the economies of Indian Tribes.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s2/b/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">To raise incomes of Indians in order to reduce the number of Indians at poverty levels and provide the means for achieving a higher standard of living on Indian reservations.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s2/b/5" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">To encourage intertribal, regional, and international trade and business development in order to assist in increasing productivity and the standard of living of members of Indian Tribes and improving the economic self-sufficiency of the governing bodies of Indian Tribes.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s2/b/6" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">To promote economic self-sufficiency and political self-determination for Indian Tribes and members of Indian Tribes.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/464/s2/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Applicability to Indian-Owned Businesses.—</heading><chapeau style="-uslm-dtd:text">The findings and purposes in subsections (a) and (b) shall apply to any Indian-owned business governed—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s2/c/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">by Tribal laws regulating trade or commerce on Indian lands; or</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s2/c/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">pursuant to section 5 of the Act of August 15, 1876 (19 Stat. 200, chapter 289; 25 U.S.C. 261).</content>
                </paragraph>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/106/464/s3" styleType="OLC" role="definitions">
            <num style="-uslm-dtd:enum" value="3">SEC. 3.<ref style="-uslm-dtd:footnote-ref" idref="IDCE2149E1545946AA8B26AEEA30DBC814" class="footnoteRef">1</ref> </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t25/s4302">25 U.S.C. 4302</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">DEFINITIONS. </heading>
            <chapeau style="-uslm-dtd:text" class="block">In this Act:</chapeau>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s3/1" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Director.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Director</term>” means the Director of Native American Business Development appointed pursuant to section 4(a)(2).</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s3/2" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Eligible entity.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">eligible entity</term>” means an Indian Tribe or Tribal organization, an Indian arts and crafts organization, as that term is defined in section 2 of the Act of August 27, 1935 (commonly known as the “<term style="-uslm-dtd:quote">Indian Arts and Crafts Act</term>”) (49 Stat. 891, chapter 748; 25 U.S.C. 305a), a Tribal enterprise, a Tribal marketing cooperative (as that term is defined by the Secretary, in consultation with the Secretary of the Interior), or any other Indian-owned business.</content><footnote id="IDCE2149E1545946AA8B26AEEA30DBC814" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">1</sup><p style="-uslm-dtd:para; margin-left:1em">Section 3(b) of Public Law 116–261 provides for amendments to add new paragraphs (1) and (8) and renumbers existing paragraphs. Subsection (e)(1) of such section 3 provides for amendments to this section in paragraphs (1), (4), (6), and (8) without reference  to the earlier amendments and refers to paragraphs prior to their redesignation. The amendments made by such subsection (e)(1) were carried out first followed by the earlier ones in subsection (b) in order to reflect the probable intent of Congress.</p></footnote>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s3/3" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Indian.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Indian</term>” has the meaning given that term in section 4(d) of the Indian Self-Determination and Education Assistance Act (25 U.S.C. 450b(d)).</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s3/4" styleType="OLC">
                <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Indian goods and services.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Indian goods and services</term>” means—</chapeau>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s3/4/A" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">Indian goods, within the meaning of section 2 of the Act of August 27, 1935 (commonly known as the “<term style="-uslm-dtd:quote">Indian Arts and Crafts Act</term>”) (49 Stat. 891, chapter 748; 25 U.S.C. 305a);</content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s3/4/B" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">goods produced or originated by an eligible entity; and</content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s3/4/C" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">services provided by eligible entities.</content>
                </subparagraph>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s3/5" styleType="OLC">
                <num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">Indian lands.—</heading>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s3/5/A" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Indian lands</term>” includes lands under the definition of—</chapeau>
                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/106/464/s3/5/A/i" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:term">Indian country</term>” under section 1151 of title 18, United States Code; or</content>
                    </clause>
                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/106/464/s3/5/A/ii" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="ii">(ii) </num><chapeau style="-uslm-dtd:text">the term “<term style="-uslm-dtd:term">reservation</term>” under—</chapeau>
                        <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/106/464/s3/5/A/ii/I" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">section 3(d) of the Indian Financing Act of 1974 (25 U.S.C. 1452(d)); or</content>
                        </subclause>
                        <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/106/464/s3/5/A/ii/II" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">section 4(10) of the Indian Child Welfare Act of 1978 (25 U.S.C. 1903(10)).</content>
                        </subclause>
                    </clause>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s3/5/B" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Former indian reservations in oklahoma.—</heading><chapeau style="-uslm-dtd:text">For purposes of applying section 3(d) of the Indian Financing Act of 1974 (25 U.S.C. 1452(d)) under subparagraph (A)(ii), the term “<term style="-uslm-dtd:term">former Indian reservations in Oklahoma</term>” shall be construed to include lands that are—</chapeau>
