    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To extend the authorization for the replacement of the existing Department of Veterans Affairs Medical Center in Denver, Colorado, to make certain improvements in the Veterans Access, Choice, and Accountability Act of 2014, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

        <section style="-uslm-dtd:section" identifier="/us/sComp/114/19/s1" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t38/s101">38 U.S.C. 101 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content style="-uslm-dtd:text" class="block">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Construction Authorization and Choice Improvement Act</shortTitle>”.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/114/19/s2" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">EXTENSION OF AUTHORIZATION FOR MAJOR MEDICAL FACILITY CONSTRUCTION PROJECT PREVIOUSLY AUTHORIZED. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/114/19/s2/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">The Secretary of Veterans Affairs may carry out the replacement of the existing Department of Veterans Affairs Medical Center in Denver, Colorado, in an amount not to exceed $1,675,000,000.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/114/19/s2/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Limitation on Obligation of Funds.—</heading><content style="-uslm-dtd:text">Notwithstanding section 8104(c) of title 38, United States Code, or any other provision of law, funds may not be obligated or expended for the project described in subsection (a) in an amount that would cause the total amount obligated for that project to exceed the amount specified in the law for that project (or would add to total obligations exceeding such specified amount).</content>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/114/19/s3" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><heading style="-uslm-dtd:header">CLARIFICATION OF DISTANCE REQUIREMENT FOR EXPANDED AVAILABILITY OF HOSPITAL CARE AND MEDICAL SERVICES FOR VETERANS THROUGH THE USE OF AGREEMENTS WITH NON-DEPARTMENT OF VETERANS AFFAIRS ENTITIES. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/114/19/s3/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><chapeau style="-uslm-dtd:text">Section 101(b)(2) of the Veterans Access, Choice, and Accountability Act of 2014 (Public Law 113-146; 38 U.S.C. 1701 note) is amended—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/19/s3/a/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">in subparagraph (B), by inserting “<quotedText style="-uslm-dtd:quote">(as calculated based on distance traveled)</quotedText>” after “<quotedText style="-uslm-dtd:quote">40 miles</quotedText>”; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/114/19/s3/a/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">in subparagraph (D)(ii), by striking subclause (II), and inserting the following new subclause (II):<quotedContent style="-uslm-dtd:quoted-block">
                    <subclause style="-uslm-dtd:subclause" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="II">“(II) </num><chapeau style="-uslm-dtd:text">faces an unusual or excessive burden in traveling to such a medical facility of the Department based on—</chapeau>
                        <item style="-uslm-dtd:item" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="aa">“(aa) </num><content style="-uslm-dtd:text">geographical challenges;</content>
                        </item>
                        <item style="-uslm-dtd:item" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="bb">“(bb) </num><content style="-uslm-dtd:text">environmental factors, such as roads that are not accessible to the general public, traffic, or hazardous weather;</content>
                        </item>
                        <item style="-uslm-dtd:item" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="cc">“(cc) </num><content style="-uslm-dtd:text">a medical condition that impacts the ability to travel; or</content>
                        </item>
                        <item style="-uslm-dtd:item" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="dd">“(dd) </num><content style="-uslm-dtd:text">other factors, as determined by the Secretary.”</content>
                        </item>
                    </subclause></quotedContent>.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/114/19/s3/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t38/s1701">38 U.S.C. 1701 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Effective Date.—</heading><content style="-uslm-dtd:text">The amendments made by subsection (a) shall take effect on the date of the enactment of this Act and apply with respect to care or services provided on or after such date.</content>
            </subsection>
