        <section style="-uslm-dtd:section" identifier="/us/sComp/100/203/s5106" styleType="OLC">
            <num style="-uslm-dtd:enum" value="5106">SEC. 5106. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t30/s226">30 U.S.C. 226 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">PENDING APPLICATIONS, OFFERS, AND BIDS. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/100/203/s5106/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><content style="-uslm-dtd:text">Notwithstanding any other provision of this subtitle and except as provided in subsection (b) of this section, all noncompetitive oil and gas lease applications and offers and competitive oil and gas bids pending on the date of enactment of this Act shall be processed, and leases shall be issued under the provisions of the Act of February 25, 1920, as in effect before its amendment by this Act, except where the issuance of any such lease would not be lawful under such provisions or other applicable law.</content><footnote id="IDA4A38A5BC24E424B825F23B3EA870DCA" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">1</sup><p style="-uslm-dtd:para; margin-left:1em">Enacted as Title V of Public Law 100–203, the Budget Reconciliation Act of 1987.</p></footnote>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/100/203/s5106/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><content style="-uslm-dtd:text">No noncompetitive lease applications or offers pending on the date of enactment of this Act for lands within the Shawnee National Forest, Illinois; the Ouachita National Forest, Arkansas; Fort Chaffee, Arkansas; or Elgin Air Force Base, Florida; shall be processed until these lands are posted for competitive bidding in accordance with section 5102 of this subtitle. If any such tract does not receive a bid equal to or greater than the national minimum acceptable bid from a responsible qualified bidder then the noncompetitive applications or offers pending for such a tract shall be reinstated and noncompetitve leases issued under the Act of February 25, 1920, as in effect before its amendment by this subtitle, except where the issuance of any such lease would not be lawful under such provisions of other applicable law. If competitive leases are issued for any such tract, then the pending noncompetitive application or offer shall be rejected.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/100/203/s5106/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><content style="-uslm-dtd:text">Except as provided in subsections (a) and (b) of this section, all oil and gas leasing pursuant to the Act of February 25, 1920, after the date of enactment of this Act shall be conducted in accordance with the provisions of this subtitle.</content>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/100/203/s5107" styleType="OLC">
            <num style="-uslm-dtd:enum" value="5107">SEC. 5107. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t30/s226">30 U.S.C. 226 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">REGULATIONS; TEST SALE. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/100/203/s5107/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Regulations.—</heading><content style="-uslm-dtd:text">The Secretary shall issue final regulations to implement this subtitle within 180 days after the enactment of this Act. The regulations shall be effective when published in the Federal Register.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/100/203/s5107/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Treatment Under Other Law.—</heading><content style="-uslm-dtd:text">The proposal or promulgation of such regulations shall not be considered a major Federal action subject to the requirements of section 102(2)(C) of the National Environmental Policy Act of 1969.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/100/203/s5107/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Test Sale.—</heading><content style="-uslm-dtd:text">The Secretary may hold one or more lease sales conducted in accordance with the amendments made by this subtitle before promulgation of regulations referred to in subsection (a). Sale procedures for such sale shall be established in the notice of sale.</content>
            </subsection>
        </section>

        <section style="-uslm-dtd:section" identifier="/us/sComp/100/203/s5062" styleType="OLC">
            <num style="-uslm-dtd:enum" value="5062">SEC. 5062. </num><heading style="-uslm-dtd:header">TRANSPORTATION OF PLUTONIUM BY AIRCRAFT THROUGH UNITED STATES AIR SPACE. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/100/203/s5062/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">Notwithstanding any other provision of law, no form of plutonium may be transported by aircraft through the air space of the United States from a foreign nation to a foreign nation unless the Nuclear Regulatory Commission has certified to Congress that the container in which such plutonium is transported is safe, as determined in accordance with subsection (b), the second undesignated paragraph under section 201 of Public Law 94–79 (89 Stat. 413; 42 U.S.C. 5841 note), and all other applicable laws.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/100/203/s5062/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Responsibilities of the Nuclear Regulatory Commission.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/100/203/s5062/b/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Determination of safety.—</heading><content style="-uslm-dtd:text">The Nuclear Regulatory Commission shall determine whether the container referred to in subsection (a) is safe for use in the transportation of plutonium by aircraft and transmit to Congress a certification for the purposes of such subsection in the case of each container determined to be safe.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/100/203/s5062/b/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Testing.