            <num style="-uslm-dtd:enum" value="I">TITLE I—</num><heading style="-uslm-dtd:header">HIGH SEAS FISHING COMPLIANCE </heading>
            <section identifier="/us/sComp/104/43/tI/s101" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="101">SEC. 101. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5501">16 U.S.C. 5501 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
                <content class="block" style="-uslm-dtd:text">This title may be cited as the “<shortTitle style="-uslm-dtd:quote"><inline style="-uslm-dtd:short-title">High Seas Fishing Compliance Act of 1995</inline></shortTitle>”.</content>
            </section>
            <section identifier="/us/sComp/104/43/tI/s102" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="102">SEC. 102. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5501">16 U.S.C. 5501</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">PURPOSE. </heading>
                <subsection role="undesignated-level" style="-uslm-dtd:subsection" styleType="OLC"><chapeau style="-uslm-dtd:text">It is the purpose of this Act—</chapeau>
                    <paragraph identifier="/us/sComp/104/43/tI/s102/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">to implement the Agreement to Promote Compliance with International Conservation and Management Measures by Fishing Vessels on the High Seas, adopted by the Conference of the Food and Agriculture Organization of the United Nations on November 24, 1993; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s102/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">to establish a system of permitting, reporting, and regulation for vessels of the United States fishing on the high seas.</content>
                    </paragraph>
                </subsection>
            </section>
            <section identifier="/us/sComp/104/43/tI/s103" role="definitions" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="103">SEC. 103. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5502">16 U.S.C. 5502</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">DEFINITIONS. </heading>
                <subsection role="undesignated-level" style="-uslm-dtd:subsection" styleType="OLC"><chapeau style="-uslm-dtd:text">As used in this Act—</chapeau>
                    <paragraph identifier="/us/sComp/104/43/tI/s103/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Agreement</term>” means the Agreement to Promote Compliance with International Conservation and Management Measures by Fishing Vessels on the High Seas, adopted by the Conference of the Food and Agriculture Organization of the United Nations on November 24, 1993.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s103/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">FAO</term>” means the Food and Agriculture Organization of the United Nations.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s103/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">high seas</term>” means the waters beyond the territorial sea or exclusive economic zone (or the equivalent) of any nation, to the extent that such territorial sea or exclusive economic zone (or the equivalent) is recognized by the United States.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s103/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">high seas fishing vessel</term>” means any vessel of the United States or subject to the jurisdiction of the United States used or intended for use—</chapeau>
                        <subparagraph identifier="/us/sComp/104/43/tI/s103/4/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">on the high seas;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tI/s103/4/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">for the purpose of the commercial exploitation of living marine resources; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tI/s103/4/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">as a harvesting vessel, as a mother ship, or as any other support vessel directly engaged in a fishing operation.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s103/5" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">international conservation and management measures</term>” means measures to conserve or manage one or more species of living marine resources that are adopted and applied in accordance with the relevant rules of international law, as reflected in the 1982 United Nations Convention on the Law of the Sea, and that are recognized by the United States. Such measures may be adopted by global, regional, or sub-regional fisheries organizations, subject to the rights and obligations of their members, or by treaties or other international agreements.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s103/6" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="6">(6) </num><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">length</term>” means—</chapeau>
                        <subparagraph identifier="/us/sComp/104/43/tI/s103/6/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">for any high seas fishing vessel built after July 18, 1982, 96 percent of the total length on a waterline at 85 percent of the least molded depth measured from the top of the keel, or the length from the foreside of the stem to the axis of the rudder stock on that waterline, if that is greater, except that in ships designed with a rake of keel the waterline on which this length is measured shall be parallel to the designed waterline; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tI/s103/6/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">for any high seas fishing vessel built before July 18, 1982, registered length as entered on the vessel's documentation.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s103/7" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">person</term>” means any individual (whether or not a citizen or national of the United States), any corporation, partnership, association, or other entity (whether or not organized or existing under the laws of any State), and any Federal, State, local, or foreign government or any entity of any such government.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s103/8" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="8">(8) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Secretary</term>” means the Secretary of Commerce.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s103/9" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="9">(9) </num><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">vessel of the United States</term>” means—</chapeau>
                        <subparagraph identifier="/us/sComp/104/43/tI/s103/9/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">a vessel documented under chapter 121 of title 46, United States Code, or numbered in accordance with chapter 123 of title 46, United States Code;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tI/s103/9/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">a vessel owned in whole or part by—</chapeau>
                            <clause identifier="/us/sComp/104/43/tI/s103/9/B/i" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the United States or a territory, commonwealth, or possession of the United States;</content>
                            </clause>
                            <clause identifier="/us/sComp/104/43/tI/s103/9/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">a State or political subdivision thereof;</content>
                            </clause>
                            <clause identifier="/us/sComp/104/43/tI/s103/9/B/iii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">a citizen or national of the United States; or</content>
                            </clause>
                            <clause identifier="/us/sComp/104/43/tI/s103/9/B/iv" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">a corporation created under the laws of the United States or any State, the District of Columbia, or any territory, commonwealth, or possession of the United States; unless the vessel has been granted the nationality of a foreign nation in accordance with article 92 of the 1982 United Nations Convention on the Law of the Sea and a claim of nationality or registry for the vessel is made by the master or individual in charge at the time of the enforcement action by an officer or employee of the United States authorized to enforce applicable provisions of the United States law; and</content>
                            </clause>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tI/s103/9/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">a vessel that was once documented under the laws of the United States and, in violation of the laws of the United States, was either sold to a person not a citizen of the United States or placed under foreign registry or a foreign flag, whether or not the vessel has been granted the nationality of a foreign nation.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s103/10" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="10">(10) </num><content style="-uslm-dtd:text">The terms “<term style="-uslm-dtd:term">vessel subject to the jurisdiction of the United States</term>” and “<term style="-uslm-dtd:quote">vessel without nationality</term>” have the same meaning as in section 3(c) of the Maritime Drug Law Enforcement Act (46 U.S.C. 1903(c)).</content>
                    </paragraph>
                </subsection>
            </section>
            <section identifier="/us/sComp/104/43/tI/s104" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="104">SEC. 104. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5503">16 U.S.C. 5503</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">PERMITTING. </heading>
                <subsection identifier="/us/sComp/104/43/tI/s104/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">No high seas fishing vessel shall engage in harvesting operations on the high seas unless the vessel has on board a valid permit issued under this section.</content>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tI/s104/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Eligibility.—</heading>
                    <paragraph identifier="/us/sComp/104/43/tI/s104/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">Any vessel of the United States is eligible to receive a permit under this section, unless the vessel was previously authorized to be used for fishing on the high seas by a foreign nation, and</chapeau>
                        <subparagraph identifier="/us/sComp/104/43/tI/s104/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the foreign nation suspended such authorization because the vessel undermined the effectiveness of international conservation and management measures, and the suspension has not expired; or</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tI/s104/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the foreign nation, within the last three years preceding application for a permit under this section, withdrew such authorization because the vessel undermined the effectiveness of international conservation and management measures.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s104/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">The restriction in paragraph (1) does not apply if ownership of the vessel has changed since the vessel undermined the effectiveness of international conservation and management measures, and the new owner has provided sufficient evidence to the Secretary demonstrating that the previous owner or operator has no further legal, beneficial or financial interest in, or control of, the vessel.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s104/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">The restriction in paragraph (1) does not apply if the Secretary makes a determination that issuing a permit would not subvert the purposes of the Agreement.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s104/b/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">The Secretary may not issue a permit to a vessel unless the Secretary is satisfied that the United States will be able to exercise effectively its responsibilities under the Agreement with respect to that vessel.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tI/s104/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Application.—</heading>
                    <paragraph identifier="/us/sComp/104/43/tI/s104/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">The owner or operator of a high seas fishing vessel may apply for a permit under this section by completing an application form prescribed by the Secretary.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s104/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">The application form shall contain—</chapeau>
                        <subparagraph identifier="/us/sComp/104/43/tI/s104/c/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the vessel's name, previous names (if known), official numbers, and port of record;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tI/s104/c/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the vessel's previous flags (if any);</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tI/s104/c/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">the vessel's International Radio Call Sign (if any);</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tI/s104/c/2/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">the names and addresses of the vessel's owners and operators;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tI/s104/c/2/E" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">where and when the vessel was built;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tI/s104/c/2/F" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">the type of vessel;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tI/s104/c/2/G" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="G">(G) </num><content style="-uslm-dtd:text">the vessel's length; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tI/s104/c/2/H" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="H">(H) </num><content style="-uslm-dtd:text">any other information the Secretary requires for the purposes of implementing the Agreement.</content>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tI/s104/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Conditions.—</heading><chapeau style="-uslm-dtd:text">The Secretary shall establish such conditions and restrictions on each permit issued under this section as are necessary and appropriate to carry out the obligations of the United States under the Agreement, including but not limited to the following:</chapeau>
                    <paragraph identifier="/us/sComp/104/43/tI/s104/d/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">The vessel shall be marked in accordance with the FAO Standard Specifications for the Marking and Identification of Fishing Vessels, or with regulations issued under section 305 of the Magnuson Fishery Conservation and Management Act<ref class="footnoteRef" idref="ID3F91C989E6E241D9AA26932B626B8CB0" style="-uslm-dtd:footnote-ref">1</ref> (16 U.S.C. 1855); and</content><footnote id="ID3F91C989E6E241D9AA26932B626B8CB0" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">1</sup><content><p style="-uslm-dtd:para; margin-left:1em">So in law. Section 211 of the Department of Commerce and Related Agencies Appropriations Act, 1997 (as contained in section 101(a), title I of Division A of Public Law 104–208; 110 Stat. 3009–41) provides:</p>
                        <p style="-uslm-dtd:para; margin-left:1em">
<headingText style="-uslm-dtd:header-in-text">Sec</headingText>. 211. (a) Effective 15 days after the enactment of the Sustainable Fisheries Act, section 1 of the Magnuson Fishery Conservation and Management Act (16 U.S.C. 1801) shall be amended to read as follows: “<quotedText style="-uslm-dtd:quote">That this Act may be cited as the ‘<quotedText style="-uslm-dtd:quote">Magnuson-Stevens Fishery Conservation and Management Act</quotedText>’.</quotedText>”</p>
                        <p style="-uslm-dtd:para; margin-left:1em">(b) Effective 15 days after the enactment of the Sustainable Fisheries Act, all references to the Magnuson Fishery Conservation and Management Act shall be redesignated as references to the Magnuson-Stevens Fishery Conservation and Management Act.</p>
                        <p style="-uslm-dtd:para; margin-left:1em">Since such section did not actually amend each occurrence of the short title in law, the former short title appears here.</p></content></footnote>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s104/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">The permit holder shall report such information as the Secretary by regulation requires, including area of fishing operations and catch statistics. The Secretary shall promulgate regulations concerning conditions under which information submitted under this paragraph may be released.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tI/s104/e" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Fees.—</heading>
                    <paragraph identifier="/us/sComp/104/43/tI/s104/e/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">The Secretary shall by regulation establish the level of fees to be charged for permits issued under this section. The amount of any fee charged for a permit issued under this section shall not exceed the administrative costs incurred in issuing such permits. The permitting fee may be in addition to any fee required under any regional permitting regime applicable to high seas fishing vessels.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s104/e/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">The fees authorized by paragraph (1) shall be collected and credited to the Operations, Research and Facilities account of the National Oceanic and Atmospheric Administration. Fees collected under this subsection shall be available for the necessary expenses of the National Oceanic and Atmospheric Administration in implementing this Act, and shall remain available until expended.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tI/s104/f" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Validity.—</heading><chapeau style="-uslm-dtd:text">A permit issued under this section for a vessel is void if—</chapeau>
                    <paragraph identifier="/us/sComp/104/43/tI/s104/f/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">any other permit or authorization required for the vessel to fish is expired, revoked, or suspended; or</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s104/f/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the vessel is no longer documented under the laws of the United States or eligible for such documentation.</content>
                    </paragraph>
                </subsection>
            </section>
            <section identifier="/us/sComp/104/43/tI/s105" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="105">SEC. 105. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5504">16 U.S.C. 5504</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">RESPONSIBILITIES OF THE SECRETARY. </heading>
                <subsection identifier="/us/sComp/104/43/tI/s105/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Record.—</heading><content style="-uslm-dtd:text">The Secretary shall maintain an automated file or record of high seas fishing vessels issued permits under section 104, including all information submitted under section 104(c)(2).</content>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tI/s105/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Information To FAO.—</heading><chapeau style="-uslm-dtd:text">The Secretary, in cooperation with the Secretary of State and the Secretary of the department in which the Coast Guard is operating, shall—</chapeau>
