    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To amend the Public Health Service Act to reauthorize programs under part A of title XI of such Act.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section style="-uslm-dtd:section" identifier="/us/sComp/113/240/s1" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t42/s201">42 U.S.C. 201 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE; TABLE OF CONTENTS. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/113/240/s1/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Short Title.—</heading><content style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Newborn Screening Saves Lives Reauthorization Act of 2014</shortTitle>”.</content>
            </subsection>

            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">IMPROVED NEWBORN AND CHILD SCREENING AND FOLLOWUP FOR HERITABLE DISORDERS. </heading>
            <chapeau style="-uslm-dtd:text" class="block">Section 1109 of the Public Health Service Act (42 U.S.C. 300b-8) is amended—</chapeau>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/113/240/s2/1" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">in subsection (a)—</chapeau>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/113/240/s2/1/A" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><chapeau style="-uslm-dtd:text">in the matter preceding paragraph (1)—</chapeau>
                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/113/240/s2/1/A/i" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">subsection (j)</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">section 1117</quotedText>”; and</content>
                    </clause>
                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/113/240/s2/1/A/ii" styleType="OLC">

                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">by amending paragraph (2) to read as follows:<quotedContent style="-uslm-dtd:quoted-block">
                    <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">“(2) </num><chapeau style="-uslm-dtd:text">to assist in providing health care professionals and newborn screening laboratory personnel with education in newborn screening, counseling, and training in—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">“(A) </num><content style="-uslm-dtd:text">relevant and new technologies in newborn screening and congenital, genetic, and metabolic disorders;</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">“(B) </num><content style="-uslm-dtd:text">the importance of the timeliness of collection, delivery, receipt, and screening of specimens; and</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">“(C) </num><content style="-uslm-dtd:text">sharing of medical and diagnostic information with providers and families;”</content>
                        </subparagraph>
                    </paragraph></quotedContent>;</content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/113/240/s2/1/C" styleType="OLC">

                    <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">by adding at the end the following:<quotedContent style="-uslm-dtd:quoted-block">
                    <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">“(5) </num><chapeau style="-uslm-dtd:text">to improve the timeliness of—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">“(A) </num><content style="-uslm-dtd:text">the collection, delivery, receipt, and screening of specimens; and</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">“(B) </num><content style="-uslm-dtd:text">the diagnosis of heritable disorders in newborns.”</content>
                        </subparagraph>
                    </paragraph></quotedContent>;</content>
                </subparagraph>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/113/240/s2/2" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">in subsection (c), by striking “<quotedText style="-uslm-dtd:quote">application submitted for a grant under subsection (a)(1)</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">application for a grant under this section</quotedText>”;</content>

        <section style="-uslm-dtd:section" identifier="/us/sComp/113/240/s3" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><heading style="-uslm-dtd:header">EVALUATING THE EFFECTIVENESS OF NEWBORN AND CHILD SCREENING AND FOLLOWUP PROGRAMS. </heading>
            <chapeau style="-uslm-dtd:text" class="block">Section 1110 of the Public Health Service Act (42 U.S.C. 300b-9) is amended—</chapeau>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/113/240/s3/1" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">in the section heading, by inserting “<quotedText style="-uslm-dtd:quote"><headingText style="-uslm-dtd:header-in-text">and followup</headingText></quotedText>” after “<quotedText style="-uslm-dtd:quote"><headingText style="-uslm-dtd:header-in-text">child screening</headingText></quotedText>”;</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/113/240/s3/2" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">in subsection (a), by striking “<quotedText style="-uslm-dtd:quote">of screening,</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">, including with respect to timeliness, of screening, followup,</quotedText>”;</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/113/240/s3/3" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><chapeau style="-uslm-dtd:text">in subsection (b)—</chapeau>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/113/240/s3/3/A" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><chapeau style="-uslm-dtd:text">in paragraph (1)—</chapeau>
                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/113/240/s3/3/A/i" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">counseling, testing</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">treatment, counseling, testing, followup,</quotedText>”; and</content>
                    </clause>

