                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Short Title.—</heading><content style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote"><inline style="-uslm-dtd:short-title">Water Resources Development Act of 1999</inline></shortTitle>”.</content>

            <num style="-uslm-dtd:enum" value="II">TITLE II—</num><heading style="-uslm-dtd:header">GENERAL PROVISIONS </heading>

                <num style="-uslm-dtd:enum" value="206">SEC. 206. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s2331">33 U.S.C. 2331</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">USE OF CONTINUING CONTRACTS FOR CONSTRUCTION OF CERTAIN PROJECTS. </heading>
                <subsection identifier="/us/sComp/106/53/tII/s206/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">Notwithstanding any other provision of law, the Secretary shall not implement a fully allocated funding policy with respect to a water resource project if initiation of construction has occurred but sufficient funds are not available to complete the project.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tII/s206/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Continuing Contracts.—</heading><content style="-uslm-dtd:text">The Secretary shall enter into a continuing contract for a project described in subsection (a).</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tII/s206/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Initiation of Construction Clarified.—</heading><chapeau style="-uslm-dtd:text">For the purposes of this section, initiation of construction for a project occurs on the date of enactment of an Act that appropriates funds for the project from 1 of the following appropriation accounts:</chapeau>
                    <paragraph identifier="/us/sComp/106/53/tII/s206/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">Construction, General.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tII/s206/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">Operation and Maintenance, General.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tII/s206/c/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">Flood Control, Mississippi River and Tributaries.</content>
                        <elided style="-uslm-dtd:omitted-text">* * * * * * *</elided>
                    </paragraph>
                </subsection>
            </section>
            <section identifier="/us/sComp/106/53/tII/s212" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="212">SEC. 212. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s2332">33 USC 2332</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORELINE AND RIVERINE PROTECTION AND RESTORATION. </heading>
                <subsection identifier="/us/sComp/106/53/tII/s212/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><chapeau style="-uslm-dtd:text">The Secretary may carry out studies and projects to—</chapeau>
                    <paragraph identifier="/us/sComp/106/53/tII/s212/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">reduce flood and hurricane and storm damage hazards; or</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tII/s212/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">restore the natural functions and values of rivers and shorelines throughout the United States.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tII/s212/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Studies and Projects.—</heading>
                    <paragraph identifier="/us/sComp/106/53/tII/s212/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Authority.—</heading>
                        <subparagraph identifier="/us/sComp/106/53/tII/s212/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Studies.—</heading><chapeau style="-uslm-dtd:text">In carrying out subsection (a), the Secretary may carry out studies to identify appropriate measures for—</chapeau>
                            <clause identifier="/us/sComp/106/53/tII/s212/b/1/A/i" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the reduction of flood and hurricane and storm damage hazards, including measures for erosion mitigation and bank stabilization; or</content>
                            </clause>
                            <clause identifier="/us/sComp/106/53/tII/s212/b/1/A/ii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the conservation and restoration of the natural functions and values of rivers and shorelines.</content>
                            </clause>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tII/s212/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Projects.—</heading><content style="-uslm-dtd:text">Subject to subsection (f)(2), in carrying out subsection (a), the Secretary may design and implement projects described in subsection (a).</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tII/s212/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Consultation and coordination.—</heading><content style="-uslm-dtd:text">The studies and projects carried out under this section shall be conducted, to the maximum extent practicable, in consultation and coordination with the Federal Emergency Management Agency and other appropriate Federal agencies, and in consultation and coordination with appropriate State and local agencies and tribes.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tII/s212/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Nonstructural approaches.—</heading><content style="-uslm-dtd:text">The studies and projects shall emphasize, to the maximum extent practicable and appropriate, nonstructural approaches to preventing or reducing flood and hurricane and storm damages, including the use of natural features or nature-based features.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tII/s212/b/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Participation.—</heading><content style="-uslm-dtd:text">The studies and projects shall be conducted, to the maximum extent practicable, in cooperation with State and local agencies and tribes to ensure the coordination of local flood and hurricane and storm damage reduction or riverine, shoreline, and wetland restoration studies with projects that conserve, restore, and manage hydrologic and hydraulic regimes and restore the natural functions and values of floodplains and coastal barriers.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tII/s212/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Cost-Sharing Requirements.—</heading>
                    <paragraph identifier="/us/sComp/106/53/tII/s212/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Studies.—</heading><content style="-uslm-dtd:text">Studies conducted under this section shall be subject to cost sharing in accordance with section 105 of the Water Resources Development Act of 1986 (33 U.S.C. 2215), except that the first $200,000 of the costs of a study conducted under this section shall be at Federal expense.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tII/s212/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Environmental restoration and nonstructural  projects.—</heading>
                        <subparagraph identifier="/us/sComp/106/53/tII/s212/c/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Design and construction of a project under this section that includes a nonstructural measure, a natural feature or nature-based feature, or an environmental restoration measure, shall be subject to cost sharing in accordance with section 103 of the Water Resources Development Act of 1986 (33 U.S.C. 2213), except that the non-Federal share of the cost to design and construct such a project benefitting an economically disadvantaged community (including economically disadvantaged communities located in urban and rural areas) shall be 10 percent.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tII/s212/c/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Items provided by non-federal interests.—</heading><content style="-uslm-dtd:text">The non-Federal interests shall provide all land, easements, rights-of-way, dredged material disposal areas, and relocations necessary for such projects.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tII/s212/c/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Credit.—</heading><content style="-uslm-dtd:text">The value of such land, easements, rights-of-way, dredged material disposal areas, and relocations shall be credited toward the payment required under this paragraph.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tII/s212/c/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Structural flood control or hurricane and storm damage reduction projects.—</heading><content style="-uslm-dtd:text">Any structural flood control or hurricane and storm damage reduction projects carried out under this section shall be subject to cost sharing in accordance with section 103 of the Water Resources Development Act of 1986 (33 U.S.C. 2213), except that the non-Federal share of the cost to design and construct such a project benefitting an economically disadvantaged community (including economically disadvantaged communities located in urban and rural areas) shall be 10 percent.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tII/s212/c/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Operation and maintenance.—</heading><content style="-uslm-dtd:text">The non-Federal interests shall be responsible for all costs associated with operating, maintaining, replacing, repairing, and rehabilitating all projects carried out under this section.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tII/s212/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Project Justification.—</heading><chapeau style="-uslm-dtd:text">Notwithstanding any requirement for economic justification established under section 209 of the Flood Control Act of 1970 (42 U.S.C. 1962–2), the Secretary may implement a project under this section if the Secretary determines that the project—</chapeau>
                    <paragraph identifier="/us/sComp/106/53/tII/s212/d/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">will significantly reduce potential flood, hurricane and storm, or erosion damages;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tII/s212/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">will improve the quality of the environment; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tII/s212/d/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">is justified considering all costs and beneficial outputs of the project.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tII/s212/e" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Areas for Examination.—</heading>
                    <paragraph identifier="/us/sComp/106/53/tII/s212/e/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">In carrying out
 this section, the Secretary shall examine appropriate locations, including—</chapeau>
                        <subparagraph identifier="/us/sComp/106/53/tII/s212/e/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">Pima County, Arizona, at Paseo De Las Iglesias and Rillito River;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tII/s212/e/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">Coachella Valley, Riverside County, California;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tII/s212/e/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">Los Angeles and San Gabriel Rivers, California;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tII/s212/e/1/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">Murrieta Creek, California;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tII/s212/e/1/E" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">Napa River Valley watershed, California, at Yountville, St. Helena, Calistoga, and American Canyon;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tII/s212/e/1/F" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">Santa Clara basin, California, at Upper Guadalupe River and Tributaries, San Francisquito Creek, and Upper Penitencia Creek;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tII/s212/e/1/G" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="G">(G) </num><content style="-uslm-dtd:text">Pond Creek, Kentucky;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tII/s212/e/1/H" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="H">(H) </num><content style="-uslm-dtd:text">Red River of the North, Minnesota, North Dakota, and South Dakota;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tII/s212/e/1/I" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">Connecticut River, New Hampshire;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tII/s212/e/1/J" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="J">(J) </num><content style="-uslm-dtd:text">Pine Mount Creek, New Jersey;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tII/s212/e/1/K" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="K">(K) </num><content style="-uslm-dtd:text">Southwest Valley, Albuquerque, New Mexico;</content>
                        </subparagraph>