                    <paragraph identifier="/us/sComp/104/43/tI/s105/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">make available to FAO information contained in the record maintained under subsection (a);</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s105/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">promptly notify FAO of changes in such information;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s105/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">promptly notify FAO of additions to or deletions from the record, and the reason for any deletion;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s105/b/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">convey to FAO information relating to any permit granted under section 104(b)(3), including the vessel's identity, owner or operator, and factors relevant to the Secretary's determination to issue the permit;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s105/b/5" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">report promptly to FAO all relevant information regarding any activities of high seas fishing vessels that undermine the effectiveness of international conservation and management measures, including the identity of the vessels and any sanctions imposed; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s105/b/6" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">provide the FAO a summary of evidence regarding any activities of foreign vessels that undermine the effectiveness of international conservation and management measures.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tI/s105/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Information to Flag Nations.—</heading><chapeau style="-uslm-dtd:text">If the Secretary, in cooperation with the Secretary of State and the Secretary of the department in which the Coast Guard is operating, has reasonable grounds to believe that a foreign vessel has engaged in activities undermining the effectiveness of international conservation and management measures, the Secretary shall—</chapeau>
                    <paragraph identifier="/us/sComp/104/43/tI/s105/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">provide to the flag nation information, including appropriate evidentiary material, relating to those activities; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s105/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">when such foreign vessel is voluntarily in a United States port, promptly notify the flag nation and, if requested by the flag nation, make arrangements to undertake such lawful investigatory measures as may be considered necessary to establish whether the vessel has been used contrary to the provisions of the Agreement.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tI/s105/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Regulations.—</heading><content style="-uslm-dtd:text">The Secretary, after consultation with the Secretary of State and the Secretary of the department in which the Coast Guard is operating, may promulgate such regulations, in accordance with section 553 of title 5, United States Code, as may be necessary to carry out the purposes of the Agreement and this title. The Secretary shall coordinate such regulations with any other entities regulating high seas fishing vessels, in order to minimize duplication of permit application and reporting requirements. To the extent practicable, such regulations shall also be consistent with regulations implementing fishery management plans under the Magnuson Fishery Conservation and Management Act<ref class="footnoteRef" idref="IDD050E5C110D645F1BCD2BC41028EF309" style="-uslm-dtd:footnote-ref">2</ref> (16 U.S.C. 1801 et seq.).</content><footnote id="IDD050E5C110D645F1BCD2BC41028EF309" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">2</sup><p style="-uslm-dtd:para; margin-left:1em">See footnote to section 104(d)(1).</p></footnote>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tI/s105/e" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Notice of International Conservation and Management Measures.—</heading><content style="-uslm-dtd:text">The Secretary, in consultation with the Secretary of State, shall publish in the Federal Register, from time to time, a notice listing international conservation and management measures recognized by the United States.</content>
                </subsection>
            </section>
            <section identifier="/us/sComp/104/43/tI/s106" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="106">SEC. 106. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5505">16 U.S.C. 5505</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">UNLAWFUL ACTIVITIES. </heading>
                <subsection role="undesignated-level" style="-uslm-dtd:subsection" styleType="OLC"><chapeau style="-uslm-dtd:text">It is unlawful for any person subject to the jurisdiction of the United States—</chapeau>
                    <paragraph identifier="/us/sComp/104/43/tI/s106/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">to use a high seas fishing vessel on the high seas in contravention of international conservation and management measures described in section 105(e);</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s106/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">to use a high seas fishing vessel on the high seas, unless the vessel has on board a valid permit issued under section 104;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s106/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">to use a high seas fishing vessel in violation of the conditions or restrictions of a permit issued under section 104;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s106/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">to falsify any information required to be reported, communicated, or recorded pursuant to this title or any regulation issued under this title, or to fail to submit in a timely fashion any required information, or to fail to report to the Secretary immediately any change in circumstances that has the effect of rendering any such information false, incomplete, or misleading;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s106/5" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">to refuse to permit an authorized officer to board a high seas fishing vessel subject to such person's control for purposes of conducting any search or inspection in connection with the enforcement of this title or any regulation issued under this title;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s106/6" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">to forcibly assault, resist, oppose, impede, intimidate, or interfere with an authorized officer in the conduct of any search or inspection described in paragraph (5);</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s106/7" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">to resist a lawful arrest or detention for any act prohibited by this section;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s106/8" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="8">(8) </num><content style="-uslm-dtd:text">to interfere with, delay, or prevent, by any means, the apprehension, arrest, or detection of another person, knowing that such person has committed any act prohibited by this section;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s106/9" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="9">(9) </num><content style="-uslm-dtd:text">to ship, transport, offer for sale, sell, purchase, import, export, or have custody, control, or possession of, any living marine resource taken or retained in violation of this title or any regulation or permit issued under this title; or</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s106/10" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="10">(10) </num><content style="-uslm-dtd:text">to violate any provision of this title or any regulation or permit issued under this title.</content>
                    </paragraph>
                </subsection>
            </section>
            <section identifier="/us/sComp/104/43/tI/s107" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="107">SEC. 107. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5506">16 U.S.C. 5506</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">ENFORCEMENT PROVISIONS. </heading>
                <subsection identifier="/us/sComp/104/43/tI/s107/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Duties of Secretaries.—</heading><content style="-uslm-dtd:text">This title shall be enforced by the Secretary of Commerce and the Secretary of the department in which the Coast Guard is operating. Such Secretaries may by agreement utilize, on a reimbursable basis or otherwise, the personnel, services, equipment (including aircraft and vessels), and facilities of any other Federal agency, or of any State agency, in the performance of such duties. Such Secretaries shall, and the head of any Federal or State agency that has entered into an agreement with either such Secretary under this section may (if the agreement so provides), authorize officers to enforce the provisions of this title or any regulation or permit issued under this title.</content>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tI/s107/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">District Court Jurisdiction.—</heading><content style="-uslm-dtd:text">The district courts of the United States shall have exclusive jurisdiction over any case or controversy arising under the provisions of this title. In the case of Guam, and any Commonwealth, territory, or possession of the United States in the Pacific Ocean, the appropriate court is the United States District Court for the District of Guam, except that in the case of American Samoa, the appropriate court is the United States District Court for the District of Hawaii.</content>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tI/s107/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Powers of Enforcement Officers.—</heading>
                    <paragraph identifier="/us/sComp/104/43/tI/s107/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">Any officer who is authorized under subsection (a) to enforce the provisions of this title may—</chapeau>
                        <subparagraph identifier="/us/sComp/104/43/tI/s107/c/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><chapeau style="-uslm-dtd:text">with or without a warrant or other process—</chapeau>
                            <clause identifier="/us/sComp/104/43/tI/s107/c/1/A/i" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">arrest any person, if the officer has reasonable cause to believe that such person has committed an act prohibited by paragraph (6), (7), (8), or (9) of section 106;</content>
                            </clause>
                            <clause identifier="/us/sComp/104/43/tI/s107/c/1/A/ii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">board, and search or inspect, any high seas fishing vessel;</content>
                            </clause>
                            <clause identifier="/us/sComp/104/43/tI/s107/c/1/A/iii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">seize any high seas fishing vessel (together with its fishing gear, furniture, appurtenances, stores, and cargo) used or employed in, or with respect to which it reasonably appears that such vessel was used or employed in, the violation of any provision of this title or any regulation or permit issued under this title;</content>
                            </clause>
                            <clause identifier="/us/sComp/104/43/tI/s107/c/1/A/iv" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">seize any living marine resource (wherever found) taken or retained, in any manner, in connection with or as a result of the commission of any act prohibited by section 106;<ref class="footnoteRef" idref="IDF2D9143516D84612AA19ADD18B32DE43" style="-uslm-dtd:footnote-ref">3</ref></content><footnote id="IDF2D9143516D84612AA19ADD18B32DE43" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">3</sup><p style="-uslm-dtd:para; margin-left:1em">So in law. Probably should be “<quotedText style="-uslm-dtd:quote">; and</quotedText>”.</p></footnote>
                            </clause>
                            <clause identifier="/us/sComp/104/43/tI/s107/c/1/A/v" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="v">(v) </num><content style="-uslm-dtd:text">seize any other evidence related to any violation of any provision of this title or any regulation or permit issued under this title;</content>
                            </clause>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tI/s107/c/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">execute any warrant or other process issued by any court of competent jurisdiction; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tI/s107/c/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">exercise any other lawful authority.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s107/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">Subject to the direction of the Secretary, a person charged with law enforcement responsibilities by the Secretary who is performing a duty related to enforcement of a law regarding fisheries or other marine resources may make an arrest without a warrant for an offense against the United States committed in his presence, or for a felony cognizable under the laws of the United States, if he has reasonable grounds to believe that the person to be arrested has committed or is committing a felony.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tI/s107/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Issuance of Citations.—</heading><content style="-uslm-dtd:text">If any authorized officer finds that a high seas fishing vessel is operating or has been operated in violation of any provision of this title, such officer may issue a citation to the owner or operator of such vessel in lieu of proceeding under subsection (c). If a permit has been issued pursuant to this title for such vessel, such officer shall note the issuance of any citation under this subsection, including the date thereof and the reason therefor, on the permit. The Secretary shall maintain a record of all citations issued pursuant to this subsection.</content>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tI/s107/e" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Liability for Costs.—</heading><content style="-uslm-dtd:text">Any person assessed a civil penalty for, or convicted of, any violation of this Act shall be liable for the cost incurred in storage, care, and maintenance of any living marine resource or other property seized in connection with the violation.</content>
                </subsection>
            </section>
            <section identifier="/us/sComp/104/43/tI/s108" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="108">SEC. 108. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5507">16 U.S.C. 5507</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">CIVIL PENALTIES AND PERMIT SANCTIONS. </heading>
                <subsection identifier="/us/sComp/104/43/tI/s108/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Civil Penalties.—</heading>
                    <paragraph identifier="/us/sComp/104/43/tI/s108/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">Any person who is found by the Secretary, after notice and opportunity for a hearing in accordance with section 554 of title 5, United States Code, to have committed an act prohibited by section 106 shall be liable to the United States for a civil penalty. The amount of the civil penalty shall not exceed $100,000 for each violation. Each day of a continuing violation shall constitute a separate offense. The amount of such civil penalty shall be assessed by the Secretary by written notice. In determining the amount of such penalty, the Secretary shall take into account the nature, circumstances, extent, and gravity of the prohibited acts committed and, with respect to the violation, the degree of culpability, any history of prior offenses, and such other matters as justice may require.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s108/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">The Secretary may compromise, modify, or remit, with or without conditions, any civil penalty that is subject to imposition or that has been imposed under this section.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tI/s108/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Permit Sanctions.—</heading>
                    <paragraph identifier="/us/sComp/104/43/tI/s108/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">In any case in which—</chapeau>
                        <subparagraph identifier="/us/sComp/104/43/tI/s108/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">a vessel of the United States has been used in the commission of an act prohibited under section 106;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tI/s108/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the owner or operator of a vessel or any other person who has been issued or has applied for a permit under section 104 has acted in violation of section 106; or</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tI/s108/b/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><chapeau style="-uslm-dtd:text">any amount in settlement of a civil forfeiture imposed on a high seas fishing vessel or other property, or any civil penalty or criminal fine imposed on a high seas fishing vessel or on an owner or operator of such a vessel or on any other person who has been issued or has applied for a permit under any fishery resource statute enforced by the Secretary, has not been paid and is overdue,<ref class="footnoteRef" idref="IDDBDA792EAC604A608D693B7F6B55EAE6" style="-uslm-dtd:footnote-ref">4</ref> the Secretary may—</chapeau><footnote id="IDDBDA792EAC604A608D693B7F6B55EAE6" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">4</sup><p style="-uslm-dtd:para; margin-left:1em">So in law. The margin beginning with the text “<quotedText style="-uslm-dtd:quote">the Secretary may—</quotedText>” through the end probably should be moved 2 ems to left so as to appear flush on the margin for paragraph (1).</p></footnote>
                            <clause identifier="/us/sComp/104/43/tI/s108/b/1/C/i" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">revoke any permit issued to or applied for by such vessel or person under this title, with or without prejudice to the issuance of subsequent permits;</content>
                            </clause>
                            <clause identifier="/us/sComp/104/43/tI/s108/b/1/C/ii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">suspend such permit for a period of time considered by the Secretary to be appropriate;</content>
                            </clause>
                            <clause identifier="/us/sComp/104/43/tI/s108/b/1/C/iii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">deny such permit; or</content>
                            </clause>
                            <clause identifier="/us/sComp/104/43/tI/s108/b/1/C/iv" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">impose additional conditions and restrictions on such permit.</content>
                            </clause>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s108/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">In imposing a sanction under this subsection, the Secretary shall take into account—</chapeau>
