    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To grant the Secretary of the Interior permanent authority to authorize States to issue electronic duck stamps, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

        <section identifier="/us/sComp/113/239/s1" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s718o">16 U.S.C. 718o note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content class="block" style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Permanent Electronic Duck Stamp Act of 2013</shortTitle>”.</content>
        </section>
        <section identifier="/us/sComp/113/239/s2" role="definitions" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s718o">16 U.S.C. 718o</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">DEFINITIONS. </heading>
            <chapeau class="block" style="-uslm-dtd:text">In this Act:</chapeau>
            <paragraph identifier="/us/sComp/113/239/s2/1" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Actual stamp.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">actual stamp</term>” means a Migratory Bird Hunting and Conservation Stamp required under the Migratory Bird Hunting and Conservation Stamp Act (16 U.S.C. 718a et seq.) that is printed on paper and sold through the means established by the authority of the Secretary immediately before the date of enactment of this Act.</content>
            </paragraph>
            <paragraph identifier="/us/sComp/113/239/s2/2" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Automated licensing system.—</heading>
                <subparagraph identifier="/us/sComp/113/239/s2/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">automated licensing system</term>” means an electronic, computerized licensing system used by a State fish and wildlife agency to issue hunting, fishing, and other associated licenses and products.</content>
                </subparagraph>
                <subparagraph identifier="/us/sComp/113/239/s2/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Inclusion.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">automated licensing system</term>” includes a point-of-sale, Internet, telephonic system, or other electronic applications used for a purpose described in subparagraph (A).</content>
                </subparagraph>
            </paragraph>
            <paragraph identifier="/us/sComp/113/239/s2/3" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Electronic stamp.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">electronic stamp</term>” means an electronic version of an actual stamp that—</chapeau>
                <subparagraph identifier="/us/sComp/113/239/s2/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">is a unique identifier for the individual to whom it is issued;</content>
                </subparagraph>
                <subparagraph identifier="/us/sComp/113/239/s2/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">can be printed on paper or produced through an electronic application with the same indicators as the State endorsement provides;</content>
                </subparagraph>
                <subparagraph identifier="/us/sComp/113/239/s2/3/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">is issued through a State automated licensing system that is authorized, under State law and by the Secretary under this Act, to issue electronic stamps;</content>
                </subparagraph>
                <subparagraph identifier="/us/sComp/113/239/s2/3/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">is compatible with the hunting licensing system of the State that issues the electronic stamp; </content>
                </subparagraph>
                <subparagraph identifier="/us/sComp/113/239/s2/3/E" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">is described in the State application approved by the Secretary under section 4(b); and</content>
                </subparagraph>
                <subparagraph identifier="/us/sComp/113/239/s2/3/F" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">may contain an image of the actual stamp.</content>
                </subparagraph>
            </paragraph>
            <paragraph identifier="/us/sComp/113/239/s2/4" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Secretary.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">Secretary</term>” means the Secretary of the Interior.</content>
            </paragraph>
        </section>
        <section identifier="/us/sComp/113/239/s3" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s718p">16 U.S.C. 718p</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">AUTHORITY TO ISSUE ELECTRONIC DUCK STAMPS. </heading>
            <subsection identifier="/us/sComp/113/239/s3/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Secretary may authorize any State to issue electronic stamps in accordance with this Act.</content>
            </subsection>
            <subsection identifier="/us/sComp/113/239/s3/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Consultation.—</heading><content style="-uslm-dtd:text">The Secretary shall implement this section in consultation with State management agencies.</content>
            </subsection>
        </section>
        <section identifier="/us/sComp/113/239/s4" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="4">SEC. 4. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s718q">16 U.S.C. 718q</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">STATE APPLICATION. </heading>
            <subsection identifier="/us/sComp/113/239/s4/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Approval of Application Required.—</heading><content style="-uslm-dtd:text">The Secretary may not authorize a State to issue electronic stamps under this Act unless the Secretary has received and approved an application submitted by the State in accordance with this section. The Secretary may determine the number of new States per year to participate in the electronic stamp program.</content>
            </subsection>
            <subsection identifier="/us/sComp/113/239/s4/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Contents of Application.—</heading><chapeau style="-uslm-dtd:text">The Secretary may not approve a State application unless the application contains—</chapeau>
                <paragraph identifier="/us/sComp/113/239/s4/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">a description of the format of the electronic stamp that the State will issue under this Act, including identifying features of the licensee that will be specified on the stamp;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/113/239/s4/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">a description of any fee the State will charge for issuance of an electronic stamp;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/113/239/s4/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">a description of the process the State will use to account for and transfer to the Secretary the amounts collected by the State that are required to be transferred to the Secretary under the program;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/113/239/s4/b/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">the manner by which the State will transmit electronic stamp customer data to the Secretary;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/113/239/s4/b/5" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">the manner by which actual stamps will be delivered;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/113/239/s4/b/6" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">the policies and procedures under which the State will issue duplicate electronic stamps; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/113/239/s4/b/7" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">such other policies, procedures, and information as may be reasonably required by the Secretary.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/113/239/s4/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Publication of Deadlines, Eligibility Requirements, and Selection Criteria.—</heading><chapeau style="-uslm-dtd:text">Not later than 30 days before the date on which the Secretary begins accepting applications under this section, the Secretary shall publish—</chapeau>
                <paragraph identifier="/us/sComp/113/239/s4/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">deadlines for submission of applications;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/113/239/s4/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">eligibility requirements for submitting applications; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/113/239/s4/c/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">criteria for approving applications.</content>