                            <num style="-uslm-dtd:enum" value="M">(M) </num><content style="-uslm-dtd:text">Briar Creek, North Carolina;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tII/s212/e/1/N" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="N">(N) </num><content style="-uslm-dtd:text">Chagrin River, Ohio;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tII/s212/e/1/O" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="O">(O) </num><content style="-uslm-dtd:text">Mill Creek, Cincinnati, Ohio;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tII/s212/e/1/P" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="P">(P) </num><content style="-uslm-dtd:text">Tillamook County, Oregon;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tII/s212/e/1/Q" style="-uslm-dtd:subparagraph" styleType="OLC">

                </subsection>
                <subsection identifier="/us/sComp/106/53/tII/s212/f" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Procedure.—</heading>
                    <paragraph identifier="/us/sComp/106/53/tII/s212/f/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">All projects.—</heading><chapeau style="-uslm-dtd:text">The Secretary shall not implement any project under this section until—</chapeau>
                        <subparagraph identifier="/us/sComp/106/53/tII/s212/f/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the Secretary submits to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a written notification describing the project and the determinations made under subsection (d)(1); and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tII/s212/f/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">21 calendar days have elapsed after the date on which the notification was received by the committees.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tII/s212/f/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Projects requiring specific authorization.—</heading><content style="-uslm-dtd:text">If the Federal share of the cost to design and construct a project under this section exceeds $15,000,000, the Secretary may only carry out the project if Congress enacts a law authorizing the Secretary to carry out the project.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tII/s212/g" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Definitions.—</heading><chapeau style="-uslm-dtd:text">In this section:</chapeau>
                    <paragraph identifier="/us/sComp/106/53/tII/s212/g/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Economically disadvantaged community.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">economically disadvantaged community</term>” has the meaning given the term as defined by the Secretary under section 160 of the Water Resources Development Act of 2020 (33 U.S.C. 2201 note).</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tII/s212/g/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Natural feature; nature-based feature.—</heading><content style="-uslm-dtd:text">The terms “<term style="-uslm-dtd:term">natural feature</term>” and “<term style="-uslm-dtd:term">nature-based feature</term>” have the meanings given those terms in section 1184(a) of the Water Resources Development Act of 2016 (33 U.S.C. 2289a(a)).</content>
                    </paragraph>
                </subsection>
            </section>
            <section identifier="/us/sComp/106/53/tII/s225" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="225">SEC. 225. </num><heading style="-uslm-dtd:header">RECREATION USER FEES. </heading>
                <subsection identifier="/us/sComp/106/53/tII/s225/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Withholding of Amounts.—</heading>
                    <paragraph identifier="/us/sComp/106/53/tII/s225/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">During fiscal years 1999 through 2002, the Secretary may withhold from the special account established under section 4(i)(1)(A) of the Land and Water Conservation Fund Act of 1965 (16 U.S.C. 460l–a(i)(1)(A)) 100 percent of the amount of receipts above a baseline of $34,000,000 per each fiscal year received from fees imposed at recreation sites under the administrative jurisdiction of the Department of the Army under section 4(b) of that Act (16 U.S.C. 460l–a(b)).</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tII/s225/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Use.—</heading><content style="-uslm-dtd:text">The amounts withheld shall be retained by the Secretary and shall be available, without further Act of appropriation, for expenditure by the Secretary in accordance with subsection (b).</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tII/s225/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Availability.—</heading><content style="-uslm-dtd:text">The amounts withheld shall remain available until September 30, 2005.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tII/s225/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Use of Amounts Withheld.—</heading><chapeau style="-uslm-dtd:text">In order to increase the quality of the visitor experience at public recreational areas and to enhance the protection of resources, the amounts withheld under subsection (a) may be used only for—</chapeau>
                    <paragraph identifier="/us/sComp/106/53/tII/s225/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">repair and maintenance projects (including projects relating to health and safety);</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tII/s225/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">interpretation;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tII/s225/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">signage;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tII/s225/b/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">habitat or facility enhancement;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tII/s225/b/5" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">resource preservation;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tII/s225/b/6" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">annual operation (including fee collection);</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tII/s225/b/7" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">maintenance; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tII/s225/b/8" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="8">(8) </num><content style="-uslm-dtd:text">law enforcement related to public use.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tII/s225/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Availability.—</heading><content style="-uslm-dtd:text">Each amount withheld by the Secretary shall be available for expenditure, without further Act of appropriation, at the specific project from which the amount, above baseline, is collected.</content>

                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">The project to prevent flood damage and for hurricane damage reduction, west bank of the Mississippi River (east of Harvey Canal), Louisiana, authorized by section 401(b) of the Water Resources Development Act of 1986 (100 Stat. 4128) and section 101(a)(17) of the Water Resources Development Act of 1996 (110 Stat. 3665), is modified to direct the Secretary to continue Federal operation, maintenance, rehabilitation, repair, and replacement of the portion of the project included in the report of the Chief of Engineers dated May 1, 1995, referred to as “<quotedText style="-uslm-dtd:quote">Algiers Canal Levees</quotedText>”.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tIII/s328/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Combination of Projects.—</heading><content style="-uslm-dtd:text">The Secretary shall carry out work authorized as part of the Westwego to Harvey Canal project, the East of Harvey Canal project, and the Lake Cataouatche modifications as a single project, to be known as the “<quotedText style="-uslm-dtd:quote">West Bank and Vicinity, New Orleans, Louisiana, Hurricane Protection Project</quotedText>”, with a combined total cost of $280,300,000.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tIII/s328/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Cost Sharing.—</heading><content style="-uslm-dtd:text">The non-Federal share of the cost of the project described in subsection (b) shall be 35 percent.</content>
                </subsection>

