    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To establish the Alyce Spotted Bear and Walter Soboleff Commission on Native Children, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
</enactingFormula>
        <section style="-uslm-dtd:section" identifier="/us/sComp/114/244/s1" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content style="-uslm-dtd:text" class="block">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Alyce Spotted Bear and Walter Soboleff Commission on Native Children Act</shortTitle>”.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/114/244/s2" styleType="OLC" role="definitions">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">DEFINITIONS. </heading>
            <chapeau style="-uslm-dtd:text" class="block">In this Act:</chapeau>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/244/s2/1" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Commission.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">Commission</term>” means the Alyce Spotted Bear and Walter Soboleff Commission on Native Children established by section 3.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/244/s2/2" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Indian.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">Indian</term>” has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (25 U.S.C. 450b).</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/244/s2/3" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Indian tribe.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">Indian tribe</term>” has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (25 U.S.C. 450b).</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/244/s2/4" styleType="OLC">
                <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Native child.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">Native child</term>” means—</chapeau>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s2/4/A" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">an Indian child, as that term is defined in section 4 of the Indian Child Welfare Act of 1978 (25 U.S.C. 1903);</content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s2/4/B" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">an Indian who is between the ages of 18 and 24 years old; and</content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s2/4/C" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">a Native Hawaiian who is not older than 24 years old.</content>
                </subparagraph>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/244/s2/5" styleType="OLC">
                <num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">Native hawaiian.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">Native Hawaiian</term>” has the meaning given the term in section 7207 of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 7517).</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/244/s2/6" styleType="OLC">
                <num style="-uslm-dtd:enum" value="6">(6) </num><heading style="-uslm-dtd:header">Secretary.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">Secretary</term>” means the Secretary of the Interior.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/244/s2/7" styleType="OLC">
                <num style="-uslm-dtd:enum" value="7">(7) </num><heading style="-uslm-dtd:header">Tribal college or university.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">Tribal College or University</term>” has the meaning given the term in section 316(b) of the Higher Education Act of 1965 (20 U.S.C. 1059c(b)).</content>
            </paragraph>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/114/244/s3" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><heading style="-uslm-dtd:header">COMMISSION ON NATIVE CHILDREN. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/114/244/s3/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">There is established a commission,<ref style="-uslm-dtd:footnote-ref" idref="IDC04EFA0E58124E3985D2DE1A7996D13D" class="footnoteRef">1</ref> to be known as the “<quotedText style="-uslm-dtd:quote">Alyce Spotted Bear and Walter Soboleff Commission on Native Children</quotedText>”.</content><footnote id="IDC04EFA0E58124E3985D2DE1A7996D13D" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">1</sup><p style="-uslm-dtd:para; margin-left:1em">The amendment made by section 415 of division D of Public Law 116–94 to strike “<quotedText style="-uslm-dtd:quote">in the Office of Tribal Justice of the Department of Justice.</quotedText>”</p></footnote>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/114/244/s3/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Membership.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/244/s3/b/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">The Commission shall be composed of 11 members, of whom—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/b/1/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><chapeau style="-uslm-dtd:text">3 shall be appointed by the President, in consultation with—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/114/244/s3/b/1/A/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the Attorney General;</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/114/244/s3/b/1/A/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the Secretary;</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/114/244/s3/b/1/A/iii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">the Secretary of Education; and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/114/244/s3/b/1/A/iv" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">the Secretary of Health and Human Services;</content>