                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/106/464/s3/5/B/i" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">within the jurisdictional areas of an Oklahoma Indian Tribe (as determined by the Secretary of the Interior); and</content>
                    </clause>
                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/106/464/s3/5/B/ii" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">recognized by the Secretary of the Interior as eligible for trust land status under part 151 of title 25, Code of Federal Regulations (as in effect on the date of enactment of this Act).</content>
                    </clause>
                </subparagraph>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s3/6" styleType="OLC">
                <num style="-uslm-dtd:enum" value="6">(6) </num><heading style="-uslm-dtd:header">Indian-owned business.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Indian-owned business</term>” means an entity organized for the conduct of trade or commerce with respect to which at least 50 percent of the property interests of the entity are owned by Indians or Indian Tribes (or a combination thereof).</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s3/7" styleType="OLC">
                <num style="-uslm-dtd:enum" value="7">(7) </num><heading style="-uslm-dtd:header">Indian tribe.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Indian Tribe</term>” has the meaning given the term “<term style="-uslm-dtd:term">Indian tribe</term>” in section 4(e) of the Indian Self-Determination and Education Assistance Act (25 U.S.C. 450b(e)).</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s3/8" styleType="OLC">
                <num style="-uslm-dtd:enum" value="8">(8) </num><heading style="-uslm-dtd:header">Office.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Office</term>” means the Office of Native American Business Development established by section 4(a)(1).</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s3/9" styleType="OLC">
                <num style="-uslm-dtd:enum" value="9">(9) </num><heading style="-uslm-dtd:header">Secretary.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Secretary</term>” means the Secretary of Commerce.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s3/10" styleType="OLC">
                <num style="-uslm-dtd:enum" value="10">(10) </num><heading style="-uslm-dtd:header">Tribal enterprise.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Tribal enterprise</term>” means a commercial activity or business managed or controlled by an Indian Tribe.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s3/11" styleType="OLC">
                <num style="-uslm-dtd:enum" value="11">(11) </num><heading style="-uslm-dtd:header">Tribal organization.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Tribal organization</term>” has the meaning given that term in section 4(l) of the Indian Self-Determination and Education Assistance Act (25 U.S.C. 450b(l)).</content>
            </paragraph>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/106/464/s4" styleType="OLC">
            <num style="-uslm-dtd:enum" value="4">SEC. 4. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t25/s4303">25 U.S.C. 4303</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">OFFICE OF NATIVE AMERICAN BUSINESS DEVELOPMENT. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/464/s4/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s4/a/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Establishment.—</heading><content style="-uslm-dtd:text">There is established within the Office of the Secretary an office known as the Office of Native American Business Development .</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s4/a/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Director.—</heading><content style="-uslm-dtd:text">The Office shall be headed by a Director, appointed by the Secretary, whose title shall be the Director of Native American Business Development. The Director shall be compensated at a rate not to exceed level V of the Executive Schedule under section 5316 of title 5, United States Code.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/464/s4/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Duties of the Secretary.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s4/b/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Secretary, acting through the Director, shall ensure the coordination of Federal programs that provide assistance, including financial and technical assistance, to eligible entities for increased business, the expansion of trade by eligible entities, and economic development on Indian lands.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s4/b/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Interagency coordination.—</heading><content style="-uslm-dtd:text">The Secretary, acting through the Director, shall coordinate Federal programs relating to Indian economic development, including any such program of the Department of the Interior, the Small Business Administration, the Department of Labor, or any other Federal agency charged with Indian economic development responsibilities.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s4/b/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Activities.—</heading><chapeau style="-uslm-dtd:text">In carrying out the duties described in paragraph (1), the Secretary, acting through the Director, shall ensure the coordination of, or, as appropriate, carry out—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s4/b/3/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">Federal programs designed to provide legal, accounting, or financial assistance to eligible entities;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s4/b/3/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">market surveys;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s4/b/3/C" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">the development of promotional materials;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s4/b/3/D" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">the financing of business development seminars;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s4/b/3/E" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">the facilitation of marketing;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s4/b/3/F" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">the participation of appropriate Federal agencies or eligible entities in trade fairs;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s4/b/3/G" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="G">(G) </num><content style="-uslm-dtd:text">any activity that is not described in subparagraphs (A) through (F) that is related to the development of appropriate markets; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s4/b/3/H" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="H">(H) </num><content style="-uslm-dtd:text">any other activity that the Secretary, in consultation with the Director, determines to be appropriate to carry out this section.</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s4/b/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Assistance.—</heading><chapeau style="-uslm-dtd:text">In conjunction with the activities described in paragraph (3), the Secretary, acting through the Director, shall provide—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s4/b/4/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><chapeau style="-uslm-dtd:text">financial assistance, technical assistance, and administrative services to eligible entities to assist those entities with—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/106/464/s4/b/4/A/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">identifying and taking advantage of business development opportunities; and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/106/464/s4/b/4/A/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">compliance with appropriate laws and regulatory practices; and</content>
