    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To amend the District of Columbia Home Rule Act to revise the timing of special elections for local office in the District of Columbia.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section style="-uslm-dtd:section" identifier="/us/sComp/112/145/s1" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content style="-uslm-dtd:text" class="block">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote"><inline style="-uslm-dtd:short-title">District of Columbia Special Election Reform Act</inline></shortTitle>”.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/112/145/s2" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">TIMING OF SPECIAL ELECTIONS FOR LOCAL OFFICE IN DISTRICT OF COLUMBIA. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/112/145/s2/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Council.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/145/s2/a/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Chair.—</heading><content style="-uslm-dtd:text">The first sentence of section 401(b)(3) of the District of Columbia Home Rule Act (sec. 1-204.01(b)(3), D.C. Official Code) is amended to read as follows: “<quotedText style="-uslm-dtd:quote">To fill a vacancy in the Office of Chairman, the Board of Elections shall hold a special election in the District on the Tuesday occurring at least 70 days and not more than 174 days after the date on which such vacancy occurs which the Board of Elections determines, based on a totality of the circumstances, taking into account, inter alia, cultural and religious holidays and the administrability of the election, will provide the opportunity for the greatest level of voter participation.</quotedText>”.</content>

                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/145/s2/a/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Members elected from wards.—</heading><content style="-uslm-dtd:text">The first sentence of section 401(d)(1) of such Act (sec. 1-204.01(d)(1), D.C. Official Code) is amended to read as follows: “<quotedText style="-uslm-dtd:quote">In the event of a vacancy in the Council of a member elected from a ward, the Board of Elections shall hold a special election in the District on the Tuesday occurring at least 70 days and not more than 174 days after the date on which such vacancy occurs which the Board of Elections determines, based on a totality of the circumstances, taking into account, inter alia, cultural and religious holidays and the administrability of the election, will provide the opportunity for the greatest level of voter participation.</quotedText>”.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/145/s2/a/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Members elected at-large.—</heading><content style="-uslm-dtd:text">The second sentence of section 401(d)(2) of such Act (sec. 1-204.01(d)(2)) is amended by striking “<quotedText style="-uslm-dtd:quote">and such special election</quotedText>” and all that follows and inserting the following: “<quotedText style="-uslm-dtd:quote">and such special election shall be held on the Tuesday occurring at least 70 days and not more than 174 days after the date on which such vacancy occurs which the Board of Elections determines, based on a totality of the circumstances, taking into account, inter alia, cultural and religious holidays and the administrability of the    election, will provide the opportunity for the greatest level of voter participation.</quotedText>”.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/112/145/s2/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Mayor.—</heading><content style="-uslm-dtd:text">The first sentence of section 421(c)(2) of such Act (sec. 1-204.21.(c)(2), D.C. Official Code) is amended to read as follows: “<quotedText style="-uslm-dtd:quote">To fill a vacancy in the Office of Mayor, the Board of Elections shall hold a special election in the District on the Tuesday occurring at least 70 days and not more than 174 days after the date on which such vacancy occurs which the Board of Elections determines, based on a totality of the circumstances, taking into account, inter alia, cultural and religious holidays and the administrability of the election, will provide the opportunity for the greatest level of voter participation.</quotedText>”.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/112/145/s2/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Attorney General.—</heading><content style="-uslm-dtd:text">The first sentence of section 435(b)(1) of such Act (sec. 1-204.35(b)(1), D.C. Official Code) is amended by striking “<quotedText style="-uslm-dtd:quote">the Board</quotedText>” and all that follows and inserting the following: “<quotedText style="-uslm-dtd:quote">the Board of Elections shall hold a special election in the District on the Tuesday occurring at least 70 days and not more than 174 days after the date on which such vacancy occurs which the Board of Elections determines, based on a totality of the circumstances, taking into account, inter alia, cultural and religious holidays and the administrability of the election, will provide the opportunity for the greatest level of voter participation.</quotedText>”.</content>

        <section style="-uslm-dtd:section" identifier="/us/sComp/112/145/s3" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><heading style="-uslm-dtd:header">EFFECTIVE DATE. </heading>
            <content style="-uslm-dtd:text" class="block">The amendments made by section 2 shall apply with respect to vacancies occurring on or after the enactment of this Act.</content>