                        </clause>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/b/1/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">3 shall be appointed by the Majority Leader of the Senate, in consultation with the Chairperson of the Committee on Indian Affairs of the Senate;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/b/1/C" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">1 shall be appointed by the Minority Leader of the Senate, in consultation with the Vice Chairperson of the Committee on Indian Affairs of the Senate;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/b/1/D" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">3 shall be appointed by the Speaker of the House of Representatives, in consultation with the Chairperson of the Committee on Natural Resources of the House of Representatives; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/b/1/E" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">1 shall be appointed by the Minority Leader of the House of Representatives, in consultation with the Ranking Member of the Committee on Natural Resources of the House of Representatives.</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/244/s3/b/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Requirements for eligibility.—</heading>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/b/2/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">Subject to subparagraph (B), each member of the Commission shall have significant experience and expertise in—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/114/244/s3/b/2/A/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">Indian affairs; and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/114/244/s3/b/2/A/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><chapeau style="-uslm-dtd:text">matters to be studied by the Commission, including—</chapeau>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/114/244/s3/b/2/A/ii/I" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">health care issues facing Native children, including mental health, physical health, and nutrition;</content>
                            </subclause>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/114/244/s3/b/2/A/ii/II" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">Indian education, including experience with Bureau of Indian Education schools and public schools, tribally operated schools, tribal colleges or universities, early childhood education programs, and the development of extracurricular programs;</content>
                            </subclause>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/114/244/s3/b/2/A/ii/III" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="III">(III) </num><content style="-uslm-dtd:text">juvenile justice programs relating to prevention and reducing incarceration and rates of recidivism; and</content>
                            </subclause>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/114/244/s3/b/2/A/ii/IV" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="IV">(IV) </num><content style="-uslm-dtd:text">social service programs that are used by Native children and designed to address basic needs, such as food, shelter, and safety, including child protective services, group homes, and shelters.</content>
                            </subclause>
                        </clause>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/b/2/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Experts.—</heading>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/114/244/s3/b/2/B/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">Native children.—</heading><chapeau style="-uslm-dtd:text">1 member of the Commission shall—</chapeau>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/114/244/s3/b/2/B/i/I" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">meet the requirements of subparagraph (A); and</content>
                            </subclause>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/114/244/s3/b/2/B/i/II" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">be responsible for providing the Commission with insight into and input from Native children on the matters studied by the Commission.</content>
                            </subclause>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/114/244/s3/b/2/B/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><heading style="-uslm-dtd:header">Research.—</heading><chapeau style="-uslm-dtd:text">1 member of the Commission shall—</chapeau>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/114/244/s3/b/2/B/ii/I" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">meet the requirements of subparagraph (A); and</content>
                            </subclause>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/114/244/s3/b/2/B/ii/II" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">have extensive experience in statistics or social science research.</content>
                            </subclause>
                        </clause>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/244/s3/b/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Terms.—</heading>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/b/3/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Each member of the Commission shall be appointed for the life of the Commission.</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/b/3/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Vacancies.—</heading><content style="-uslm-dtd:text">A vacancy in the Commission shall be filled in the manner in which the original appointment was made.</content>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/114/244/s3/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Operation.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/244/s3/c/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Chairperson.—</heading><content style="-uslm-dtd:text">Not later than 15 days after the date on which all members of the Commission have been appointed, the Commission shall select 1 member to serve as Chairperson of the Commission.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/244/s3/c/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Meetings.—</heading>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/c/2/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Commission shall meet at the call of the Chairperson.</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/c/2/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Initial meeting.—</heading><content style="-uslm-dtd:text">The initial meeting of the Commission shall take place not later than 30 days after the date described in paragraph (1).</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/244/s3/c/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Quorum.—</heading><content style="-uslm-dtd:text">A majority of the members of the Commission shall constitute a quorum, but a lesser number of members may hold hearings.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/244/s3/c/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Rules.—</heading><content style="-uslm-dtd:text">The Commission may establish, by majority vote, any rules for the conduct of Commission business, in accordance with this Act and other applicable law.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/114/244/s3/d" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Native Advisory Committee.