                        <subparagraph identifier="/us/sComp/104/43/tI/s108/b/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the nature, circumstances, extent, and gravity of the prohibited acts for which the sanction is imposed; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tI/s108/b/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">with respect to the violator, the degree of culpability, any history of prior offenses, and such other matters as justice may require.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s108/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">Transfer of ownership of a high seas fishing vessel, by sale or otherwise, shall not extinguish any permit sanction that is in effect or is pending at the time of transfer of ownership. Before executing the transfer of ownership of a vessel, by sale or otherwise, the owner shall disclose in writing to the prospective transferee the existence of any permit sanction that will be in effect or pending with respect to the vessel at the time of the transfer. The Secretary may waive or compromise a sanction in the case of a transfer pursuant to court order.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s108/b/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">In the case of any permit that is suspended under this subsection for nonpayment of a civil penalty or criminal fine, the Secretary shall reinstate the permit upon payment of the penalty or fine and interest thereon at the prevailing rate.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s108/b/5" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">No sanctions shall be imposed under this subsection unless there has been prior opportunity for a hearing on the facts underlying the violation for which the sanction is imposed, either in conjunction with a civil penalty proceeding under this section or otherwise.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tI/s108/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Hearing.—</heading><content style="-uslm-dtd:text">For the purposes of conducting any hearing under this section, the Secretary may issue subpoenas for the attendance and testimony of witnesses and the production of relevant papers, books, and documents, and may administer oaths. Witnesses summoned shall be paid the same fees and mileage that are paid to witnesses in the courts of the United States. In case of contempt or refusal to obey a subpoena served upon any person pursuant to this subsection, the district court of the United States for any district in which such person is found, resides, or transacts business, upon application by the United States and after notice to such person, shall have jurisdiction to issue an order requiring such person to appear and give testimony before the Secretary or to appear and produce documents before the Secretary, or both, and any failure to obey such order of the court may be punished by such court as a contempt thereof.</content>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tI/s108/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Judicial Review.—</heading><content style="-uslm-dtd:text">Any person against whom a civil penalty is assessed under subsection (a) or against whose vessel a permit sanction is imposed under subsection (b) (other than a permit suspension for nonpayment of penalty or fine) may obtain review thereof in the United States district court for the appropriate district by filing a complaint against the Secretary in such court within 30 days from the date of such penalty or sanction. The Secretary shall promptly file in such court a certified copy of the record upon which such penalty or sanction was imposed, as provided in section 2112 of title 28, United States Code. The findings and order of the Secretary shall be set aside by such court if they are not found to be supported by substantial evidence, as provided in section 706(2) of title 5, United States Code.</content>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tI/s108/e" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Collection.—</heading>
                    <paragraph identifier="/us/sComp/104/43/tI/s108/e/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">If any person fails to pay an assessment of a civil penalty after it has become a final and unappealable order, or after the appropriate court has entered final judgment in favor of the Secretary, the matter shall be referred to the Attorney General, who shall recover the amount assessed in any appropriate district court of the United States. In such action the validity and appropriateness of the final order imposing the civil penalty shall not be subject to review.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s108/e/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">A high seas fishing vessel (including its fishing gear, furniture, appurtenances, stores, and cargo) used in the commission of an act prohibited by section 106 shall be liable in rem for any civil penalty assessed for such violation under subsection (a) and may be proceeded against in any district court of the United States having jurisdiction thereof. Such penalty shall constitute a maritime lien on such vessel that may be recovered in an action in rem in the district court of the United States having jurisdiction over the vessel.</content>
                    </paragraph>
                </subsection>
            </section>
            <section identifier="/us/sComp/104/43/tI/s109" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="109">SEC. 109. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5508">16 U.S.C. 5508</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">CRIMINAL OFFENSES. </heading>
                <subsection identifier="/us/sComp/104/43/tI/s109/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Offenses.—</heading><content style="-uslm-dtd:text">A person is guilty of an offense if the person commits any act prohibited by paragraph (6), (7), (8), or (9) of section 106.</content>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tI/s109/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Punishment.—</heading><content style="-uslm-dtd:text">Any offense described in subsection (a) is a class A misdemeanor punishable by a fine under title 18, United States Code, or imprisonment for not more than one year, or both; except that if in the commission of any offense the person uses a dangerous weapon, engages in conduct that causes bodily injury to any authorized officer, or places any such officer in fear of imminent bodily injury, the offense is a felony punishable by a fine under title 18, United States Code, or imprisonment for not more than 10 years, or both.</content>
                </subsection>
            </section>
            <section identifier="/us/sComp/104/43/tI/s110" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="110">SEC. 110. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5509">16 U.S.C. 5509</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">FORFEITURES. </heading>
                <subsection identifier="/us/sComp/104/43/tI/s110/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">Any high seas fishing vessel (including its fishing gear, furniture, appurtenances, stores, and cargo) used, and any living marine resources (or the fair market value thereof) taken or retained, in any manner, in connection with or as a result of the commission of any act prohibited by section 106 (other than an act for which the issuance of a citation under section 107 is a sufficient sanction) shall be subject to forfeiture to the United States. All or part of such vessel may, and all such living marine resources (or the fair market value thereof) shall, be forfeited to the United States pursuant to a civil proceeding under this section.</content>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tI/s110/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Jurisdiction of District Courts.—</heading><content style="-uslm-dtd:text">Any district court of the United States shall have jurisdiction, upon application of the Attorney General on behalf of the United States, to order any forfeiture authorized under subsection (a) and any action provided for under subsection (d).</content>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tI/s110/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Judgment.—</heading><chapeau style="-uslm-dtd:text">If a judgment is entered for the United States in a civil forfeiture proceeding under this section, the Attorney General may seize any property or other interest declared forfeited to the United States, which has not previously been seized pursuant to this title or for which security has not previously been obtained. The provisions of the customs laws relating to—</chapeau>
                    <paragraph identifier="/us/sComp/104/43/tI/s110/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the seizure, forfeiture, and condemnation of property for violation of the customs law;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s110/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the disposition of such property or the proceeds from the sale thereof; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s110/c/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">the remission or mitigation of any such forfeiture;</content>
                    </paragraph><continuation role="subsection" style="-uslm-dtd:continuation-text">shall apply to seizures and forfeitures incurred, or alleged to have been incurred, under the provisions of this title, unless such provisions are inconsistent with the purposes, policy, and provisions of this title.</continuation>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tI/s110/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Procedure.—</heading>
                    <paragraph identifier="/us/sComp/104/43/tI/s110/d/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">Any officer authorized to serve any process in rem that is issued by a court under section 107(b) shall—</chapeau>
                        <subparagraph identifier="/us/sComp/104/43/tI/s110/d/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">stay the execution of such process; or</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tI/s110/d/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">discharge any living marine resources seized pursuant to such process;</content>
                        </subparagraph><continuation role="paragraph" style="-uslm-dtd:continuation-text">upon receipt of a satisfactory bond or other security from any person claiming such property. Such bond or other security shall be conditioned upon such person delivering such property to the appropriate court upon order thereof, without any impairment of its value, or paying the monetary value of such property pursuant to an order of such court. Judgment shall be recoverable on such bond or other security against both the principal and any sureties in the event that any condition thereof is breached, as determined by such court.</continuation>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tI/s110/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">Any living marine resources seized pursuant to this title may be sold, subject to the approval of the appropriate court, for not less than the fair market value thereof. The proceeds of any such sale shall be deposited with such court pending the disposition of the matter involved.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tI/s110/e" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Rebuttable Presumption.—</heading><content style="-uslm-dtd:text">For purposes of this section, all living marine resources found on board a high seas fishing vessel and which are seized in connection with an act prohibited by section 106 are presumed to have been taken or retained in violation of this title, but the presumption can be rebutted by an appropriate showing of evidence to the contrary.</content>
                </subsection>
            </section>
            <section identifier="/us/sComp/104/43/tI/s111" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="111">SEC. 111. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5501">16 U.S.C. 5501 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">EFFECTIVE DATE. </heading>

                <num style="-uslm-dtd:enum" value="202">SEC. 202. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5601">16 U.S.C. 5601</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">REPRESENTATION OF UNITED STATES UNDER CONVENTION. </heading>
                <subsection identifier="/us/sComp/104/43/tII/s202/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Commissioners.—</heading>
                    <paragraph identifier="/us/sComp/104/43/tII/s202/a/1" style="-uslm-dtd:paragraph" styleType="OLC">

                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">be known as a “<quotedText style="-uslm-dtd:quote">United States Commissioner to the Northwest Atlantic Fisheries Organization</quotedText>”; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tII/s202/a/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">serve at the pleasure of the Secretary.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tII/s202/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Requirements for appointments.—</heading>
                        <subparagraph identifier="/us/sComp/104/43/tII/s202/a/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><chapeau style="-uslm-dtd:text">The Secretary shall ensure that of the individuals serving as Commissioners—</chapeau>
                            <clause identifier="/us/sComp/104/43/tII/s202/a/2/A/i" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">at least 1 is appointed from among representatives of the commercial fishing industry;</content>
                            </clause>
                            <clause identifier="/us/sComp/104/43/tII/s202/a/2/A/ii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">1 (but no more than 1) is an official of the Government; and</content>
                            </clause>
                            <clause identifier="/us/sComp/104/43/tII/s202/a/2/A/iii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">1, other than the individual appointed under clause (ii), is a voting member of the New England Fishery Management Council.</content>
                            </clause>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tII/s202/a/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">The Secretary may not appoint as a Commissioner an individual unless the individual is knowledgeable and experienced concerning the fishery resources to which the Convention applies.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tII/s202/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Terms.—</heading>
                        <subparagraph identifier="/us/sComp/104/43/tII/s202/a/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><chapeau style="-uslm-dtd:text">The term of an individual appointed as a Commissioner—</chapeau>
                            <clause identifier="/us/sComp/104/43/tII/s202/a/3/A/i" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">shall be specified by the Secretary at the time of appointment; and</content>
                            </clause>
                            <clause identifier="/us/sComp/104/43/tII/s202/a/3/A/ii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">may not exceed 4 years.</content>
                            </clause>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tII/s202/a/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">An individual who is not a Government official may not serve more than 2 consecutive terms as a Commissioner.</content>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tII/s202/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Alternate Commissioners.—</heading>
                    <paragraph identifier="/us/sComp/104/43/tII/s202/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Appointment.—</heading><content style="-uslm-dtd:text">The Secretary may, for any anticipated absence of a duly appointed Commissioner, designate an individual to serve as an Alternate Commissioner.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tII/s202/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Functions.—</heading><content style="-uslm-dtd:text">An Alternate Commissioner may exercise all powers and perform all duties of the Commissioner for whom the Alternate Commissioner is designated.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tII/s202/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Representatives.—</heading>
                    <paragraph identifier="/us/sComp/104/43/tII/s202/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Appointment.—</heading><content style="-uslm-dtd:text">The Secretary shall appoint not more than 3 individuals to serve as the representatives of the United States on the Scientific Council, who shall each be known as a “<quotedText style="-uslm-dtd:quote">United States Representative to the Northwest Atlantic Fisheries Organization Scientific Council</quotedText>”.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tII/s202/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Eligibility for appointment.—</heading>
                        <subparagraph identifier="/us/sComp/104/43/tII/s202/c/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">The Secretary may not appoint an individual as a Representative unless the individual is knowledgeable and experienced concerning the scientific issues dealt with by the Scientific Council.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tII/s202/c/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">The Secretary shall appoint as a Representative at least 1 individual who is an official of the Government.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tII/s202/c/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Term.—</heading><chapeau style="-uslm-dtd:text">An individual appointed as a Representative—</chapeau>
                        <subparagraph identifier="/us/sComp/104/43/tII/s202/c/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">shall serve for a term of not to exceed 4 years, as specified by the Secretary at the time of appointment;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tII/s202/c/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">may be reappointed; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tII/s202/c/3/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">shall serve at the pleasure of the Secretary.</content>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tII/s202/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Alternate Representatives.—</heading>
                    <paragraph identifier="/us/sComp/104/43/tII/s202/d/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Appointment.—</heading><content style="-uslm-dtd:text">The Secretary may, for any anticipated absence of a duly appointed Representative, designate an individual to serve as an Alternate Representative.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tII/s202/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Functions.—</heading><content style="-uslm-dtd:text">An Alternate Representative may exercise all powers and perform all duties of the Representative for whom the Alternate Representative is designated.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tII/s202/e" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Experts and Advisers.—</heading><content style="-uslm-dtd:text">The Commissioners, Alternate Commissioners, Representatives, and Alternate Representatives may be accompanied at meetings of the Organization by experts and advisers.</content>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tII/s202/f" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Coordination and Consultation.—</heading>
                    <paragraph identifier="/us/sComp/104/43/tII/s202/f/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">In carrying out their functions under the Convention, Commissioners, Alternate Commissioners, Representatives, and Alternate Representatives shall—</chapeau>
                        <subparagraph identifier="/us/sComp/104/43/tII/s202/f/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">coordinate with the appropriate Regional Fishery Management Councils established by section 302 of the Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1852); and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tII/s202/f/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">consult with the committee established under section 208.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tII/s202/f/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Relationship to other law.—</heading><content style="-uslm-dtd:text">Chapter 10 of title 5, United States Code, shall not apply to coordination and consultations under this subsection.</content>
                    </paragraph>
                </subsection>
            </section>
            <section identifier="/us/sComp/104/43/tII/s203" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="203">SEC. 203. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5602">16 U.S.C. 5602</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">REQUESTS FOR SCIENTIFIC ADVICE. </heading>
                <subsection identifier="/us/sComp/104/43/tII/s203/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Restriction.—</heading><chapeau style="-uslm-dtd:text">A Representative may not make a request or specification described in paragraph (1) or (2) of subsection (b), respectively, unless the Representative has first—</chapeau>
                    <paragraph identifier="/us/sComp/104/43/tII/s203/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">consulted with the appropriate Regional Fishery Management Councils; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tII/s203/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">received the consent of the Commissioners for that action.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tII/s203/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Requests and Terms of Reference Described.—</heading><chapeau style="-uslm-dtd:text">The requests and specifications referred to in subsection (a) are, respectively—</chapeau>