                </paragraph>
            </subsection>
        </section>
        <section identifier="/us/sComp/113/239/s5" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="5">SEC. 5. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s718r">16 U.S.C. 718r</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">STATE OBLIGATIONS AND AUTHORITIES. </heading>
            <subsection identifier="/us/sComp/113/239/s5/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Delivery of Electronic Stamp.—</heading><chapeau style="-uslm-dtd:text">The Secretary shall require that each individual to whom a State sells an electronic stamp under this Act shall receive the electronic stamp—</chapeau>
                <paragraph identifier="/us/sComp/113/239/s5/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">on the date of purchase of the electronic stamp; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/113/239/s5/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">in a manner agreed upon by the State and Secretary.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/113/239/s5/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Collection and Transfer of Electronic Stamp Revenue and Customer Information.—</heading>
                <paragraph identifier="/us/sComp/113/239/s5/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Requirement to transmit.—</heading><chapeau style="-uslm-dtd:text">The Secretary shall require each State authorized to issue electronic stamps to collect and submit to the Secretary in accordance with this section—</chapeau>
                    <subparagraph identifier="/us/sComp/113/239/s5/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the first name, last name, and complete mailing address of each individual that purchases an electronic stamp from the State;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/113/239/s5/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the face value amount of each electronic stamp sold by the State; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/113/239/s5/b/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">the amount of the Federal portion of any fee required by the agreement for each stamp sold.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/113/239/s5/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Time of transmittal.—</heading><content style="-uslm-dtd:text">The Secretary shall require the submission under paragraph (1) to be made with respect to sales of electronic stamps by a State according to the written agreement between the Secretary and the State agency.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/113/239/s5/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Additional fees not affected.—</heading><content style="-uslm-dtd:text">This section shall not apply to the State portion of any fee collected by a State under subsection (c).</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/113/239/s5/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Electronic Stamp Issuance Fee.—</heading><content style="-uslm-dtd:text">A State authorized to issue electronic stamps may charge a reasonable fee to cover costs incurred by the State and the Department of the Interior in issuing electronic stamps under this Act, including costs of delivery of actual stamps under subsection (e).</content>
            </subsection>
            <subsection identifier="/us/sComp/113/239/s5/d" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Duplicate Electronic Stamps.—</heading><content style="-uslm-dtd:text">A State authorized to issue electronic stamps may issue a duplicate electronic stamp to replace an electronic stamp issued by the State that is lost or damaged.</content>
            </subsection>
            <subsection identifier="/us/sComp/113/239/s5/e" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Delivery of Actual Stamps.—</heading><content style="-uslm-dtd:text">The Secretary shall issue an actual stamp after March 10 of each year to each individual that purchased an electronic stamp for the preceding waterfowl season.</content>
            </subsection>
            <subsection identifier="/us/sComp/113/239/s5/f" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Limitation on Authority To Require Purchase of State License.—</heading><content style="-uslm-dtd:text">A State may not require that an individual purchase a State hunting license as a condition of issuing an electronic stamp under this Act.</content>
            </subsection>
        </section>
        <section identifier="/us/sComp/113/239/s6" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="6">SEC. 6. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s718s">16 U.S.C. 718s</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">ELECTRONIC STAMP REQUIREMENTS; RECOGNITION OF ELECTRONIC STAMP. </heading>
            <subsection identifier="/us/sComp/113/239/s6/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Stamp Requirements.—</heading><chapeau style="-uslm-dtd:text">The Secretary shall require an electronic stamp issued by a State under this Act—</chapeau>
                <paragraph identifier="/us/sComp/113/239/s6/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">to have the same format as any other license, validation, or privilege the State issues under the automated licensing system of the State; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/113/239/s6/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">to specify identifying features of the licensee that are adequate to enable Federal, State, and other law enforcement officers to identify the holder.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/113/239/s6/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Recognition of Electronic Stamp.—</heading><chapeau style="-uslm-dtd:text">Any electronic stamp issued by a State under this Act shall—</chapeau>
                <paragraph identifier="/us/sComp/113/239/s6/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">bestow upon the licensee the same privileges as are bestowed by an actual stamp;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/113/239/s6/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">be recognized nationally as a valid Federal migratory bird hunting and conservation stamp; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/113/239/s6/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">authorize the licensee to hunt migratory waterfowl in any other State, in accordance with the laws of the other State governing that hunting.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/113/239/s6/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Duration.—</heading><content style="-uslm-dtd:text">An electronic stamp issued by a State shall be valid through the first June 30 that occurs after the date of issuance of the electronic stamp by the State.</content>
            </subsection>

        <section identifier="/us/sComp/113/239/s7" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="7">SEC. 7. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s718t">16 U.S.C. 718t</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">TERMINATION OF STATE PARTICIPATION. </heading>
            <chapeau class="block" style="-uslm-dtd:text">The authority of a State to issue electronic stamps under this Act may be terminated—</chapeau>
            <paragraph identifier="/us/sComp/113/239/s7/1" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">by the Secretary, if the Secretary—</chapeau>
                <subparagraph identifier="/us/sComp/113/239/s7/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">finds that the State has violated any of the terms of the application of the State approved by the Secretary under section 4; and</content>
                </subparagraph>
                <subparagraph identifier="/us/sComp/113/239/s7/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">provides to the State written notice of the termination by not later than the date that is 30 days before the date of termination; or</content>
                </subparagraph>
            </paragraph>
            <paragraph identifier="/us/sComp/113/239/s7/2" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">by the State, by providing written notice to the Secretary by not later than the date that is 30 days before the termination date.</content>
            </paragraph>
