    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To improve the Government-wide management of Federal property.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section style="-uslm-dtd:section" identifier="/us/sComp/114/318/s1" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t40/s101">40 U.S.C. 101 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content style="-uslm-dtd:text" class="block">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Federal Property Management Reform Act of 2016</shortTitle>”.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/114/318/s2" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t40/s621">40 U.S.C. 621 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">PURPOSE. </heading>
            <chapeau style="-uslm-dtd:text" class="block">The purpose of this Act is to increase the efficiency and effectiveness of the Federal Government in managing property of the Federal Government by—</chapeau>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/318/s2/1" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">requiring the United States Postal Service to take appropriate measures to better manage and account for property;</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/318/s2/2" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">providing for increased collocation with Postal Service facilities and guidance on Postal Service leasing practices; and</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/318/s2/3" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">establishing a Federal Real Property Council to develop guidance on and ensure the implementation of strategies for better managing Federal property.</content>
            </paragraph>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/114/318/s3" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><heading style="-uslm-dtd:header">PROPERTY MANAGEMENT. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/114/318/s3/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Chapter 5 of subtitle I of title 40, United States Code, is amended by adding at the end the following:<quotedContent style="-uslm-dtd:quoted-block">
                <subchapter style="-uslm-dtd:subchapter">
                    <num style="-uslm-dtd:enum" value="VII">“Subchapter VII—</num><heading style="-uslm-dtd:header">Property Management </heading>
                    <section style="-uslm-dtd:section" styleType="USC" role="definitions">
                        <num style="-uslm-dtd:enum" value="621">“§ 621. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t40/s621">40 U.S.C. 621</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Definitions </heading>
                        <chapeau style="-uslm-dtd:text" class="block">“In this subchapter:</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">“(1) </num><heading style="-uslm-dtd:header">Administrator.—</heading><content style="-uslm-dtd:text">The term ‘<term style="-uslm-dtd:quote">Administrator</term>’ means the Administrator of General Services.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">“(2) </num><heading style="-uslm-dtd:header">Council.—</heading><content style="-uslm-dtd:text">The term ‘<term style="-uslm-dtd:quote">Council</term>’ means the Federal Real Property Council established by section 623(a).</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">“(3) </num><heading style="-uslm-dtd:header">Director.—</heading><content style="-uslm-dtd:text">The term ‘<term style="-uslm-dtd:quote">Director</term>’ means the Director of the Office of Management and Budget.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="4">“(4) </num><heading style="-uslm-dtd:header">Federal agency.—</heading><chapeau style="-uslm-dtd:text">The term ‘<term style="-uslm-dtd:quote">Federal agency</term>’ means—</chapeau>
                            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">“(A) </num><content style="-uslm-dtd:text">an executive department or independent establishment in the executive branch of the Government; or</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">“(B) </num><content style="-uslm-dtd:text">a wholly owned Government corporation (other than the United States Postal Service).</content>
                            </subparagraph>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="5">“(5) </num><heading style="-uslm-dtd:header">Field office.—</heading><content style="-uslm-dtd:text">The term ‘<term style="-uslm-dtd:quote">field office</term>’ means any office of a Federal agency that is not the headquarters office location for the Federal agency.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="6">“(6) </num><heading style="-uslm-dtd:header">Postal property.—</heading><content style="-uslm-dtd:text">The term ‘<term style="-uslm-dtd:quote">postal property</term>’ means any property owned or leased by the United States Postal Service.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="7">“(7) </num><heading style="-uslm-dtd:header">Public-private partnership.—</heading><content style="-uslm-dtd:text">The term ‘<term style="-uslm-dtd:quote">public-private partnership</term>’ means any partnership or working relationship between a Federal agency and a corporation, individual, or nonprofit organization for the purpose of financing, constructing, operating, managing, or maintaining one or more Federal real property assets.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="8">“(8) </num><heading style="-uslm-dtd:header">Underutilized property.—</heading><chapeau style="-uslm-dtd:text">The term ‘<term style="-uslm-dtd:quote">underutilized property</term>’ means a portion or the entirety of any real property, including any improvements, that is used—</chapeau>
                            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">“(A) </num><content style="-uslm-dtd:text">irregularly or intermittently by the accountable Federal agency for program purposes of the Federal agency; or</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">“(B) </num><content style="-uslm-dtd:text">for program purposes that can be satisfied only with a portion of the property.</content>
