    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">Authorizing the Secretary of Agriculture to collect and publish statistics of the grade and staple length of cotton.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

        <section identifier="/us/sComp/69/337/s3a" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3a">SEC. 3a. </num><heading style="-uslm-dtd:header">COTTON CLASSIFICATION SERVICES. </heading>
            <subsection identifier="/us/sComp/69/337/s3a/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><chapeau style="-uslm-dtd:text">The Secretary of Agriculture (referred to in this section as the “<quotedText style="-uslm-dtd:quote">Secretary</quotedText>”) shall—</chapeau>
                <paragraph identifier="/us/sComp/69/337/s3a/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">
 </heading><content style="-uslm-dtd:text">make cotton classification services available to producers of cotton; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/69/337/s3a/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">
 </heading><content style="-uslm-dtd:text">provide for the collection of classification fees from participating producers or agents that voluntarily agree to collect and remit the fees on behalf of producers.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/69/337/s3a/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Fees.—</heading>
                <paragraph identifier="/us/sComp/69/337/s3a/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header"> Use of fees.—</heading><content style="-uslm-dtd:text">Classification fees collected under subsection (a)(2) and the proceeds from the sales of samples submitted under this section shall, to the maximum extent practicable, be used to pay the cost of the services provided under this section, including administrative and supervisory costs.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/69/337/s3a/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Announcement of fees.—</heading><content style="-uslm-dtd:text">The Secretary shall announce a uniform classification fee and any applicable surcharge for classification services not later than June 1 of the year in which the fee applies.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/69/337/s3a/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Consultation.—</heading>
                <paragraph identifier="/us/sComp/69/337/s3a/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">In establishing the amount of fees under this section, the Secretary shall consult with representatives of the United States cotton industry.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/69/337/s3a/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Exemption.—</heading><content style="-uslm-dtd:text">Chapter 10 of title 5, United States Code, shall not apply to consultations with representatives of the United States cotton industry under this section.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/69/337/s3a/d" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Crediting of Fees.—</heading><chapeau style="-uslm-dtd:text">Any fees collected under this section and under section 3d, late payment penalties, the proceeds from the sales of samples, and interest earned from the investment of such funds shall—</chapeau>
                <paragraph identifier="/us/sComp/69/337/s3a/d/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">
 </heading><content style="-uslm-dtd:text"> be credited to the current appropriation account that incurs the cost of services provided under this section and section 3d; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/69/337/s3a/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">
 </heading><content style="-uslm-dtd:text">remain available without fiscal year limitation to pay the expenses of the Secretary in providing those services.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/69/337/s3a/e" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Investment of Funds.—</heading><chapeau style="-uslm-dtd:text">Funds described in subsection (d) may be invested—</chapeau>
                <paragraph identifier="/us/sComp/69/337/s3a/e/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">
 </heading><content style="-uslm-dtd:text">by the Secretary in insured or fully collateralized, interest-bearing accounts; or</content>
                </paragraph>
                <paragraph identifier="/us/sComp/69/337/s3a/e/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">at the discretion of the Secretary, by the Secretary of the Treasury in United States Government debt instruments.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/69/337/s3a/f" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Lease Agreements.—</heading><content style="-uslm-dtd:text">Notwithstanding any other provision of law, the Secretary may enter into long-term lease agreements that exceed 5 years or may take title to property (including through purchase agreements) for the purpose of obtaining offices to be used for the classification of cotton in accordance with this Act, if the Secretary determines that action would best effectuate the purposes of this Act.</content>
            </subsection>
            <subsection identifier="/us/sComp/69/337/s3a/g" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Authorization of Appropriations.—</heading><content style="-uslm-dtd:text">To the extent that financing is not available from fees and the proceeds from the sales of samples, there are authorized to be appropriated such sums as are necessary to carry out this section.</content>
            </subsection>