                        </clause>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s4/b/4/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">such other assistance as the Secretary, in consultation with the Director, determines to be necessary for the development of business opportunities for eligible entities to enhance the economies of Indian Tribes.</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s4/b/5" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">Priorities.—</heading><chapeau style="-uslm-dtd:text">In carrying out the duties and activities described in paragraphs (3) and (4), the Secretary, acting through the Director, shall give priority to activities that—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s4/b/5/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">provide the greatest degree of economic benefits to Indians; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s4/b/5/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">foster long-term stable economies of Indian Tribes.</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s4/b/6" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="6">(6) </num><heading style="-uslm-dtd:header">Prohibition.—</heading><content style="-uslm-dtd:text">The Secretary may not provide under this section assistance for any activity related to the operation of a gaming activity on Indian lands pursuant to the Indian Gaming Regulatory Act (25 U.S.C. 2710 et seq.).</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/464/s4/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Duties of Director.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s4/c/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">The Director shall serve as—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s4/c/1/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the program and policy advisor to the Secretary with respect to the trust and governmental relationship between the United States and Indian Tribes; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s4/c/1/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">the point of contact for Indian Tribes, Tribal organizations, and Indians regarding—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/106/464/s4/c/1/B/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">policies and programs of the Department of Commerce; and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/106/464/s4/c/1/B/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">other matters relating to economic development and doing business in Indian lands.</content>
                        </clause>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s4/c/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Departmental coordination.—</heading><chapeau style="-uslm-dtd:text">The Director shall coordinate with all offices and agencies within the Department of Commerce to ensure that each office and agency has an accountable process to ensure—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s4/c/2/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">meaningful and timely coordination and assistance, as required by this Act; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s4/c/2/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">consultation with Indian Tribes regarding the policies, programs, assistance, and activities of the offices and agencies.</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s4/c/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Office operations.—</heading><content style="-uslm-dtd:text">There are authorized to be appropriated to carry out this section not more than $2,000,000 for each fiscal year.</content>
                </paragraph>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/106/464/s5" styleType="OLC">
            <num style="-uslm-dtd:enum" value="5">SEC. 5. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t25/s4304">25 U.S.C. 4304</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">NATIVE AMERICAN TRADE AND EXPORT PROMOTION. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/464/s5/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">The Secretary, acting through the Director, shall carry out a Native American export and trade promotion program (referred to in this section as the “<quotedText style="-uslm-dtd:quote">program</quotedText>”).</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/464/s5/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Coordination of Federal Programs and Services.—</heading><chapeau style="-uslm-dtd:text">In carrying out the program, the Secretary, acting through the Director, and in cooperation with the heads of appropriate Federal agencies, shall ensure the coordination of Federal programs and services designed to—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s5/b/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">develop the economies of Indian Tribes; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s5/b/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">stimulate the demand for Indian goods and services that are available from eligible entities.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/464/s5/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Activities.—</heading><chapeau style="-uslm-dtd:text">In carrying out the duties described in subsection (b), the Secretary, acting through the Director, shall ensure the coordination of, or, as appropriate, carry out—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s5/c/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">Federal programs designed to provide technical or financial assistance to eligible entities;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s5/c/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the development of promotional materials;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s5/c/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">the financing of appropriate trade missions;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s5/c/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">the marketing of Indian goods and services;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s5/c/5" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">the participation of appropriate Federal agencies or eligible entities in international trade fairs; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s5/c/6" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">any other activity related to the development of markets for Indian goods and services.