                    <paragraph identifier="/us/sComp/104/43/tII/s203/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">any request, under Article VII(10)(b) of the Convention, that the Scientific Council consider and report on a question pertaining to the scientific basis for the management and conservation of fishery resources in waters under the jurisdiction of the United States within the Convention Area; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tII/s203/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">any specification, under Article VII(11) of the Convention, of the terms of reference for the consideration of a question referred to the Scientific Council pursuant to Article VII(10)(b) of the Convention.</content>
                    </paragraph>
                </subsection>
            </section>
            <section identifier="/us/sComp/104/43/tII/s204" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="204">SEC. 204. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5603">16 U.S.C. 5603</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">AUTHORITIES OF SECRETARY OF STATE WITH RESPECT TO CONVENTION. </heading>
                <subsection role="undesignated-level" style="-uslm-dtd:subsection" styleType="OLC"><chapeau style="-uslm-dtd:text">The Secretary of State may, on behalf of the Government of the United States—</chapeau>
                    <paragraph identifier="/us/sComp/104/43/tII/s204/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">receive and transmit reports, requests, recommendations, proposals, and other communications of and to the Organization and its subsidiary organs;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tII/s204/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">object, or withdraw an objection, to the proposal of the Commission consistent with the procedures detailed in Articles XIV and XV of the Convention;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tII/s204/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">give or withdraw notice of intent not to be bound by a measure of the Commission consistent with the procedures detailed in Articles XIV and XV of the Convention;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tII/s204/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">object or withdraw an objection to an amendment to the Convention; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tII/s204/5" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">act upon, or refer to any other appropriate authority, any other communication referred to in paragraph (1).</content>
                    </paragraph>
                </subsection>
            </section>
            <section identifier="/us/sComp/104/43/tII/s205" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="205">SEC. 205. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5604">16 U.S.C. 5604</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">INTERAGENCY COOPERATION. </heading>
                <subsection identifier="/us/sComp/104/43/tII/s205/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Authorities of the Secretary.—</heading><chapeau style="-uslm-dtd:text">In carrying out the provisions of the Convention and this title, the Secretary may arrange for cooperation with—</chapeau>
                    <paragraph identifier="/us/sComp/104/43/tII/s205/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">any department, agency, or instrumentality of the United States;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tII/s205/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">a State;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tII/s205/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">a Council; or</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tII/s205/a/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">a private institution or an organization.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tII/s205/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Other Agencies.—</heading><chapeau style="-uslm-dtd:text">The head of any Federal agency may—</chapeau>
                    <paragraph identifier="/us/sComp/104/43/tII/s205/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">cooperate in the conduct of scientific and other programs, and furnish facilities and personnel, for the purposes of assisting the Organization in carrying out its duties under the Convention; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tII/s205/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">accept reimbursement from the Organization for providing such services, facilities, and personnel.</content>
                    </paragraph>
                </subsection>
            </section>
            <section identifier="/us/sComp/104/43/tII/s206" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="206">SEC. 206. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5605">16 U.S.C. 5605</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">RULEMAKING. </heading>
                <content class="block" style="-uslm-dtd:text">The Secretary shall promulgate regulations as may be necessary to carry out the purposes and objectives of the Convention and this title. Any such regulation may be made applicable, as necessary, to all persons and all vessels subject to the jurisdiction of the United States, wherever located.</content>
            </section>
            <section identifier="/us/sComp/104/43/tII/s207" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="207">SEC. 207. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5606">16 U.S.C. 5606</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">PROHIBITED ACTS AND ENFORCEMENT. </heading>
                <subsection identifier="/us/sComp/104/43/tII/s207/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Prohibition.—</heading><chapeau style="-uslm-dtd:text">It is unlawful for any person or vessel that is subject to the jurisdiction of the United States—</chapeau>
                    <paragraph identifier="/us/sComp/104/43/tII/s207/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">to violate any regulation issued under this title or any measure that is legally binding on the United States under the Convention;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tII/s207/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">to refuse to permit any authorized enforcement officer to board a fishing vessel that is subject to the person's control for purposes of conducting any search , investigation, or inspection in connection with the enforcement of this title, any regulation issued under this title, or any measure that is legally binding on the United States under the Convention;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tII/s207/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">forcibly to assault, resist, oppose, impede, intimidate, or interfere with any authorized enforcement officer in the conduct of any search , investigation, or inspection described in paragraph (2);</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tII/s207/a/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">to resist a lawful arrest for any act prohibited by this section;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tII/s207/a/5" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">to ship, transport, offer for sale, sell, purchase, import, export, or have custody, control, or possession of, any fishery resources taken or retained in violation of this section; or</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tII/s207/a/6" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">to interfere with, delay, or prevent, by any means, the apprehension or arrest of another person, knowing that the other person has committed an act prohibited by this section.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tII/s207/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Additional Prohibitions and Enforcement.—</heading><content style="-uslm-dtd:text">For additional prohibitions relating to this Act and enforcement of this Act, see section 606 of the High Seas Driftnet Fishing Moratorium Protection Act (16 U.S.C. 1826g).</content>
                </subsection>
            </section>
            <section identifier="/us/sComp/104/43/tII/s208" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="208">SEC. 208. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5607">16 U.S.C. 5607</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">CONSULTATIVE COMMITTEE. </heading>
                <subsection identifier="/us/sComp/104/43/tII/s208/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Establishment.—</heading><content style="-uslm-dtd:text">The Secretary of State and the Secretary, shall jointly establish a consultative committee to advise the Secretaries on issues related to the Convention.</content>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tII/s208/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Membership.—</heading>
                    <paragraph identifier="/us/sComp/104/43/tII/s208/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">The membership of the Committee shall include representatives from the New England and Mid-Atlantic Fishery Management Councils, the States represented on those Councils, the Atlantic States Marine Fisheries Commission, the fishing industry, the seafood processing industry, and others knowledgeable and experienced in the conservation and management of fisheries in the Northwest Atlantic Ocean.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tII/s208/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Terms and Reappointment.—</heading><content style="-uslm-dtd:text">Each member of the consultative committee shall serve for a term of 2 years and shall be eligible for reappointment.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tII/s208/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Duties of the Committee.—</heading><chapeau style="-uslm-dtd:text">Members of the consultative committee may attend—</chapeau>
                    <paragraph identifier="/us/sComp/104/43/tII/s208/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">all public meetings of the  Commission;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tII/s208/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">any other meetings to which they are invited by the  Commission; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tII/s208/c/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">all nonexecutive meetings of the United States Commissioners.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tII/s208/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Relationship to Other Law.—</heading><content style="-uslm-dtd:text">Chapter 10 of title 5, United States Code, shall not apply to the consultative committee established under this section.</content>
                </subsection>
            </section>
            <section identifier="/us/sComp/104/43/tII/s209" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="209">SEC. 209. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5608">16 U.S.C. 5608</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">ADMINISTRATIVE MATTERS. </heading>
                <subsection identifier="/us/sComp/104/43/tII/s209/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Prohibition on Compensation.—</heading><chapeau style="-uslm-dtd:text">A person shall not receive any compensation from the Government by reason of any service of the person as—</chapeau>
                    <paragraph identifier="/us/sComp/104/43/tII/s209/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">a Commissioner, Alternate Commissioner, Representative, or Alternative Representative;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tII/s209/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">an expert or adviser authorized under section 202(e); or</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tII/s209/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">a member of the consultative committee established by section 208.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tII/s209/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Travel and Expenses.—</heading><content style="-uslm-dtd:text">The Secretary of State shall, subject to the availability of appropriations, pay all necessary travel and other expenses of persons described in subsection (a)(1) and of not more than six experts and advisers authorized under section 202(e) with respect to their actual performance of their official duties pursuant to this title, in accordance with the Federal Travel Regulations and sections 5701, 5702, 5704 through 5708, and 5731 of title 5, United States Code.</content>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tII/s209/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Status as Federal Employees.—</heading><content style="-uslm-dtd:text">A person shall not be considered to be a Federal employee by reason of any service of the person in a capacity described in subsection (a), except for purposes of injury compensation and tort claims liability under chapter 81 of title 5, United States Code, and chapter 171 of title 28, United States Code, respectively.</content>
                </subsection>
            </section>
            <section identifier="/us/sComp/104/43/tII/s210" role="definitions" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="210">SEC. 210. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5609">16 U.S.C. 5609</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">DEFINITIONS. </heading>
                <chapeau class="block" style="-uslm-dtd:text">In this title:</chapeau>
                <paragraph identifier="/us/sComp/104/43/tII/s210/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">1982 convention.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">1982 Convention</term>” means the United Nations Convention on the Law of the Sea of 10 December 1982.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/104/43/tII/s210/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Authorized enforcement officer.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">authorized enforcement officer</term>” means a person authorized to enforce this title, any regulation issued under this title, or any measure that is legally binding on the United States under the Convention.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/104/43/tII/s210/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Commission.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Commission</term>” means the body provided for by Articles V, VI, XIII, XIV, and XV of the Convention.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/104/43/tII/s210/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Commissioner.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Commissioner</term>” means a United States Commissioner to the Northwest Atlantic Fisheries Organization appointed under section 202.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/104/43/tII/s210/5" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">Convention.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Convention</term>” means the Convention on Future Multilateral Cooperation in the Northwest Atlantic Fisheries, done at Ottawa on October 24, 1978, and as amended on September 28, 2007.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/104/43/tII/s210/6" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="6">(6) </num><heading style="-uslm-dtd:header">Convention area.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Convention Area</term>” means the waters of the Northwest Atlantic Ocean north of 35°00′ N and west of a line extending due north from 35°00′ N and 42°00′ W to 59°00′ N, thence due west to 44°00′ W, and thence due north to the coast of Greenland, and the waters of the Gulf of St. Lawrence, Davis Strait and Baffin Bay south of 78°10′ N.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/104/43/tII/s210/7" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="7">(7) </num><heading style="-uslm-dtd:header">Council.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Council</term>” means the New England Fishery Management Council or the Mid-Atlantic Fishery Management Council.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/104/43/tII/s210/8" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="8">(8) </num><heading style="-uslm-dtd:header">Fishery resources.—</heading>
                    <subparagraph identifier="/us/sComp/104/43/tII/s210/8/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">fishery resources</term>” means all fish, mollusks, and crustaceans, including any products thereof, within the Convention Area.</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/104/43/tII/s210/8/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Exclusions.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">fishery resources</term>” does not include—</chapeau>
                        <clause identifier="/us/sComp/104/43/tII/s210/8/B/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">sedentary species over which coastal States may exercise sovereign rights consistent with Article 77 of the 1982 Convention; or</content>
                        </clause>
                        <clause identifier="/us/sComp/104/43/tII/s210/8/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">insofar as they are managed under other international treaties, anadromous and catadromous stocks and highly migratory species listed in Annex I of the 1982 Convention.</content>
                        </clause>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/104/43/tII/s210/9" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="9">(9) </num><heading style="-uslm-dtd:header">Fishing activities.—</heading>
                    <subparagraph identifier="/us/sComp/104/43/tII/s210/9/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">fishing activities</term>” means harvesting or processing fishery resources, or transhipping of fishery resources or products derived from fishery resources, or any other activity in preparation for, in support of, or related to the harvesting of fishery resources.</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/104/43/tII/s210/9/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Inclusions.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">fishing activities</term>” includes—</chapeau>
                        <clause identifier="/us/sComp/104/43/tII/s210/9/B/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the actual or attempted searching for or catching or taking of fishery resources;</content>
                        </clause>
                        <clause identifier="/us/sComp/104/43/tII/s210/9/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">any activity that can reasonably be expected to result in locating, catching, taking, or harvesting of fishery resources for any purpose; and</content>
                        </clause>
                        <clause identifier="/us/sComp/104/43/tII/s210/9/B/iii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">any operation at sea in support of, or in preparation for, any activity described in this paragraph.</content>
                        </clause>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/104/43/tII/s210/9/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Exclusions.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">fishing activities</term>” does not include any operation related to emergencies involving the health and safety of crew members or the safety of a vessel.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/104/43/tII/s210/10" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="10">(10) </num><heading style="-uslm-dtd:header">Fishing vessel.—</heading>
                    <subparagraph identifier="/us/sComp/104/43/tII/s210/10/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">fishing vessel</term>” means a vessel that is or has been engaged in fishing activities.</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/104/43/tII/s210/10/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Inclusions.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">fishing vessel</term>” includes a fish processing vessel or a vessel engaged in transshipment or any other activity in preparation for or related to fishing activities, or in experimental or exploratory fishing activities.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/104/43/tII/s210/11" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="11">(11) </num><heading style="-uslm-dtd:header">Organization.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Organization</term>” means the Northwest Atlantic Fisheries Organization provided for by Article V of the Convention.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/104/43/tII/s210/12" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="12">(12) </num><heading style="-uslm-dtd:header">Person.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">person</term>” means any individual (whether or not a citizen or national of the United States), and any corporation, partnership, association, or other entity (whether or not organized or existing under the laws of any State).</content>
