            <num style="-uslm-dtd:enum" value="VI">TITLE VI—</num><heading style="-uslm-dtd:header">NATIONAL EMERGENCY MANAGEMENT </heading>
            <section style="-uslm-dtd:section" identifier="/us/sComp/109/295/tVI/s601" styleType="OLC">
                <num style="-uslm-dtd:enum" value="601">SEC. 601. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t6/s701">6 U.S.C. 701 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
                <content style="-uslm-dtd:text" class="block">This title may be cited as the “<shortTitle style="-uslm-dtd:quote">Post-Katrina Emergency Management Reform Act of 2006</shortTitle>”.</content>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/109/295/tVI/s602" styleType="OLC" role="definitions">
                <num style="-uslm-dtd:enum" value="602">SEC. 602. </num><heading style="-uslm-dtd:header">DEFINITIONS. </heading>
                <chapeau style="-uslm-dtd:text" class="block">In this title—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/s602/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:quote">Administrator</term>” means the Administrator of
the Agency;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/s602/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:quote">Agency</term>” means the Federal Emergency
Management Agency;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/s602/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><chapeau style="-uslm-dtd:text">the term “<term style="-uslm-dtd:quote">appropriate committees of Congress</term>”means——</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/295/tVI/s602/3/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the Committee on Homeland Security and Governmental
Affairs of the Senate; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/295/tVI/s602/3/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">those committees of the House of Representatives
that the Speaker of the House of Representatives determines
appropriate;</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/s602/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:quote">catastrophic incident</term>” means any natural
disaster, act of terrorism, or other man-made disaster that
results in extraordinary levels of casualties or damage or
disruption severely affecting the population (including mass
evacuations), infrastructure, environment, economy, national
morale, or government functions in an area;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/s602/5" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:quote">Department</term>” means the Department of Homeland
Security;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/s602/6" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">the terms “<term style="-uslm-dtd:quote">emergency</term>” and “<term style="-uslm-dtd:quote">major disaster</term>” have the
meanings given the terms in section 102 of the Robert T.
Stafford Disaster Relief and Emergency Assistance Act (42
U.S.C. 5122);</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/s602/7" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:quote">emergency management</term>” means the governmental
function that coordinates and integrates all activities
necessary to build, sustain, and improve the capability to prepare
for, protect against, respond to, recover from, or mitigate
against threatened or actual natural disasters, acts of terrorism,
or other man-made disasters;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/s602/8" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="8">(8) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:quote">emergency response provider</term>” has the
meaning given the term in section 2 of the Homeland Security
Act of 2002 (6 U.S.C. 101), as amended by this Act;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/s602/9" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="9">(9) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:quote">Federal coordinating officer</term>” means a Federal
coordinating officer as described in section 302 of the Robert
T. Stafford Disaster Relief and Emergency Assistance Act (42
U.S.C. 5143);</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/s602/10" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="10">(10) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:quote">individual with a disability</term>” has the meaning
given the term in section 3 of the Americans with Disabilities
Act of 1990 (42 U.S.C. 12102);</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/s602/11" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="11">(11) </num><content style="-uslm-dtd:text">the terms “<term style="-uslm-dtd:quote">local government</term>” and “<term style="-uslm-dtd:quote">State</term>” have the
meaning given the terms in section 2 of the Homeland Security
Act of 2002 (6 U.S.C. 101);</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/s602/12" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="12">(12) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:quote">National Incident Management System</term>”
means a system to enable effective, efficient, and collaborative
incident management;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/s602/13" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="13">(13) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:quote">National Response Plan</term>” means the National
Response Plan or any successor plan prepared under section
502(a)(6) of the Homeland Security Act of 2002 (as amended
by this Act);</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/s602/14" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="14">(14) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:quote">Secretary</term>” means the Secretary of Homeland
Security;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/s602/15" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="15">(15) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:quote">surge capacity</term>” means the ability to rapidly
and substantially increase the provision of search and rescue
capabilities, food, water, medicine, shelter and housing, medical
care, evacuation capacity, staffing (including disaster assistance
employees), and other resources necessary to save lives and
protect property during a catastrophic incident; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/s602/16" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="16">(16) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:quote">tribal government</term>” means the government
of an Indian tribe or authorized tribal organization, or in Alaska
a Native village or Alaska Regional Native Corporation.</content>

                </paragraph>
            </section>
            <subtitle style="-uslm-dtd:subtitle" identifier="/us/sComp/109/295/tVI/stC" styleType="OLC">
                <num style="-uslm-dtd:enum" value="C">Subtitle C—</num><heading style="-uslm-dtd:header">Comprehensive Preparedness System </heading>
