    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">Authorizing the construction, repair, and preservation of certain public works on rivers and harbors for navigation, flood control, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

        <title identifier="/us/sComp/85/500/tI" style="-uslm-dtd:title" styleType="traditional">
            <num style="-uslm-dtd:enum" value="I">TITLE I—</num><heading style="-uslm-dtd:header">RIVERS AND HARBORS </heading>
            <elided style="-uslm-dtd:omitted-text">* * * * * * *</elided>
            <section identifier="/us/sComp/85/500/tI/s104" style="-uslm-dtd:section" styleType="traditional">
                <num style="-uslm-dtd:enum" value="104">Sec. 104. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s610">33 U.S.C. 610</ref><b>]</b> </editorialNote><subsection class="inline" identifier="/us/sComp/85/500/tI/s104/a" style="-uslm-dtd:subsection" styleType="OLC"><num style="-uslm-dtd:enum" value="a">(a) </num>
                <paragraph identifier="/us/sComp/85/500/tI/s104/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">There is hereby authorized a comprehensive program to provide for prevention, control, and progressive<ref class="footnoteRef" idref="ID31D9A1634F494AE088805D9EAAFF3A84" style="-uslm-dtd:footnote-ref">1</ref> eradication of noxious aquatic plant growths and aquatic invasive species from the navigable waters, tributary streams, connecting channels, and other allied waters of the United States, in the combined interest of navigation, flood control, drainage, agriculture, fish and wildlife conservation, public health, and related purposes, including continued research for development of the most effective and economic control measures, to be administered by the Chief of Engineers, under the direction of the Secretary of the Army, in cooperation with other Federal and State agencies. </content>
                </paragraph>
                <paragraph identifier="/us/sComp/85/500/tI/s104/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Local interests.—</heading><content style="-uslm-dtd:text">Local interests shall agree to hold and save the United States free from claims that may occur from control operations and to participate to the extent of 30 per centum of the cost of such operations. </content>
                </paragraph>
                <paragraph identifier="/us/sComp/85/500/tI/s104/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Federal costs.—</heading><content style="-uslm-dtd:text">Costs for research and planning undertaken pursuant to the authorities of this section shall be borne fully by the Federal Government.</content>
                </paragraph><footnote id="ID31D9A1634F494AE088805D9EAAFF3A84" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">1</sup><p style="-uslm-dtd:para; margin-left:1em">The amendment to strike “<quotedText style="-uslm-dtd:quote">control and progressive,</quotedText>” and insert “<quotedText style="-uslm-dtd:quote">prevention, control, and progressive</quotedText>” made by section 1039(d)(1)(D)(i) of Public Law 113–121 was executed by striking “<quotedText style="-uslm-dtd:quote">control and progressive</quotedText>” and inserting the new language to effectuate the probable intent of Congress. </p></footnote></subsection>
                <subsection identifier="/us/sComp/85/500/tI/s104/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Authorization of Appropriations.—</heading>
                    <paragraph identifier="/us/sComp/85/500/tI/s104/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">There is authorized to be appropriated to carry out this section (except for subsections (f) and (g)) $130,000,000 for each fiscal year, of which—</chapeau>
                        <subparagraph identifier="/us/sComp/85/500/tI/s104/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">$30,000,000 shall be made available to carry out subsection (d)(1)(A)(i);</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/85/500/tI/s104/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">$30,000,000 shall be made available to carry out subsection (d)(1)(A)(ii); </content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/85/500/tI/s104/b/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">$30,000,000 shall be made available to carry out subsection (d)(1)(A)(iii);</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/85/500/tI/s104/b/1/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text"> $30,000,000 shall be made available to carry out subsection (d)(1)(A)(iv); and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/85/500/tI/s104/b/1/E" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text"> $10,000,000 shall be made available to carry out subsection (d)(1)(A)(v).</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/85/500/tI/s104/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Other programs.—</heading>
                        <subparagraph identifier="/us/sComp/85/500/tI/s104/b/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">There are authorized to be appropriated—</chapeau>
                            <clause identifier="/us/sComp/85/500/tI/s104/b/2/A/i" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text"> $10,000,000 for each of fiscal years 2025 through 2029 to carry out subsection (f); and</content>
                            </clause>
                            <clause identifier="/us/sComp/85/500/tI/s104/b/2/A/ii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">$75,000,000 for each of fiscal years 2021 through 2029 to carry out subsection (g)(2).</content>
                            </clause>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/85/500/tI/s104/b/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Invasive plant species pilot program.—</heading><content style="-uslm-dtd:text">There is authorized to be appropriated to the Secretary of the Interior, acting through the Director of the United States Fish and Wildlife Service, $10,000,000 to carry out subsection (g)(3).</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/85/500/tI/s104/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Control operations.—</heading><content style="-uslm-dtd:text">Any funds made available under paragraph (1) or (2)(A) to be used for control operations shall be allocated by the Chief of Engineers on a priority basis, based on the urgency and need of each area and the availability of local funds.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/85/500/tI/s104/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Support.—</heading><content style="-uslm-dtd:text">In carrying out the program under this section,