                </paragraph>
                <paragraph identifier="/us/sComp/104/43/tII/s210/13" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="13">(13) </num><heading style="-uslm-dtd:header">Representative.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Representative</term>” means a United States Representative to the Northwest Atlantic Fisheries Scientific Council appointed under section 202.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/104/43/tII/s210/14" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="14">(14) </num><heading style="-uslm-dtd:header">Scientific council.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Scientific Council</term>” means the Scientific Council provided for by Articles V, VI, and VII of the Convention.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/104/43/tII/s210/15" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="15">(15) </num><heading style="-uslm-dtd:header">Secretary.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Secretary</term>” means the Secretary of Commerce.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/104/43/tII/s210/16" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="16">(16) </num><heading style="-uslm-dtd:header">State.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">State</term>” means each of the several States of the United States, the District of Columbia, and any other commonwealth, territory, or possession of the United States.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/104/43/tII/s210/17" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="17">(17) </num><heading style="-uslm-dtd:header">Transshipment.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">transshipment</term>” means the unloading of all or any of the fishery resources on board a fishing vessel to another fishing vessel either at sea or in port.</content>
                </paragraph>

                <num style="-uslm-dtd:enum" value="602">SEC. 602. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s1826d">16 U.S.C. 1826d note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">FINDINGS. </heading>
                <chapeau class="block" style="-uslm-dtd:text">The Congress finds that—</chapeau>
                <paragraph identifier="/us/sComp/104/43/tVI/s602/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">Congress has enacted and the President has signed into law numerous Acts to control or prohibit large-scale driftnet fishing both within the jurisdiction of the United States and beyond the exclusive economic zone of any nation, including the Driftnet Impact Monitoring, Assessment, and Control Act of 1987 (title IV, Public Law 100-220), the Driftnet Act Amendments of 1990 (Public Law 101-627), and the High Seas Driftnet Fisheries Enforcement Act (title I, Public Law 102-582);</content>
                </paragraph>
                <paragraph identifier="/us/sComp/104/43/tVI/s602/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the United States is a party to the Convention for the Prohibition of Fishing with Long Driftnets in the South Pacific, also known as the Wellington Convention;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/104/43/tVI/s602/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">the General Assembly of the United Nations has adopted three resolutions and three decisions which established and reaffirm a global moratorium on large-scale driftnet fishing on the high seas, beginning with Resolution 44/225 in 1989 and most recently in Decision 48/445 in 1993;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/104/43/tVI/s602/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">the General Assembly of the United Nations adopted these resolutions and decisions at the request of the United States and other concerned nations;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/104/43/tVI/s602/5" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">the best scientific information demonstrates the wastefulness and potentially destructive impacts of large-scale driftnet fishing on living marine resources and seabirds; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/104/43/tVI/s602/6" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">Resolution 46/215 of the United Nations General Assembly calls on all nations, both individually and collectively, to prevent large-scale driftnet fishing on the high seas.</content>
                </paragraph>
            </section>
            <section identifier="/us/sComp/104/43/tVI/s603" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="603">SEC. 603. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s1826d">16 U.S.C. 1826d</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">PROHIBITION. </heading>
                <content class="block" style="-uslm-dtd:text">The United States, or any agency or official acting on behalf of the United States, may not enter into any international agreement with respect to the conservation and management of living marine resources or the use of the high seas by fishing vessels that would prevent full implementation of the global moratorium on large-scale driftnet fishing on the high seas, as such moratorium is expressed in Resolution 46/215 of the United Nations General Assembly.</content>
            </section>
            <section identifier="/us/sComp/104/43/tVI/s604" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="604">SEC. 604. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s1826e">16 U.S.C. 1826e</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">NEGOTIATIONS. </heading>
                <content class="block" style="-uslm-dtd:text">The Secretary of State, on behalf of the United States, shall seek to enhance the implementation and effectiveness of the United Nations General Assembly resolutions and decisions regarding the moratorium on large-scale driftnet fishing on the high seas through appropriate international agreements and organizations.</content>
            </section>
            <section identifier="/us/sComp/104/43/tVI/s605" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="605">SEC. 605. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s1826f">16 U.S.C. 1826f</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">CERTIFICATION. </heading>
                <content class="block" style="-uslm-dtd:text">The Secretary of State shall determine in writing prior to the signing or provisional application by the United States of any international agreement with respect to the conservation and management of living marine resources or the use of the high seas by fishing vessels that the prohibition contained in section 603 will not be violated if such agreement is signed or provisionally applied.</content>
            </section>
            <section identifier="/us/sComp/104/43/tVI/s606" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="606">SEC. 606. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s1826g">16 U.S.C. 1826g</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">ENFORCEMENT. </heading>
                <subsection identifier="/us/sComp/104/43/tVI/s606/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">The Secretary and the Secretary of the department in which the Coast Guard is operating shall enforce this Act, and the Acts to which this section applies, in accordance with this section. Each such Secretary may, by agreement, on a reimbursable basis or otherwise, utilize the personnel services, equipment (including aircraft and vessels), and facilities of any other Federal agency, and of any State agency, in the performance of such duties.</content>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tVI/s606/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Acts to Which Section Applies.—</heading><chapeau style="-uslm-dtd:text">This section applies to—</chapeau>
                    <paragraph identifier="/us/sComp/104/43/tVI/s606/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the Pacific Salmon Treaty Act of 1985 (16 U.S.C. 3631 et seq.);</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s606/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the Dolphin Protection Consumer Information Act (16 U.S.C. 1385);</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s606/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">the Tuna Conventions Act of 1950 (16 U.S.C. 951 et seq.);</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s606/b/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">the North Pacific Anadromous Stocks Act of 1992 (16 U.S.C. 5001 et seq.);</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s606/b/5" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">the Atlantic Tunas Convention Act of 1975 (16 U.S.C. 971 et seq.);</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s606/b/6" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">the Northwest Atlantic Fisheries Convention Act of 1995 (16 U.S.C. 5601 et seq.);</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s606/b/7" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">the Western and Central Pacific Fisheries Convention Implementation Act (16 U.S.C. 6901 et seq.); </content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s606/b/8" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="8">(8) </num><content style="-uslm-dtd:text">the <inline style="-uslm-dtd:short-title">Antigua Convention Implementing Act of 2015</inline>; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s606/b/9" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="9">(9) </num><content style="-uslm-dtd:text">the Ensuring Access to Pacific Fisheries Act.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tVI/s606/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Administration and Enforcement.—</heading>
                    <paragraph identifier="/us/sComp/104/43/tVI/s606/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Secretary shall prevent any person from violating this Act, or any Act to which this section applies, in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though sections 308 through 311 of the Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1858 through 1861) were incorporated into and made a part of and applicable to this Act and each such Act.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s606/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">International cooperation.—</heading><content style="-uslm-dtd:text">The Secretary may, subject to appropriations and in the course of carrying out the Secretary’s responsibilities under the Acts to which this section applies, engage in international cooperation to help other nations combat illegal, unreported, and unregulated fishing and achieve sustainable fisheries.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tVI/s606/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Special Rules.—</heading>
                    <paragraph identifier="/us/sComp/104/43/tVI/s606/d/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Additional enforcement authority.—</heading><content style="-uslm-dtd:text">In addition to the powers of officers authorized pursuant to subsection (c), any officer who is authorized by the Secretary, or the head of any Federal or State agency that has entered into an agreement with the Secretary under subsection (a), may enforce the provisions of any Act to which this section applies, with the same jurisdiction, powers, and duties as though section 311 of the Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1861) were incorporated into and made a part of each such Act.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s606/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Disclosure of enforcement information.—</heading>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s606/d/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">The Secretary, subject to the data confidentiality provisions in section 402 of the Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1881a), may disclose, as necessary and appropriate, information, including information collected under joint authority of the Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1801 et seq.) and the Atlantic Tunas Convention Act of 1975 (16 U.S.C. 71 et seq.) or the Western and Central Pacific Fisheries Convention Implementation Act (16 U.S.C. 6901 et seq.) or other statutes implementing international fishery agreements, to any other Federal or State government agency, the Food and Agriculture Organization of the United Nations, the secretariat or equivalent of an international fishery management organization or arrangement made pursuant to an international fishery agreement, or a foreign government, if—</chapeau>
                            <clause identifier="/us/sComp/104/43/tVI/s606/d/2/A/i" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">such government, organization, or arrangement has policies and procedures to protect such information from unintended or unauthorized disclosure; and</content>
                            </clause>
                            <clause identifier="/us/sComp/104/43/tVI/s606/d/2/A/ii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><chapeau style="-uslm-dtd:text">such disclosure is necessary—</chapeau>
                                <subclause identifier="/us/sComp/104/43/tVI/s606/d/2/A/ii/I" style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">to ensure compliance with any law or regulation enforced or administered by the Secretary;</content>
                                </subclause>
                                <subclause identifier="/us/sComp/104/43/tVI/s606/d/2/A/ii/II" style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">to administer or enforce any international fishery agreement to which the United States is a party;</content>
                                </subclause>
                                <subclause identifier="/us/sComp/104/43/tVI/s606/d/2/A/ii/III" style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="III">(III) </num><content style="-uslm-dtd:text">to administer or enforce a binding conservation measure adopted by any international organization or arrangement to which the United States is a party;</content>
                                </subclause>
                                <subclause identifier="/us/sComp/104/43/tVI/s606/d/2/A/ii/IV" style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="IV">(IV) </num><content style="-uslm-dtd:text">to assist in any investigative, judicial, or administrative enforcement proceeding in the United States; or</content>
                                </subclause>
                                <subclause identifier="/us/sComp/104/43/tVI/s606/d/2/A/ii/V" style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="V">(V) </num><content style="-uslm-dtd:text">to assist in any law enforcement action undertaken by a law enforcement agency of a foreign government, or in relation to a legal proceeding undertaken by a foreign government to the extent the enforcement action is consistent with rules and regulations of a regional fisheries management organization (as that term is defined by the United Nation’s Food and Agriculture Organization Agreement on Port State Measures to Prevent, Deter and Eliminate Illegal, Unreported and Unregulated Fishing) of which the United States is a member, or the Secretary has determined that the enforcement action is consistent with the requirements under Federal law for enforcement actions with respect to illegal, unreported, and unregulated fishing.</content>
                                </subclause>
                            </clause>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s606/d/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Data confidentiality provisions not applicable.—</heading><chapeau style="-uslm-dtd:text">The data confidentiality provisions of section 402 of the Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1881a) shall not apply with respect to this Act with respect to—</chapeau>
                            <clause identifier="/us/sComp/104/43/tVI/s606/d/2/B/i" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">any obligation of the United States to share information under a regional fisheries management organization (as that term is defined by the United Nation’s Food and Agriculture Organization Agreement on Port State Measures to Prevent, Deter and Eliminate Illegal, Unreported and Unregulated Fishing) of which the United States is a member; or</content>
                            </clause>
                            <clause identifier="/us/sComp/104/43/tVI/s606/d/2/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">any information collected by the Secretary regarding foreign vessels.</content>
                            </clause>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tVI/s606/e" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Prohibited Acts.—</heading><chapeau style="-uslm-dtd:text">It is unlawful for any person—</chapeau>
                    <paragraph identifier="/us/sComp/104/43/tVI/s606/e/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">to violate any provision of this Act or any regulation or permit issued pursuant to this Act;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s606/e/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">to refuse to permit any officer authorized to enforce the provisions of this Act to board, search, or inspect a vessel, subject to such person’s control for the purposes of conducting any search, investigation, or inspection in connection with the enforcement of this Act, any regulation promulgated under this Act, or any Act to which this section applies;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s606/e/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">to forcibly assault, resist, oppose, impede, intimidate, or interfere with any such authorized officer in the conduct of any search, investigation, or inspection described in paragraph (2);</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s606/e/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">to resist a lawful arrest for any act prohibited by this section or any Act to which this section applies;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s606/e/5" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">to interfere with, delay, or prevent, by any means, the apprehension, arrest, or detection of another person, knowing that such person has committed any act prohibited by this section or any Act to which this section applies; or</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s606/e/6" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="6">(6) </num><chapeau style="-uslm-dtd:text">to forcibly assault, resist, oppose, impede, intimidate, sexually harass, bribe, or interfere with—</chapeau>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s606/e/6/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">any observer on a vessel under this Act or any Act to which this section applies; or</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s606/e/6/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">any data collector employed by the National Marine Fisheries Service or under contract to any person to carry out responsibilities under this Act or any Act to which this section applies.</content>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tVI/s606/f" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Civil Penalty.—</heading><content style="-uslm-dtd:text">Any person who commits any act that is unlawful under subsection (e) shall be liable to the United States for a civil penalty, and may be subject to a permit sanction, under section 308 of the Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1858).</content>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tVI/s606/g" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Criminal Penalty.—</heading><content style="-uslm-dtd:text">Any person who commits an act that is unlawful under subsection (e)(2), (e)(3), (e)(4), (e)(5), or (e)(6) is deemed to be guilty of an offense punishable under section 309(b) of the Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1859(b)).</content>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tVI/s606/h" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="h">(h) </num><heading style="-uslm-dtd:header">Utilization of Federal Agency Assets.—</heading><content style="-uslm-dtd:text">The President shall utilize appropriate assets of the Department of Defense, the United States Coast Guard, and other Federal agencies to detect, monitor, and prevent violations of the United Nations moratorium on large-scale driftnet fishing on the high seas for all fisheries under the jurisdiction of the United States and, in the case of fisheries not under the jurisdiction of the United States, to the fullest extent permitted under international law.</content>