                        <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">by inserting before the semicolon the following: “<quotedText style="-uslm-dtd:quote">, including, as appropriate, through the assessment of health and development outcomes for such children through adolescence</quotedText>”;</content>
                    </clause>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/113/240/s3/3/B" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">in paragraph (2)—</chapeau>
                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/113/240/s3/3/B/i" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">counseling, testing</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">treatment, counseling, testing, followup,</quotedText>”;</content>
                    </clause>
                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/113/240/s3/3/B/ii" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">by inserting “<quotedText style="-uslm-dtd:quote">in a timely manner</quotedText>” after “<quotedText style="-uslm-dtd:quote">in newborns and children</quotedText>”; and</content>
                    </clause>
                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/113/240/s3/3/B/iii" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">or</quotedText>” at the end;</content>
                    </clause>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/113/240/s3/3/C" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">in paragraph (3), by striking the period at the end and inserting a semicolon; and</content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/113/240/s3/3/D" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">by adding at the end the following:<quotedContent style="-uslm-dtd:quoted-block">
                    <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">“(4) </num><content style="-uslm-dtd:text">methods that may be identified to improve quality in the diagnosis, treatment, and disease management of heritable disorders based on gaps in services or care; or</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">“(5) </num><chapeau style="-uslm-dtd:text">methods or best practices by which the eligible entities described in section 1109 can achieve in a timely manner—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">“(A) </num><content style="-uslm-dtd:text">collection, delivery, receipt, and screening of newborn screening specimens; and</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">“(B) </num><content style="-uslm-dtd:text">diagnosis of heritable disorders in newborns.”</content>
                        </subparagraph>
                    </paragraph></quotedContent>; and</content>
                </subparagraph>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/113/240/s3/4" styleType="OLC">
                <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">by striking subsection (d) (relating to authorization of appropriations).</content>
            </paragraph>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/113/240/s4" styleType="OLC">
            <num style="-uslm-dtd:enum" value="4">SEC. 4. </num><heading style="-uslm-dtd:header">ADVISORY COMMITTEE ON HERITABLE DISORDERS IN NEWBORNS AND CHILDREN. </heading>
            <chapeau style="-uslm-dtd:text" class="block">Section 1111 of the Public Health Service Act (42 U.S.C. 300b-10) is amended—</chapeau>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/113/240/s4/1" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">in subsection (b)—</chapeau>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/113/240/s4/1/A" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">by redesignating paragraphs (4) through (6) as paragraphs (6) through (8), respectively;</content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/113/240/s4/1/B" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">by inserting after paragraph (3), the following:<quotedContent style="-uslm-dtd:quoted-block">
                    <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">“(4) </num><content style="-uslm-dtd:text">provide technical assistance, as appropriate, to individuals and organizations regarding the submission of nominations to the uniform screening panel, including prior to the submission of such nominations;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">“(5) </num><content style="-uslm-dtd:text">take appropriate steps, at its discretion, to prepare for the review of nominations prior to their submission, including for conditions for which a screening method has been validated but other nomination criteria are not yet met, in order to facilitate timely action by the Advisory Committee once such submission has been received by the Committee;”</content>
                    </paragraph></quotedContent>;</content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/113/240/s4/1/C" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">in paragraph (6) (as so redesignated), by inserting “<quotedText style="-uslm-dtd:quote">, including the cost</quotedText>” after “<quotedText style="-uslm-dtd:quote">public health impact</quotedText>”; and</content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/113/240/s4/1/D" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="D">(D) </num><chapeau style="-uslm-dtd:text">in paragraph (8) (as so redesignated)—</chapeau>
                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/113/240/s4/1/D/i" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">in subparagraph (A), by striking “<quotedText style="-uslm-dtd:quote">achieve rapid diagnosis</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">achieve best practices in rapid diagnosis and appropriate treatment</quotedText>”;</content>
                    </clause>
                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/113/240/s4/1/D/ii" styleType="OLC">

                </subparagraph>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/113/240/s4/3" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">by redesignating subsections (f) and (g) as subsections (g) and (h), respectively;</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/113/240/s4/4" styleType="OLC">

