AN ACTTo encourage the restoration of estuary habitat through more efficient project financing and enhanced coordination of Federal and non-Federal restoration programs, and for other purposes.

<num style="-uslm-dtd:enum" value="I">TITLE I—</num><heading style="-uslm-dtd:header">ESTUARY RESTORATION </heading>

<section style="-uslm-dtd:section" identifier="/us/sComp/106/457/tI/s104" styleType="OLC">
<num style="-uslm-dtd:enum" value="104">SEC. 104. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t33/s2903">33 U.S.C. 2903</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">ESTUARY HABITAT RESTORATION PROGRAM. </heading>
<subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/457/tI/s104/a" styleType="OLC">
<num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Establishment.—</heading><content style="-uslm-dtd:text">There is established an estuary habitat restoration program under which the Secretary may carry out estuary habitat restoration projects and provide technical assistance through the award of contracts and cooperative agreements in accordance with the requirements of this title.</content>
</subsection>
<subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/457/tI/s104/b" styleType="OLC">
<num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Origin of Projects.—</heading><content style="-uslm-dtd:text">A proposed estuary habitat restoration project shall originate from a non-Federal interest consistent with State or local laws.</content>
</subsection>
<subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/457/tI/s104/c" styleType="OLC">
<num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Selection of Projects.—</heading>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/457/tI/s104/c/1" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Secretary shall select estuary habitat restoration projects from a list of project proposals submitted by the Estuary Habitat Restoration Council under section 105(b).</content>
</paragraph>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/457/tI/s104/c/2" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Required elements.—</heading><chapeau style="-uslm-dtd:text">Each estuary habitat restoration project selected by the Secretary must—</chapeau>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/457/tI/s104/c/2/A" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">address restoration needs identified in an estuary habitat restoration plan;</content>
</subparagraph>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/457/tI/s104/c/2/B" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">be consistent with the estuary habitat restoration strategy developed under section 106;</content>
</subparagraph>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/457/tI/s104/c/2/C" styleType="OLC">
<num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">include a monitoring plan that is consistent with standards for monitoring developed under section 107 to ensure that short-term and long-term restoration goals are achieved; and</content>
</subparagraph>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/457/tI/s104/c/2/D" styleType="OLC">
<num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">include satisfactory assurance from the non-Federal interests proposing the project that the non-Federal interests will have adequate personnel, funding, and authority to carry out items of local cooperation and properly maintain the project.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/457/tI/s104/c/3" styleType="OLC">
<num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Factors for selection of projects.—</heading><chapeau style="-uslm-dtd:text">In selecting an estuary habitat restoration project, the Secretary shall consider the following factors:</chapeau>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/457/tI/s104/c/3/A" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">Whether the project is part of an approved Federal or State estuary management or habitat restoration plan.</content>
</subparagraph>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/457/tI/s104/c/3/B" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">The technical feasibility of the project.</content>
</subparagraph>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/457/tI/s104/c/3/C" styleType="OLC">
<num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">The scientific merit of the project.</content>
</subparagraph>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/457/tI/s104/c/3/D" styleType="OLC">
<num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">Whether the project will encourage increased coordination and cooperation among Federal, State, and local government agencies.</content>
</subparagraph>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/457/tI/s104/c/3/E" styleType="OLC">
<num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">Whether the project fosters public-private partnerships and uses Federal resources to encourage increased private sector involvement, including consideration of the amount of private funds or in-kind contributions for an estuary habitat restoration activity.</content>
</subparagraph>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/457/tI/s104/c/3/F" styleType="OLC">
<num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">Whether the project is cost-effective.</content>
</subparagraph>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/457/tI/s104/c/3/G" styleType="OLC">
<num style="-uslm-dtd:enum" value="G">(G) </num><content style="-uslm-dtd:text">Whether the State in which the non-Federal interest is proposing the project has a dedicated source of funding to acquire or restore estuary habitat, natural areas, and open spaces for the benefit of estuary habitat restoration or protection.</content>
</subparagraph>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/457/tI/s104/c/3/H" styleType="OLC">
<num style="-uslm-dtd:enum" value="H">(H) </num><content style="-uslm-dtd:text">Other factors that the Secretary determines to be reasonable and necessary for consideration.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/457/tI/s104/c/4" styleType="OLC">
<num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Priority.—</heading><chapeau style="-uslm-dtd:text">In selecting estuary habitat restoration projects to be carried out under this title, the Secretary shall give priority consideration to a project if, in addition to meriting selection based on the factors under paragraph (3)—</chapeau>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/457/tI/s104/c/4/A" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the project occurs within a watershed in which there is a program being carried out that addresses sources of pollution and other activities that otherwise would re-impair the restored habitat; or</content>
</subparagraph>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/457/tI/s104/c/4/B" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the project includes pilot testing of or a demonstration of an innovative technology or approach having the potential for improved cost-effectiveness in estuary habitat restoration.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/457/tI/s104/d" styleType="OLC">
<num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Cost Sharing.—</heading>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/457/tI/s104/d/1" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Federal share.—</heading>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/457/tI/s104/d/1/A" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Except
as provided in paragraph (2) and subsection (e)(2), the Federal share of the cost of an estuary habitat restoration project (other than the cost of operation and maintenance of the project) carried out under this title shall not exceed 65 percent of such cost.</content>
</subparagraph>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/457/tI/s104/d/1/B" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Monitoring.—</heading>
<clause style="-uslm-dtd:clause" identifier="/us/sComp/106/457/tI/s104/d/1/B/i" styleType="OLC">
<num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">Costs.—</heading><content style="-uslm-dtd:text">The costs of monitoring an estuary habitat restoration project funded under this title may be included in the total cost of the estuary habitat restoration project.</content>
</clause>
<clause style="-uslm-dtd:clause" identifier="/us/sComp/106/457/tI/s104/d/1/B/ii" styleType="OLC">
<num style="-uslm-dtd:enum" value="ii">(ii) </num><heading style="-uslm-dtd:header">Goals.—</heading><chapeau style="-uslm-dtd:text">The goals of the monitoring shall be—</chapeau>