                            </subparagraph>
                        </paragraph>
                    </section>
                    <section style="-uslm-dtd:section" styleType="USC">
                        <num style="-uslm-dtd:enum" value="622">“§ 622. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t40/s622">40 U.S.C. 622</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Collocation among United States Postal Service properties </heading>
                        <subsection style="-uslm-dtd:subsection" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="a">“(a) </num><heading style="-uslm-dtd:header">Identification of Postal Property.—</heading><chapeau style="-uslm-dtd:text">Each year, the Postmaster General shall—</chapeau>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">“(1) </num><content style="-uslm-dtd:text">identify a list of postal properties with space available for use by Federal agencies; and</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">“(2) </num><chapeau style="-uslm-dtd:text">not later than September 30, submit the list to—</chapeau>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">“(A) </num><content style="-uslm-dtd:text">the Committee on Homeland Security and Governmental Affairs of the Senate; and</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">“(B) </num><content style="-uslm-dtd:text">the Committee on Oversight and Government Reform of the House of Representatives.</content>
                                </subparagraph>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="b">“(b) </num><heading style="-uslm-dtd:header">Voluntary Identification of Postal Property.—</heading><content style="-uslm-dtd:text">Each year, the Postmaster General may submit the list under subsection (a) to the Council.</content>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="c">“(c) </num><heading style="-uslm-dtd:header">Submission of List of Postal Properties to Federal Agencies.—</heading>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">“(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Not later than 30 days after the completion of a list under subsection (a), the Council shall provide the list to each Federal agency.</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">“(2) </num><heading style="-uslm-dtd:header">Review by federal agencies.—</heading><chapeau style="-uslm-dtd:text">Not later than 90 days after the receipt of the list submitted under paragraph (1), each Federal agency shall—</chapeau>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">“(A) </num><content style="-uslm-dtd:text">review the list;</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">“(B) </num><content style="-uslm-dtd:text">review properties under the control of the Federal agency; and</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="C">“(C) </num><content style="-uslm-dtd:text">recommend collocations if appropriate.</content>
                                </subparagraph>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="d">“(d) </num><heading style="-uslm-dtd:header">Terms of Collocation.—</heading><content style="-uslm-dtd:text">On approval of the recommendations under subsection (c) by the Postmaster General and the applicable agency head, the Federal agency or appropriate landholding entity may work with the Postmaster General to establish appropriate terms of a lease for each postal property.</content>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="e">“(e) </num><heading style="-uslm-dtd:header">Rule of Construction.—</heading><content style="-uslm-dtd:text">Nothing in this section exceeds, modifies, or supplants any other Federal law relating to any competitive bidding process governing the leasing of postal property.</content>
                        </subsection>
                    </section>
                    <section style="-uslm-dtd:section" styleType="USC">
                        <num style="-uslm-dtd:enum" value="623">“§ 623. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t40/s623">40 U.S.C. 623</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Establishment of a Federal Real Property Council </heading>
                        <subsection style="-uslm-dtd:subsection" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="a">“(a) </num><heading style="-uslm-dtd:header">Establishment.—</heading><content style="-uslm-dtd:text">There is established a Federal Real Property Council.</content>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="b">“(b) </num><heading style="-uslm-dtd:header">Purpose.—</heading><chapeau style="-uslm-dtd:text">The purpose of the Council shall be—</chapeau>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">“(1) </num><content style="-uslm-dtd:text">to develop guidance and ensure implementation of an efficient and effective real property management strategy;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">“(2) </num><content style="-uslm-dtd:text">to identify opportunities for the Federal Government to better manage property and assets of the Federal Government; and</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="3">“(3) </num><content style="-uslm-dtd:text">to reduce the costs of managing property of the Federal Government, including operations, maintenance, and security associated with Federal property.</content>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="c">“(c) </num><heading style="-uslm-dtd:header">Composition.—</heading>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">“(1) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">The Council shall be composed exclusively of—</chapeau>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">“(A) </num><content style="-uslm-dtd:text">the senior real property officers of each Federal agency;</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">“(B) </num><content style="-uslm-dtd:text">the Deputy Director for Management of the Office of Management and Budget;</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="C">“(C) </num><content style="-uslm-dtd:text">the Controller of the Office of Management and Budget;</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="D">“(D) </num><content style="-uslm-dtd:text">the Administrator; and</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="E">“(E) </num><content style="-uslm-dtd:text">any other full-time or permanent part-time Federal officials or employees, as the Chairperson determines to be necessary.</content>