                <chapter style="-uslm-dtd:chapter" identifier="/us/sComp/109/295/tVI/stC/ch1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">CHAPTER 1—</num><heading style="-uslm-dtd:header">NATIONAL PREPAREDNESS SYSTEM
                    <elided style="-uslm-dtd:omitted-text">* * * * * * *</elided> </heading>
                    <section style="-uslm-dtd:section" identifier="/us/sComp/109/295/tVI/stC/ch1/s648" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="648">SEC. 648. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t6/s748">6 U.S.C. 748</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">TRAINING AND EXERCISES. </heading>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/295/tVI/stC/ch1/s648/a" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">National Training Program.—</heading>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s648/a/1" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Beginning not later than 180 days after the date of enactment of this Act, the Administrator, in coordination with the heads of appropriate Federal agencies, the National Council on Disability, and the National Advisory Council, shall carry out a national training program to implement the national preparedness goal, National Incident Management System, National Response Plan, and other related plans and strategies.</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s648/a/2" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Training partners.—</heading><chapeau style="-uslm-dtd:text">In developing and implementing the national training program, the Administrator shall—</chapeau>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s648/a/2/A" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">work with government training facilities, academic institutions, private organizations, and other entities that provide specialized, state-of-the-art training for emergency managers or emergency response providers; and</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s648/a/2/B" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">utilize, as appropriate, training courses provided by community colleges, State and local public safety academies, State and private universities, and other facilities.</content>
                                </subparagraph>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/295/tVI/stC/ch1/s648/b" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">National Exercise Program.—</heading>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s648/b/1" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Beginning not later than 180 days after the date of enactment of this Act, the Administrator, in coordination with the heads of appropriate Federal agencies, the National Council on Disability, and the National Advisory Council, shall carry out a national exercise program to test and evaluate the national preparedness goal, National Incident Management System, National Response Plan, and other related plans and strategies.</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s648/b/2" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Requirements.—</heading><chapeau style="-uslm-dtd:text">The national exercise program—</chapeau>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s648/b/2/A" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">(A) </num><chapeau style="-uslm-dtd:text">shall be—</chapeau>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/109/295/tVI/stC/ch1/s648/b/2/A/i" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">as realistic as practicable, based on current risk assessments, including credible and emerging threats, vulnerabilities, and consequences, and designed to stress the national preparedness system;</content>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/109/295/tVI/stC/ch1/s648/b/2/A/ii" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">designed, as practicable, to simulate the partial or complete incapacitation of a State, local, or tribal government;</content>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/109/295/tVI/stC/ch1/s648/b/2/A/iii" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">carried out, as appropriate, with a minimum degree of notice to involved parties regarding the timing and details of such exercises, consistent with safety considerations;</content>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/109/295/tVI/stC/ch1/s648/b/2/A/iv" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">designed to provide for the systematic evaluation of readiness and enhance operational understanding of the incident command system and relevant mutual aid agreements;</content>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/109/295/tVI/stC/ch1/s648/b/2/A/v" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="v">(v) </num><content style="-uslm-dtd:text">designed to address the unique requirements of populations with special needs, including the elderly; and</content>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/109/295/tVI/stC/ch1/s648/b/2/A/vi" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="vi">(vi) </num><content style="-uslm-dtd:text">designed to promptly develop after-action reports and plans for quickly incorporating lessons learned into future operations; and</content>
                                    </clause>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s648/b/2/B" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">shall include a selection of model exercises that State, local, and tribal governments can readily adapt for use and provide assistance to State, local, and tribal governments with the design, implementation, and evaluation of exercises (whether a model exercise program or an exercise designed locally) that—</chapeau>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/109/295/tVI/stC/ch1/s648/b/2/B/i" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">conform to the requirements under subparagraph (A);</content>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/109/295/tVI/stC/ch1/s648/b/2/B/ii" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">are consistent with any applicable State, local, or tribal strategy or plan; and</content>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/109/295/tVI/stC/ch1/s648/b/2/B/iii" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">provide for systematic evaluation of readiness.</content>
                                    </clause>
                                </subparagraph>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s648/b/3" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">National level exercises.—</heading><chapeau style="-uslm-dtd:text">The Administrator shall periodically, but not less than biennially, perform national exercises for the following purposes:</chapeau>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s648/b/3/A" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">To test and evaluate the capability of Federal, State, local, and tribal governments to detect, disrupt, and prevent threatened or actual catastrophic acts of terrorism, especially those involving weapons of mass destruction.</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s648/b/3/B" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">To test and evaluate the readiness of Federal, State, local, and tribal governments to respond and recover in a coordinated and unified manner to catastrophic incidents.</content>