                </subsection>
            </section>
            <section identifier="/us/sComp/104/43/tVI/s607" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="607">SEC. 607. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s1826h">16 U.S.C. 1826h</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">BIENNIAL REPORT ON INTERNATIONAL COMPLIANCE. </heading>
                <subsection identifier="/us/sComp/104/43/tVI/s607/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><chapeau style="-uslm-dtd:text">
 The Secretary, in consultation with the Secretary of State, shall provide to Congress, by not later than 2 years after the date of enactment of the Magnuson-Stevens Fishery Conservation and Management Reauthorization Act of 2006, and every 2 years thereafter, on June 1 of that year a report that includes—</chapeau>
                    <paragraph identifier="/us/sComp/104/43/tVI/s607/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the state of knowledge on the status of international living marine resources shared by the United States or subject to treaties or agreements to which the United States is a party, including a list of all such fish stocks classified as overfished, overexploited, depleted, endangered, or threatened with extinction by any international or other authority charged with management or conservation of living marine resources;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s607/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">a list of nations that have been identified under section 609(a) or 610(a), including the specific offending activities and any subsequent actions taken pursuant to section 609 or 610;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s607/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">a description of efforts taken by nations on those lists to comply take appropriate corrective action consistent with sections 609 and 610, and an evaluation of the progress of those efforts, including steps taken by the United States to implement those sections and to improve international compliance;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s607/a/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">progress at the international level, consistent with section 608, to strengthen the efforts of international fishery management organizations to end illegal, unreported, or unregulated fishing; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s607/a/5" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">steps taken by the Secretary at the international level to adopt international measures comparable to those of the United States to reduce impacts of fishing and other practices on protected living marine resources, if no international agreement to achieve such goal exists, or if the relevant international fishery or conservation organization has failed to implement effective measures to end or reduce the adverse impacts of fishing practices on such species.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tVI/s607/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Additional Information.—</heading><chapeau style="-uslm-dtd:text">In addition to the information described in paragraphs (1) through (5) of subsection (a), the report shall include—</chapeau>
                    <paragraph identifier="/us/sComp/104/43/tVI/s607/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">a description of the actions taken to carry out the provisions of section 206 of the Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1826), including—</chapeau>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s607/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">an evaluation of the progress of those efforts, the impacts on living marine resources, including available observer data, and specific plans for further action;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s607/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">a list and description of any new fisheries developed by nations that conduct, or authorize their nationals to conduct, large-scale driftnet fishing beyond the exclusive economic zone of any nation; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s607/b/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">a list of the nations that conduct, or authorize their nationals to conduct, large-scale driftnet fishing beyond the exclusive economic zone of any nation in a manner that diminishes the effectiveness of or is inconsistent with any international agreement governing large-scale driftnet fishing to which the United States is a party or otherwise subscribes; and</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s607/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">a description of the actions taken to carry out the provisions of section 202(h) of the Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1822(h)).</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tVI/s607/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Certification.—</heading><content style="-uslm-dtd:text">If, at any time, the Secretary, in consultation with the Secretary of State and the Secretary of the department in which the Coast Guard is operating, identifies any nation that warrants inclusion in the list described under subsection (b)(1)(C), due to large scale drift net fishing, the Secretary shall certify that fact to the President. Such certification shall be deemed to be a certification for the purposes of section 8(a) of the Fishermen's Protective Act of 1967 (22 U.S.C. 1978(a)).</content>
                </subsection>
            </section>
            <section identifier="/us/sComp/104/43/tVI/s608" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="608">SEC. 608. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s1826i">16 U.S.C. 1826i</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">ACTION TO STRENGTHEN INTERNATIONAL FISHERY
MANAGEMENT ORGANIZATIONS. </heading>
                <subsection identifier="/us/sComp/104/43/tVI/s608/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><chapeau style="-uslm-dtd:text">The Secretary, in consultation with the Secretary of State, and in cooperation with relevant fishery management councils and any relevant advisory committees, shall take actions to improve the effectiveness of international fishery management organizations, or arrangements
made pursuant to an international fishery agreement, in conserving and managing fish stocks under their jurisdiction. These actions shall include—</chapeau>
                    <paragraph identifier="/us/sComp/104/43/tVI/s608/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">urging international fishery management organizations to which the United States is a member—</chapeau>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s608/a/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">to incorporate multilateral market-related measures against member or nonmember governments whose vessels engage in illegal, unreported, or unregulated fishing;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s608/a/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">to seek adoption of lists that identify fishing vessels and vessel owners engaged in illegal, unreported, or unregulated fishing that can be shared among all members and other international fishery management organizations;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s608/a/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">to seek international adoption of a centralized vessel monitoring system in order to monitor and document capacity in fleets of all nations involved in fishing in areas under an international fishery management organization’s jurisdiction;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s608/a/1/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">to increase use of observers and technologies needed to monitor compliance with conservation and management measures established by the organization, including vessel monitoring systems and automatic identification systems;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s608/a/1/E" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">to seek adoption of stronger port state controls in all nations, particularly those nations in whose ports vessels engaged in illegal, unreported, or unregulated fishing land or transship fish; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s608/a/1/F" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">to adopt shark conservation measures, including measures to prohibit removal of any of the fins of a shark (including the tail) and discarding the carcass of the shark at sea;</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s608/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">urging international fishery management organizations to which the United States is a member, as well as all members of those organizations, to adopt and expand the use of market-related measures to combat illegal, unreported, or unregulated fishing, including—</chapeau>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s608/a/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">import prohibitions, landing restrictions, or other market-based measures needed to enforce compliance with international fishery management organization measures, such as quotas and catch limits;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s608/a/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">import restrictions or other market-based measures to prevent the trade or importation of fish caught by vessels identified multilaterally as engaging in illegal, unreported, or unregulated fishing; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s608/a/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">catch documentation and certification schemes to improve tracking and identification of catch of vessels engaged in illegal, unreported, or unregulated fishing,  including advance transmission of catch documents to ports of entry;</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s608/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">seeking to enter into international agreements that require measures for the conservation of sharks, including measures to prohibit removal of any of the fins of a shark (including the tail) and discarding the carcass of the shark at sea, that are comparable to those of the United States, taking into account different conditions; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s608/a/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">urging other nations at bilateral, regional, and international levels, including the Convention on International Trade in Endangered Species of Fauna and Flora and the World Trade Organization to take all steps necessary, consistent with international law, to adopt measures and policies that will prevent fish or other living marine resources harvested by vessels engaged in illegal, unreported, or unregulated fishing from being traded or imported into their nation or territories.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tVI/s608/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Disclosure of Information.—</heading>
                    <paragraph identifier="/us/sComp/104/43/tVI/s608/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Secretary, subject to the data confidentiality provisions in section 402 of the Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1881a) except as provided in paragraph (2), may disclose, as necessary and appropriate, information, including information collected under joint authority of the Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1801 et seq.) and the Atlantic Tunas Convention Act of 1975 (16 U.S.C. 71 et seq.), the Western and Central Pacific Fisheries Convention Implementation Act (16 U.S.C. 6901 et seq.), any other statute implementing an international fishery agreement, to any other Federal or State government agency, the Food and Agriculture Organization of the United Nations, or the secretariat or equivalent of an international fishery management organization or arrangement made pursuant to an international fishery agreement, if such government, organization, or arrangement, respectively, has policies and procedures to protect such information from unintended or unauthorized disclosure.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s608/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Exceptions.—</heading><chapeau style="-uslm-dtd:text">The data confidentiality provisions in section 402 of the Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1881a) shall not apply with respect to this Act—</chapeau>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s608/b/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">for obligations of the United States to share information under a regional fisheries management organization (as that term is defined by the United Nation’s Food and Agriculture Organization Agreement on Port State Measures to Prevent, Deter and Eliminate Illegal, Unreported and Unregulated Fishing) of which the United States is a member; or</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s608/b/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">to any information collected by the Secretary regarding foreign vessels.</content>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tVI/s608/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">IUU Vessel Lists.—</heading><chapeau style="-uslm-dtd:text">The Secretary may—</chapeau>
                    <paragraph identifier="/us/sComp/104/43/tVI/s608/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">develop, maintain, and make public a list of vessels and vessel owners engaged in illegal, unreported, or unregulated fishing or fishing-related activities in support of illegal, unreported, or unregulated fishing, including vessels or vessel owners identified by an international fishery management organization or arrangement made pursuant to an international fishery agreement, that—</chapeau>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s608/c/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the United States is party to; or</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s608/c/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the United States is not party to, but whose procedures and criteria in developing and maintaining a list of such vessels and vessel owners are substantially similar to such procedures and criteria adopted pursuant to an international fishery agreement to which the United States is a party; and</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s608/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">take appropriate action against listed vessels and vessel owners, including action against fish, fish parts, or fish products from such vessels, in accordance with applicable United States law and consistent with applicable international law, including principles, rights, and obligations established in applicable international fishery management agreements and trade agreements.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tVI/s608/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Regulations.—</heading><content style="-uslm-dtd:text">The Secretary may promulgate regulations to implement this section.</content>
                </subsection>
                <paragraph identifier="/us/sComp/104/43/tVI/s608/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">urging international fishery management organizations
to which the United States is a member—</chapeau>
                    <subparagraph identifier="/us/sComp/104/43/tVI/s608/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">to incorporate multilateral market-related measures
against member or nonmember governments whose vessels engage in illegal, unreported, or unregulated
fishing;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/104/43/tVI/s608/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">to seek adoption of lists that identify fishing vessels
and vessel owners engaged in illegal, unreported, or unregulated fishing that can be shared among all members
and other international fishery management organizations;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/104/43/tVI/s608/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">to seek international adoption of a centralized
vessel monitoring system in order to monitor and document capacity in fleets of all nations involved in fishing in areas
under an international fishery management organization’s jurisdiction;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/104/43/tVI/s608/1/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">to increase use of observers and technologies
needed to monitor compliance with conservation and management measures established by the organization,

                    </subparagraph>
                    <subparagraph identifier="/us/sComp/104/43/tVI/s608/1/E" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">to seek adoption of stronger port state controls
in all nations, particularly those nations in whose ports vessels engaged in illegal, unreported, or unregulated
fishing land or transship fish; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/104/43/tVI/s608/1/F" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">to adopt shark conservation measures, including
measures to prohibit removal of any of the fins of a shark (including the tail) and discarding the carcass of the shark

                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/104/43/tVI/s608/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">urging international fishery management organizations
to which the United States is a member, as well as all members of those organizations, to adopt and expand the use of market related

                    <subparagraph identifier="/us/sComp/104/43/tVI/s608/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">

                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">catch documentation and certification schemes to

                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/104/43/tVI/s608/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">seeking to enter into international agreements that
require measures for the conservation of sharks, including measures to prohibit removal of any of the fins of a shark

                </paragraph>

by vessels engaged in illegal, unreported, or unregulated fishing from being traded or imported into their nation or territories.</content>
                </paragraph>
            </section>
            <section identifier="/us/sComp/104/43/tVI/s609" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="609">SEC. 609. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s1826j">16 U.S.C. 1826j</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">ILLEGAL, UNREPORTED, OR UNREGULATED FISHING. </heading>
                <subsection identifier="/us/sComp/104/43/tVI/s609/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Identification.—</heading>
                    <paragraph identifier="/us/sComp/104/43/tVI/s609/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Identification for actions of fishing vessels.—</heading><chapeau style="-uslm-dtd:text">The Secretary shall, based on a cumulative compilation and analysis of data collected and provided by international fishery management organizations and other nations and organizations, identify, and list in the report under section 607, a nation if any fishing vessel of that nation is engaged, or has been engaged at any point during the preceding 3 years, in illegal, unreported, or unregulated fishing—</chapeau>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s609/a/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">that undermines the effectiveness of measures required by an international fishery management organization, taking into account whether the relevant international fishery management organization has failed to implement effective measures to send the illegal, unreported, or unregulated fishing activity by  that nation or the nation is not a party to, or does not maintain cooperating status with, such organization; or</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s609/a/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">where no international fishery management organization