                <num style="-uslm-dtd:enum" value="334">SEC. 334. </num><heading style="-uslm-dtd:header">MISSOURI RIVER MITIGATION PROJECT, MISSOURI, KANSAS, IOWA, AND NEBRASKA. </heading>
                <subsection identifier="/us/sComp/106/53/tIII/s334/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">The project for mitigation of fish and wildlife losses, Missouri River Bank Stabilization and Navigation Project, Missouri, Kansas, Iowa, and Nebraska, authorized by section 601(a) of the Water Resources Development Act of 1986 (100 Stat. 4143) is modified to increase by 118,650 acres the amount of land and interests in land to be acquired for the project.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tIII/s334/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Study.—</heading>
                    <paragraph identifier="/us/sComp/106/53/tIII/s334/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Secretary, in conjunction with the States of Missouri, Kansas, Iowa, and Nebraska, shall conduct a study to determine the cost of restoring, under the authority of the Missouri River fish and wildlife mitigation project, a total of 118,650 acres of lost Missouri River fish and wildlife habitat.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tIII/s334/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Report.—</heading><content style="-uslm-dtd:text">Not later than 180 days after the date of enactment of this Act, the Secretary shall report to Congress on the results of the study.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tIII/s334/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Use of Other Funds.—</heading>

                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">The Secretary shall consult with other Federal agencies to determine if lands or interests in lands acquired by such other Federal agencies—</chapeau>
                        <subparagraph identifier="/us/sComp/106/53/tIII/s334/c/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">meet the purposes of the Missouri River Mitigation Project, Missouri, Kansas, Iowa, and Nebraska, authorized by section 601(a) of the Water Resources Development Act of 1986 (100 Stat. 4143; 113 Stat. 306; 121 Stat. 1155); and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tIII/s334/c/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">whether such lands are restricted by such other Federal agencies from being applied toward the total number of acres required under subsection (a).</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tIII/s334/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Application of lands.—</heading><content style="-uslm-dtd:text">Upon making a determination under paragraph (1) that lands or interests in lands acquired by a Federal agency meet the purposes of the project described in paragraph (1)(A) and that such lands are not otherwise restricted, the Secretary shall apply the lands or interests in lands acquired toward the total number of acres required under subsection (a), regardless of the source of the Federal funds used to acquire such lands or interests in lands.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tIII/s334/c/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Savings provision.—</heading><content style="-uslm-dtd:text">Nothing in this subsection authorizes any transfer of administrative jurisdiction over any lands or interests in lands acquired by a Federal agency that are applied toward the total number of acres required under subsection (a) pursuant to this subsection.</content>
                    </paragraph>
                </subsection>
            </section>
        </title>
        <title identifier="/us/sComp/106/53/tIV" style="-uslm-dtd:title" styleType="OLC">
            <num style="-uslm-dtd:enum" value="IV">TITLE IV—</num><heading style="-uslm-dtd:header">STUDIES </heading>
            <elided style="-uslm-dtd:omitted-text">* * * * * * *</elided>
            <section identifier="/us/sComp/106/53/tIV/s441" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="441">SEC. 441. </num><heading style="-uslm-dtd:header">WESTERN LAKE ERIE BASIN, OHIO, INDIANA, AND MICHIGAN. </heading>
                <subsection identifier="/us/sComp/106/53/tIV/s441/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">The Secretary shall conduct a study to develop measures to improve flood risk management, hurricane and storm damage risk reduction, navigation, water quality, recreation, and fish and wildlife habitat in a comprehensive manner in the western Lake Erie basin, Ohio, Indiana, and Michigan, including watersheds of the Maumee, Ottawa, and Portage Rivers.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tIV/s441/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Cooperation.—</heading><chapeau style="-uslm-dtd:text">In carrying out any study under this section, the Secretary shall—</chapeau>
                    <paragraph identifier="/us/sComp/106/53/tIV/s441/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">cooperate with interested Federal, State, and local agencies and nongovernmental organizations; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tIV/s441/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">consider all relevant programs of the agencies.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tIV/s441/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Treatment of Studies.—</heading><content style="-uslm-dtd:text">Any study carried out by the Secretary under this section after the date of enactment of the <inline style="-uslm-dtd:short-title">Water Resources Development Act of 2024</inline> shall be treated as a continuation of the initial study carried out under this section.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tIV/s441/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Projects.—</heading><content style="-uslm-dtd:text">A project resulting from a study carried out under this section may be implemented pursuant to section 212.</content>
                </subsection>
            </section>