                                </subparagraph>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">“(2) </num><heading style="-uslm-dtd:header">Chairperson.—</heading><content style="-uslm-dtd:text">The Deputy Director for Management of the Office of Management and Budget shall serve as Chairperson of the Council.</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="3">“(3) </num><heading style="-uslm-dtd:header">Executive director.—</heading>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">“(A) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">The Chairperson shall designate an Executive Director to assist in carrying out the duties of the Council.</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">“(B) </num><heading style="-uslm-dtd:header">Qualifications.—</heading><chapeau style="-uslm-dtd:text">The Executive Director shall—</chapeau>
                                    <clause style="-uslm-dtd:clause" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="i">“(i) </num><content style="-uslm-dtd:text">be appointed from among individuals who have substantial experience in the areas of commercial real estate and development, real property management, and Federal operations and management; and</content>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="ii">“(ii) </num><content style="-uslm-dtd:text">hold no outside employment that may conflict with duties inherent to the position.</content>
                                    </clause>
                                </subparagraph>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="d">“(d) </num><heading style="-uslm-dtd:header">Meetings.—</heading>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">“(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Council shall meet subject to the call of the Chairperson.</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">“(2) </num><heading style="-uslm-dtd:header">Minimum.—</heading><content style="-uslm-dtd:text">The Council shall meet not fewer than 4 times each year.</content>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="e">“(e) </num><heading style="-uslm-dtd:header">Duties.—</heading><chapeau style="-uslm-dtd:text">The Council, in consultation with the Director and the Administrator, shall—</chapeau>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">“(1) </num><chapeau style="-uslm-dtd:text">not later than 1 year after the date of enactment of this subchapter, establish a real property management plan template, to be updated annually, which shall include performance measures, specific milestones, measurable savings, strategies, and Government-wide goals based on the goals established under section 524(a)(7) to reduce surplus property or to achieve better utilization of underutilized property, and evaluation criteria to determine the effectiveness of real property management that are designed—</chapeau>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">“(A) </num><content style="-uslm-dtd:text">to enable Congress and heads of Federal agencies to track progress in the achievement of property management objectives on a Government-wide basis;</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">“(B) </num><content style="-uslm-dtd:text">to improve the management of real property; and</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="C">“(C) </num><content style="-uslm-dtd:text">to allow for comparison of the performance of Federal agencies against industry and other public sector agencies;</content>
                                </subparagraph>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">“(2) </num><content style="-uslm-dtd:text">develop utilization rates consistent throughout each category of space, considering the diverse nature of the Federal portfolio and consistent with nongovernmental space use rates;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="3">“(3) </num><content style="-uslm-dtd:text">develop a strategy to reduce the reliance of Federal agencies on leased space for long-term needs if ownership would be less costly;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="4">“(4) </num><content style="-uslm-dtd:text">provide guidance on eliminating inefficiencies in the Federal leasing process;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="5">“(5) </num><content style="-uslm-dtd:text">compile a list of field offices that are suitable for collocation with other property assets;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="6">“(6) </num><content style="-uslm-dtd:text">research best practices regarding the use of public-private partnerships to manage properties and develop guidelines for the use of those partnerships in the management of Federal property; and</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="7">“(7) </num><chapeau style="-uslm-dtd:text">not later than 1 year after the date of enactment of this subchapter and annually during the 4-year period beginning on the date that is 1 year after the date of enactment of this subchapter and ending on the date that is 5 years after the date of enactment of this subchapter, the Council shall submit to the Director a report that contains—</chapeau>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">“(A) </num><content style="-uslm-dtd:text">a list of the remaining excess property that is real property, surplus property that is real property, and underutilized property of each Federal agency;</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">“(B) </num><content style="-uslm-dtd:text">the progress of the Council toward developing guidance for Federal agencies to ensure that the assessment required under section 524(a)(11)(B) is carried out in a uniform manner;</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="C">“(C) </num><content style="-uslm-dtd:text">the progress of Federal agencies toward achieving the goals established under section 524(a)(7);</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="D">“(D) </num><content style="-uslm-dtd:text">if necessary, recommendations for legislation or statutory reforms that would further the goals of the Council, including streamlining the disposal of excess or underutilized real property; and</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="E">“(E) </num><content style="-uslm-dtd:text">a list of entities that are consulted under subsection (f).</content>