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/244/s3/d/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Establishment.—</heading><content style="-uslm-dtd:text">The Commission shall establish a committee, to be known as the “<quotedText style="-uslm-dtd:quote">Native Advisory Committee</quotedText>”.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/244/s3/d/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Membership.—</heading>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/d/2/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Composition.—</heading><chapeau style="-uslm-dtd:text">The Native Advisory Committee shall consist of—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/114/244/s3/d/2/A/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">1 representative of Indian tribes from each region of the Bureau of Indian Affairs who is 25 years of age or older; and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/114/244/s3/d/2/A/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">1 Native Hawaiian who is 25 years of age or older.</content>
                        </clause>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/d/2/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Qualifications.—</heading><content style="-uslm-dtd:text">Each member of the Native Advisory Committee shall have experience relating to matters to be studied by the Commission.</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/244/s3/d/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Duties.—</heading><chapeau style="-uslm-dtd:text">The Native Advisory Committee shall—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/d/3/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">serve as an advisory body to the Commission; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/d/3/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">provide to the Commission advice and recommendations, submit materials, documents, testimony, and such other information as the Commission determines to be necessary to carry out the duties of the Commission under this section.</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/244/s3/d/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Native children subcommittee.—</heading><content style="-uslm-dtd:text">The Native Advisory Committee shall establish a subcommittee that shall consist of at least 1 member from each region of the Bureau of Indian Affairs and 1 Native Hawaiian, each of whom shall be a Native child, and have experience serving on the council of a tribal, regional, or national youth organization.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/114/244/s3/e" styleType="OLC">
                <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Comprehensive Study of Native Children Issues.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/244/s3/e/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">The Commission shall conduct a comprehensive study of Federal, State, local, and tribal programs that serve Native children, including an evaluation of—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/e/1/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the impact of concurrent jurisdiction on child welfare systems;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/e/1/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the barriers Indian tribes and Native Hawaiians face in applying, reporting on, and using existing public and private grant resources, including identification of any Federal cost-sharing requirements;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/e/1/C" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">the obstacles to nongovernmental financial support, such as from private foundations and corporate charities, for programs benefitting Native children;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/e/1/D" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">the issues relating to data collection, such as small sample sizes, large margins of error, or other issues related to the validity and statistical significance of data on Native children;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/e/1/E" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">the barriers to the development of sustainable, multidisciplinary programs designed to assist high-risk Native children and families of those high-risk Native children;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/e/1/F" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">cultural or socioeconomic challenges in communities of Native children;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/e/1/G" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="G">(G) </num><content style="-uslm-dtd:text">any examples of successful program models and use of best practices in programs that serve children and families;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/e/1/H" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="H">(H) </num><content style="-uslm-dtd:text">the barriers to interagency coordination on programs benefitting Native children; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/e/1/I" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">the use of memoranda of agreement or interagency agreements to facilitate or improve agency coordination, including the effects of existing memoranda or interagency agreements on program service delivery and efficiency.</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/244/s3/e/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Coordination.—</heading><chapeau style="-uslm-dtd:text">In conducting the study under paragraph (1), the Commission shall, to the maximum extent practicable—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/e/2/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">to avoid duplication of efforts, collaborate with other workgroups focused on similar issues, such as the Task Force on American Indian/Alaska Native Children Exposed to Violence of the Attorney General; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/e/2/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">to improve coordination and reduce travel costs, use available technology.</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/244/s3/e/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Recommendations.