 the Secretary is encouraged to use contracts, cooperative agreements, and grants with colleges and universities and other non-
Federal entities.</content>
                </subsection>
                <subsection identifier="/us/sComp/85/500/tI/s104/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Watercraft Inspection and Decontamination Stations.—</heading>
                    <paragraph identifier="/us/sComp/85/500/tI/s104/d/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading>
                        <subparagraph identifier="/us/sComp/85/500/tI/s104/d/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Watercraft inspection and decontamination stations.—</heading><chapeau style="-uslm-dtd:text">In carrying out this section, the Secretary shall establish (as applicable), operate, and maintain new or existing watercraft inspection and decontamination stations—</chapeau>
                            <clause identifier="/us/sComp/85/500/tI/s104/d/1/A/i" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">to protect the Columbia River Basin;</content>
                            </clause>
                            <clause identifier="/us/sComp/85/500/tI/s104/d/1/A/ii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">to protect the Upper Missouri River Basin; </content>
                            </clause>
                            <clause identifier="/us/sComp/85/500/tI/s104/d/1/A/iii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">to protect the Upper Colorado River Basin and the South Platte and Arkansas River Basins;</content>
                            </clause>
                            <clause identifier="/us/sComp/85/500/tI/s104/d/1/A/iv" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">to protect the Russian River Basin, California; and</content>
                            </clause>
                            <clause identifier="/us/sComp/85/500/tI/s104/d/1/A/v" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="v">(v) </num><content style="-uslm-dtd:text">to protect basins and watersheds that adjoin an international border between the United States and Canada.</content>
                            </clause>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/85/500/tI/s104/d/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Locations.—</heading><content style="-uslm-dtd:text">The Secretary shall place watercraft inspection and decontamination stations under subparagraph (A) at locations with the highest likelihood of preventing the spread of aquatic invasive species into and out of waters of the United States, as determined by the Secretary in consultation with the Governors and entities described in paragraph (3).</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/85/500/tI/s104/d/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Rapid response.—</heading><content style="-uslm-dtd:text">The Secretary shall assist States within the areas described in subparagraph (A) with rapid
 response to any aquatic invasive species, including quagga or zebra
 mussel, infestation.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/85/500/tI/s104/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Cost share.—</heading><chapeau style="-uslm-dtd:text">The non-Federal share of the cost of constructing, operating, and maintaining watercraft inspection and decontamination stations described in paragraph (1) (including personnel costs) shall be—</chapeau>
                        <subparagraph identifier="/us/sComp/85/500/tI/s104/d/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">35 percent; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/85/500/tI/s104/d/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">provided by the State or local governmental entity in which such inspection station is located.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/85/500/tI/s104/d/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Coordination.—</heading><chapeau style="-uslm-dtd:text">In carrying out this subsection, the Secretary shall consult and coordinate with—</chapeau>
                        <subparagraph identifier="/us/sComp/85/500/tI/s104/d/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the Governors of the States within the areas described in each of clauses (i) through (v) of paragraph (1)(A), as applicable;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/85/500/tI/s104/d/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">Indian tribes; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/85/500/tI/s104/d/3/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><chapeau style="-uslm-dtd:text">other Federal agencies, including—</chapeau>
                            <clause identifier="/us/sComp/85/500/tI/s104/d/3/C/i" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the Department of Agriculture;</content>
                            </clause>
                            <clause identifier="/us/sComp/85/500/tI/s104/d/3/C/ii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the Department of Energy;</content>
                            </clause>
                            <clause identifier="/us/sComp/85/500/tI/s104/d/3/C/iii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">the Department of Homeland Security;</content>
                            </clause>
                            <clause identifier="/us/sComp/85/500/tI/s104/d/3/C/iv" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">the Department of Commerce; and</content>
                            </clause>
                            <clause identifier="/us/sComp/85/500/tI/s104/d/3/C/v" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="v">(v) </num><content style="-uslm-dtd:text">the Department of the Interior.</content>