                <subsection identifier="/us/sComp/106/53/tIV/s455/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Strategic Plans.—</heading>
                    <paragraph identifier="/us/sComp/106/53/tIV/s455/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Study.—</heading><content style="-uslm-dtd:text">The Secretary shall conduct a comprehensive study of the Great Lakes region to ensure the future use, management, and protection of water resources and related resources of the Great Lakes basin.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tIV/s455/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Report.—</heading>
                        <subparagraph identifier="/us/sComp/106/53/tIV/s455/a/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">As expeditiously as possible, but not later than 3 years after the date of enactment of this Act, and every 2 years thereafter, the Secretary shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate a report outlining a strategic plan for Corps of Engineers programs and proposed Corps of Engineers projects in the Great Lakes basin.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tIV/s455/a/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Contents.—</heading><chapeau style="-uslm-dtd:text">The plan shall include—</chapeau>
                            <clause identifier="/us/sComp/106/53/tIV/s455/a/2/B/i" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><chapeau style="-uslm-dtd:text">details of projects in the Great Lakes region relating to—</chapeau>
                                <subclause identifier="/us/sComp/106/53/tIV/s455/a/2/B/i/I" style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">navigation improvements, maintenance, and operations for commercial and recreational vessels;</content>
                                </subclause>
                                <subclause identifier="/us/sComp/106/53/tIV/s455/a/2/B/i/II" style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">environmental restoration activities;</content>
                                </subclause>
                                <subclause identifier="/us/sComp/106/53/tIV/s455/a/2/B/i/III" style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="III">(III) </num><content style="-uslm-dtd:text">water level maintenance activities;</content>
                                </subclause>
                                <subclause identifier="/us/sComp/106/53/tIV/s455/a/2/B/i/IV" style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="IV">(IV) </num><content style="-uslm-dtd:text">technical and planning assistance to States and remedial action planning committees;</content>
                                </subclause>
                                <subclause identifier="/us/sComp/106/53/tIV/s455/a/2/B/i/V" style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="V">(V) </num><content style="-uslm-dtd:text">sediment transport analysis, sediment management planning, and activities to support prevention of excess sediment loadings;</content>
                                </subclause>
                                <subclause identifier="/us/sComp/106/53/tIV/s455/a/2/B/i/VI" style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="VI">(VI) </num><content style="-uslm-dtd:text">flood damage reduction and shoreline erosion prevention; and</content>
                                </subclause>
                                <subclause identifier="/us/sComp/106/53/tIV/s455/a/2/B/i/VII" style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="VII">(VII) </num><content style="-uslm-dtd:text">all other relevant activities of the Corps of Engineers; and</content>
                                </subclause>
                            </clause>
                            <clause identifier="/us/sComp/106/53/tIV/s455/a/2/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">an analysis of factors limiting use of programs and authorities of the Corps of Engineers in existence on the date of enactment of this Act in the Great Lakes basin, including the need for new or modified authorities.</content>
                            </clause>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tIV/s455/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Authorization of appropriations.—</heading><content style="-uslm-dtd:text">There is authorized to be appropriated to carry out this section $1,000,000 for the period of fiscal years 2000 through 2003.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tIV/s455/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Great Lakes Biohydrological Information.—</heading>
                    <paragraph identifier="/us/sComp/106/53/tIV/s455/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Inventory.—</heading>
                        <subparagraph identifier="/us/sComp/106/53/tIV/s455/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Not later than 90 days after the date of enactment of this Act, the Secretary shall request each Federal agency that may possess information relevant to the Great Lakes biohydrological system to provide an inventory of all such information in the possession of the agency.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tIV/s455/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Relevant information.—</heading><chapeau style="-uslm-dtd:text">For the purpose of subparagraph (A), relevant information includes information on—</chapeau>
                            <clause identifier="/us/sComp/106/53/tIV/s455/b/1/B/i" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">ground and surface water hydrology;</content>
                            </clause>
                            <clause identifier="/us/sComp/106/53/tIV/s455/b/1/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">natural and altered tributary dynamics;</content>
                            </clause>
                            <clause identifier="/us/sComp/106/53/tIV/s455/b/1/B/iii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">biological aspects of the system influenced by and influencing water quantity and water movement;</content>
                            </clause>
                            <clause identifier="/us/sComp/106/53/tIV/s455/b/1/B/iv" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">meteorological projections and the impacts of weather conditions on Great Lakes water levels; and</content>
                            </clause>
                            <clause identifier="/us/sComp/106/53/tIV/s455/b/1/B/v" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="v">(v) </num><content style="-uslm-dtd:text">other Great Lakes biohydrological system data relevant to sustainable water use management.</content>
                            </clause>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tIV/s455/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Report.—</heading>
                        <subparagraph identifier="/us/sComp/106/53/tIV/s455/b/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">Not later than 18 months after the date of enactment of this Act, the Secretary, in consultation with the States, Indian tribes, and Federal agencies, and after requesting information from the provinces and the federal government of Canada, shall—</chapeau>
                            <clause identifier="/us/sComp/106/53/tIV/s455/b/2/A/i" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">compile the inventories of information;</content>
                            </clause>
                            <clause identifier="/us/sComp/106/53/tIV/s455/b/2/A/ii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">analyze the information for consistency and gaps; and</content>
                            </clause>
                            <clause identifier="/us/sComp/106/53/tIV/s455/b/2/A/iii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">submit to Congress, the International Joint Commission, and the Great Lakes States a report that includes recommendations on ways to improve the information base on the biohydrological dynamics of the Great Lakes ecosystem as a whole, so as to support environmentally sound decisions regarding diversions and consumptive uses of Great Lakes water.</content>
                            </clause>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tIV/s455/b/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Recommendations.—</heading><content style="-uslm-dtd:text">The recommendations in the report under subparagraph (A) shall include recommendations relating to the resources and funds necessary for implementing improvement of the information base.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tIV/s455/b/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Considerations.—</heading><chapeau style="-uslm-dtd:text">In developing the report under subparagraph (A), the Secretary, in cooperation with the Secretary of State, the Secretary of Transportation, and the heads of other agencies as appropriate, shall consider and report on the status of the issues described and recommendations made in—</chapeau>
                            <clause identifier="/us/sComp/106/53/tIV/s455/b/2/C/i" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the Report of the International Joint Commission to the Governments of the United States and Canada under the 1977 reference issued in 1985; and</content>
                            </clause>
                            <clause identifier="/us/sComp/106/53/tIV/s455/b/2/C/ii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the 1993 Report of the International Joint Commission to the Governments of Canada and the United States on Methods of Alleviating Adverse Consequences of Fluctuating Water Levels in the Great Lakes St. Lawrence Basin.</content>
                            </clause>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tIV/s455/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Great Lakes Recreational Boating.—</heading><content style="-uslm-dtd:text">Not later than 18 months after the date of enactment of this Act, the Secretary, using information and studies in existence on the date of enactment of this Act to the extent practicable, and in cooperation with the Great Lakes States, shall submit to Congress a report detailing the economic benefits of recreational boating in the Great Lakes basin, particularly at harbors benefiting from operation and maintenance projects of the Corps of Engineers.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tIV/s455/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Cooperation.—</heading><chapeau style="-uslm-dtd:text">In undertaking activities under this section, the Secretary shall—</chapeau>
                    <paragraph identifier="/us/sComp/106/53/tIV/s455/d/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">encourage public participation; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tIV/s455/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">cooperate, and, as appropriate, collaborate, with Great Lakes States, tribal governments, and Canadian federal, provincial, and tribal governments.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tIV/s455/e" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Water Use Activities and Policies.—</heading><content style="-uslm-dtd:text">The Secretary may provide technical assistance to the Great Lakes States to develop interstate guidelines to improve the consistency and efficiency of State-level water use activities and policies in the Great Lakes basin.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tIV/s455/f" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Cost Sharing.—</heading><content style="-uslm-dtd:text">The Secretary may seek and accept funds from non-Federal entities to be used to pay up to 25 percent of the cost of carrying out subsections (b), (c), (d), and (e).</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tIV/s455/g" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">In-Kind Contributions for Study.—</heading><content style="-uslm-dtd:text">The non-Federal interest may provide up to 100 percent of the non-Federal share required under subsection (f) in the form of in-kind services and materials.</content>