—</heading><chapeau style="-uslm-dtd:text">Taking into consideration the results of the study under paragraph (1) and the analysis of any existing data relating to Native children received from Federal agencies, the Commission shall—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/e/3/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><chapeau style="-uslm-dtd:text">develop recommendations for goals, and plans for achieving those goals, for Federal policy relating to Native children in the short-, mid-, and long-term, which shall be informed by the development of accurate child well-being measures, except that the Commission shall not consider or recommend the recognition or the establishment of a government-to-government relationship with—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/114/244/s3/e/3/A/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">any entity not recognized on or before the date of enactment of this Act by the Federal Government through an Act of Congress, Executive action, judicial decree, or any other action; or</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/114/244/s3/e/3/A/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">any entity not included in the list authorized pursuant to the Federally Recognized Indian Tribe List Act of 1994 (25 U.S.C. 479a et seq.);</content>
                        </clause>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/e/3/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">make recommendations on necessary modifications and improvements to programs that serve Native children  at the Federal, State, and tribal levels, on the condition that the recommendations recognize the diversity in cultural values, integrate the cultural strengths of the communities of the Native children, and will result in—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/114/244/s3/e/3/B/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><chapeau style="-uslm-dtd:text">improvements to the child welfare system that—</chapeau>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/114/244/s3/e/3/B/i/I" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">reduce the disproportionate rate at which Native children enter child protective services and the period of time spent in the foster system;</content>
                            </subclause>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/114/244/s3/e/3/B/i/II" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">increase coordination among social workers, police, and foster families assisting Native children while in the foster system to result in the increased safety of Native children while in the foster system;</content>
                            </subclause>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/114/244/s3/e/3/B/i/III" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="III">(III) </num><content style="-uslm-dtd:text">encourage the hiring and retention of licensed social workers in Native communities;</content>
                            </subclause>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/114/244/s3/e/3/B/i/IV" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="IV">(IV) </num><content style="-uslm-dtd:text">address the lack of available foster homes in Native communities; and</content>
                            </subclause>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/114/244/s3/e/3/B/i/V" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="V">(V) </num><content style="-uslm-dtd:text">reduce truancy and improve the academic proficiency and graduation rates of Native children in the foster system;</content>
                            </subclause>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/114/244/s3/e/3/B/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><chapeau style="-uslm-dtd:text">improvements to the mental and physical health of Native children, taking into consideration the rates of suicide, substance abuse, and access to nutrition and health care, including—</chapeau>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/114/244/s3/e/3/B/ii/I" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">an analysis of the increased access of Native children to Medicaid under the Patient Protection and Affordable Care Act (Public Law 111-148) and the effect of that increase on the ability of Indian tribes and Native Hawaiians to develop sustainable health programs; and</content>
                            </subclause>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/114/244/s3/e/3/B/ii/II" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">an evaluation of the effects of a lack of public sanitation infrastructure, including in-home sewer and water, on the health status of Native children;</content>
                            </subclause>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/114/244/s3/e/3/B/iii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iii">(iii) </num><chapeau style="-uslm-dtd:text">improvements to educational and vocational opportunities for Native children that will lead to—</chapeau>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/114/244/s3/e/3/B/iii/I" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">increased school attendance, performance, and graduation rates for Native children across all educational levels, including early education, post-secondary, and graduate school;</content>
                            </subclause>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/114/244/s3/e/3/B/iii/II" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">localized strategies developed by educators, tribal and community leaders, and law enforcement to prevent and reduce truancy among Native children;</content>
                            </subclause>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/114/244/s3/e/3/B/iii/III" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="III">(III) </num><content style="-uslm-dtd:text">scholarship opportunities at a Tribal College or University and other public and private postsecondary institutions;</content>
                            </subclause>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/114/244/s3/e/3/B/iii/IV" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="IV">(IV) </num><content style="-uslm-dtd:text">increased participation of the immediate families of Native children;</content>
                            </subclause>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/114/244/s3/e/3/B/iii/V" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="V">(V) </num><content style="-uslm-dtd:text">coordination among schools and Indian tribes that serve Native children, including in the areas of data sharing and student tracking;</content>