                            </clause>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/85/500/tI/s104/e" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Monitoring and Contingency Planning.—</heading><chapeau style="-uslm-dtd:text">In carrying out this section, the Secretary may—</chapeau>
                    <paragraph identifier="/us/sComp/85/500/tI/s104/e/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">carry out risk assessments of water resources facilities;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/85/500/tI/s104/e/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">monitor for aquatic invasive species;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/85/500/tI/s104/e/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">assist States in early detection of, and monitoring and contingency planning for, aquatic invasive species, including quagga and zebra mussels; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/85/500/tI/s104/e/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">monitor water quality, including sediment cores and fish tissue samples.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/85/500/tI/s104/f" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Invasive Species Management Pilot Program.—</heading>
                    <paragraph identifier="/us/sComp/85/500/tI/s104/f/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Definition of invasive species.—</heading><content style="-uslm-dtd:text">In this subsection, the term “<term style="-uslm-dtd:term">invasive species</term>” has the meaning given the term in section 1 of Executive Order 13112 (64 Fed. Reg. 6183; relating to invasive species (February 3, 1999)) (as amended by section 2 of Executive Order 13751 (81 Fed. Reg. 88609; relating to safeguarding the Nation from the impacts of invasive species (December 5, 2016))).</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/85/500/tI/s104/f/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Development of plans.—</heading><content style="-uslm-dtd:text">The Secretary, in coordination with the Aquatic Nuisance Species Task Force, shall carry out a pilot program under which the Secretary shall collaborate with States in the Upper Missouri River Basin in developing voluntary aquatic invasive species management plans to mitigate the effects of invasive species on public infrastructure facilities located on reservoirs of the Corps of Engineers in those States.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/85/500/tI/s104/f/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Management plan.—</heading>
                        <subparagraph identifier="/us/sComp/85/500/tI/s104/f/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">The Secretary, in consultation with the Governor of each State in the Upper Missouri River Basin that elects to participate in the pilot program, shall prepare a management plan, or update or expand an existing plan, for each participating State that identifies public infrastructure facilities located on reservoirs of the Corps of Engineers in those States that—</chapeau>
                            <clause identifier="/us/sComp/85/500/tI/s104/f/3/A/i" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">are affected by aquatic invasive species; and</content>
                            </clause>
                            <clause identifier="/us/sComp/85/500/tI/s104/f/3/A/ii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">need financial and technical assistance in order to maintain operations.</content>
                            </clause>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/85/500/tI/s104/f/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Use of existing plans.—</heading><content style="-uslm-dtd:text">In developing a management plan under subparagraph (A), the Secretary shall consider a management plan submitted by a participating State under section 1204(a) of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (16 U.S.C. 4724(a)).</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/85/500/tI/s104/f/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Termination of authority.—</heading><content style="-uslm-dtd:text">The authority provided under this subsection shall terminate on September 30, 2028.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/85/500/tI/s104/g" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Invasive Species Prevention, Control, and Eradication.—</heading>
                    <paragraph identifier="/us/sComp/85/500/tI/s104/g/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Definition of invasive species.—</heading><content style="-uslm-dtd:text">In this subsection, the term “<term style="-uslm-dtd:term">invasive species</term>” has the meaning given the term in section 1 of Executive Order 13112 (64 Fed. Reg. 6183; relating to invasive species (February 3, 1999)) (as amended by section 2 of Executive Order 13751 (81 Fed. Reg. 88609; relating to safeguarding the Nation from the impacts of invasive species (December 5, 2016))).</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/85/500/tI/s104/g/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Invasive species partnerships.—</heading>
                        <subparagraph identifier="/us/sComp/85/500/tI/s104/g/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Secretary may enter into partnerships with applicable States and other Federal agencies to carry out actions to prevent the introduction of, control, or eradicate, to the maximum extent practicable, invasive species that adversely impact water quantity, water quality, or ecosystems in the Platte River Basin, the Upper Colorado River Basin, the Upper Snake River Basin, the Lake Erie Basin, the Ohio River Basin, the Connecticut River Basin, and the Upper Missouri River Basin.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/85/500/tI/s104/g/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Prioritization.—</heading><content style="-uslm-dtd:text">In selecting actions to carry out under a partnership under subparagraph (A), the Secretary shall give priority to projects that are intended to control or eradicate the Russian olive (<i style="-uslm-dtd:italic">Elaeagnus angustifolia</i>), hydrilla (<i style="-uslm-dtd:italic">Hydrilla verticillata</i>), or saltcedar (of the genus <i style="-uslm-dtd:italic">Tamarix</i>).</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/85/500/tI/s104/g/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Invasive plant species pilot program.—</heading>
