    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To streamline the process by which active duty military, reservists, and veterans receive commercial driver’s licenses.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section style="-uslm-dtd:section" identifier="/us/sComp/115/105/s1" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t49/s30101">49 U.S.C. 30101 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content style="-uslm-dtd:text" class="block">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Jobs for Our Heroes Act</shortTitle>”.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/115/105/s2" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">MEDICAL CERTIFICATE FOR VETERANS OPERATING COMMERCIAL MOTOR VEHICLES. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/105/s2/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Qualified Examiners.—</heading><content style="-uslm-dtd:text">Section 5403(d)(2) of the FAST Act (49 U.S.C. 31149 note; 129 Stat. 1548) is amended to read as follows:<quotedContent style="-uslm-dtd:quoted-block">
                <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">“(2) </num><heading style="-uslm-dtd:header">Qualified examiner.—</heading><chapeau style="-uslm-dtd:text">The term ‘<quotedText style="-uslm-dtd:quote">qualified examiner</quotedText>’ means an individual who—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">“(A) </num><content style="-uslm-dtd:text">is employed by the Department of Veterans Affairs as an advanced practice nurse, doctor of chiropractic, doctor of medicine, doctor of osteopathy, physician assistant, or other medical professional;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">“(B) </num><content style="-uslm-dtd:text">is licensed, certified, or registered in a State to perform physical examinations;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">“(C) </num><content style="-uslm-dtd:text">is familiar with the standards for, and physical requirements of, an operator required to be medically certified under section 31149 of title 49, United States Code; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">“(D) </num><content style="-uslm-dtd:text">has never, with respect to such section, been found to have acted fraudulently, including by fraudulently awarding a medical certificate.”</content>
                    </subparagraph>
                </paragraph></quotedContent>.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/105/s2/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Conforming Amendments.—</heading><chapeau style="-uslm-dtd:text">Section 5403 of the FAST Act (49 U.S.C. 31149 note; 129 Stat. 1548) is amended—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/105/s2/b/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">in subsection (a), by striking “<quotedText style="-uslm-dtd:quote">physician-approved veteran operator, the qualified physician</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">veteran operator approved by a qualified examiner, the qualified examiner</quotedText>”;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/105/s2/b/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">in subsection (b)(1)—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/105/s2/b/2/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">the physician</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">the examiner</quotedText>”; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/105/s2/b/2/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">qualified physician</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">qualified examiner</quotedText>”;</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/105/s2/b/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><chapeau style="-uslm-dtd:text">in subsection (c)—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/105/s2/b/3/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">qualified physicians</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">qualified examiners</quotedText>”; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/105/s2/b/3/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">such physicians</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">such examiners</quotedText>”; and</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/105/s2/b/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><chapeau style="-uslm-dtd:text">in subsection (d)—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/105/s2/b/4/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">by redesignating paragraphs (1), (2), and (3) as paragraphs (3), (1), and (2), respectively, and by moving the text of paragraph (3), as redesignated, to appear after paragraph (2), as redesignated; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/105/s2/b/4/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">in paragraph (3), as redesignated—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/115/105/s2/b/4/B/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">in the paragraph heading, by striking “<quotedText style="-uslm-dtd:quote"><headingText style="-uslm-dtd:header-in-text">Physician-approved veteran operator</headingText></quotedText>” and inserting “<quotedText style="-uslm-dtd:quote"><headingText style="-uslm-dtd:header-in-text">Veteran operator approved by a qualified examiner</headingText></quotedText>”; and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/115/105/s2/b/4/B/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">physician-approved veteran operator</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">veteran operator approved by a qualified examiner</quotedText>”.</content>
                        </clause>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/115/105/s2/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t49/s31149">49 U.S.C. 31149 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Rulemaking.—</heading><content style="-uslm-dtd:text">The amendments made by this section shall be incorporated into any rulemaking proceeding related to section 5403 of the FAST Act (49 U.S.C. 31149 note; 129 Stat. 1548) that is being conducted as of the date of the enactment of this Act.</content>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/115/105/s3" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><heading style="-uslm-dtd:header">COMMERCIAL DRIVER’S LICENSE STANDARDS FOR CURRENT AND FORMER MEMBERS OF THE ARMED FORCES. </heading>
            <chapeau style="-uslm-dtd:text" class="block">Section 31305(d) of title 49, United States Code, is amended—</chapeau>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/105/s3/1" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">in the subsection heading, by striking “<quotedText style="-uslm-dtd:quote"><headingText style="-uslm-dtd:header-in-text">Veteran Operators</headingText></quotedText>” and inserting “<quotedText style="-uslm-dtd:quote"><headingText style="-uslm-dtd:header-in-text">Operators Who Are Members of the Armed Forces, Reservists, or Veterans</headingText></quotedText>”;</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/105/s3/2" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">in paragraph (1)(B), by striking “<quotedText style="-uslm-dtd:quote">subparagraph (A) during, at least,</quotedText>” and inserting<quotedContent style="-uslm-dtd:quoted-block" class="inline"><chapeau style="-uslm-dtd:text">“subparagraph (A)—</chapeau>
                <clause style="-uslm-dtd:clause" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="i">“(i) </num><content style="-uslm-dtd:text">while serving in the armed forces or reserve components; and</content>
                </clause>
                <clause style="-uslm-dtd:clause" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="ii">“(ii) </num><content style="-uslm-dtd:text">during”</content>
                </clause></quotedContent>; and</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/115/105/s3/3" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><chapeau style="-uslm-dtd:text">in paragraph (2)(B)—</chapeau>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/105/s3/3/A" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">by inserting “<quotedText style="-uslm-dtd:quote">current or</quotedText>” before “<quotedText style="-uslm-dtd:quote">former</quotedText>” each place the term appears; and</content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/115/105/s3/3/B" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">by inserting “<quotedText style="-uslm-dtd:quote">one of</quotedText>” before “<quotedText style="-uslm-dtd:quote">the reserve components</quotedText>”.</content>
                </subparagraph>
            </paragraph>