                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">The Secretary may provide technical, planning, and design assistance to Federal and non-Federal interests for carrying out projects to address water quality problems caused by drainage and related activities from abandoned and inactive noncoal mines.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s560/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Specific Measures.—</heading><chapeau style="-uslm-dtd:text">Assistance provided under subsection (a) may be in support of projects for the purposes of—</chapeau>
                    <paragraph identifier="/us/sComp/106/53/tV/s560/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">managing drainage from abandoned and inactive noncoal mines;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tV/s560/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">restoring and protecting streams, rivers, wetlands, other waterbodies, and riparian areas degraded by drainage from abandoned and inactive noncoal mines; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tV/s560/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">demonstrating management practices and innovative and alternative treatment technologies to minimize or eliminate adverse environmental effects associated with drainage from abandoned and inactive noncoal mines.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s560/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Non-Federal Share.—</heading><content style="-uslm-dtd:text">The non-Federal share of the cost of assistance under subsection (a) shall be 50 percent, except that the Federal share with respect to projects located on land owned by the United States, on land held in trust by the Secretary of the Interior on behalf of, and for the benefit of, an Indian Tribe, or on restricted land of any Indian Tribe, shall be 100 percent.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s560/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Effect on Authority of Secretary of the Interior.—</heading><content style="-uslm-dtd:text">Nothing in this section affects the authority of the Secretary of the Interior under title IV of the Surface Mining Control and Reclamation Act of 1977 (30 U.S.C. 1231 et seq.).</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s560/e" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Technology Database for Reclamation of Abandoned Mines.—</heading><content style="-uslm-dtd:text">The Secretary may provide assistance to non-Federal and nonprofit entities to develop, manage, and maintain a database of conventional and innovative, cost-effective technologies for reclamation of abandoned and inactive noncoal mine sites. Such assistance shall be provided through the Restoration of Abandoned Mine Sites Program managed by the Albuquerque District Office of the Corps of Engineers.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s560/f" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Authorization of Appropriations.—</heading><content style="-uslm-dtd:text">There is authorized to be appropriated to carry out this section $50,000,000.</content>

                <num style="-uslm-dtd:enum" value="569">SEC. 569. </num><heading style="-uslm-dtd:header">NORTHEASTERN MINNESOTA. </heading>
                <subsection identifier="/us/sComp/106/53/tV/s569/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Definition of Northeastern Minnesota.—</heading><content style="-uslm-dtd:text">In this section, the term “<term style="-uslm-dtd:term">northeastern Minnesota</term>” means the counties of Cook, Lake, St. Louis, Koochiching, Itasca, Cass, Crow Wing, Aitkin, Carlton, Pine, Kanabec, Mille Lacs, Morrison, Beltrami, Hubbard, Wadena, Isanti, and Chisago, Minnesota.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s569/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Establishment of Program.—</heading><content style="-uslm-dtd:text">The Secretary may establish a pilot program to provide environmental assistance to non-Federal interests in northeastern Minnesota.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s569/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Form of Assistance.—</heading><content style="-uslm-dtd:text">Assistance under this section may be in the form of design and construction assistance for waterrelated environmental infrastructure and resource protection and development projects in northeastern Minnesota, including projects for wastewater treatment and related facilities, water supply and related facilities, environmental restoration, and surface water resource protection and development.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s569/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Public Ownership Requirement.—</heading><content style="-uslm-dtd:text">The Secretary may provide assistance for a project under this section only if the project is publicly owned.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s569/e" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Local Cooperation Agreement.—</heading>
                    <paragraph identifier="/us/sComp/106/53/tV/s569/e/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Before providing assistance under this section, the Secretary shall enter into a local cooperation agreement with a non-Federal interest to provide for design and construction of the project to be carried out with the assistance.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tV/s569/e/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Requirements.—</heading><chapeau style="-uslm-dtd:text">Each local cooperation agreement entered into under this subsection shall provide for the following:</chapeau>
                        <subparagraph identifier="/us/sComp/106/53/tV/s569/e/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Plan.—</heading><content style="-uslm-dtd:text">Development by the Secretary, in consultation with appropriate Federal and State officials, of a facilities or resource protection and development plan, including appropriate engineering plans and specifications.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tV/s569/e/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Legal and institutional structures.—</heading><content style="-uslm-dtd:text">Establishment of such legal and institutional structures as are necessary to ensure the effective long-term operation of the project by the non-Federal interest.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tV/s569/e/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Cost sharing.—</heading>
                        <subparagraph identifier="/us/sComp/106/53/tV/s569/e/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Federal share of project costs under each local cooperation agreement entered into under this subsection shall be 75 percent. The Federal share may be in the form of grants or reimbursements of project costs.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tV/s569/e/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Credit for design work.—</heading><content style="-uslm-dtd:text">The non-Federal interest shall receive credit for the reasonable costs of design work completed by the non-Federal interest before entering into a local cooperation agreement with the Secretary for a project.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tV/s569/e/3/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Credit for interest.—</heading><content style="-uslm-dtd:text">In case of a delay in the funding of the non-Federal share of the costs of a project that is the subject of an agreement under this section, the non-Federal interest shall receive credit for reasonable interest incurred in providing - the non-Federal share of the project’s costs.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tV/s569/e/3/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><heading style="-uslm-dtd:header">Land, easements, and rights-of-way credit.—</heading><content style="-uslm-dtd:text">The non-Federal interest shall receive credit for land, easements, rights-of-way, and relocations toward the non-Federal share of project costs (including all reasonable costs associated with obtaining permits necessary for the construction, operation, and maintenance of the project on publicly owned or controlled land), but not to exceed 25 percent of total project costs.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tV/s569/e/3/E" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="E">(E) </num><heading style="-uslm-dtd:header">Operation and maintenance.—</heading><content style="-uslm-dtd:text">The non-Federal share of operation and maintenance costs for projects constructed with assistance provided under this section shall be 100 percent.</content>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s569/f" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Applicability of Other Federal and State Laws.—</heading><content style="-uslm-dtd:text">Nothing in this section waives, limits, or otherwise affects the applicability of any provision of Federal or State law that would otherwise apply to a project to be carried out with assistance provided under this section.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s569/g" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Nonprofit Entities.—</heading><content style="-uslm-dtd:text">In accordance with section 221(b) of the Flood Control Act of 1970 (42 U.S.C. 1962d–5b(b)), for any project carried out under this section, a non-Federal interest may include a nonprofit entity with the consent of the affected local government.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s569/h" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="h">(h) </num><heading style="-uslm-dtd:header">Authorization of Appropriations.—</heading><content style="-uslm-dtd:text">There is authorized to be appropriated to carry out this section $80,000,000 for the period beginning with fiscal year 2000, to remain available until expended.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s569/i" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">Corps of Engineers Expenses.—</heading><content style="-uslm-dtd:text">Not more than 10 percent of the amounts appropriated to carry out this section may be used by the Corps of Engineers district offices to administer projects under this section at Federal expense.</content>
                </subsection>

                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Definition of Native Corporation.—</heading><content style="-uslm-dtd:text">In this section, the term “<term style="-uslm-dtd:term">Native Corporation</term>” has the meaning given the term in section 3 of the Alaska Native Claims Settlement Act (43 U.S.C. 1602).</content>