                                </subparagraph>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="f">“(f) </num><heading style="-uslm-dtd:header">Consultation.—</heading><chapeau style="-uslm-dtd:text">In carrying out the duties described in subsection (e), the Council shall also consult with representatives of—</chapeau>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">“(1) </num><content style="-uslm-dtd:text">State, local, and tribal authorities, as appropriate, and other affected communities; and</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">“(2) </num><chapeau style="-uslm-dtd:text">appropriate private sector entities and nongovernmental organizations that have expertise in areas of—</chapeau>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">“(A) </num><content style="-uslm-dtd:text">commercial real estate and development;</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">“(B) </num><content style="-uslm-dtd:text">government management and operations;</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="C">“(C) </num><content style="-uslm-dtd:text">space planning;</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="D">“(D) </num><content style="-uslm-dtd:text">community development, including transportation and planning;</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="E">“(E) </num><content style="-uslm-dtd:text">historic preservation; and</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="F">“(F) </num><content style="-uslm-dtd:text">providing housing to the homeless population.</content>
                                </subparagraph>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="g">“(g) </num><heading style="-uslm-dtd:header">Council Resources.—</heading><content style="-uslm-dtd:text">The Director and the Administrator shall provide staffing, and administrative support for the Council, as appropriate.</content>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="h">“(h) </num><heading style="-uslm-dtd:header">Access to Report.—</heading><chapeau style="-uslm-dtd:text">The Council shall provide, on an annual basis, the real property management plan template required  under subsection (e)(1) and the reports required under subsection (e)(7) to—</chapeau>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">“(1) </num><content style="-uslm-dtd:text">the Committee on Homeland Security and Governmental Affairs of the Senate;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">“(2) </num><content style="-uslm-dtd:text">the Committee on Environment and Public Works of the Senate;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="3">“(3) </num><content style="-uslm-dtd:text">the Committee on Oversight and Government Reform of the House of Representatives;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="4">“(4) </num><content style="-uslm-dtd:text">the Committee on Transportation and Infrastructure of the House of Representatives; and</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="5">“(5) </num><content style="-uslm-dtd:text">the Comptroller General of the United States.</content>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">“(i) </num><heading style="-uslm-dtd:header">Exclusions.—</heading><chapeau style="-uslm-dtd:text">In this section, surplus property shall not include—</chapeau>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">“(1) </num><content style="-uslm-dtd:text">any military installation (as defined in section 2910 of the Defense Base Closure and Realignment Act of 1990 (10 U.S.C. 2687 note; Public Law 101-510));</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">“(2) </num><content style="-uslm-dtd:text">any property that is excepted from the definition of the term ‘<quotedText style="-uslm-dtd:quote">property</quotedText>’ under section 102;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="3">“(3) </num><content style="-uslm-dtd:text">Indian and native Eskimo property held in trust by the Federal Government as described in section 3301(a)(5)(C)(iii);</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="4">“(4) </num><content style="-uslm-dtd:text">real property operated and maintained by the Tennessee Valley Authority pursuant to the Tennessee Valley Authority Act of 1933 (16 U.S.C. 831 et seq.);</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="5">“(5) </num><content style="-uslm-dtd:text">any real property the Director excludes for reasons of national security;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="6">“(6) </num><chapeau style="-uslm-dtd:text">any public lands (as defined in section 203 of the Public Lands Corps Act of 1993 (16 U.S.C. 1722)) administered by—</chapeau>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">“(A) </num><chapeau style="-uslm-dtd:text">the Secretary of the Interior, acting through—</chapeau>
                                    <clause style="-uslm-dtd:clause" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="i">“(i) </num><content style="-uslm-dtd:text">the Director of the Bureau of Land Management;</content>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="ii">“(ii) </num><content style="-uslm-dtd:text">the Director of the National Park Service;</content>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="iii">“(iii) </num><content style="-uslm-dtd:text">the Commissioner of Reclamation; or</content>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="iv">“(iv) </num><content style="-uslm-dtd:text">the Director of the United States Fish and Wildlife Service; or</content>