                                </subparagraph>
                            </paragraph>
                        </subsection>
                    </section>
                    <section style="-uslm-dtd:section" identifier="/us/sComp/109/295/tVI/stC/ch1/s650" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="650">SEC. 650. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t6/s750">6 U.S.C. 750</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">REMEDIAL ACTION MANAGEMENT PROGRAM. </heading>
                        <chapeau style="-uslm-dtd:text" class="block">The Administrator, in coordination with the National Council on Disability and the National Advisory Council, shall establish a remedial action management program to—</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s650/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">analyze training, exercises, and real-world events to identify and disseminate lessons learned and best practices;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s650/2" styleType="OLC">

                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s650/3" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">conduct remedial action tracking and long-term trend analysis.</content>
                        </paragraph>

                        <num style="-uslm-dtd:enum" value="653">SEC. 653. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t6/s753">6 U.S.C. 753</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">FEDERAL PREPAREDNESS. </heading>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/a" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Agency responsibility.—</heading><chapeau style="-uslm-dtd:text">In support of the national preparedness system, the President shall ensure that each Federal agency with responsibilities under the National Response Plan—</chapeau>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/a/1" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">has the operational capability to meet the national preparedness goal, including—</chapeau>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/a/1/A" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the personnel to make and communicate decisions;</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/a/1/B" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">organizational structures that are assigned, trained, and exercised for the missions of the agency;</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/a/1/C" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">sufficient physical resources; and</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/a/1/D" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">the command, control, and communication channels to make, monitor, and communicate decisions;</content>
                                </subparagraph>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/a/2" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">complies with the National Incident Management System, including credentialing of personnel and typing of resources likely needed to respond to a natural disaster, act of terrorism, or other man-made disaster in accordance with section 510 of the Homeland Security Act of 2002 (6 U.S.C. 320);</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/a/3" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">develops, trains, and exercises rosters of response personnel to be deployed when the agency is called upon to support a Federal response; </content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/a/4" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">develops deliberate operational plans and the corresponding capabilities, including crisis planning, to respond effectively to natural disasters, acts of terrorism, and other man-made disasters in support of the National Response Plan to ensure a coordinated Federal response; and</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/a/5" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">regularly updates, verifies the accuracy of, and provides to the Administrator the information in the inventory required under section 651.</content>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/b" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Operational plans.—</heading><chapeau style="-uslm-dtd:text">An operations plan developed under subsection (a)(4) shall meet the following requirements:</chapeau>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/b/1" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">The operations plan shall be coordinated under a unified system with a common terminology, approach, and framework.</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/b/2" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">The operations plan shall be developed, in coordination with State, local, and tribal government officials, to address both regional and national risks.</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/b/3" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="3">(3) </num><chapeau style="-uslm-dtd:text">The operations plan shall contain, as appropriate, the following elements:</chapeau>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/b/3/A" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">Concepts of operations.</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/b/3/B" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">Critical tasks and responsibilities.</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/b/3/C" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">Detailed resource and personnel requirements, together with sourcing requirements.</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/b/3/D" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">Specific provisions for the rapid integration of the resources and personnel of the agency into the overall response.</content>
                                </subparagraph>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/b/4" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="4">(4) </num><chapeau style="-uslm-dtd:text">The operations plan shall address, as appropriate, the following matters:</chapeau>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/b/4/A" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">(A) </num><chapeau style="-uslm-dtd:text">Support of State, local, and tribal governments in conducting mass evacuations, including—</chapeau>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/b/4/A/i" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">transportation and relocation;</content>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/b/4/A/ii" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">short- and long-term sheltering and accommodation;</content>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/b/4/A/iii" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">provisions for populations with special needs, keeping families together, and expeditious location of missing children; and</content>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/b/4/A/iv" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">policies and provisions for pets.</content>