exists with a mandate to regulate the fishing activity in question.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s609/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">For actions of a nation.—</heading><chapeau style="-uslm-dtd:text">The Secretary shall identify, and list in such report, a nation engaging in or endorsing illegal, unreported, or unregulated fishing. In determining which nations to list in such report, the Secretary shall consider the following:</chapeau>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s609/a/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">Any nation that is violating, or has violated at any point during the 3 years preceding the date of the determination, conservation and management measures, including catch and other data reporting obligations and requirements, required under an international fishery management agreement to which the United States is a party.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s609/a/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">Any nation that is failing, or has failed in the 3-year period preceding the date of the determination, to effectively address or regulate illegal, unreported, or unregulated fishing within its fleets in any areas where its vessels are fishing.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s609/a/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">Any nation that fails to discharge duties incumbent upon it under international law or practice as a flag, port, or coastal state to take action to prevent, deter, and eliminate illegal, unreported, or unregulated fishing.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s609/a/2/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">Any nation that has been identified as producing for export to the United States seafood-related goods through forced labor or oppressive child labor (as those terms are defined in section 11329 of the <inline style="-uslm-dtd:short-title">Don Young Coast Guard Authorization Act of 2022</inline>) in the most recent List of Goods Produced by Child Labor or Forced Labor in accordance with the Trafficking Victims Protection Act of 2000 (22 U.S.C. 7101 et seq.).</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s609/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Application to other entities.—</heading><content style="-uslm-dtd:text">Where the provisions of this Act are applicable to nations, they shall also be applicable, as appropriate, to other entities that have competency to enter into international fishery management agreements.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s609/a/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Timing.—</heading><content style="-uslm-dtd:text">The Secretary shall make an identification under paragraph (1) or (2) at any time that the Secretary has sufficient information to make such identification.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tVI/s609/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Notification.—</heading><content style="-uslm-dtd:text">The Secretary shall notify the President and that nation of such an identification.</content>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tVI/s609/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Consultation.—</heading><chapeau style="-uslm-dtd:text">No later than 60 days after submitting
a report to Congress under section 607, the Secretary, acting through the Secretary of State, shall—</chapeau>
                    <paragraph identifier="/us/sComp/104/43/tVI/s609/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">notify nations listed in the report of the requirements
of this section;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s609/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">initiate consultations for the purpose of encouraging
such nations to take the appropriate corrective action with respect to the offending activities of their fishing vessels identified
in the report; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s609/c/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">notify any relevant international fishery management
organization of the actions taken by the United States under this section.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tVI/s609/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">IUU Certification Procedure.—</heading>
                    <paragraph identifier="/us/sComp/104/43/tVI/s609/d/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Certification.—</heading><chapeau style="-uslm-dtd:text">The Secretary shall establish a procedure, consistent with the provisions of subchapter II of chapter 5 of title 5, United States Code, for determining if a nation identified under subsection (a) and listed in the report under section 607 has taken appropriate corrective action with respect to the offending activities  identified in the report under section 607. The certification procedure shall provide for notice and an opportunity for comment by any such nation. The Secretary shall determine, on the basis of the procedure, and certify to the Congress no later than 90 days after the date on which the Secretary promulgates a final rule containing the procedure, and biennially thereafter in the report under section 607—</chapeau>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s609/d/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">whether the government of each nation identified under subsection (a) has provided documentary evidence that it has taken corrective action with respect to the offending activities  identified in the report; or</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s609/d/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">whether the relevant international fishery
management organization has implemented measures that are effective in ending the illegal, unreported, or unregulated
fishing activity by vessels of that nation.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s609/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Alternative procedure.—</heading><chapeau style="-uslm-dtd:text">The Secretary may establish a procedure to authorize, on a shipment-by-shipment, shipper-by-shipper, or other basis the importation of fish or fish products from a vessel of a  nation issued a negative certification under paragraph (1) if the Secretary determines that—</chapeau>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s609/d/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the vessel has not engaged in illegal, unreported,
or unregulated fishing under an international fishery management agreement to which the United States is a
party; or</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s609/d/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the vessel is not identified by an international
fishery management organization as participating in illegal, unreported, or unregulated fishing activities.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s609/d/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Effect of certification determination.—</heading>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s609/d/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Effect of negative certification.—</heading><content style="-uslm-dtd:text">The provisions of subsection (a) and paragraphs (3) and (4) of subsection (b) of section 101 of the High Seas Driftnet Fisheries Enforcement Act (16 U.S.C. 1826a(a) and (b)(3) and (4)) shall apply to any nation that, after being identified and notified under subsection (b) has failed to take the appropriate corrective actions for which the Secretary has issued a negative certification under this subsection. </content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s609/d/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Effect of positive certification.—</heading><content style="-uslm-dtd:text">The provisions of subsection (a) and paragraphs (3) and (4) of subsection (b) of section 101 of the High Seas Driftnet Fisheries Enforcement Act (16 U.S.C. 1826a(a) and (b)(3) and (4)) shall not apply to any nation identified under subsection (a) for which the Secretary has issued a positive certification under this subsection.</content>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tVI/s609/e" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Illegal, Unreported, or Unregulated Fishing
Defined.—</heading>
                    <paragraph identifier="/us/sComp/104/43/tVI/s609/e/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">In this Act the term ‘illegal, unreported,
or unregulated fishing’ has the meaning established under paragraph (2).</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s609/e/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Secretary to define term within legislative guidelines.—</heading><content style="-uslm-dtd:text">Within 3 months after the date of enactment of the
Magnuson-Stevens Fishery Conservation and Management Reauthorization Act of 2006, the Secretary shall publish a
definition of the term ‘illegal, unreported, or unregulated fishing’ for purposes of this Act.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s609/e/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Guidelines.—</heading><chapeau style="-uslm-dtd:text">The Secretary shall include in the definition,
at a minimum—</chapeau>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s609/e/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">fishing activities that violate conservation and
management measures required under an international fishery management agreement to which the United States
is a party, including catch limits or quotas, capacity restrictions, bycatch reduction requirements, and shark conservation measures;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s609/e/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">overfishing of fish stocks shared by the United
States, for which there are no applicable international conservation or management measures or in areas with no
applicable international fishery management organization or agreement, that has adverse impacts on such stocks;
and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s609/e/3/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">fishing activity that has an adverse impact on
seamounts, hydrothermal vents, and cold water corals located beyond national jurisdiction, for which there are
no applicable conservation or management measures or in areas with no applicable international fishery management
organization or agreement.</content>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tVI/s609/f" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Authorization of appropriations.—</heading><content style="-uslm-dtd:text">There are authorized
to be appropriated to the Secretary for fiscal years 2007 through 2013 such sums as are necessary to carry out this section.</content>
                </subsection>
            </section>
            <section identifier="/us/sComp/104/43/tVI/s610" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="610">SEC. 610. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s1826k">16 U.S.C. 1826k</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">EQUIVALENT CONSERVATION MEASURES. </heading>
                <subsection identifier="/us/sComp/104/43/tVI/s610/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Identification.—</heading>
                    <paragraph identifier="/us/sComp/104/43/tVI/s610/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">The Secretary shall identify and list in the report under section 607—</chapeau>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s610/a/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><chapeau style="-uslm-dtd:text">a nation if—</chapeau>
                            <clause identifier="/us/sComp/104/43/tVI/s610/a/1/A/i" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">any fishing vessel of that nation is engaged, or has been engaged during the 3 years preceding the date of the determination, in fishing activities or practices on the high seas or within the exclusive economic zone of any nation, that have resulted in bycatch of a protected living marine resource; and</content>
                            </clause>
                            <clause identifier="/us/sComp/104/43/tVI/s610/a/1/A/ii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the vessel’s flag state has not adopted, implemented, and enforced a regulatory program governing such fishing designed to end or reduce such bycatch that is comparable in effectiveness to the regulatory program of the United States, taking into account differing conditions; and</content>
                            </clause>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s610/a/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">a nation if—</chapeau>
                            <clause identifier="/us/sComp/104/43/tVI/s610/a/1/B/i" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">any fishing vessel of that nation is engaged, or has engaged during the 3 years preceding the date of the determination, in fishing activities on the high seas or within the exclusive economic zone of another nation that target or incidentally catch sharks; and</content>
                            </clause>
                            <clause identifier="/us/sComp/104/43/tVI/s610/a/1/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the vessel’s flag state has not adopted, implemented, and enforced a regulatory program to provide for the conservation of sharks, including measures to prohibit removal of any of the fins of a shark, including the tail, before landing the shark in port, that is comparable to that of the United States.</content>
                            </clause>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s610/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Timing.—</heading><content style="-uslm-dtd:text">The Secretary shall make an identification under paragraph (1) at any time that the Secretary has sufficient information to make such identification.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tVI/s610/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Consultation and Negotiation.—</heading><chapeau style="-uslm-dtd:text">The Secretary of State, acting in consultation with the Secretary, shall—</chapeau>
                    <paragraph identifier="/us/sComp/104/43/tVI/s610/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">notify, as soon as practicable, the President and nations that are engaged in, or that have any fishing vessels engaged in, fishing activities or practices described in subsection (a), about the provisions of this Act;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s610/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">initiate discussions as soon as practicable with all foreign nations that are engaged in, or a fishing vessel of which has engaged in, fishing activities described in subsection (a), for the purpose of entering into bilateral and multilateral treaties with such nations to protect such species and to address any underlying failings or gaps that may have contributed to identification under this Act; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s610/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">initiate the amendment of any existing international treaty for the protection and conservation of such species to which the United States is a party in order to make such treaty consistent with the purposes and policies of this section.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tVI/s610/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Conservation Certification Procedure.—</heading>
                    <paragraph identifier="/us/sComp/104/43/tVI/s610/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Determination.—</heading><chapeau style="-uslm-dtd:text">The Secretary shall establish a
procedure consistent with the provisions of subchapter II of chapter 5 of title 5, United States Code, for determining
whether the government of a harvesting nation identified under subsection (a) and listed in the report under section 607—</chapeau>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s610/c/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">has provided documentary evidence of the adoption
of a regulatory program governing the conservation of the protected living marine resource that is comparable to that
of the United States, taking into account different conditions, and which, in the case of pelagic longline fishing,
includes mandatory use of circle hooks, careful handling and release equipment, and training and observer programs;
and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s610/c/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">has established a management plan containing
requirements that will assist in gathering species-specific data to support international stock assessments and conservation
enforcement efforts for protected living marine resources.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s610/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Procedural requirement.—</heading><content style="-uslm-dtd:text">The procedure establishedby the Secretary under paragraph (1) shall include notice and opportunity for comment by the public and any such nation.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s610/c/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Certification.—</heading><content style="-uslm-dtd:text">The Secretary shall certify to the Congress
by January 31, 2007, and biennially thereafter whether each such nation has provided the documentary evidence
described in paragraph (1)(A) and established a management plan described in paragraph (1)(B).</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s610/c/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Alternative procedure.—</heading><chapeau style="-uslm-dtd:text">The Secretary may establish a procedure to authorize, on a shipment-by-shipment, shipper-by-shipper, or other basis the importation of fish or fish products from a vessel of a nation issued a negative certification under paragraph (1) if the Secretary determines that such imports were harvested by practices that do not result in bycatch of a protected marine species, or were harvested by practices that—</chapeau>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s610/c/4/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">are comparable to those of the United States, taking into account different conditions;  and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s610/c/4/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">include the gathering of species specific data that can be used to support international and regional stock assessments and conservation efforts for protected living marine resources.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s610/c/5" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">Effect of certification.—</heading><content style="-uslm-dtd:text">The provisions of section101(a) and section 101(b)(3) and (4) of this Act (16 U.S.C. 1826a(a), (b)(3), and (b)(4))  shall apply to any nation identified under subsection (a) for which the Secretary has issued a negative certification under this subsection, but shall not apply to any nation identified under subsection (a) for which the Secretary has issued a positive certification under this subsection.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tVI/s610/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">International Cooperation and Assistance.—</heading><chapeau style="-uslm-dtd:text">To the
greatest extent possible consistent with existing authority and the availability of funds, the Secretary shall—</chapeau>
                    <paragraph identifier="/us/sComp/104/43/tVI/s610/d/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">provide appropriate assistance to nations identified
by the Secretary under subsection (a) and international organizations of which those nations are members to assist
those nations in qualifying for certification under subsection (c);</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s610/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">undertake, where appropriate, cooperative research
activities on species statistics and improved harvesting techniques, with those nations or organizations;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s610/d/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">encourage and facilitate the transfer of appropriate