                                    </clause>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">“(B) </num><content style="-uslm-dtd:text">the Secretary of Agriculture, acting through the Chief of the Forest Service; or</content>
                                </subparagraph>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="7">“(7) </num><content style="-uslm-dtd:text">any property operated and maintained by the United States Postal Service.</content>
                            </paragraph>
                        </subsection>
                    </section>
                    <section style="-uslm-dtd:section" styleType="USC">
                        <num style="-uslm-dtd:enum" value="624">“§ 624. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t40/s624">40 U.S.C. 624</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Information on certain leasing authorities </heading>
                        <subsection style="-uslm-dtd:subsection" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="a">“(a) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">Except as provided in subsection (b), not later than December 31 of each year following the date of enactment of this subchapter, a Federal agency with independent leasing authority shall submit to the Council a list of all leases, including operating leases, in effect on the date of enactment of this subchapter that includes—</chapeau>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">“(1) </num><content style="-uslm-dtd:text">the date on which each lease was executed;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">“(2) </num><content style="-uslm-dtd:text">the date on which each lease will expire;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="3">“(3) </num><content style="-uslm-dtd:text">a description of the size of the space;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="4">“(4) </num><content style="-uslm-dtd:text">the location of the property;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="5">“(5) </num><content style="-uslm-dtd:text">the tenant agency;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="6">“(6) </num><content style="-uslm-dtd:text">the total annual rental payment; and</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="7">“(7) </num><content style="-uslm-dtd:text">the amount of the net present value of the total estimated legal obligations of the Federal Government over the life of the contract.</content>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="b">“(b) </num><heading style="-uslm-dtd:header">Exception.—</heading><chapeau style="-uslm-dtd:text">Subsection (a) shall not apply to—</chapeau>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">“(1) </num><content style="-uslm-dtd:text">the United States Postal Service; or</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">“(2) </num><content style="-uslm-dtd:text">any other property the Director excludes from subsection (a) for reasons of national security.”</content>
                            </paragraph>

                            <num style="-uslm-dtd:enum" value="2">“(2) </num><heading style="-uslm-dtd:header">Postal property.—</heading><content style="-uslm-dtd:text">The term ‘<term style="-uslm-dtd:quote">postal property</term>’ means any property owned or leased by the Postal Service.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">“(3) </num><heading style="-uslm-dtd:header">Underutilized property.—</heading><chapeau style="-uslm-dtd:text">The term ‘<term style="-uslm-dtd:quote">underutilized property</term>’ means a portion or the entirety of any real property that is postal property, including any improvements, that is used—</chapeau>
                            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">“(A) </num><content style="-uslm-dtd:text">irregularly or intermittently by the Postal Service for program purposes of the Postal Service; or</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">“(B) </num><content style="-uslm-dtd:text">for program purposes that can be satisfied only with a portion of the property.</content>
                            </subparagraph>
                        </paragraph>

                            <num style="-uslm-dtd:enum" value="a">“(a) </num><heading style="-uslm-dtd:header">In General.—</heading><chapeau style="-uslm-dtd:text">The Postal Service—</chapeau>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">“(1) </num><content style="-uslm-dtd:text">shall maintain adequate inventory controls and accountability systems for postal property;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">“(2) </num><content style="-uslm-dtd:text">shall develop current and future workforce projections so as to have the capacity to assess the needs of the Postal Service workforce regarding the use of property;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="3">“(3) </num><chapeau style="-uslm-dtd:text">may develop a 5-year management template that—</chapeau>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">“(A) </num><content style="-uslm-dtd:text">establishes goals and policies that will lead to the reduction of excess property and underutilized property in the inventory of the Postal Service;</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">“(B) </num><content style="-uslm-dtd:text">adopts workplace practices, configurations, and management techniques that can achieve increased levels  of productivity and decrease the need for real property assets;</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="C">“(C) </num><content style="-uslm-dtd:text">assesses leased space to identify space that is not fully used or occupied;</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="D">“(D) </num><content style="-uslm-dtd:text">develops recommendations on how to address excess capacity at Postal Service facilities without negatively impacting mail delivery; and</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="E">“(E) </num><content style="-uslm-dtd:text">develops recommendations on ensuring the security of mail processing operations; and</content>