                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Definition of Northern West Virginia.—</heading><content style="-uslm-dtd:text">In this section, the term “<term style="-uslm-dtd:term">northern West Virginia</term>” means the counties of Barbour, Berkeley, Brooke, Doddridge, Grant, Hampshire, Hancock, Hardy, Harrison, Jefferson, Lewis, Marion, Marshall, Mineral, Morgan, Monongalia, Ohio, Pleasants, Preston, Randolph, Ritchie, Taylor, Tucker, Tyler, Upshur, Wetzel, and Wood, West Virginia.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s571/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Establishment of Program.—</heading><content style="-uslm-dtd:text">The Secretary may establish a pilot program to provide environmental assistance to non-Federal interests in northern West Virginia.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s571/c" style="-uslm-dtd:subsection" styleType="OLC">

                <subsection identifier="/us/sComp/106/53/tV/s571/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Public Ownership Requirement.—</heading><content style="-uslm-dtd:text">The Secretary may provide assistance for a project under this section only if the project is publicly owned.</content>

                        <subparagraph identifier="/us/sComp/106/53/tV/s571/e/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Credit for design work.—</heading><content style="-uslm-dtd:text">The non-Federal interest shall receive credit for the reasonable costs of design work completed by the non-Federal interest before entering into a local cooperation agreement with the Secretary for a project. The credit for the design work shall not exceed 6 percent of the total construction costs of the project.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tV/s571/e/3/C" style="-uslm-dtd:subparagraph" styleType="OLC">

                        <subparagraph identifier="/us/sComp/106/53/tV/s571/e/3/F" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="F">(F) </num><heading style="-uslm-dtd:header">Exception.—</heading><content style="-uslm-dtd:text">In the case of a project benefitting an economically disadvantaged community (as defined by the Secretary under section 160 of the Water Resources Development Act of 2020 (33 U.S.C. 2201 note)), the Federal share of the project costs under the applicable local cooperation agreement entered into under this subsection shall be 90 percent.</content>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s571/f" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Applicability of Other Federal and State Laws.—</heading><content style="-uslm-dtd:text">Nothing in this section waives, limits, or otherwise affects the applicability of any provision of Federal or State law that would otherwise apply to a project to be carried out with assistance provided under this section.</content>

                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Establishment of Program.—</heading><content style="-uslm-dtd:text">The Secretary may establish a pilot program to provide environmental assistance to non-Federal interests in Mississippi.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s592/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Form of Assistance.—</heading><content style="-uslm-dtd:text">Assistance under this section may be in the form of design and construction assistance for waterrelated environmental infrastructure and resource protection and development projects in Mississippi, including projects for wastewater treatment and related facilities, elimination or control of combined sewer overflows, water supply and related facilities, environmental restoration, surface water resource protection and development, stormwater management, drainage systems, and water quality enhancement.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s592/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Public Ownership Requirement.—</heading><content style="-uslm-dtd:text">The Secretary may provide assistance for a project under this section only if the project is publicly owned.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s592/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Local Cooperation Agreement.—</heading>
                    <paragraph identifier="/us/sComp/106/53/tV/s592/d/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Before providing assistance under this section, the Secretary shall enter into a local cooperation agreement with a non-Federal interest to provide for design and construction of the project to be carried out with the assistance.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tV/s592/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Requirements.—</heading><chapeau style="-uslm-dtd:text">Each local cooperation agreement entered into under this subsection shall provide for the following: (A) PLAN.-Development by the Secretary, in consultation with appropriate Federal and State officials, of a facilities or resource protection and development plan, including appropriate engineering plans and specifications.</chapeau>
                        <subparagraph identifier="/us/sComp/106/53/tV/s592/d/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Legal and institutional structures.—</heading><content style="-uslm-dtd:text">Establishment of such legal and institutional structures as are necessary to ensure the effective long-term operation of the project by the non-Federal interest.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tV/s592/d/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Cost sharing.—</heading>
                        <subparagraph identifier="/us/sComp/106/53/tV/s592/d/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Federal share of project costs under each local cooperation agreement entered into under this subsection shall be 75 percent. The Federal share may be in the form of grants or reimbursements of project costs.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tV/s592/d/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Credit for design work.—</heading><content style="-uslm-dtd:text">The non-Federal interest shall receive credit for the reasonable costs of design work completed by the non-Federal interest before entering into a local cooperation agreement with the Secretary for a project. The credit for the design work shall not exceed 6 percent of the total construction costs of the project.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tV/s592/d/3/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Credit for interest.—</heading><content style="-uslm-dtd:text">In case of a delay in the funding of the non-Federal share of the costs of a project that is the subject of an agreement under this section, the non-Federal interest shall receive credit for reasonable interest incurred in providing the non-Federal share of the project’s costs.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tV/s592/d/3/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><heading style="-uslm-dtd:header">Land, easements, and rights-of-way credit.—</heading><content style="-uslm-dtd:text">The non-Federal interest shall receive credit for land, easements, rights-of-way, and relocations toward the non-Federal share of project costs (including all reasonable costs associated with obtaining permits necessary for the construction, operation, and maintenance of the project on publicly owned or controlled land), but not to exceed 25 percent of total project costs.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tV/s592/d/3/E" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="E">(E) </num><heading style="-uslm-dtd:header">Operation and maintenance.—</heading><content style="-uslm-dtd:text">The non-Federal share of operation and maintenance costs for projects constructed with assistance provided under this section shall be 100 percent.</content>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s592/e" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Applicability of Other Federal and State Laws.—</heading><content style="-uslm-dtd:text">Nothing in this section waives, limits, or otherwise affects the applicability of any provision of Federal or State law that would otherwise apply to a project to be carried out with assistance provided under this section.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s592/f" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Report.—</heading><content style="-uslm-dtd:text">Not later than December 31, 2001, the Secretary shall submit to Congress a report on the results of the pilot program carried out under this section, including recommendations concerning whether the program should be implemented on a national basis.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s592/g" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Authorization of Appropriations.—</heading><content style="-uslm-dtd:text">There is authorized to be appropriated to carry out this section $300,000,000, to remain available until expended.</content>
                </subsection>
            </section>
            <section identifier="/us/sComp/106/53/tV/s593" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="593">SEC. 593. </num><heading style="-uslm-dtd:header">CENTRAL NEW MEXICO. </heading>
                <subsection identifier="/us/sComp/106/53/tV/s593/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Definition of Central New Mexico.—</heading><content style="-uslm-dtd:text">In this section, the term “<term style="-uslm-dtd:term">central New Mexico</term>” means the counties of Bernalillo, Colfax, Sandoval, and Valencia, New Mexico.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s593/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Establishment of Program.—</heading><content style="-uslm-dtd:text">The Secretary may establish a pilot program to provide environmental assistance to non-Federal interests in central New Mexico.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s593/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Form of Assistance.—</heading><content style="-uslm-dtd:text">Assistance under this section may be in the form of design and construction assistance for waterrelated environmental infrastructure and resource protection and development projects in central New Mexico, including projects for wastewater treatment and related facilities, water supply, conservation, water reuse, and related facilities, stormwater retention and remediation, environmental restoration, and surface water resource protection and development.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s593/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Public Ownership Requirement.—</heading><content style="-uslm-dtd:text">The Secretary may provide assistance for a project under this section only if the project is publicly owned.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s593/e" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Local Cooperation Agreement.—</heading>

