    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To provide assistance to improve elementary, secondary, and postsecondary education in mathematics and science; to provide a national policy for engineering, technical, and scientific personnel; to provide cost sharing by the private sector in training such personnel; to encourage creation of new engineering, technical, and scientific jobs; and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
</enactingFormula><section style="-uslm-dtd:section" styleType="OLC" role="undesignated-level" class="inline"><content style="-uslm-dtd:text"><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s3901">20 U.S.C. 3901 note</ref><b>]</b> </editorialNote>That this Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Education for Economic Security Act</shortTitle>”.</content></section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/s2" styleType="traditional">
            <heading style="-uslm-dtd:header">statement of purpose </heading>
            <num style="-uslm-dtd:enum" value="2">Sec. 2. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s3901">20 U.S.C. 3901</ref><b>]</b> </editorialNote><content style="-uslm-dtd:text">It is the purpose of this Act to improve the quality of mathematics and science teaching and instruction in the United States.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/s3" styleType="traditional" role="definitions">
            <heading style="-uslm-dtd:header">definitions </heading>
            <num style="-uslm-dtd:enum" value="3">Sec. 3. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s3902">20 U.S.C. 3902</ref><b>]</b> </editorialNote><chapeau style="-uslm-dtd:text">For the purpose of this Act—</chapeau>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/s3/1" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">area career and technical education school</term>” has the same meaning given that term under section 3(3) of the Carl D. Perkins Career and Technical Education Act of 2006.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/s3/2" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Director</term>” means the Director of the National Science Foundation.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/s3/3" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">elementary school</term>” has the same meaning given that term under section 8101 of the Elementary and Secondary Education Act of 1965.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/s3/4" styleType="OLC">
                <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Governor</term>” means the chief executive of a State.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/s3/5" styleType="OLC">
                <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Foundation</term>” means the National Science Foundation.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/s3/6" styleType="OLC">
                <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">institution of higher education</term>” has the same meaning given that term by section 101 of the Higher Education Act of 1965.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/s3/7" styleType="OLC">
                <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">local educational agency</term>” has the same meaning given that term under section 8101 of the Elementary and Secondary Education Act of 1965.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/s3/8" styleType="OLC">
                <num style="-uslm-dtd:enum" value="8">(8) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">secondary school</term>” has the same meaning given that term under section 8101 of the Elementary and Secondary Education Act of 1965.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/s3/9" styleType="OLC">
                <num style="-uslm-dtd:enum" value="9">(9) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Secretary</term>” means the Secretary of Education.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/s3/10" styleType="OLC">
                <num style="-uslm-dtd:enum" value="10">(10) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">State</term>” means each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the Virgin Islands, the Trust Territory of the Pacific Islands, and the Northern Mariana Islands.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/s3/11" styleType="OLC">
                <num style="-uslm-dtd:enum" value="11">(11) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">State agency for higher education</term>” means the State board of higher education or other agency or officer primarily responsible for the State supervision of higher education, or, if there is no such officer or agency, an officer or agency designated for the purpose of this title by the Governor or by State law.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/s3/12" styleType="OLC">
                <num style="-uslm-dtd:enum" value="12">(12) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">State educational agency</term>” has the meaning given that term under section 8101 of the Elementary and Secondary Education Act of 1965.</content>
            </paragraph>
        </section>
        <title style="-uslm-dtd:title; -uslm-dtd-nonstandard:all-cap 10 no-bold" identifier="/us/sComp/98/377/tI" styleType="nonstandard">
            <num style="-uslm-dtd:enum" value="I">TITLE I—</num><heading style="-uslm-dtd:header">NATIONAL SCIENCE FOUNDATION SCIENCE AND ENGINEERING EDUCATION </heading>
            <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tI/s101" styleType="traditional">
                <heading style="-uslm-dtd:header">policy </heading>
                <num style="-uslm-dtd:enum" value="101">Sec. 101. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s3911">20 U.S.C. 3911</ref><b>]</b> </editorialNote><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tI/s101/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a) </num><chapeau style="-uslm-dtd:text">The Congress declares that the science and engineering education responsibilities of the National Science Foundation are—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tI/s101/a/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">to improve the quality of instruction in the fields of mathematics, science, and engineering;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tI/s101/a/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">to support research, fellowships, teacher-faculty-business exchange programs in mathematics, science, and engineering;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tI/s101/a/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">to improve the quality and availability of instrumentation for mathematics, science, and engineering instruction;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tI/s101/a/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">to encourage partnerships in education between local and State education agencies, business and industry, colleges and universities, and cultural and professional institutions and societies; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tI/s101/a/5" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">to improve the quality of education at all levels in the fields of mathematics, science, and engineering.</content>