                            </subclause>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/114/244/s3/e/3/B/iii/VI" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="VI">(VI) </num><content style="-uslm-dtd:text">accurate identification of students as Native children; and</content>
                            </subclause>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/114/244/s3/e/3/B/iii/VII" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="VII">(VII) </num><content style="-uslm-dtd:text">increased school counseling services, improved access to quality nutrition at school, and safe student transportation;</content>
                            </subclause>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/114/244/s3/e/3/B/iv" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">improved policies and practices by local school districts that would result in improved academic proficiency for Native children;</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/114/244/s3/e/3/B/v" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="v">(v) </num><content style="-uslm-dtd:text">increased access to extracurricular activities for Native children that are designed to increase self-esteem, promote community engagement, and support academic excellence while also serving to prevent unplanned pregnancy, membership in gangs, drug and alcohol abuse, and suicide, including activities that incorporate traditional language and cultural practices of Indians and Native Hawaiians;</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/114/244/s3/e/3/B/vi" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="vi">(vi) </num><chapeau style="-uslm-dtd:text">taking into consideration the report of the Indian Law and Order Commission issued pursuant to section 15(f) of the Indian Law Enforcement Reform Act (25 U.S.C. 2812(f)), improvements to Federal, State, and tribal juvenile justice systems and detention programs—</chapeau>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/114/244/s3/e/3/B/vi/I" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">to provide greater access to educational opportunities and social services for incarcerated Native children;</content>
                            </subclause>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/114/244/s3/e/3/B/vi/II" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">to promote prevention and reduce incarceration and recidivism rates among Native children;</content>
                            </subclause>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/114/244/s3/e/3/B/vi/III" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="III">(III) </num><content style="-uslm-dtd:text">to identify intervention approaches and alternatives to incarceration of Native children;</content>
                            </subclause>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/114/244/s3/e/3/B/vi/IV" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="IV">(IV) </num><content style="-uslm-dtd:text">to incorporate families and the traditional cultures of Indians and Native Hawaiians in the juvenile justice process, including through the development of a family court for juvenile offenses; and</content>
                            </subclause>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/114/244/s3/e/3/B/vi/V" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="V">(V) </num><content style="-uslm-dtd:text">to prevent unnecessary detentions and identify successful reentry programs;</content>
                            </subclause>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/114/244/s3/e/3/B/vii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="vii">(vii) </num><chapeau style="-uslm-dtd:text">expanded access to a continuum of early development and learning services for Native children from prenatal to age 5 that are culturally competent, support Native language preservation, and comprehensively promote the health, well-being, learning, and development of Native children, such as—</chapeau>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/114/244/s3/e/3/B/vii/I" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">high quality early care and learning programs for children starting from birth, including Early Head Start, Head Start, child care, and preschool programs;</content>
                            </subclause>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/114/244/s3/e/3/B/vii/II" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">programs, including home visiting and family resource and support programs, that increase the capacity of parents to support the learning and development of the children of the parents, beginning prenatally, and connect the parents with necessary resources;</content>
                            </subclause>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/114/244/s3/e/3/B/vii/III" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="III">(III) </num><content style="-uslm-dtd:text">early intervention and preschool services for infants, toddlers, and preschool-aged children with developmental delays or disabilities; and</content>
                            </subclause>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/114/244/s3/e/3/B/vii/IV" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="IV">(IV) </num><content style="-uslm-dtd:text">professional development opportunities for Native providers of early development and learning services;</content>
                            </subclause>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/114/244/s3/e/3/B/viii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="viii">(viii) </num><content style="-uslm-dtd:text">the development of a system that delivers wrap-around services to Native children in a way that is comprehensive and sustainable, including through increased coordination among Indian tribes, schools,  law enforcement, health care providers, social workers, and families;</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/114/244/s3/e/3/B/ix" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ix">(ix) </num><chapeau style="-uslm-dtd:text">more flexible use of existing Federal programs, such as by—</chapeau>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/114/244/s3/e/3/B/ix/I" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">providing Indians and Native Hawaiians with more flexibility to carry out programs, while maintaining accountability, minimizing administrative time, cost, and expense and reducing the burden of Federal paperwork requirements; and</content>