technology to those nations or organizations to assist those nations in qualifying for certification under subsection (c); and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s610/d/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">provide assistance to those nations or organizations

                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tVI/s610/e" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Protected Living Marine Resource Defined.—</heading><chapeau style="-uslm-dtd:text">In this
section the term “<quotedText style="-uslm-dtd:quote">protected living marine resource </quotedText>”—</chapeau>
                    <paragraph identifier="/us/sComp/104/43/tVI/s610/e/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">except as provided in paragraph (2), means nontarget fish, sea turtles, or marine mammals that are protected under United States law or international agreement, including—</chapeau>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s610/e/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the Marine Mammal Protection Act of 1972 (16 U.S.C. 1361 et seq.);</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s610/e/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the Endangered Species Act of 1973 (16 U.S.C. 1531 et seq.);</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s610/e/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">the Shark Finning Prohibition Act (16 U.S.C. 1822 note); and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/104/43/tVI/s610/e/1/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">the Convention on International Trade in Endangered Species of Wild Fauna and Flora, done at Washington March 3, 1973 (27 UST 1087; TIAS 8249); but</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVI/s610/e/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">does not include species, except sharks, managed under
the Magnuson-Stevens Fishery Conservation and Management Act, the Atlantic Tunas Convention Act, or any international
fishery management agreement.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tVI/s610/f" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Authorization of Appropriations.—</heading><content style="-uslm-dtd:text">There are authorized
to be appropriated to the Secretary for fiscal years 2007 through 2013 such sums as are necessary to carry out this section.</content>

            <num style="-uslm-dtd:enum" value="VII">TITLE VII—</num><heading style="-uslm-dtd:header">YUKON RIVER SALMON ACT </heading>
            <section identifier="/us/sComp/104/43/tVII/s701" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="701">SEC. 701. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5701">16 U.S.C. 5701 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
                <content class="block" style="-uslm-dtd:text">This title may be cited as the “<shortTitle style="-uslm-dtd:quote"><inline style="-uslm-dtd:short-title">Yukon River Salmon Act of 1995</inline></shortTitle>”.</content>
            </section>
            <section identifier="/us/sComp/104/43/tVII/s702" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="702">SEC. 702. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5701">16 U.S.C. 5701</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">PURPOSES. </heading>
                <subsection role="undesignated-level" style="-uslm-dtd:subsection" styleType="OLC"><chapeau style="-uslm-dtd:text">It is the purpose of this title—</chapeau>
                    <paragraph identifier="/us/sComp/104/43/tVII/s702/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">to implement the interim agreement for the conservation of salmon stocks originating from the Yukon River in Canada agreed to through an exchange of notes between the Government of the United States and the Government of Canada on February 3, 1995;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVII/s702/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">to provide for representation by the United States on the Yukon River Panel established under such agreement; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVII/s702/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">to authorize to be appropriated sums necessary to carry out the responsibilities of the United States under such agreement.</content>
                    </paragraph>
                </subsection>
            </section>
            <section identifier="/us/sComp/104/43/tVII/s703" role="definitions" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="703">SEC. 703. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5702">16 U.S.C. 5702</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">DEFINITIONS. </heading>
                <subsection role="undesignated-level" style="-uslm-dtd:subsection" styleType="OLC"><chapeau style="-uslm-dtd:text">As used in this title—</chapeau>
                    <paragraph identifier="/us/sComp/104/43/tVII/s703/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Agreement</term>” means the interim agreement for the conservation of salmon stocks originating from the Yukon River in Canada agreed to through an exchange of notes between the Government of the United States and the Government of Canada on February 3, 1995.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVII/s703/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Panel</term>” means the Yukon River Panel established by the Agreement.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVII/s703/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Yukon River Joint Technical Committee</term>” means the technical committee established by paragraph C.2 of the Memorandum of Understanding concerning the Pacific Salmon Treaty between the Government of the United States and the Government of Canada recorded January 28, 1985.</content>
                    </paragraph>
                </subsection>
            </section>
            <section identifier="/us/sComp/104/43/tVII/s704" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="704">SEC. 704. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5703">16 U.S.C. 5703</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">PANEL. </heading>
                <subsection identifier="/us/sComp/104/43/tVII/s704/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Representation.—</heading><chapeau style="-uslm-dtd:text">The United States shall be represented on the Panel by six individuals, of whom—</chapeau>
                    <paragraph identifier="/us/sComp/104/43/tVII/s704/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">one shall be an official of the United States Government with expertise in salmon conservation and management;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVII/s704/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">one shall be an official of the State of Alaska with expertise in salmon conservation and management; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVII/s704/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">four shall be knowledgeable and experienced with regard to the salmon fisheries on the Yukon River.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tVII/s704/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Appointments.—</heading><chapeau style="-uslm-dtd:text">Panel members shall be appointed as follows:</chapeau>
                    <paragraph identifier="/us/sComp/104/43/tVII/s704/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">The Panel member described in subsection (a)(1) shall be appointed by the Secretary of State.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVII/s704/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">The Panel member described in subsection (a)(2) shall be appointed by the Governor of Alaska.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVII/s704/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">The Panel members described in subsection (a)(3) shall be appointed by the Secretary of State from a list of at least 3 individuals nominated for each position by the Governor of Alaska. The Governor of Alaska may consider suggestions for nominations provided by organizations with expertise in Yukon River salmon fisheries. The Governor of Alaska may make appropriate nominations to allow for, and the Secretary of State shall appoint, at least one member under subsection (a)(3) who is qualified to represent the interests of Lower Yukon River fishing districts, and at least one member who is qualified to represent the interests of Upper Yukon River fishing districts. At least one of the Panel members under subsection (a)(3) shall be an Alaska Native.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tVII/s704/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Alternates.—</heading><content style="-uslm-dtd:text">The Secretary of State may designate an alternate Panel member for each Panel member the Secretary appoints under subsections<ref class="footnoteRef" idref="IDE7F4251E4FE84894A45869BBD28524AE" style="-uslm-dtd:footnote-ref">5</ref> (b)(1) and (3), who meets the same qualifications, to serve in the absence of the Panel member. The Governor of the State of Alaska may designate an alternative Panel member for the Panel member appointed under subsection (b)(2), who meets the same qualifications, to serve in the absence of that Panel member.</content><footnote id="IDE7F4251E4FE84894A45869BBD28524AE" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">5</sup><p style="-uslm-dtd:para; margin-left:1em">So in original. Probably should be “<quotedText style="-uslm-dtd:quote">subsection</quotedText>”.</p></footnote>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tVII/s704/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Term Length.—</heading><content style="-uslm-dtd:text">Panel members and alternate Panel members shall serve four-year terms. Any individual appointed to fill a vacancy occurring before the expiration of any term shall be appointed for the remainder of that term.</content>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tVII/s704/e" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Reappointment.—</heading><content style="-uslm-dtd:text">Panel members and alternate Panel members shall be eligible for reappointment.</content>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tVII/s704/f" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Decisions.—</heading><content style="-uslm-dtd:text">Decisions by the United States section of the Panel shall be made by the consensus of the Panel members appointed under paragraphs (2) and (3) of subsection (a).</content>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tVII/s704/g" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Consultation.—</heading><content style="-uslm-dtd:text">In carrying out their functions under the Agreement, Panel members may consult with such other interested parties as they consider appropriate.</content>
                </subsection>
            </section>
            <section identifier="/us/sComp/104/43/tVII/s705" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="705">SEC. 705. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5704">16 U.S.C. 5704</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">ADVISORY COMMITTEE. </heading>
                <subsection identifier="/us/sComp/104/43/tVII/s705/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Appointments.—</heading><content style="-uslm-dtd:text">The Governor of Alaska may appoint an Advisory Committee of not less than eight, but not more than twelve, individuals who are knowledgeable and experienced with regard to the salmon fisheries on the Yukon River. At least 2 of the Advisory Committee members shall be Alaska Natives. Members of the Advisory Committee may attend all meetings of the United States section of the Panel, and shall be given the opportunity to examine and be heard on any matter under consideration by the United States section of the Panel.</content>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tVII/s705/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Compensation.—</heading><content style="-uslm-dtd:text">The members of such Advisory Committee shall receive no compensation for their services.</content>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tVII/s705/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Term Length.—</heading><content style="-uslm-dtd:text">Advisory Committee members shall serve two-year terms. Any individual appointed to fill a vacancy occurring before the expiration of any term shall be appointed for the remainder of that term.</content>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tVII/s705/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Reappointment.—</heading><content style="-uslm-dtd:text">Advisory Committee members shall be eligible for reappointment.</content>
                </subsection>
            </section>
            <section identifier="/us/sComp/104/43/tVII/s706" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="706">SEC. 706. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5705">16 U.S.C. 5705</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">EXEMPTION. </heading>
                <content class="block" style="-uslm-dtd:text">Chapter 10 of title 5, United States Code, shall not apply to the Panel, the Yukon River Joint Technical Committee, or the Advisory Committee created under section 705 of this title.</content>
            </section>
            <section identifier="/us/sComp/104/43/tVII/s707" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="707">SEC. 707. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5706">16 U.S.C. 5706</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">AUTHORITY AND RESPONSIBILITY. </heading>
                <subsection identifier="/us/sComp/104/43/tVII/s707/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Responsible Management Entity.—</heading><content style="-uslm-dtd:text">The State of Alaska Department of Fish and Game shall be the responsible management entity for the United States for the purposes of the Agreement.</content>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tVII/s707/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Effect of Designation.—</heading><content style="-uslm-dtd:text">The designation under subsection (a) shall not be considered to expand, diminish, or change the management authority of the State of Alaska or the Federal Government with respect to fishery resources.</content>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tVII/s707/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Recommendations of Panel.—</heading><content style="-uslm-dtd:text">In addition to recommendations made by the Panel to the responsible management entities in accordance with the Agreement, the Panel may make recommendations concerning the conservation and management of salmon originating in the Yukon River to the Department of the Interior, Department of Commerce, Department of State, North Pacific Fishery Management Council, and other Federal or State entities as appropriate. Recommendations by the Panel shall be advisory in nature.</content>
                </subsection>
            </section>
            <section identifier="/us/sComp/104/43/tVII/s708" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="708">SEC. 708. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5707">16 U.S.C. 5707</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">CONTINUATION OF AGREEMENT. </heading>
                <content class="block" style="-uslm-dtd:text">In the event that the Treaty between Canada and the United States of America concerning Pacific Salmon, signed at Ottawa, January 28, 1985, terminates prior to the termination of the Agreement, and the functions of the Panel are assumed by the “<quotedText style="-uslm-dtd:quote">Yukon River Salmon Commission</quotedText>” referenced in the Agreement, the provisions of this title which apply to the Panel shall thereafter apply to the Yukon River Salmon Commission, and the other provisions of this title shall remain in effect.</content>
            </section>
            <section identifier="/us/sComp/104/43/tVII/s709" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="709">SEC. 709. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5708">16 U.S.C. 5708</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">ADMINISTRATIVE MATTERS. </heading>
                <subsection identifier="/us/sComp/104/43/tVII/s709/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><content style="-uslm-dtd:text">Panel members and alternate Panel members who are not State or Federal employees shall receive compensation at the daily rate of GS–15 of the General Schedule when engaged in the actual performance of duties.</content>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tVII/s709/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><content style="-uslm-dtd:text">Travel and other necessary expenses shall be paid for all Panel members, alternate Panel members, United States members of the Joint Technical Committee, and members of the Advisory Committee when engaged in the actual performance of duties.</content>
                </subsection>
                <subsection identifier="/us/sComp/104/43/tVII/s709/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><content style="-uslm-dtd:text">Except for officials of the United States Government, individuals described in subsection (b) shall not be considered to be Federal employees while engaged in the actual performance of duties, except for the purposes of injury compensation or tort claims liability as provided in chapter 81 of title 5, United States Code, and chapter 71<ref class="footnoteRef" idref="IDA9E4BFE37EFE413BAC94DD1A41F62F5D" style="-uslm-dtd:footnote-ref">6</ref> of title 28, United States Code.</content><footnote id="IDA9E4BFE37EFE413BAC94DD1A41F62F5D" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">6</sup><p style="-uslm-dtd:para; margin-left:1em">So in original.                 </subsection>
            </section>
            <section identifier="/us/sComp/104/43/tVII/s710" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="710">SEC. 710. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5709">16 U.S.C. 5709</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">AUTHORIZATION OF APPROPRIATIONS. </heading>
                <subsection role="undesignated-level" style="-uslm-dtd:subsection" styleType="OLC"><chapeau style="-uslm-dtd:text">There are authorized to be appropriated $4,000,000 for each fiscal year for carrying out the purposes and provisions of the Agreement and this title including—</chapeau>
                    <paragraph identifier="/us/sComp/104/43/tVII/s710/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">necessary travel expenses of Panel members, alternate Panel members, United States members of the Joint Technical Committee, and members of the Advisory Committee in accordance with Federal Travel Regulations and sections 5701, 5702, 5704 through 5708, and 5731 of title 5, United States Code;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVII/s710/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the United States share of the joint expenses of the Panel and the Joint Technical Committee: <i style="-uslm-dtd:italic">Provided, </i>That Panel members and alternate Panel members shall not, with respect to commitments concerning the United States share of the joint expenses, be subject to section 262(b)<ref class="footnoteRef" idref="ID952072F5A3F9476BB4A82C010343F08E" style="-uslm-dtd:footnote-ref">7</ref> of title 22, United States Code, insofar as it limits the authority of United States representatives to international organizations with respect to such commitments;</content><footnote id="ID952072F5A3F9476BB4A82C010343F08E" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">7</sup><p style="-uslm-dtd:para; margin-left:1em">So in original.                     <paragraph identifier="/us/sComp/104/43/tVII/s710/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">not more than $3,000,000 for each fiscal year to the Department of the Interior and to the Department of Commerce for survey, restoration, and enhancement activities related to Yukon River salmon; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/104/43/tVII/s710/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">$400,000 in each of fiscal years 1996, 1997, 1998, and 1999 to be contributed to the Yukon River Restoration and Enhancement Fund and used in accordance with the <br style="-uslm-dtd:linebreak"/>Agreement.</content>