                                </subparagraph>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="4">“(4) </num><chapeau style="-uslm-dtd:text">if the Postal Service develops a template under paragraph (3) shall, as part of that template and on a regular basis—</chapeau>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">“(A) </num><content style="-uslm-dtd:text">conduct an inventory of postal property that is real property; and</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">“(B) </num><chapeau style="-uslm-dtd:text">publish a report that covers each property identified under subparagraph (A), similar to the USPS Owned Facilities Report and the USPS Leased Facilities Report, that includes—</chapeau>
                                    <clause style="-uslm-dtd:clause" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="i">“(i) </num><content style="-uslm-dtd:text">the date on which the Postal Service first occupied the property;</content>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="ii">“(ii) </num><content style="-uslm-dtd:text">the size of the property in square footage and acreage;</content>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="iii">“(iii) </num><content style="-uslm-dtd:text">the geographical location of the property, including an address and description;</content>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="iv">“(iv) </num><content style="-uslm-dtd:text">the extent to which the property is being utilized;</content>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="v">“(v) </num><content style="-uslm-dtd:text">the actual annual operating costs associated with the property;</content>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="vi">“(vi) </num><content style="-uslm-dtd:text">the total cost of capital expenditures associated with the property;</content>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="vii">“(vii) </num><content style="-uslm-dtd:text">the number of postal employees, contractor employees, and functions housed at the property;</content>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="viii">“(viii) </num><content style="-uslm-dtd:text">the extent to which the mission of the Postal Service is dependent on the property; and</content>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="ix">“(ix) </num><content style="-uslm-dtd:text">the estimated amount of capital expenditures projected to maintain and operate the property over each of the next 5 years after the date of enactment of this chapter.</content>
                                    </clause>
                                </subparagraph>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="b">“(b) </num><heading style="-uslm-dtd:header">Rule of Construction.—</heading><content style="-uslm-dtd:text">Nothing in subsection (a)(4)(B) shall be construed to require the Postal Service to obtain an appraisal of postal property.”</content>
                        </subsection>
                    </section>

            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/114/318/s4/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Technical and Conforming Amendment.—</heading><content style="-uslm-dtd:text">The table of chapters for part III of title 39, United States Code, is amended by adding at the end the following:<quotedContent style="-uslm-dtd:quoted-block">

        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/114/318/s5" styleType="OLC">
            <num style="-uslm-dtd:enum" value="5">SEC. 5. </num><heading style="-uslm-dtd:header">INSPECTOR GENERAL REPORT ON UNITED STATES POSTAL SERVICE PROPERTY. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/114/318/s5/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Definition of Excess Property.—</heading><content style="-uslm-dtd:text">In this section, the term “<quotedText style="-uslm-dtd:quote">excess property</quotedText>” has the meaning given the term in section 2901 of title 39, United States Code, as added by section 4.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/114/318/s5/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Excess Property Report.—</heading><chapeau style="-uslm-dtd:text">Not later than 2 years after the date of enactment of this Act, the Inspector General of the United States Postal Service shall submit to Congress a report that includes—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/318/s5/b/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">a survey of excess property held by the United States Postal Service; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/318/s5/b/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">recommendations for repurposing property identified in paragraph (1)—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/318/s5/b/2/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><chapeau style="-uslm-dtd:text">to—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/114/318/s5/b/2/A/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">reduce excess capacity; and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/114/318/s5/b/2/A/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">increase collocation with other Federal agencies; and</content>
                        </clause>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/318/s5/b/2/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">without diminishing the ability of the United States Postal Service to meet the service standards established under section 3691 of title 39, United States Code, as in effect on January 1, 2016.</content>
                    </subparagraph>
                </paragraph>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/114/318/s6" styleType="OLC">