                <subsection style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="g">“(g) </num><heading style="-uslm-dtd:header">Continuation of Operation of Committee.—</heading>
                    <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">“(1) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">Notwithstanding section 14 of the Federal Advisory Committee Act, the Advisory Committee shall continue to operate through the end of fiscal year 2019.</content>

                        <num style="-uslm-dtd:enum" value="2">“(2) </num><heading style="-uslm-dtd:header">Continuation if not reauthorized.—</heading><content style="-uslm-dtd:text">If at the end of fiscal year 2019 the duration of the Advisory Committee has not been extended by statute, the Advisory Committee may be deemed, for purposes of the Federal Advisory Committee Act, an advisory committee established by the President or an officer of the Federal Government under section 9(a) of such Act.”</content>

            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/113/240/s5/2" styleType="OLC">

            </paragraph>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/113/240/s6" styleType="OLC">
            <num style="-uslm-dtd:enum" value="6">SEC. 6. </num><heading style="-uslm-dtd:header">LABORATORY QUALITY AND SURVEILLANCE. </heading>
            <chapeau style="-uslm-dtd:text" class="block">Section 1113 of the Public Health Service Act (42 U.S.C. 300b-12) is amended—</chapeau>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/113/240/s6/1" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">in the section heading, by inserting “<quotedText style="-uslm-dtd:quote"><headingText style="-uslm-dtd:header-in-text">and surveillance</headingText></quotedText>” before the period;</content>
            </paragraph>

                <subsection style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">“(b) </num><heading style="-uslm-dtd:header">Surveillance Activities.—</heading><chapeau style="-uslm-dtd:text">The Secretary, acting through the Director of the Centers for Disease Control and Prevention, and taking into consideration the expertise of the Advisory Committee on Heritable Disorders in Newborns and Children established under section 1111, may provide, as appropriate, for the coordination of surveillance activities, including—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">“(1) </num><content style="-uslm-dtd:text">through standardized data collection and reporting, as well as the use of electronic health records; and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">“(2) </num><content style="-uslm-dtd:text">by promoting data sharing regarding newborn screening with State-based birth defects and developmental disabilities monitoring programs.”</content>
                    </paragraph>
                </subsection></quotedContent>.</content>
            </paragraph>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/113/240/s7" styleType="OLC">
            <num style="-uslm-dtd:enum" value="7">SEC. 7. </num><heading style="-uslm-dtd:header">INTERAGENCY COORDINATING COMMITTEE ON NEWBORN AND CHILD SCREENING. </heading>
            <chapeau style="-uslm-dtd:text" class="block">Section 1114 of the Public Health Service Act (42 U.S.C. 300b-13) is amended—</chapeau>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/113/240/s7/1" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">in subsection (c), by striking “<quotedText style="-uslm-dtd:quote">the Administrator, the Director of the Agency for Healthcare Research and Quality,</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">the Administrator of the Health Resources and Services Administration, the Director of the Agency for Healthcare Research and Quality, the Commissioner of Food and Drugs,</quotedText>”; and</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/113/240/s7/2" styleType="OLC">

            <num style="-uslm-dtd:enum" value="8">SEC. 8. </num><heading style="-uslm-dtd:header">NATIONAL CONTINGENCY PLAN FOR NEWBORN SCREENING. </heading>
            <chapeau style="-uslm-dtd:text" class="block">Section 1115(a) of the Public Health Service Act (42 U.S.C. 300b-14(a)) is amended—</chapeau>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/113/240/s8/1" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">consortia</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">consortium</quotedText>”; and</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/113/240/s8/2" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">by adding at the end the following: “<quotedText style="-uslm-dtd:quote">The plan shall be updated as needed and at least every five years.</quotedText>”.</content>
            </paragraph>
        </section>

            <num style="-uslm-dtd:enum" value="9">SEC. 9. </num><heading style="-uslm-dtd:header">HUNTER KELLY RESEARCH PROGRAM. </heading>
            <chapeau style="-uslm-dtd:text" class="block">Section 1116 of the Public Health Service Act (42 U.S.C. 300b-15) is amended—</chapeau>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/113/240/s9/1" styleType="OLC">