                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Before providing assistance under this section, the Secretary shall enter into a local cooperation agreement with a non-Federal interest to provide for design and construction of the project to be carried out with the assistance.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tV/s593/e/2" style="-uslm-dtd:paragraph" styleType="OLC">

                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s593/h" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="h">(h) </num><heading style="-uslm-dtd:header">Authorization of Appropriations.—</heading><content style="-uslm-dtd:text">There is authorized to be appropriated to carry out this section $150,000,000 for the period beginning with fiscal year 2000, to remain available until expended.</content>
                </subsection>
            </section>
            <section identifier="/us/sComp/106/53/tV/s594" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="594">SEC. 594. </num><heading style="-uslm-dtd:header">OHIO AND NORTH DAKOTA. </heading>
                <subsection identifier="/us/sComp/106/53/tV/s594/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Establishment of Program.—</heading><content style="-uslm-dtd:text">The Secretary shall establish a program to provide environmental assistance to non-Federal interests in Ohio and North Dakota.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s594/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Form of Assistance.—</heading><chapeau style="-uslm-dtd:text">Assistance under this section may be in the form of design and construction assistance for waterrelated environmental infrastructure and resource protection and development projects in Ohio and North Dakota, including projects for—</chapeau>
                    <paragraph identifier="/us/sComp/106/53/tV/s594/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">wastewater treatment and related facilities;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tV/s594/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">combined sewer overflow, water supply, storage, treatment, and related facilities;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tV/s594/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">mine drainage;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tV/s594/b/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">environmental restoration; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tV/s594/b/5" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">surface water resource protection and development.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s594/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Public Ownership Requirement.—</heading><content style="-uslm-dtd:text">The Secretary may provide assistance for a project under this section only if the project is publicly owned.</content>
                </subsection>

                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Before providing assistance under this section, the Secretary shall enter into a project cooperation agreement with a non-Federal interest to provide for design and construction of the project to be carried out with the assistance.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tV/s594/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Requirements.—</heading><chapeau style="-uslm-dtd:text">Each project cooperation agreement entered into under this subsection shall provide for the following:</chapeau>
                        <subparagraph identifier="/us/sComp/106/53/tV/s594/d/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">