                                    </clause>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/b/4/B" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">The preparedness and deployment of public health and medical resources, including resources to address the needs of evacuees and populations with special needs.</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/b/4/C" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">The coordination of interagency search and rescue operations, including land, water, and airborne search and rescue operations.</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/b/4/D" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">The roles and responsibilities of the Senior Federal Law Enforcement Official with respect to other law enforcement entities.</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/b/4/E" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">The protection of critical infrastructure.</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/b/4/F" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">The coordination of maritime salvage efforts among relevant agencies.</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/b/4/G" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="G">(G) </num><content style="-uslm-dtd:text">The coordination of Department of Defense and National Guard support of civilian authorities.</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/b/4/H" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="H">(H) </num><content style="-uslm-dtd:text">To the extent practicable, the utilization of Department of Defense, National Air and Space Administration, National Oceanic and Atmospheric Administration, and commercial aircraft and satellite remotely sensed imagery.</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/b/4/I" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">The coordination and integration of support from the private sector and nongovernmental organizations.</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/b/4/J" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="J">(J) </num><content style="-uslm-dtd:text">The safe disposal of debris, including hazardous materials, and, when practicable, the recycling of debris.</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/b/4/K" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="K">(K) </num><content style="-uslm-dtd:text">The identification of the required surge capacity.</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/b/4/L" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="L">(L) </num><content style="-uslm-dtd:text">Specific provisions for the recovery of affected geographic areas.</content>
                                </subparagraph>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/c" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Mission assignments.—</heading><content style="-uslm-dtd:text">To expedite the provision of assistance under the National Response Plan, the President shall ensure that the Administrator, in coordination with Federal agencies with responsibilities under the National Response Plan, develops prescripted mission assignments, including logistics, communications, mass care, health services, and public safety.</content>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/d" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Certification.—</heading><content style="-uslm-dtd:text">The President shall certify to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Homeland Security and the Committee on Transportation and Infrastructure of the House of Representatives on an annual basis that each Federal agency with responsibilities under the National Response Plan complies with subsections (a) and (b).</content>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/e" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Construction.—</heading><chapeau style="-uslm-dtd:text">Nothing in this section shall be construed to limit the authority of the Secretary of Defense with regard to—</chapeau>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/e/1" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the command, control, training, planning, equipment, exercises, or employment of Department of Defense forces; or</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/stC/ch1/s653/e/2" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the allocation of Department of Defense resources.</content>
                            </paragraph>
                        </subsection>

                    <num style="-uslm-dtd:enum" value="2">CHAPTER 2—</num><heading style="-uslm-dtd:header">ADDITIONAL PREPAREDNESS </heading>
                    <section style="-uslm-dtd:section" identifier="/us/sComp/109/295/tVI/stC/ch2/s661" styleType="appropriation">
                        <num style="-uslm-dtd:enum" value="661">SEC. 661. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t6/s761">6 U.S.C. 761</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">EMERGENCY MANAGEMENT ASSISTANCE COMPACT GRANTS. </heading>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/295/tVI/stC/ch2/s661/a" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">The Administrator may make grants to administer the Emergency Management Assistance Compact consented to by the Joint Resolution entitled “<quotedText style="-uslm-dtd:quote">Joint Resolution granting the consent of Congress to the Emergency Management Assistance Compact</quotedText>” (Public Law 104-321; 110 Stat. 3877).</content>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/295/tVI/stC/ch2/s661/b" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Uses.—</heading><chapeau style="-uslm-dtd:text">A grant under this section shall be used—</chapeau>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/stC/ch2/s661/b/1" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">to carry out recommendations identified in the Emergency Management Assistance Compact after-action reports for the 2004 and 2005 hurricane season;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/stC/ch2/s661/b/2" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">to administer compact operations on behalf of all member States and territories;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/stC/ch2/s661/b/3" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">to continue coordination with the Agency and appropriate Federal agencies;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/stC/ch2/s661/b/4" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">to continue coordination with State, local, and tribal government entities and their respective national organizations; and</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/stC/ch2/s661/b/5" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">to assist State and local governments, emergency response providers, and organizations representing such providers with credentialing emergency response providers and the typing of emergency response resources.