                        <num style="-uslm-dtd:enum" value="D">“(D) </num><content style="-uslm-dtd:text">conducting pilot studies on conditions recommended by the Advisory Committee on Heritable Disorders in Newborns and Children to ensure that screenings are ready for nationwide implementation; and”</content>
                    </subparagraph></quotedContent>; and</content>
                </subparagraph>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/113/240/s9/2" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">in subsection (c), by striking “<quotedText style="-uslm-dtd:quote">of the National Institutes of Health Reform Act of 2006</quotedText>”.</content>

                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/113/240/s11/a/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Not later than 2 years after the date of enactment of this Act, the Comptroller General of the United States shall submit a report to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Energy and Commerce of the House of Representatives concerning the timeliness of screening for heritable disorders in newborns.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/113/240/s11/a/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Contents.—</heading><chapeau style="-uslm-dtd:text">The report submitted under paragraph (1) shall include the following:</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/113/240/s11/a/2/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">An analysis of information regarding the timeliness of newborn screening, which may include the time elapsed from birth to specimen collection, specimen collection to receipt by laboratory, specimen receipt to reporting, reporting to followup testing, and followup testing to confirmed diagnosis.</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/113/240/s11/a/2/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">A summary of any guidelines, recommendations, or best practices available to States and health care providers intended to support a timely newborn screening system.</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/113/240/s11/a/2/C" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">An analysis of any barriers to maintaining a timely newborn screening system which may exist and recommendations for addressing such barriers.</content>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/113/240/s11/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t42/s300b-17">42 U.S.C. 300b-17</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Report by Secretary.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/113/240/s11/b/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">The Secretary of Health and Human Services shall—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/113/240/s11/b/1/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><chapeau style="-uslm-dtd:text">not later than 1 year after the date of enactment of this Act, submit to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Energy and Commerce of the House of Representatives a report on activities related to—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/113/240/s11/b/1/A/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">newborn screening; and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/113/240/s11/b/1/A/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">screening children who have or are at risk for heritable disorders; and</content>
                        </clause>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/113/240/s11/b/1/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">not less than every 2 years, submit to such committees an updated version of such report.</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/113/240/s11/b/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Contents.—</heading><chapeau style="-uslm-dtd:text">The report submitted under this subsection shall contain a description of—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/113/240/s11/b/2/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the ongoing activities under sections 1109, 1110, and 1112 through 1115 of the Public Health Service Act; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/113/240/s11/b/2/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the amounts expended on such activities.</content>
                    </subparagraph>
                </paragraph>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/113/240/s12" styleType="OLC">
            <num style="-uslm-dtd:enum" value="12">SEC. 12. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t42/s289">42 U.S.C. 289 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">INFORMED CONSENT FOR NEWBORN SCREENING RESEARCH. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/113/240/s12/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Research on newborn dried blood spots shall be considered research carried out on human subjects meeting the definition of section 46.102(f)(2) of title 45, Code of Federal Regulations, for purposes of Federally funded research conducted pursuant to the Public Health Service Act until such time as updates to the Federal Policy for the Protection of Human Subjects (the Common Rule) are promulgated pursuant to subsection (c). For purposes of this subsection, sections 46.116(c) and 46.116(d) of title 45, Code of Federal Regulations, shall not apply.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/113/240/s12/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Effective Date.—</heading><content style="-uslm-dtd:text">Subsection (a) shall apply only to newborn dried blood spots used for purposes of Federally funded research that were collected not earlier than 90 days after the date of enactment of this Act.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/113/240/s12/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Regulations.—</heading><content style="-uslm-dtd:text">Not later than 6 months after the date of enactment of this Act, the Secretary of Health and Human Services shall promulgate proposed regulations related to the updating of the Federal Policy for the Protection of Human Subjects (the Common Rule), particularly with respect to informed consent. Not later than 2 years after such date of enactment, the Secretary shall promulgate final regulations based on such proposed regulations.</content>
            </subsection>