<subclause style="-uslm-dtd:subclause" identifier="/us/sComp/106/457/tI/s104/d/1/B/ii/I" styleType="OLC">
<num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">to measure the effectiveness of the restoration project; and</content>
</subclause>
<subclause style="-uslm-dtd:subclause" identifier="/us/sComp/106/457/tI/s104/d/1/B/ii/II" styleType="OLC">
<num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">to allow adaptive management to ensure project success.</content>
</subclause>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/457/tI/s104/d/2" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Innovative technology costs.—</heading><content style="-uslm-dtd:text">The Federal share of the incremental additional cost of including in a project pilot testing of or a demonstration of an innovative technology or approach described in subsection (c)(4)(B) shall be 85 percent.</content>
</paragraph>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/457/tI/s104/d/3" styleType="OLC">
<num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Non-federal share.—</heading><content style="-uslm-dtd:text">The non-Federal share of the cost of an estuary habitat restoration project carried out under this title shall include lands, easements, rights-of-way, and relocations and may include services (including monitoring), or any other form of in-kind contribution determined by the Secretary to be an appropriate contribution equivalent to the monetary amount required for the non-Federal share of the activity.</content>
</paragraph>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/457/tI/s104/d/4" styleType="OLC">
<num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Operation and maintenance.—</heading><content style="-uslm-dtd:text">The non-Federal interests shall be responsible for all costs associated with operating, maintaining, replacing, repairing, and rehabilitating all projects carried out under this section.</content>
</paragraph>
</subsection>
<subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/457/tI/s104/e" styleType="OLC">
<num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Interim Actions.—</heading>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/457/tI/s104/e/1" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Pending completion of the estuary habitat restoration strategy to be developed under section 106, the Secretary may take interim actions to carry out an estuary habitat restoration activity.</content>
</paragraph>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/457/tI/s104/e/2" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Federal share.—</heading><content style="-uslm-dtd:text">The Federal share of the cost of an estuary habitat restoration activity before the completion of the estuary habitat restoration strategy shall not exceed 25 percent of such cost.</content>
</paragraph>
</subsection>
<subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/457/tI/s104/f" styleType="OLC">
<num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Cooperation of Non-Federal Interests.—</heading>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/457/tI/s104/f/1" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">The Secretary may not carry out an estuary habitat restoration project until a non-Federal interest has entered into a written agreement with the Secretary in which the non-Federal interest agrees to—</chapeau>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/457/tI/s104/f/1/A" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">provide all lands, easements, rights-of-way, and relocations and any other elements the Secretary determines appropriate under subsection (d)(3); and</content>
</subparagraph>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/457/tI/s104/f/1/B" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">provide for long-term maintenance and monitoring of the project.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/457/tI/s104/f/2" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Nongovernmental organizations.—</heading><content style="-uslm-dtd:text">Notwithstanding section 221(b) of the Flood Control Act of 1970 (42 U.S.C. 1962d-5b(b)), for any project to be undertaken under this title, the Secretary, in consultation and coordination with appropriate State and local governmental agencies and Indian tribes, may allow a nongovernmental organization to serve as the non-Federal interest for the project.</content>
</paragraph>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/457/tI/s104/f/3" styleType="OLC">
<num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Project agreements.—</heading><content style="-uslm-dtd:text">For a project carried out under this title, the requirements of section 103(j)(1) of the Water Resources Development Act of 1986 (33 U.S.C. 2213(j)(1)) may be fulfilled by a nongovernmental organization serving as the non-Federal interest for the project pursuant to paragraph (2).</content>
</paragraph>
</subsection>
<subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/457/tI/s104/g" styleType="OLC">
<num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Delegation of Project Implementation.—</heading>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/457/tI/s104/g/1" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">In carrying
out this title, the Secretary may delegate project implementation to another Federal department or agency on a reimbursable basis if the Secretary, upon the recommendation of the Council, determines such delegation is appropriate.</content>
</paragraph>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/457/tI/s104/g/2" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Small projects.—</heading>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/457/tI/s104/g/2/A" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Small project defined.—</heading><content style="-uslm-dtd:text">In this paragraph, the term “<quotedText style="-uslm-dtd:quote">small project</quotedText>” means a project carried out under this title with an estimated Federal cost of less than $1,000,000.</content>
</subparagraph>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/457/tI/s104/g/2/B" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Delegation of project implementation.—</heading><chapeau style="-uslm-dtd:text">In carrying out this section, the Secretary, on recommendation of the Council, may delegate implementation of a small project to—</chapeau>
<clause style="-uslm-dtd:clause" identifier="/us/sComp/106/457/tI/s104/g/2/B/i" styleType="OLC">
<num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the Secretary of the Interior (acting through the Director of the United States Fish and Wildlife Service);</content>
</clause>
<clause style="-uslm-dtd:clause" identifier="/us/sComp/106/457/tI/s104/g/2/B/ii" styleType="OLC">
<num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the Under Secretary for Oceans and Atmosphere of the Department of Commerce;</content>
</clause>
<clause style="-uslm-dtd:clause" identifier="/us/sComp/106/457/tI/s104/g/2/B/iii" styleType="OLC">
<num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">the Administrator of the Environmental Protection Agency; or</content>
</clause>
<clause style="-uslm-dtd:clause" identifier="/us/sComp/106/457/tI/s104/g/2/B/iv" styleType="OLC">
<num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">the Secretary of Agriculture.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/457/tI/s104/g/2/C" styleType="OLC">
<num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Funding.—</heading><content style="-uslm-dtd:text">A small project delegated to the head of a Federal department or agency under this paragraph may be carried out using funds appropriated to the department or agency under section 109(a)(1) or other funds available to the department or agency.</content>
</subparagraph>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/457/tI/s104/g/2/D" styleType="OLC">
<num style="-uslm-dtd:enum" value="D">(D) </num><heading style="-uslm-dtd:header">Agreements.—</heading><content style="-uslm-dtd:text">The head of a Federal department or agency to which a small project is delegated under this paragraph shall enter into an agreement with the non-Federal interest for the project generally in conformance with the criteria in subsections (d) and (e). Cooperative agreements may be used for any delegated project to allow the non-Federal interest to carry out the project on behalf of the Federal agency.</content>
</subparagraph>
</paragraph>
</subsection>
</section>