—</heading><chapeau style="-uslm-dtd:text">In order to make a determination with respect to a container under paragraph (1), the Nuclear Regulatory Commission shall—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/100/203/s5062/b/2/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">require an actual drop test from maximum cruising altitude of a full-scale sample of such container loaded with test materials; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/100/203/s5062/b/2/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">require an actual crash test of a cargo aircraft fully loaded with full-scale samples of such container loaded with test material unless the Commission determines, after consultation with an independent scientific review panel, that the stresses on the container produced by other tests used in developing the container exceed the stresses which would occur during a worst case plutonium air shipment accident.</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/100/203/s5062/b/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Limitation.—</heading><content style="-uslm-dtd:text">The Nuclear Regulatory Commission may not certify under this section that a container is safe for use in the transportation of plutonium by aircraft if the container ruptured or released its contents during testing conducted in accordance with paragraph (2).</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/100/203/s5062/b/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Evaluation.—</heading><content style="-uslm-dtd:text">The Nuclear Regulatory Commission shall evaluate the container certification required by title II of the Energy Reorganization Act of 1974 (42 U.S.C. 5841 et seq.) and subsection (a) in accordance with the National Environmental Policy Act of 1969 (83 Stat. 852; 42 U.S.C. 4321 et seq.) and all other applicable law.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/100/203/s5062/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Content of Certification.—</heading><chapeau style="-uslm-dtd:text">A certification referred to in subsection (a) with respect to a container shall include—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/100/203/s5062/c/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the determination of the Nuclear Regulatory Commission as to the safety of such container;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/100/203/s5062/c/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">a statement that the requirements of subsection (b)(2) were satisfied in the testing of such container; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/100/203/s5062/c/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">a statement that the container did not rupture or release its contents into the environment during testing.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/100/203/s5062/d" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Design of Testing Procedures.—</heading><content style="-uslm-dtd:text">The tests required by subsection (b) shall be designed by the Nuclear Regulatory Commission to replicate actual worst case transportation conditions to the maximum extent practicable. In designing such tests, the Commission shall provide for public notice of the proposed test procedures, provide a reasonable opportunity for public comment on such procedures, and consider such comments, if any.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/100/203/s5062/e" styleType="OLC">
                <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Testing Results: Reports and Public Disclosure.—</heading><content style="-uslm-dtd:text">The Nuclear Regulatory Commission shall transmit to Congress a report on the results of each test conducted under this section and shall make such results available to the public.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/100/203/s5062/f" styleType="OLC">
                <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Alternative Routes and Means of Transportation.—</heading><content style="-uslm-dtd:text">With respect to any shipments of plutonium from a foreign nation to a foreign nation which are subject to United States consent rights contained in an Agreement for Peaceful Nuclear Cooperation, the President is authorized to make every effort to pursue and conclude arrangements for alternative routes and means of transportation, including sea shipment. All such arrangements shall be subject to stringent physical security conditions, and other conditions designed to protect the public health and safety, and provisions of this section, and all other applicable laws.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/100/203/s5062/g" styleType="OLC">
                <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Inapplicability to Medical Devices.—</heading><content style="-uslm-dtd:text">Subsections (a) through (e) shall not apply with respect to plutonium in any form contained in a medical device designed for individual human application.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/100/203/s5062/h" styleType="OLC">
                <num style="-uslm-dtd:enum" value="h">(h) </num><heading style="-uslm-dtd:header">Inapplicability to Military Uses.—</heading><content style="-uslm-dtd:text">Subsections (a) through (e) shall not apply to plutonium in the form of nuclear weapons nor to other shipments of plutonium determined by the Department of Energy to be directly connected with the United States national security or defense programs.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/100/203/s5062/i" styleType="OLC">
                <num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">Inapplicability to Previously Certified Containers.—</heading><content style="-uslm-dtd:text">This section shall not apply to any containers for the shipment of plutonium previously certified as safe by the Nuclear Regulatory Commission under Public Law 94–79 (89 Stat. 413; 42 U.S.C. 5841 note).</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/100/203/s5062/j" styleType="OLC">
                <num style="-uslm-dtd:enum" value="j">(j) </num><heading style="-uslm-dtd:header">Payment of Costs.—</heading><content style="-uslm-dtd:text">All costs incurred by the Nuclear Regulatory Commission associated with the testing program required by this section, and administrative costs related thereto, shall be reimbursed to the Nuclear Regulatory Commission by any foreign country receiving plutonium shipped through United States airspace in containers specified by the Commission.</content>
            </subsection><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t42/s5841">42 U.S.C. 5841 note</ref><b>]</b> </editorialNote>
        </section>