                </paragraph></subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tI/s101/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><content style="-uslm-dtd:text">In exercising its responsibilities to strengthen scientific and engineering research potential and science and engineering education programs at all levels, the Foundation shall avoid undue concentration of support for research and education activities.</content>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tI/s102" styleType="traditional">
                <heading style="-uslm-dtd:header">functional objectives; uses of funds </heading>
                <num style="-uslm-dtd:enum" value="102">Sec. 102. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s3912">20 U.S.C. 3912</ref><b>]</b> </editorialNote><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tI/s102/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a) </num><content style="-uslm-dtd:text">In carrying out its science and engineering education responsibilities, the Foundation shall have the following functional objectives: public understanding of science and technology, faculty enhancement, student education and training, instructional development and instrumentation, and materials development and dissemination.</content></subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tI/s102/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><chapeau style="-uslm-dtd:text">Funds under this title shall, consistent with such functional objectives, be used for—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tI/s102/b/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">enhancement of public understanding of science and engineering through informal education activities using a variety of mediums such as broadcasting, museums, clubs, and amateur science societies;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tI/s102/b/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">development of new science and engineering faculty resources and talents;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tI/s102/b/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">enhancement of the quality of science and engineering instruction in colleges of teacher education;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tI/s102/b/4" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">development of four-year college faculty and instructors in high technology fields;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tI/s102/b/5" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">development of two-year community college faculty and instructors especially in high technology fields;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tI/s102/b/6" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">development of precollege mathematics, science and engineering education and training;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tI/s102/b/7" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">encouragement of potential students, including underrepresented and underserved populations, to pursue careers in mathematics, science, engineering, and critical foreign languages;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tI/s102/b/8" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="8">(8) </num><content style="-uslm-dtd:text">development of instructional instrumentation and systems for postsecondary technical, engineering, and scientific education; and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tI/s102/b/9" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="9">(9) </num><content style="-uslm-dtd:text">development of science, engineering, and education networks to aid in the development and dissemination of successful curricula, methods, and materials.</content>
                    </paragraph>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tI/s103" styleType="traditional">
                <heading style="-uslm-dtd:header">teacher institutes </heading>
                <num style="-uslm-dtd:enum" value="103">Sec. 103. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s3913">20 U.S.C. 3913</ref><b>]</b> </editorialNote><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tI/s103/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a) </num><content style="-uslm-dtd:text">The Foundation shall, in accordance with the provisions of this title, make competitive grants to institutions of higher education, businesses, nonprofit private organizations (including schools), local education agencies, professional engineering and scientific associations, museums, libraries, public broadcasting entities (as defined in section 397(11) of the Communications Act of 1934), and appropriate State agencies to support institutes and workshops for supervisors and teachers in public and private elementary and secondary schools for the purpose of improving the subject knowledge and teaching skills of such teachers in the areas of mathematics and science.</content></subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tI/s103/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><content style="-uslm-dtd:text">In making grants under this section, the Foundation shall assure that there is an equitable distribution among States of institutes established and operated with funds made available under this section. The Foundation shall award not less than one institute in each State, except that the Foundation may waive this requirement if there is no proposal from a State which meets the requirements of this title. Proposals which exceed $300,000 in any fiscal year incorporating the services or resources of more than two entities in the design and operation of the institute, may be funded at the discretion of the Director of the Foundation.</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tI/s103/c" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><content style="-uslm-dtd:text">Institutes assisted under this title may, to the extent possible, involve the cooperation of advanced technology businesses and other businesses which are able to supply assistance in the teaching of mathematics and science.</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tI/s103/d" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><content style="-uslm-dtd:text">In making grants under this title, the Foundation shall require assurances that local education agencies will be involved in the planning and development of the institute in the case of applications submitted by other eligible applicants described in subsection (a) of this section, or that one or more such applicants will be involved in the planning and development of the institute in the case of applications submitted by State or local education agencies.</content>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tI/s104" styleType="traditional">
                <heading style="-uslm-dtd:header">materials development and methods research for mathematics, science, and engineering </heading>