<section style="-uslm-dtd:section" identifier="/us/sComp/106/457/tI/s109" styleType="OLC">
<num style="-uslm-dtd:enum" value="109">SEC. 109. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t33/s2908">33 U.S.C. 2908</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">FUNDING. </heading>
<subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/457/tI/s109/a" styleType="OLC">
<num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Authorization of Appropriations.—</heading>
<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/457/tI/s109/a/1" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Estuary habitat restoration projects.—</heading><chapeau style="-uslm-dtd:text">There is authorized to be appropriated for carrying out and providing technical assistance for estuary habitat restoration projects—</chapeau>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/457/tI/s109/a/1/A" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">to the Secretary, $25,000,000 for each of fiscal years 2008 through 2021;</content>
</subparagraph>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/457/tI/s109/a/1/B" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">to the Secretary of the Interior (acting through the Director of the United States Fish and Wildlife Service), $2,500,000 for each of fiscal years 2008 through 2021;</content>
</subparagraph>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/457/tI/s109/a/1/C" styleType="OLC">
<num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">to the Under Secretary for Oceans and Atmosphere of the Department of Commerce, $2,500,000 for each of fiscal years 2008 through 2021;</content>
</subparagraph>
<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/457/tI/s109/a/1/D" styleType="OLC">
<num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">to the Administrator of the Environmental Protection Agency, $2,500,000 for each of fiscal years 2008 through 2021; and</content>

<subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/106/457/tI/s109/a/1/E" styleType="OLC">
<num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">to the Secretary of Agriculture, $2,500,000 for each of fiscal years 2008 through 2021.</content>
</subparagraph><continuation style="-uslm-dtd:continuation-text" role="paragraph">Such sums shall remain available until expended.</continuation>

<paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/106/457/tI/s109/a/2" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Monitoring.—</heading><content style="-uslm-dtd:text">There is authorized to be appropriated to the Under Secretary for Oceans and Atmosphere of the Department of Commerce for the acquisition, maintenance, and management of monitoring data on restoration projects carried out under this title and other information compiled under section 107, $1,500,000 for each of fiscal years 2001 through 2021. Such sums shall remain available until expended.</content>

<subsection style="-uslm-dtd:subsection" identifier="/us/sComp/106/457/tI/s109/b" styleType="OLC">
<num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Set-Aside for Administrative Expenses of the Council.—</heading><content style="-uslm-dtd:text">Not to exceed 3 percent of the amounts appropriated for a fiscal year under subsection (a)(1) or $1,500,000, whichever is greater, may be used by the Secretary for administration and operation of the Council.</content>