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/464/s5/d" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Technical Assistance.—</heading><chapeau style="-uslm-dtd:text">In conjunction with the activities described in subsection (c), the Secretary, acting through the Director, shall provide technical assistance and administrative services to eligible entities to assist those entities with—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s5/d/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the identification of appropriate markets for Indian goods and services;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s5/d/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">entering the markets referred to in paragraph (1);</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s5/d/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">compliance with foreign or domestic laws and practices with respect to financial institutions with respect to the export and import of Indian goods and services; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s5/d/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">entering into financial arrangements to provide for the export and import of Indian goods and services.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/464/s5/e" styleType="OLC">
                <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Priorities.—</heading><chapeau style="-uslm-dtd:text">In carrying out the duties and activities described in subsections (b) and (c), the Secretary, acting through the Director, shall give priority to activities that—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s5/e/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">provide the greatest degree of economic benefits to Indians; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s5/e/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">foster long-term stable international markets for Indian goods and services.</content>
                </paragraph>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/106/464/s6" styleType="OLC">
            <num style="-uslm-dtd:enum" value="6">SEC. 6. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t25/s4305">25 U.S.C. 4305</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">INTERTRIBAL TOURISM DEMONSTRATION PROJECTS. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/464/s6/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Program To Conduct Tourism Projects.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s6/a/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Secretary, acting through the Director, shall conduct a Native American tourism program to facilitate the development and conduct of tourism demonstration projects by Indian Tribes, on a Tribal, intertribal, or regional basis.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s6/a/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Demonstration projects.—</heading>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s6/a/2/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Under the program established under this section, in order to assist in the development and promotion of tourism on and in the vicinity of Indian lands, the Secretary, acting through the Director, shall, in coordination with the Under Secretary of Agriculture for Rural Development, assist eligible entities in the planning, development, and implementation of tourism development demonstration projects that meet the criteria described in subparagraph (B).</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s6/a/2/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Projects described.—</heading><chapeau style="-uslm-dtd:text">In selecting tourism development demonstration projects under this section, the Secretary, acting through the Director, shall select projects that have the potential to increase travel and tourism revenues by attracting visitors to Indian lands and lands in the vicinity of Indian lands, including projects that provide for—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/106/464/s6/a/2/B/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the development and distribution of educational and promotional materials pertaining to attractions located on and near Indian lands;</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/106/464/s6/a/2/B/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the development of educational resources to assist in private and public tourism development on and in the vicinity of Indian lands; and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/106/464/s6/a/2/B/iii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">the coordination of tourism-related joint ventures and cooperative efforts between eligible entities and appropriate State and local governments that have jurisdiction over areas in the vicinity of Indian lands.</content>
                        </clause>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s6/a/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Grants.—</heading><content style="-uslm-dtd:text">To carry out the program under this section, the Secretary, acting through the Director, may award grants or enter into other appropriate arrangements with Indian Tribes, Tribal organizations, intertribal consortia, or other Tribal entities that the Secretary, in consultation with the Director, determines to be appropriate.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s6/a/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Locations.—</heading><chapeau style="-uslm-dtd:text">In providing for tourism development demonstration projects under the program under this section, the Secretary, acting through the Director, shall provide for a demonstration project to be conducted—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s6/a/4/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">for Indians of the Four Corners area located in the area adjacent to the border between Arizona, Utah, Colorado, and New Mexico;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s6/a/4/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">for Indians of the northwestern area that is commonly known as the Great Northwest (as determined by the Secretary);</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s6/a/4/C" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">for the Oklahoma Indians in Oklahoma;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s6/a/4/D" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">for the Indians of the Great Plains area (as determined by the Secretary); and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s6/a/4/E" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">for Alaska Natives in Alaska.</content>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/464/s6/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Assistance.