            <num style="-uslm-dtd:enum" value="6">SEC. 6. </num><heading style="-uslm-dtd:header">DUTIES OF FEDERAL AGENCIES. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/114/318/s6/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><chapeau style="-uslm-dtd:text">Section 524(a) of title 40, United States Code, is amended—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/318/s6/a/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">in paragraph (4), by striking “<quotedText style="-uslm-dtd:quote">and</quotedText>” at the end;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/318/s6/a/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">in paragraph (5), by striking the period at the end and inserting a semicolon; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/318/s6/a/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">by adding at the end the following:<quotedContent style="-uslm-dtd:quoted-block">
                    <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="6">“(6) </num><content style="-uslm-dtd:text">develop current and future workforce projections so as to have the capacity to assess the needs of the Federal workforce regarding the use of real property;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="7">“(7) </num><content style="-uslm-dtd:text">establish goals and policies that will lead the executive agency to reduce excess property and underutilized property in the inventory of the executive agency;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="8">“(8) </num><chapeau style="-uslm-dtd:text">submit to the Federal Real Property Council an annual report on all excess property that is real property and underutilized property in the inventory of the executive agency, including—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">“(A) </num><content style="-uslm-dtd:text">whether underutilized property can be better utilized, including through collocation with other executive agencies or consolidation with other facilities; and</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">“(B) </num><content style="-uslm-dtd:text">the extent to which the executive agency believes that retention of the underutilized property serves the needs of the executive agency;</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="9">“(9) </num><content style="-uslm-dtd:text">adopt workplace practices, configurations, and management techniques that can achieve increased levels of productivity and decrease the need for real property assets;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="10">“(10) </num><content style="-uslm-dtd:text">assess leased space to identify space that is not fully used or occupied;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="11">“(11) </num><chapeau style="-uslm-dtd:text">on an annual basis and subject to the guidance of the Federal Real Property Council—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">“(A) </num><content style="-uslm-dtd:text">conduct an inventory of real property under control of the executive agency; and</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">“(B) </num><chapeau style="-uslm-dtd:text">make an assessment of each property, which shall include—</chapeau>
                            <clause style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">“(i) </num><content style="-uslm-dtd:text">the age and condition of the property;</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">“(ii) </num><content style="-uslm-dtd:text">the size of the property in square footage and acreage;</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iii">“(iii) </num><content style="-uslm-dtd:text">the geographical location of the property, including an address and description;</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iv">“(iv) </num><content style="-uslm-dtd:text">the extent to which the property is being utilized;</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="v">“(v) </num><content style="-uslm-dtd:text">the actual annual operating costs associated with the property;</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="vi">“(vi) </num><content style="-uslm-dtd:text">the total cost of capital expenditures incurred by the Federal Government associated with the property;</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="vii">“(vii) </num><content style="-uslm-dtd:text">sustainability metrics associated with the property;</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="viii">“(viii) </num><content style="-uslm-dtd:text">the number of Federal employees and contractor employees and functions housed at the property;</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ix">“(ix) </num><content style="-uslm-dtd:text">the extent to which the mission of the executive agency is dependent on the property;</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="x">“(x) </num><content style="-uslm-dtd:text">the estimated amount of capital expenditures projected to maintain and operate the property during the 5-year period beginning on the date of enactment of this paragraph; and</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="xi">“(xi) </num><content style="-uslm-dtd:text">any additional information required by the Administrator of General Services to carry out section 623; and</content>
                            </clause>
                        </subparagraph>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="12">“(12) </num><content style="-uslm-dtd:text">provide to the Federal Real Property Council and the Administrator of General Services the information described in paragraph (11)(B) to be used for the establishment and maintenance of the database described in section 21 of the Federal Assets Sale and Transfer Act of 2016.”</content>
                    </paragraph></quotedContent>.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/114/318/s6/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Definition of Executive Agency.—</heading><content style="-uslm-dtd:text">Section 524 of title 40, United States Code, is amended by adding at the end the following:<quotedContent style="-uslm-dtd:quoted-block">
                <subsection style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">“(c) </num><heading style="-uslm-dtd:header">Definition of Executive Agency.—</heading><content style="-uslm-dtd:text">For the purpose of paragraphs (6) through (12) of subsection (a), the term ‘<quotedText style="-uslm-dtd:quote">executive agency</quotedText>’ shall have the meaning given the term ‘<quotedText style="-uslm-dtd:quote">Federal agency</quotedText>’ in section 621.”</content>