                            </subclause>
                            <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/114/244/s3/e/3/B/ix/II" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="II">(II) </num><chapeau style="-uslm-dtd:text">allowing unexpended Federal funds to be used flexibly to support programs benefitting Native children, while taking into account—</chapeau>
                                <item style="-uslm-dtd:item" identifier="/us/sComp/114/244/s3/e/3/B/ix/II/aa" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="aa">(aa) </num><content style="-uslm-dtd:text">the Indian Employment, Training and Related Services Demonstration Act of 1992 (25 U.S.C. 3401 note; 106 Stat. 2302);</content>
                                </item>
                                <item style="-uslm-dtd:item" identifier="/us/sComp/114/244/s3/e/3/B/ix/II/bb" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="bb">(bb) </num><content style="-uslm-dtd:text">the Coordinated Tribal Assistance Solicitation program of the Department of Justice;</content>
                                </item>
                                <item style="-uslm-dtd:item" identifier="/us/sComp/114/244/s3/e/3/B/ix/II/cc" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="cc">(cc) </num><content style="-uslm-dtd:text">the Federal policy of self-determination; and</content>
                                </item>
                                <item style="-uslm-dtd:item" identifier="/us/sComp/114/244/s3/e/3/B/ix/II/dd" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="dd">(dd) </num><content style="-uslm-dtd:text">any consolidated grant programs; and</content>
                                </item>
                            </subclause>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/114/244/s3/e/3/B/x" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="x">(x) </num><content style="-uslm-dtd:text">solutions to other issues that, as determined by the Commission, would improve the health, safety, and well-being of Native children;</content>
                        </clause>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/e/3/C" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><chapeau style="-uslm-dtd:text">make recommendations for improving data collection methods that consider—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/114/244/s3/e/3/C/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the adoption of standard definitions and compatible systems platforms to allow for greater linkage of data sets across Federal agencies;</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/114/244/s3/e/3/C/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the appropriateness of existing data categories for comparative purposes;</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/114/244/s3/e/3/C/iii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">the development of quality data and measures, such as by ensuring sufficient sample sizes and frequency of sampling, for Federal, State, and tribal programs that serve Native children;</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/114/244/s3/e/3/C/iv" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">the collection and measurement of data that are useful to Indian tribes and Native Hawaiians;</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/114/244/s3/e/3/C/v" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="v">(v) </num><content style="-uslm-dtd:text">the inclusion of Native children in longitudinal studies; and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/114/244/s3/e/3/C/vi" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="vi">(vi) </num><content style="-uslm-dtd:text">tribal access to data gathered by Federal, State, and local governmental agencies; and</content>
                        </clause>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/e/3/D" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">identify models of successful Federal, State, and tribal programs in the areas studied by the Commission.</content>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/114/244/s3/f" styleType="OLC">
                <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Report.—</heading><chapeau style="-uslm-dtd:text">Not later than 5 years after the date on which all members of the Commission are appointed and amounts are made available to carry out this Act, the Commission shall submit to the President, the Committee on Natural Resources of the House of Representatives, the Committee on Indian Affairs of the Senate, and the Committees on Appropriations of the House of Representatives and the Senate, a report that contains—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/244/s3/f/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">a detailed statement of the findings and conclusions of the Commission; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/244/s3/f/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the recommendations of the Commission for such legislative and administrative actions as the Commission considers to be appropriate.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/114/244/s3/g" styleType="OLC">
                <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Powers.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/244/s3/g/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Hearings.—</heading>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/g/1/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Commission may hold such hearings, meet and act at such times and places, take such testimony, and receive such evidence as the Commission considers to be advisable to carry out the duties of the Commission under this section, except that the Commission shall hold not less than 5 hearings in Native communities.</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/g/1/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Public requirement.—</heading><content style="-uslm-dtd:text">The hearings of the Commission under this paragraph shall be open to the public.</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/244/s3/g/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Witness expenses.—</heading>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/g/2/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">A witness requested to appear before the Commission shall be paid the same fees and allowances as are paid to witnesses under section 1821 of title 28, United States Code.