                            <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Project costs.—</heading>
                            <clause identifier="/us/sComp/106/53/tV/s594/d/3/A/i" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Except as provided in clause (iii), the Federal share of
 project costs under each project cooperation agreement entered into under this subsection shall be 75 percent. </content>
                            </clause>
                            <clause identifier="/us/sComp/106/53/tV/s594/d/3/A/ii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><heading style="-uslm-dtd:header">Form.—</heading><content style="-uslm-dtd:text">The Federal share may
 be in the form of grants or reimbursements of project costs.</content>
                            </clause>
                            <clause identifier="/us/sComp/106/53/tV/s594/d/3/A/iii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iii">(iii) </num><heading style="-uslm-dtd:header">Exception.—</heading><content style="-uslm-dtd:text">The non-Federal share of the cost of a project under this section benefitting an economically disadvantaged community (as defined by the Secretary under section 160 of the Water Resources Development Act of 2020 (33 U.S.C. 2201 note)) shall be 10 percent.</content>
                            </clause>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tV/s594/d/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Credit for design work.—</heading><content style="-uslm-dtd:text">The non-Federal interest shall receive credit for the reasonable costs of design work completed by the non-Federal interest before entering into a project cooperation agreement with the Secretary.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tV/s594/d/3/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Credit for certain financing costs.—</heading><content style="-uslm-dtd:text">In case of a delay in the reimbursement of the non-Federal share of the costs of a project, the non-Federal interest shall receive credit for reasonable interest and other associated financing costs necessary for the non-Federal interest to provide the non-Federal share of the project costs.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tV/s594/d/3/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><heading style="-uslm-dtd:header">Land, easements, rights-of-way, and relocations.—</heading><content style="-uslm-dtd:text">The non-Federal interest shall receive credit for land, easements, rights-of-way, and relocations provided by the non-Federal interest toward the non-Federal share of project costs (including costs associated with obtaining permits necessary for the placement of the project on publicly owned or controlled land), but not to exceed 25 percent of total project costs.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tV/s594/d/3/E" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="E">(E) </num><heading style="-uslm-dtd:header">Operation and maintenance.—</heading><content style="-uslm-dtd:text">The non-Federal share of operation and maintenance costs for projects constructed under an agreement entered into under this subsection shall be 100 percent.</content>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s594/e" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Applicability of Other Federal and State Laws.—</heading><content style="-uslm-dtd:text">Nothing in this section waives, limits, or otherwise affects the applicability of any provision of Federal or State law that would otherwise apply to a project to be carried out with assistance provided under this section.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s594/f" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Nonprofit Entities.—</heading><content style="-uslm-dtd:text">In accordance with section 221 of the Flood Control Act of 1970 (42 U.S.C. 1962d-5b), a non-Federal interest for any project carried out under this section may include a nonprofit entity, with the consent of the affected local government.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s594/g" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Report.—</heading><content style="-uslm-dtd:text">Not later than December 31, 2001, the Secretary shall submit to Congress a report on the results of the program carried out under this section, including recommendations concerning whether the program should be implemented on a national basis.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s594/h" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="h">(h) </num><heading style="-uslm-dtd:header">Authorization of Appropriations.—</heading><content style="-uslm-dtd:text">There is authorized to be appropriated to carry out this section $300,000,000 for Ohio and $100,000,000 for North Dakota.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s594/i" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">Authorization of Additional Appropriations.—</heading><content style="-uslm-dtd:text">In addition to amounts authorized under subsection (h), there is authorized to be appropriated to carry out this section $100,000,000, to be divided between the States referred to in subsection (a). </content>
                </subsection>
            </section>
            <section identifier="/us/sComp/106/53/tV/s595" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="595">SEC. 595. </num><heading style="-uslm-dtd:header">WESTERN RURAL WATER. </heading>
                <subsection identifier="/us/sComp/106/53/tV/s595/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Definitions.—</heading><chapeau style="-uslm-dtd:text">In this section:</chapeau>
                    <paragraph identifier="/us/sComp/106/53/tV/s595/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Non-federal interest.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">non-Federal interest</term>” includes an entity declared to be a political subdivision of the State of New Mexico.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tV/s595/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Rural nevada.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">rural Nevada</term>” means (A) the counties of Lincoln, White Pine, Nye, Eureka, Elko, Humboldt, Pershing, Churchill, Storey, Lyon, Carson, Douglas, Mineral, Esmeralda, and Lander, Nevada;</chapeau>
                        <subparagraph identifier="/us/sComp/106/53/tV/s595/a/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the portions of Washoe County, Nevada, that are located outside the cities of Reno and Sparks; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tV/s595/a/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">the portions of Clark County, Nevada, that are located outside the cities of Las Vegas, North Las Vegas, and Henderson and the unincorporated portion of the county in the Las Vegas Valley.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tV/s595/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Rural utah.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">rural Utah</term>” means—</chapeau>
                        <subparagraph identifier="/us/sComp/106/53/tV/s595/a/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the counties of Box Elder, Cache, Rich, Tooele, Morgan, Summit, Dagett, Wasatch, Duchesne, Uintah, Juab, Sanpete, Carbon, Millard, Sevier, Emery, Grand, Beaver, Piute, Wayne, Iron, Garfield, San Juan, and Kane, Utah; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tV/s595/a/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the portions of Washington County, Utah, that are located outside the city of St. George, Utah.</content>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s595/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Establishment of Program.—</heading><content style="-uslm-dtd:text">The Secretary may establish a program for providing environmental assistance to non-Federal interests in Arizona, rural Idaho, Montana, rural Nevada, NewMexico, rural Utah, and Wyoming.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s595/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Form of Assistance.—</heading><chapeau style="-uslm-dtd:text">Assistance under this section may be in the form of—</chapeau>
                    <paragraph identifier="/us/sComp/106/53/tV/s595/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">design and construction assistance for water-related environmental infrastructure, including natural and nature-based infrastructure and resource protection and development in Arizona, Idaho, Montana, rural Nevada, New Mexico, rural Utah, and Wyoming, including projects for—</chapeau>
                        <subparagraph identifier="/us/sComp/106/53/tV/s595/c/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">wastewater treatment and related facilities;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tV/s595/c/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">water supply and related facilities;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tV/s595/c/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">environmental restoration; </content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tV/s595/c/1/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">surface water resource protection and development; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tV/s595/c/1/E" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">drought resilience measures; and</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tV/s595/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">technical assistance to small and rural communities for water planning and issues relating to access to water resources.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s595/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Public Ownership Requirement.—</heading><content style="-uslm-dtd:text">The Secretary may provide assistance for a project under this section only if the project is publicly owned.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s595/e" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Local Cooperation Agreement.—</heading>
                    <paragraph identifier="/us/sComp/106/53/tV/s595/e/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Before providing assistance under this section, the Secretary shall enter into a local cooperation agreement with a non-Federal interest to provide for design and construction of the project to be carried out with the assistance.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tV/s595/e/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Requirements.—</heading><chapeau style="-uslm-dtd:text">Each local cooperation agreement entered into under this subsection shall provide for the following:</chapeau>
                        <subparagraph identifier="/us/sComp/106/53/tV/s595/e/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Plan.—</heading><content style="-uslm-dtd:text">Development by the Secretary, in consultation with appropriate Federal and State officials, of a facilities or resource protection and development plan, including appropriate engineering plans and specifications.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tV/s595/e/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Legal and institutional structures.—</heading><content style="-uslm-dtd:text">Establishment of such legal and institutional structures as are necessary to ensure the effective long-term operation of the project by the non-Federal interest.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tV/s595/e/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Cost sharing.—</heading>
                        <subparagraph identifier="/us/sComp/106/53/tV/s595/e/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Federal share of project costs under each local cooperation agreement entered into under this subsection shall be 75 percent. The Federal share may be in the form of grants or reimbursements of project costs.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tV/s595/e/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Credit for design work.—</heading><content style="-uslm-dtd:text">The non-Federal interest shall receive credit for the reasonable costs of design work completed by the non-Federal interest before entering into a local cooperation agreement with the Secretary for a project.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tV/s595/e/3/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Credit for interest.—</heading><content style="-uslm-dtd:text">In case of a delay in the funding of the non-Federal share of the costs of a project that is the subject of an agreement under this section, the non-Federal interest shall receive credit for reasonable interest incurred in providing the non-Federal share of the project costs.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tV/s595/e/3/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><heading style="-uslm-dtd:header">Land, easements, rights-of-way, and relocations.—</heading><content style="-uslm-dtd:text">The non-Federal interest shall receive credit for land, easements, rights-of-way, and relocations provided by the non-Federal interest toward the non-Federal share of project costs (including all reasonable costs associated with obtaining permits necessary for the construction, operation, and maintenance of the project on publicly owned or controlled land), but not to exceed 25 percent of total project costs.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tV/s595/e/3/E" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="E">(E) </num><heading style="-uslm-dtd:header">Operation and maintenance.—</heading><content style="-uslm-dtd:text">The non-Federal share of operation and maintenance costs for projects constructed with assistance provided under this section shall be 100 percent.</content>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s595/f" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Applicability of Other Federal and State Laws.—</heading><content style="-uslm-dtd:text">Nothing in this section waives, limits, or otherwise affects the applicability of any provision of Federal or State law that would otherwise apply to a project to be carried out with assistance provided under this section.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s595/g" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Report.—</heading><content style="-uslm-dtd:text">Not later than December 31, 2001, the Secretary shall submit to Congress a report on the results of the program carried out under this section, including recommendations concerning whether the program should be implemented on a national basis.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s595/h" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="h">(h) </num><heading style="-uslm-dtd:header">Eligibility.—</heading>
                    <paragraph identifier="/us/sComp/106/53/tV/s595/h/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Assistance under this section shall be made available to all eligible States and locales described in subsection (b) consistent with program priorities determined by the Secretary in accordance with criteria developed by the Secretary to establish the program priorities.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tV/s595/h/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Selection of projects.—</heading><chapeau style="-uslm-dtd:text">In selecting projects for assistance under this section, the Secretary shall give priority to a project located in an eligible State or local entity for which the project sponsor is prepared to—</chapeau>
                        <subparagraph identifier="/us/sComp/106/53/tV/s595/h/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">execute a new or amended project cooperation agreement; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/53/tV/s595/h/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">commence promptly after the date of enactment of the Water Resources Development Act of 2016.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tV/s595/h/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Rural projects.—</heading><content style="-uslm-dtd:text">The Secretary shall consider a project authorized under this section and an environmental infrastructure project authorized under section 219 of the Water Resources Development Act of 1992 (Public Law 102–580; 106 Stat. 4835) for new starts on the same basis as any other similarly funded project.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/53/tV/s595/i" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">Authorization of Appropriations.—</heading><chapeau style="-uslm-dtd:text">There is authorized to be appropriated to carry out this section, to remain available until expended—</chapeau>
                    <paragraph identifier="/us/sComp/106/53/tV/s595/i/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">for the period beginning with fiscal year 2001, $850,000,000 for Idaho, Montana, rural Nevada, New Mexico, rural Utah, and Wyoming; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/53/tV/s595/i/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">$250,000,000 for Arizona.</content>
                    </paragraph>
