    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To amend the Energy Policy and Conservation Act to permit exemptions for external power supplies from certain efficiency standards, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section style="-uslm-dtd:section" identifier="/us/sComp/113/263/s1" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t42/s6201">42 U.S.C. 6201 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content style="-uslm-dtd:text" class="block">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">EPS Service Parts Act of 2014</shortTitle>”.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/113/263/s2" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">EXEMPT SUPPLIES. </heading>
            <content style="-uslm-dtd:text" class="block">Section 325(u) of the Energy Policy and Conservation Act (42 U.S.C. 6295(u)) is amended by adding at the end the following:<quotedContent style="-uslm-dtd:quoted-block">
            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="5">“(5) </num><heading style="-uslm-dtd:header">Exempt supplies.—</heading>
                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">“(A) </num><heading style="-uslm-dtd:header">February 10, 2014, rule.—</heading>
                    <clause style="-uslm-dtd:clause" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="i">“(i) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">An external power supply shall not be subject to the final rule entitled ‘<quotedText style="-uslm-dtd:quote">Energy Conservation Program: Energy Conservation Standards for External Power Supplies</quotedText>’, published at 79 Fed. Reg. 7845 (February 10, 2014), if the external power supply—</chapeau>
                        <subclause style="-uslm-dtd:subclause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="I">“(I) </num><content style="-uslm-dtd:text">is manufactured during the period beginning on February 10, 2016, and ending on February 10, 2020;</content>
                        </subclause>
                        <subclause style="-uslm-dtd:subclause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="II">“(II) </num><content style="-uslm-dtd:text">is marked in accordance with the External Power Supply International Efficiency Marking Protocol, as in effect on February 10, 2016;</content>
                        </subclause>
                        <subclause style="-uslm-dtd:subclause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="III">“(III) </num><content style="-uslm-dtd:text">meets, where applicable, the standards under paragraph (3)(A), and has been certified to the Secretary as meeting International Efficiency Level IV or higher of the External Power Supply International Efficiency Marking Protocol, as in effect on February 10, 2016; and</content>
                        </subclause>
                        <subclause style="-uslm-dtd:subclause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="IV">“(IV) </num><chapeau style="-uslm-dtd:text">is made available by the manufacturer as a service part or a spare part for an end-use product that—</chapeau>
                            <item style="-uslm-dtd:item" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="aa">“(aa) </num><content style="-uslm-dtd:text">constitutes the primary load; and</content>
                            </item>
                            <item style="-uslm-dtd:item" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="bb">“(bb) </num><content style="-uslm-dtd:text">was manufactured before February 10, 2016.</content>
                            </item>
                        </subclause>
                    </clause>
                    <clause style="-uslm-dtd:clause" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="ii">“(ii) </num><heading style="-uslm-dtd:header">Reporting.—</heading><content style="-uslm-dtd:text">The Secretary may require manufacturers of products exempted pursuant to clause (i) to report annual total units shipped as service and spare parts that fall below International Efficiency Level VI.</content>
                    </clause>
                    <clause style="-uslm-dtd:clause" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="iii">“(iii) </num><heading style="-uslm-dtd:header">Limitation of exemption.—</heading><content style="-uslm-dtd:text">The Secretary may issue a rule, after providing public notice and opportunity for public comment, to limit the applicability of the exemption established under clause (i) if the Secretary determines that the exemption is resulting in a significant reduction of the energy savings that would otherwise result from the final rule described in such clause.</content>
                    </clause>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">“(B) </num><heading style="-uslm-dtd:header">Amended standards.—</heading>
                    <clause style="-uslm-dtd:clause" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="i">“(i) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">The Secretary may exempt an external power supply from any amended standard under this subsection if the external power supply—</chapeau>
                        <subclause style="-uslm-dtd:subclause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="I">“(I) </num><content style="-uslm-dtd:text">is manufactured within four years of the compliance date of the amended standard;</content>
                        </subclause>
                        <subclause style="-uslm-dtd:subclause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="II">“(II) </num><content style="-uslm-dtd:text">complies with applicable marking requirements adopted by the Secretary prior to the amendment;</content>
                        </subclause>
                        <subclause style="-uslm-dtd:subclause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="III">“(III) </num><content style="-uslm-dtd:text">meets the standards that were in effect prior to the amendment; and</content>
                        </subclause>
                        <subclause style="-uslm-dtd:subclause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="IV">“(IV) </num><chapeau style="-uslm-dtd:text">is made available by the manufacturer as a service part or a spare part for an end-use product that—</chapeau>
                            <item style="-uslm-dtd:item" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="aa">“(aa) </num><content style="-uslm-dtd:text">constitutes the primary load; and</content>
                            </item>
                            <item style="-uslm-dtd:item" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="bb">“(bb) </num><content style="-uslm-dtd:text">was manufactured before the compliance date of the amended standard.</content>
                            </item>
                        </subclause>
                    </clause>
                    <clause style="-uslm-dtd:clause" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="ii">“(ii) </num><heading style="-uslm-dtd:header">Reporting.—</heading><content style="-uslm-dtd:text">The Secretary may require manufacturers of a product exempted pursuant to clause (i) to report annual total units shipped as service and spare parts that do not meet the amended standard.”</content>
                    </clause>
                </subparagraph>