</content>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/295/tVI/stC/ch2/s661/c" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Coordination.—</heading><content style="-uslm-dtd:text">The Administrator shall consult with the Administrator of the Emergency Management Assistance Compact  to ensure effective coordination of efforts in responding to requests for assistance.</content>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/295/tVI/stC/ch2/s661/d" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Authorization.—</heading><content style="-uslm-dtd:text">There is authorized to be appropriated to carry out this section $4,000,000 for each of fiscal years 2018 through 2022. Such sums shall remain available until expended.</content>
                        </subsection>
                    </section>
                    <section style="-uslm-dtd:section" identifier="/us/sComp/109/295/tVI/stC/ch2/s662" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="662">SEC. 662. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t6/s762">6 U.S.C. 762</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">EMERGENCY MANAGEMENT PERFORMANCE GRANTS PROGRAM </heading>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/295/tVI/stC/ch2/s662/a" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Definitions.—</heading><chapeau style="-uslm-dtd:text">In this section—</chapeau>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/stC/ch2/s662/a/1" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the term “<quotedText style="-uslm-dtd:quote">program</quotedText>” means the emergency management performance grants program described in subsection (b); and</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/stC/ch2/s662/a/2" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the term “<quotedText style="-uslm-dtd:quote">State</quotedText>” has the meaning given that term in section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5122).</content>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/295/tVI/stC/ch2/s662/b" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Administrator of the Federal Emergency Management Agency shall continue implementation of an emergency management performance grants program, to make grants    to States to assist State, local, and tribal governments in preparing for all hazards, as authorized by the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5121 et seq.).</content>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/295/tVI/stC/ch2/s662/c" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Federal Share.—</heading><content style="-uslm-dtd:text">Except as otherwise specifically provided by title VI of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5121 et seq.), the Federal share of the cost of an activity carried out using funds made available under the program shall not exceed 50 percent.</content>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/295/tVI/stC/ch2/s662/d" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Apportionment.—</heading><chapeau style="-uslm-dtd:text">For fiscal year 2008, and each fiscal year thereafter, the Administrator shall apportion the amounts appropriated to carry out the program among the States as follows:</chapeau>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/stC/ch2/s662/d/1" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Baseline amount.—</heading><content style="-uslm-dtd:text">The Administrator shall first apportion 0.25 percent of such amounts to each of American Samoa, the Commonwealth of the Northern Mariana Islands, Guam, and the Virgin Islands and 0.75 percent of such amounts to each of the remaining States.</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/stC/ch2/s662/d/2" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Remainder.—</heading><chapeau style="-uslm-dtd:text">The Administrator shall apportion the remainder of such amounts in the ratio that—</chapeau>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/295/tVI/stC/ch2/s662/d/2/A" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the population of each State; bears to</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/109/295/tVI/stC/ch2/s662/d/2/B" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the population of all States.</content>
                                </subparagraph>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/295/tVI/stC/ch2/s662/e" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Consistency in Allocation.—</heading><content style="-uslm-dtd:text">Notwithstanding subsection (d), in any fiscal year before fiscal year 2013 in which the appropriation for grants under this section is equal to or greater than the appropriation for emergency management performance grants in fiscal year 2007, no State shall receive an amount under this section for that fiscal year less than the amount that State received in fiscal year 2007.</content>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/109/295/tVI/stC/ch2/s662/f" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Authorization of Appropriations.—</heading><content style="-uslm-dtd:text">There is authorized to be appropriated to carry out the program, for each of fiscal years 2018 through 2022, $950,000,000.</content>

                    <num style="-uslm-dtd:enum" value="699">SEC. 699. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t6/s811">6 U.S.C. 811</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">AUTHORIZATION OF APPROPRIATIONS. </heading>
                    <chapeau style="-uslm-dtd:text" class="block">There are authorized to be appropriated to carry out this title and the amendments made by this title for the administration and operations of the Agency—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/stG/s699/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">for fiscal year 2008, an amount equal to the amount appropriated for fiscal year 2007 for administration and operations of the Agency, multiplied by 1.1;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/stG/s699/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">for fiscal year 2009, an amount equal to the amount described in paragraph (1), multiplied by 1.1; and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/109/295/tVI/stG/s699/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">for fiscal year 2010, an amount equal to the amount described in paragraph (2), multiplied by 1.1.</content>