                </subsection></quotedContent>.</content>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/114/318/s7" styleType="OLC">
            <num style="-uslm-dtd:enum" value="7">SEC. 7. </num><heading style="-uslm-dtd:header">TECHNICAL AMENDMENTS. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/114/318/s7/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Definition of Applicable Act.—</heading><content style="-uslm-dtd:text">In this section, the term “<quotedText style="-uslm-dtd:quote">applicable Act</quotedText>” means the Federal Assets Sale and Transfer Act of 2016 (H.R. 4465, 114th Congress, 2d Session).</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/114/318/s7/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t40/s1303">40 U.S.C. 1303 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Board.—</heading><content style="-uslm-dtd:text">Section 4(c) of the applicable Act is amended by striking paragraphs (1) through (3) and inserting the following:<quotedContent style="-uslm-dtd:quoted-block">
                <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">“(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Board shall be composed of a Chairperson appointed by the President, by and with the advice and consent of the Senate, and 6 members appointed by the President.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">“(2) </num><heading style="-uslm-dtd:header">Appointments.—</heading>
                    <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">“(A) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">In selecting individuals for appointments to the Board, the President shall appoint members in the following manner:</chapeau>
                        <clause style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">“(i) </num><content style="-uslm-dtd:text">Two members recommended by the Speaker of the House of Representatives.</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">“(ii) </num><content style="-uslm-dtd:text">Two members recommended by the majority leader of the Senate.</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iii">“(iii) </num><content style="-uslm-dtd:text">One member recommended by the minority leader of the House of Representatives.</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iv">“(iv) </num><content style="-uslm-dtd:text">One member recommended by the minority leader of the Senate.</content>
                        </clause>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">“(B) </num><heading style="-uslm-dtd:header">Deadline.—</heading><content style="-uslm-dtd:text">The appointment of members to the Board shall be made not later than 90 days after the date of enactment of this Act.</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">“(3) </num><heading style="-uslm-dtd:header">Terms.—</heading><content style="-uslm-dtd:text">The term for each member of the Board shall be 6 years.”</content>
                </paragraph></quotedContent>.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/114/318/s7/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Agency Retention of Proceeds.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/318/s7/c/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Section 571 of title 40, United States Code (as amended by section 20 of the applicable Act), is amended by adding at the end the following:<quotedContent style="-uslm-dtd:quoted-block">
                    <subsection style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="d">“(d) </num><heading style="-uslm-dtd:header">Savings Provision.—</heading><content style="-uslm-dtd:text">Nothing in this section modifies, alters, or repeals any other provision of Federal law directing the use of retained proceeds relating to the sale of property of an agency.”</content>
                    </subsection></quotedContent>.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/318/s7/c/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t40/s571">40 U.S.C. 571 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Effective Date.—</heading><content style="-uslm-dtd:text">The amendments made by this subsection shall take effect as if enacted as part of the applicable Act.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/114/318/s7/d" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t40/s1303">40 U.S.C. 1303 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Sale.—</heading><chapeau style="-uslm-dtd:text">Section 24 of the applicable Act is amended—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/318/s7/d/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">by redesignating subsection (c) as subsection (d); and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/318/s7/d/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">by inserting after subsection (b) the following:<quotedContent style="-uslm-dtd:quoted-block">
                    <subsection style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">“(c) </num><heading style="-uslm-dtd:header">Requirement.—</heading><content style="-uslm-dtd:text">Notwithstanding any other provision of law, the sale of the property by the Administrator of General Services shall ensure continuity of security measures, parking access, and infrastructure requirements of the James Forrestal Building while it is occupied by the Department of Energy.”</content>
                    </subsection></quotedContent>.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/114/318/s7/e" styleType="OLC">
                <num style="-uslm-dtd:enum" value="e">(e) </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t40/s571">40 U.S.C. 571 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Effective date.—</heading><content style="-uslm-dtd:text">Except as provided in subsection (c)(2), this section and the amendments made by this section shall take effect immediately after the enactment of the applicable Act.</content>
            </subsection>