</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/g/2/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Per diem and mileage.—</heading><content style="-uslm-dtd:text">The fees and allowances for a witness shall be paid from funds made available to the Commission.</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/244/s3/g/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Information from federal, tribal, and state agencies.—</heading>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/g/3/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Commission may secure directly from a Federal agency such information as the Commission considers to be necessary to carry out this section.</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/g/3/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Tribal and state agencies.—</heading><content style="-uslm-dtd:text">The Commission may request the head of any tribal or State agency to provide to the Commission such information as the Commission considers to be necessary to carry out this Act.</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/244/s3/g/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Postal services.—</heading><content style="-uslm-dtd:text">The Commission may use the United States mails in the same manner and under the same conditions as other agencies of the Federal Government.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/244/s3/g/5" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">Gifts.—</heading><content style="-uslm-dtd:text">The Commission may accept, use, and dispose of gifts or donations of services or property related to the purpose of the Commission.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/114/244/s3/h" styleType="OLC">
                <num style="-uslm-dtd:enum" value="h">(h) </num><heading style="-uslm-dtd:header">Commission Personnel Matters.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/244/s3/h/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Travel expenses.—</heading><content style="-uslm-dtd:text">A member of the Commission shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for an employee of an agency under subchapter I of chapter 57 of title 5, United States Code, while away from the home or regular place of business of the member in the performance of the duties of the Commission.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/244/s3/h/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Detail of federal employees.—</heading>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/h/2/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">On the affirmative vote of ⅔ of the members of the Commission—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/114/244/s3/h/2/A/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the Attorney General, the Secretary, the Secretary of Education, and the Secretary of the Health and Human Services shall each detail, without reimbursement, 1 or more employees of the Department of Justice, the Department of the Interior, the Department of Education, and the Department of Health and Human Services; and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/114/244/s3/h/2/A/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">with the approval of the appropriate Federal agency head, an employee of any other Federal agency may be, without reimbursement, detailed to the Commission.</content>
                        </clause>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/h/2/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Effect on detailees.—</heading><content style="-uslm-dtd:text">Detail under this paragraph shall be without interruption or loss of civil service status, benefits, or privileges.</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/244/s3/h/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Procurement of temporary and intermittent services.—</heading>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/h/3/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">On request of the Commission, the Attorney General shall provide to the Commission, on a reimbursable basis, reasonable and appropriate office space, supplies, and administrative assistance.</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/114/244/s3/h/3/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">No requirement for physical facilities.—</heading><content style="-uslm-dtd:text">The Administrator of General Services shall not be required to locate a permanent, physical office space for the operation of the Commission.</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/244/s3/h/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Members not federal employees.—</heading><content style="-uslm-dtd:text">No member of the Commission, the Native Advisory Committee, or the Native Children Subcommittee shall be considered to be a Federal employee.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/114/244/s3/i" styleType="OLC">
                <num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">Termination of Commission.—</heading><content style="-uslm-dtd:text">The Commission shall terminate 90 days after the date on which the Commission submits the report under subsection (f).</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/114/244/s3/j" styleType="OLC">
                <num style="-uslm-dtd:enum" value="j">(j) </num><heading style="-uslm-dtd:header">Nonapplicability of FACA.—</heading><content style="-uslm-dtd:text">The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Commission, the Native Advisory Committee, or the Native Children Subcommittee.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/114/244/s3/k" styleType="OLC">
                <num style="-uslm-dtd:enum" value="k">(k) </num><heading style="-uslm-dtd:header">Effect.—</heading><chapeau style="-uslm-dtd:text">This Act shall not be construed to recognize or establish a government-to-government relationship with—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/244/s3/k/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">any entity not recognized on or before the date of enactment of this Act by the Federal Government through an Act of Congress, Executive action, judicial decree, or any other action; or</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/244/s3/k/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">any entity not included in the list authorized pursuant to the Federally Recognized Indian Tribe List Act of 1994 (25 U.S.C. 479a et seq.).</content>
                </paragraph>
            </subsection>
