            <num style="-uslm-dtd:enum" value="IV">TITLE IV—</num><heading style="-uslm-dtd:header">AUTHORIZATION OF APPROPRIATIONS FOR THE
NATIONAL OCEANIC AND ATMOSPHERIC ADMINISTRATION </heading>

            <section style="-uslm-dtd:section" identifier="/us/sComp/100/685/tIV/s407" styleType="traditional-inline">
                <num style="-uslm-dtd:enum" value="407">Sec. 407. </num><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/100/685/tIV/s407/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a) </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t15/s313">15 U.S.C. 313 note</ref><b>]</b> </editorialNote><content style="-uslm-dtd:text">The Secretary shall prepare and submit to the Congress, not later than 90 days after the date of enactment of this Act, a 10-year strategic plan for the comprehensive modernization of the National Weather Service. The strategic plan shall set forth basic service improvement objectives of the modernization as well as the critical new technological components and the associated operational changes necessary to fulfill the objectives of weather and flood warning service improvements.</content><footnote id="IDD1F9D9A8DFB44E48B449C57E82EC6BE9" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">1</sup><p style="-uslm-dtd:para; margin-left:1em">These sections were enacted as sections 407 through 409 of the National Aeronautics and Space Administration Authorization Act, Fiscal Year 1989 (Public Law 100–685).</p></footnote></subsection><editorialNote style="-uslm-dtd:subsection">
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/100/685/tIV/s407/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b"><b>[</b>(b) </num><content style="-uslm-dtd:text">through (d) Repealed.<b>]</b></content>