—</heading><chapeau style="-uslm-dtd:text">The Secretary, acting through the Director, shall provide financial assistance, technical assistance, and administrative services to participants that the Secretary, acting through the Director, selects to carry out a tourism development project under this section, with respect to—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s6/b/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">feasibility studies conducted as part of that project;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s6/b/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">market analyses;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s6/b/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">participation in tourism and trade missions; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s6/b/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">any other activity that the Secretary, in consultation with the Director, determines to be appropriate to carry out this section.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/464/s6/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Infrastructure Development.—</heading><content style="-uslm-dtd:text">The demonstration projects conducted under this section shall include provisions to facilitate the development and financing of infrastructure, including the development of Indian reservation roads in a manner consistent with title 23, United States Code.</content>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/106/464/s7" styleType="OLC">
            <num style="-uslm-dtd:enum" value="7">SEC. 7. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t25/s4306">25 U.S.C. 4306</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">REPORT TO CONGRESS. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/464/s7/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Secretary, in consultation with the Director, shall prepare and submit to the Committee on Indian Affairs of the Senate and the Committee on Resources of the House of Representatives a report on the operation of the Office.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/464/s7/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Contents of Report.—</heading><chapeau style="-uslm-dtd:text">Each report prepared under subsection (a) shall include—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s7/b/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">for the period covered by the report, a summary of the activities conducted by the Secretary, acting through the Director, in carrying out sections 4 through 6; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s7/b/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">any recommendations for legislation that the Secretary, in consultation with the Director, determines to be necessary to carry out sections 4 through 6.</content>
                </paragraph>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/106/464/s8" styleType="OLC">
            <num style="-uslm-dtd:enum" value="8">SEC. 8. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t25/s4306a">25 U.S.C.
4306a</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">INDIAN COMMUNITY DEVELOPMENT INITIATIVES. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/464/s8/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Interagency Coordination.—</heading><chapeau style="-uslm-dtd:text">Not later than 1 year after the enactment of this section, the Secretary, the Secretary of the Interior, and the Secretary of the Treasury shall coordinate—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s8/a/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">to develop initiatives that—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s8/a/1/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><chapeau style="-uslm-dtd:text">encourage, promote, and provide education regarding investments in Indian communities through—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/106/464/s8/a/1/A/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the loan guarantee program of Bureau of Indian Affairs under section 201 of the Indian Financing Act of 1974 (25 U.S.C. 1481);</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/106/464/s8/a/1/A/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">programs carried out using amounts in the Community Development Financial Institutions Fund established under section 104(a) of the Community Development Banking and Financial Institutions Act of 1994 (12 U.S.C. 4703(a)); and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/106/464/s8/a/1/A/iii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">other capital development programs;</content>
                        </clause>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s8/a/1/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">examine and develop alternatives that would qualify as collateral for financing in Indian communities; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s8/a/1/C" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">provide entrepreneur and other training relating to economic development through tribally controlled colleges and universities and other Indian organizations with experience in providing such training;</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s8/a/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">to consult with Indian Tribes and with the Securities and Exchange Commission to study, and collaborate to establish, regulatory changes necessary to qualify an Indian Tribe as an accredited investor for the purposes of sections 230.500 through 230.508 of title 17, Code of Federal Regulations (or successor regulations), consistent with the goals of promoting capital formation and ensuring qualifying Indian Tribes have the ability to withstand investment loss, on a basis comparable to other legal entities that qualify as accredited investors who are not natural persons;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s8/a/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">to identify regulatory, legal, or other barriers to increasing investment, business, and economic development, including qualifying or approving collateral structures, measurements of economic strength, and contributions of Indian economies in Indian communities through the Authority established under section 4 of the Indian Tribal Regulatory Reform and Business Development Act of 2000 (25 U.S.C. 4301 note);</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s8/a/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">to ensure consultation with Indian Tribes regarding increasing investment in Indian communities and the development of the report required in paragraph (5); and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s8/a/5" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><chapeau style="-uslm-dtd:text">not less than once every 2 years, to provide a report to Congress regarding—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s8/a/5/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">improvements to Indian communities resulting from such initiatives and recommendations for promoting sustained growth of the Tribal economies;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s8/a/5/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">results of the study and collaboration regarding the necessary changes referenced in paragraph (2) and the impact of allowing Indian Tribes to qualify as an accredited investor; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s8/a/5/C" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">the identified regulatory, legal, and other barriers referenced in paragraph (3).