    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To prohibit the Corps of Engineers from taking certain actions to establish a restricted area prohibiting public access to waters downstream of a dam, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

        <section style="-uslm-dtd:section" identifier="/us/sComp/113/13/s1" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content style="-uslm-dtd:text" class="block">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote"><inline style="-uslm-dtd:short-title">Freedom to Fish Act</inline></shortTitle>”.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/113/13/s2" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">RESTRICTED AREAS AT CORPS OF ENGINEERS DAMS. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/113/13/s2/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Definitions.—</heading><chapeau style="-uslm-dtd:text">In this Act:</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/113/13/s2/a/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Restricted area.—</heading><content style="-uslm-dtd:text">The term “<quotedText style="-uslm-dtd:quote">restricted area</quotedText>” means a restricted area for hazardous waters at dams and other civil works structures in the Cumberland River basin established in accordance with chapter 10 of the regulation entitled “<quotedText style="-uslm-dtd:quote">Project Operations: Navigation and Dredging Operations and Maintenance Policies</quotedText>”, published by the Corps of Engineers on November 29, 1996, and any related regulations or guidance.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/113/13/s2/a/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Secretary.—</heading><content style="-uslm-dtd:text">The term “<quotedText style="-uslm-dtd:quote">Secretary</quotedText>” means the Secretary of the Army, acting through the Chief of Engineers.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/113/13/s2/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Existing Restricted Area.—</heading><chapeau style="-uslm-dtd:text">If the Secretary has established a restricted area or modified an existing restricted area during the period beginning on August 1, 2012, and ending on the day before the date of enactment of this Act, the Secretary shall—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/113/13/s2/b/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">cease implementing and enforcing the restricted area until the date that is 5 years after the date of enactment of the Water Resources Development Act of 2018; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/113/13/s2/b/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">remove any permanent physical barriers constructed in connection with the restricted area.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/113/13/s2/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Establishing New or Modified Restricted Area.—</heading><chapeau style="-uslm-dtd:text">If, on or after the date of enactment of this Act, the Secretary establishes any new or modified restricted area, the Secretary shall—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/113/13/s2/c/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">ensure that any restrictions are based on operational conditions that create hazardous waters;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/113/13/s2/c/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">publish a draft describing the restricted area and seek and consider public comment on that draft prior to establishing the restricted area;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/113/13/s2/c/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">not implement or enforce the restricted area until the date that is 5 years after the date of enactment of the Water Resources Development Act of 2018; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/113/13/s2/c/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">not take any action to establish a permanent physical barrier in connection with the restricted area.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/113/13/s2/d" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Exclusions.—</heading><content style="-uslm-dtd:text">For purposes of this section, the installation and maintenance of measures for alerting the public of hazardous water conditions and restricted areas, including sirens, strobe lights, and signage, shall not be considered to be a permanent physical barrier.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/113/13/s2/e" styleType="OLC">
                <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Enforcement.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/113/13/s2/e/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Enforcement of a restricted area shall be the sole responsibility of the State in which the restricted area is located.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/113/13/s2/e/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Existing authorities.—</heading><content style="-uslm-dtd:text">The Secretary shall not assess any penalty for entrance into a restricted area under section 4 of the Act entitled “<quotedText style="-uslm-dtd:quote">An Act authorizing the construction of certain public works on rivers and harbors for flood control, and for other purposes</quotedText>”, approved December 22, 1944 (16 U.S.C. 460d).</content>
                </paragraph>
            </subsection>
        </section>