                <num style="-uslm-dtd:enum" value="408">Sec. 408. </num><content style="-uslm-dtd:text">Repealed.</content>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/100/685/tIV/s409" styleType="traditional-inline">
                <num style="-uslm-dtd:enum" value="409">Sec. 409. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t15/s1534">15 U.S.C. 1534</ref><b>]</b> </editorialNote><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/100/685/tIV/s409/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a) </num><content style="-uslm-dtd:text">Except as otherwise provided in this section, the Secretary is authorized to assess fees, based on fair market value, for access to environmental data and information and products derived therefrom collected and/or archived by the National Oceanic and Atmospheric Administration.</content></subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/100/685/tIV/s409/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b)</num><paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/100/685/tIV/s409/b/1" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">The Secretary shall provide data, information, and products described in subsection (a) to Federal, State, and local government agencies, to universities, and to other nonprofit institutions at the cost of reproduction and transmission, if such data, information, and products are to be used for research and not for commercial purposes.</content></paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/100/685/tIV/s409/b/2" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">The Secretary shall waive the assessment of fees under subsection (a) as necessary to continue to provide data, information, or products to foreign governments and international organizations on a basis of exchanging such data, information, and products or as otherwise provided by international agreement.</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/100/685/tIV/s409/b/3" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">The Secretary shall waive the assessment of fees authorized by subsection (a) as necessary to continue to provide weather warnings, watches, and similar products and services essential to the mission of the National Oceanic Atmospheric Administration.</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/100/685/tIV/s409/c" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><content style="-uslm-dtd:text">The initial schedule of any fees assessed under this section, and any subsequent amendment to such schedule, shall be published by the Secretary in the Federal Register at least 30 days before such fees will take effect. The initial schedule shall remain in effect without amendment for the three-year period beginning on the date that fees under the schedule take effect.</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/100/685/tIV/s409/d" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><chapeau style="-uslm-dtd:text">Any assessment of fees under this section by the National Environmental Satellite, Data, and Information Service for archived data shall meet the following requirements:</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/100/685/tIV/s409/d/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">The initial schedule of fees established by the National Environmental Satellite, Data, and Information Service for archived data shall remain in effect for the 3-year period beginning on the date that the fees under that schedule take effect.</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/100/685/tIV/s409/d/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">With respect to the first one-year period during which the initial fee schedule is in effect, fees shall be assessed at no more than one-third of the fair market value specified in subsection (a).</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/100/685/tIV/s409/d/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">With respect to the second one-year period during which the initial fee schedule is in effect, fees shall be assessed at not more than two-thirds of such fair market value.</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/100/685/tIV/s409/d/4" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">With respect to the third one-year period during which the initial fee schedule is in effect, and with respect to any period thereafter, fees shall be assessed at no more than the full amount of such fair market value.</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/100/685/tIV/s409/e" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><content style="-uslm-dtd:text">Fees collected under this section by the National Environmental Satellite, Data, and Information Service for archived data shall be available to the National Environmental Satellite, Data, and Information Service for expenses incurred in the operation of its data archive centers.</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/100/685/tIV/s409/f" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="f">(f) </num><chapeau style="-uslm-dtd:text">The Secretary shall, not later than 90 days after the date of enactment of this Act, submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Science, Space, and Technology of the House of Representatives<ref style="-uslm-dtd:footnote-ref" idref="IDC0C7EAAA4FF74B8DAFEB4B86EECD249D" class="footnoteRef">2</ref> a report which sets forth—</chapeau><footnote id="IDC0C7EAAA4FF74B8DAFEB4B86EECD249D" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">2</sup><p style="-uslm-dtd:para; margin-left:1em">In accordance with section 1(a)(10) of Public Law 104–14 (109 Stat. 187), “<quotedText style="-uslm-dtd:quote">the Committee on Science, Space, and Technology of the House of Representatives shall be treated as referring to the Committee on Science of the House of Representatives</quotedText>”.</p></footnote>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/100/685/tIV/s409/f/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">any plan of the Secretary for assessing fees under this section by the National Environmental Satellite, Data, and Information Service for archived data, including the methodology and bases by which the amount of such fees shall be determined, and the estimated revenues therefrom; and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/100/685/tIV/s409/f/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">any plan of the Secretary for using revenues generated from such fees, as well as other resources, to improve the capability of the National Environmental Satellite, Data, and Information Service to collect, manage, process, archive, and disseminate the increasing amounts of data generated from satellites, radars, and other technologies.</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/100/685/tIV/s409/g" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="g">(g) </num><content style="-uslm-dtd:text">The authority of the Secretary to assess fees under this section shall be in addition to, and shall not be construed to limit, the authority under any other law to assess fees relating to the environmental data activities of the National Oceanic and Atmospheric Administration, including the authority of the Secretary pursuant to section 1307 of title 44, United States Code. Nothing in this section shall be construed to authorize the Secretary to assess fees for nautical and aeronautical products of the National Oceanic and Atmospheric Administration in addition to those fees authorized under section 1307 of title 44, United States Code.</content>
                </subsection>

        <title style="-uslm-dtd:title" identifier="/us/sComp/100/685/tV" styleType="traditional">
            <num style="-uslm-dtd:enum" value="V">TITLE V—</num><heading style="-uslm-dtd:header">NATIONAL SPACE COUNCIL </heading>
            <section style="-uslm-dtd:section" identifier="/us/sComp/100/685/tV/s501" styleType="traditional">
                <heading style="-uslm-dtd:header">national space council </heading>
                <num style="-uslm-dtd:enum" value="501">Sec. 501. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t42/s2471">42 U.S.C. 2471</ref><b>]</b> </editorialNote><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/100/685/tV/s501/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a) </num><content style="-uslm-dtd:text">Effective February 1, 1989, there is established in the Executive Office of the President the National Space Council, which shall be chaired by the Vice President.</content><footnote id="ID3E1DD30E2BF1466295430899AADB41A7" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">3</sup><p style="-uslm-dtd:para; margin-left:1em">This title was enacted as title V of the National Aeronautics and Space Administration Authorization Act, Fiscal Year 1989 (Public Law 100–685).</p></footnote></subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/100/685/tV/s501/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><content style="-uslm-dtd:text">By March 1, 1989, the President shall submit to the Congress a report that outlines the composition and functions of the National Space Council.</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/100/685/tV/s501/c" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><content style="-uslm-dtd:text">The Council may employ a staff of not more than seven persons, which is to be headed by a civilian executive secretary, who shall be appointed by the President.</content>
                </subsection>