</content>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/464/s8/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Waiver.—</heading><content style="-uslm-dtd:text">For assistance provided pursuant to section 108 of the Community Development Banking and Financial Institutions Act of 1994 (12 U.S.C. 4707) to benefit Native Community Development Financial Institutions, as defined by the Secretary of the Treasury, section 108(e) of such Act shall not apply.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/464/s8/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Indian Economic Development Feasibility Study.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s8/c/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Government Accountability Office shall conduct a study and, not later than 18 months after the date of enactment of this subsection, submit to the Committee on Indian Affairs of the Senate and the Committee on Natural Resources of the House of Representatives a report on the findings of the study and recommendations.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/464/s8/c/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Contents.—</heading><chapeau style="-uslm-dtd:text">The study shall include an assessment of each of the following:</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s8/c/2/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The study shall assess current Federal capitalization and related programs and services that are available to assist Indian communities with business and economic development, including manufacturing, physical infrastructure (such as telecommunications and broadband), community development, and facilities construction for such purposes. For each of the Federal programs and services identified, the study shall assess the current use and demand by Indian Tribes, individuals, businesses, and communities of the programs, the capital needs of Indian Tribes, businesses, and communities related to economic development, the extent to which the programs and services overlap or are duplicative, and the extent that similar programs have been used to assist non-Indian communities compared to the extent used for Indian communities.</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s8/c/2/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Financing assistance.—</heading><chapeau style="-uslm-dtd:text">The study shall assess and quantify the extent of assistance provided to non-Indian borrowers and to Indian (both Tribal and individual) borrowers (including information about such assistance as a percentage of need for Indian borrowers and for non-Indian borrowers, assistance to Indian borrowers and to non-Indian borrowers as a percentage of total applicants, and such assistance to Indian borrowers as individuals as compared to such assistance to Indian Tribes) through the loan programs, the loan guarantee programs, or bond guarantee programs of the—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/106/464/s8/c/2/B/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">Department of the Interior;</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/106/464/s8/c/2/B/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">Department of Agriculture;</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/106/464/s8/c/2/B/iii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">Department of Housing and Urban Development;</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/106/464/s8/c/2/B/iv" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">Department of Energy;</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/106/464/s8/c/2/B/v" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="v">(v) </num><content style="-uslm-dtd:text">Small Business Administration; and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/106/464/s8/c/2/B/vi" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="vi">(vi) </num><content style="-uslm-dtd:text">Community Development Financial Institutions Fund of the Department of the Treasury.</content>
                        </clause>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s8/c/2/C" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Tax incentives.—</heading><chapeau style="-uslm-dtd:text">The study shall assess and quantify the extent of the assistance and allocations afforded for non-Indian projects and for Indian projects pursuant to each of the following tax incentive programs:</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/106/464/s8/c/2/C/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">New market tax credit.</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/106/464/s8/c/2/C/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">Low income housing tax credit.</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/106/464/s8/c/2/C/iii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">Investment tax credit.</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/106/464/s8/c/2/C/iv" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">Renewable energy tax incentives.</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/106/464/s8/c/2/C/v" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="v">(v) </num><content style="-uslm-dtd:text">Accelerated depreciation.</content>
                        </clause>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/464/s8/c/2/D" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><heading style="-uslm-dtd:header">Tribal investment incentive.—</heading><content style="-uslm-dtd:text">The study shall assess various alternative incentives that could be provided to enable and encourage Tribal governments to invest in an Indian community development investment fund or bank.</content>
                    </subparagraph>
                </paragraph>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/106/464/s10" styleType="OLC">
            <num style="-uslm-dtd:enum" value="10">SEC. 10.<ref style="-uslm-dtd:footnote-ref" idref="ID153BF33575BB409BADF35CD09A271154" class="footnoteRef">2</ref> </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t25/s4307">25 U.S.C. 4307</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">AUTHORIZATION OF APPROPRIATIONS. </heading>
            <content style="-uslm-dtd:text" class="block">There are authorized to be appropriated such sums as are necessary to carry out this Act, to remain available until expended.</content><footnote id="ID153BF33575BB409BADF35CD09A271154" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">2</sup><p style="-uslm-dtd:para; margin-left:1em">There is no section 9 in law. See amendments made by section 3(d) of Public Law 116–261.</p></footnote>