                        <subparagraph identifier="/us/sComp/85/500/tI/s104/g/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Definitions.—</heading><chapeau style="-uslm-dtd:text">In this paragraph:</chapeau>
                            <clause identifier="/us/sComp/85/500/tI/s104/g/3/A/i" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">Eligible entity.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">eligible entity</term>” means a partnership between or among 2 or more entities that—</chapeau>
                                <subclause identifier="/us/sComp/85/500/tI/s104/g/3/A/i/I" style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="I">(I) </num><chapeau style="-uslm-dtd:text">includes—</chapeau>
                                    <item identifier="/us/sComp/85/500/tI/s104/g/3/A/i/I/aa" style="-uslm-dtd:item" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="aa">(aa) </num><content style="-uslm-dtd:text">at least 1 flood control district; and</content>
                                    </item>
                                    <item identifier="/us/sComp/85/500/tI/s104/g/3/A/i/I/bb" style="-uslm-dtd:item" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="bb">(bb) </num><content style="-uslm-dtd:text">at least 1 city, county, township, town, borough, parish, village, or other general purpose political subdivision of a State or Indian Tribe (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (25 U.S.C. 5304)); and</content>
                                    </item>
                                </subclause>
                                <subclause identifier="/us/sComp/85/500/tI/s104/g/3/A/i/II" style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">may include any other entity (such as a nonprofit organization or institution of higher education), as determined by the Secretary.</content>
                                </subclause>
                            </clause>
                            <clause identifier="/us/sComp/85/500/tI/s104/g/3/A/ii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><heading style="-uslm-dtd:header">Invasive plant species.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">invasive plant species</term>” means a plant that is nonnative to the ecosystem under consideration, the introduction of which causes or is likely to cause economic harm or harm to human health.</content>
                            </clause>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/85/500/tI/s104/g/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Pilot program.—</heading><chapeau style="-uslm-dtd:text">The Secretary of the Interior, acting through the Director of the United States Fish and Wildlife Service, shall establish a pilot program under which such Secretary shall work with eligible entities to carry out activities—</chapeau>
                            <clause identifier="/us/sComp/85/500/tI/s104/g/3/B/i" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><chapeau style="-uslm-dtd:text">to remove invasive plant species in riparian areas that contribute to drought conditions in—</chapeau>
                                <subclause identifier="/us/sComp/85/500/tI/s104/g/3/B/i/I" style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">the Lower Colorado River Basin;</content>
                                </subclause>
                                <subclause identifier="/us/sComp/85/500/tI/s104/g/3/B/i/II" style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">the Rio Grande River Basin;</content>
                                </subclause>
                                <subclause identifier="/us/sComp/85/500/tI/s104/g/3/B/i/III" style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="III">(III) </num><content style="-uslm-dtd:text">the Texas Gulf Coast Basin; and</content>
                                </subclause>
                                <subclause identifier="/us/sComp/85/500/tI/s104/g/3/B/i/IV" style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="IV">(IV) </num><content style="-uslm-dtd:text">the Arkansas-White-Red Basin;</content>
                                </subclause>
                            </clause>
                            <clause identifier="/us/sComp/85/500/tI/s104/g/3/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">where appropriate, to replace the invasive plant species described in clause (i) with ecologically suitable native species; and</content>
                            </clause>
                            <clause identifier="/us/sComp/85/500/tI/s104/g/3/B/iii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">to maintain and monitor riparian areas in which activities are carried out under clauses (i) and (ii).</content>
                            </clause>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/85/500/tI/s104/g/3/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Report to congress.—</heading><content style="-uslm-dtd:text">Not later than 18 months after the date of enactment of this subsection, the Secretary of the Interior, acting through the Director of the United States Fish and Wildlife Service, shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report describing the implementation of the pilot program.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/85/500/tI/s104/g/3/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><heading style="-uslm-dtd:header">Termination of authority.—</heading><content style="-uslm-dtd:text">The authority provided under this paragraph shall terminate on September 30, 2028.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/85/500/tI/s104/g/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Cost share.—</heading><content style="-uslm-dtd:text">The Federal share of an action carried out under a partnership under paragraph (2) or an activity carried out under the pilot program under paragraph (3) shall not exceed 80 percent of the total cost of the action or activity.</content>
                    </paragraph>