                <num style="-uslm-dtd:enum" value="104">Sec. 104. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s3914">20 U.S.C. 3914</ref><b>]</b> </editorialNote><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tI/s104/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a) </num><chapeau style="-uslm-dtd:text">The Foundation is authorized, in accordance with the provisions of this title, to award competitive grants to institutions of higher education, businesses, nonprofit private organizations, local education agencies, professional engineering and scientific associations, museums, libraries, public broadcasting entities (as defined in section 397(11) of the Communications Act of 1934), and appropriate State agencies—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tI/s104/a/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">for instructional curriculum improvement and faculty development in mathematics, science, and engineering;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tI/s104/a/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">for programs designed to enhance public understanding of mathematics, science, and engineering, including the use of pulic broadcasting entities; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tI/s104/a/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">for research on methods of instruction and educational programs in mathematics, science, engineering, and critical foreign languages.</content>
                </paragraph></subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tI/s104/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><chapeau style="-uslm-dtd:text">Studies conducted under subsection (a)(3) may include—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tI/s104/b/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">teaching and learning research and its application to local and private sector instructional materials development and to improved teacher training programs;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tI/s104/b/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">research on the use of local and informal science education activities;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tI/s104/b/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">research on recruitment, retention, and improvement of mathematics, science, engineering, and critical languages faculties; and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tI/s104/b/4" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">analysis of materials and methods for mathematics, science, and engineering education used in other countries and their potential application in the United States.</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tI/s104/c" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><content style="-uslm-dtd:text">Funds awarded for such competitive grants shall be expended through a system requiring matching of the grant. The minimum amount required as a match shall be equal to a percentage of the grant that is determined by the Foundation. Funds made available for matching purposes may include in-kind services or other resources.</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tI/s104/d" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><content style="-uslm-dtd:text">In making grant applications for materials or methods research for the purposes described in subsections (a)(1) and (a)(3), the Foundation shall assure the involvement of appropriate State or local education agencies in the case of applications submitted by other entities described in subsection (a), or that one or more of such other entities will be consulted in the case of applications submitted by State or local education agencies.</content>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tI/s105" styleType="traditional">
                <heading style="-uslm-dtd:header">graduate fellowships </heading>
                <num style="-uslm-dtd:enum" value="105">Sec. 105. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s3915">20 U.S.C. 3915</ref><b>]</b> </editorialNote><content style="-uslm-dtd:text">The Foundation is authorized, in accordance with the provisions of this title, to establish and carry out a program of graduate fellowships for the purpose of encouraging and assisting promising students to continue their education and research in mathematics, science, and engineering.</content>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tI/s106" styleType="traditional">
                <heading style="-uslm-dtd:header">other functional activities </heading>
                <num style="-uslm-dtd:enum" value="106">Sec. 106. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s3916">20 U.S.C. 3916</ref><b>]</b> </editorialNote><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tI/s106/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a) </num><content style="-uslm-dtd:text">The Foundation is authorized to expend up to 15 per centum of the funds available for science and engineering education for applications which the Foundation determines will meet one or more of the functional objectives described in section 102(b).</content></subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tI/s106/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><chapeau style="-uslm-dtd:text">Such programs may include a program for the exchange of mathematics, science, or engineering faculty between institutions of higher education (particularly institutions having nationally recognized research facilities) and eligible institutions. For the purposes of this section, the term “<term style="-uslm-dtd:term">eligible institution</term>” means an institution of higher education which—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tI/s106/b/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">has an enrollment which includes a substantial percentage of students who are members of a minority group, or who are economically or educationally disadvantaged; or</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tI/s106/b/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">is located in a community that is not within commuting distance of a major institution of higher education; and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tI/s106/b/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">demonstrates a commitment to meet the special educational needs of students who are members of a minority group or are economically or educationally disadvantaged.</content>
                    </paragraph>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tI/s107" styleType="traditional-inline">
                <num style="-uslm-dtd:enum" value="107">Sec. 107. </num><content style="-uslm-dtd:text">Repealed by section 2141(a) of Public Law 104–66 (109 Stat. 731).</content>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tI/s108" styleType="traditional">
                <heading style="-uslm-dtd:header">approval of proposals </heading>
                <num style="-uslm-dtd:enum" value="108">Sec. 108. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s3918">20 U.S.C. 3918</ref><b>]</b> </editorialNote><content style="-uslm-dtd:text">The Foundation shall adopt approval procedures designed to assure that awards are made on the basis of the scientific and educational merit as determined by the peer review process. To the maximum extent possible, the Foundation shall assure that there is an equitable distribution of resources with respect to institutions and geographical areas.</content>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tI/s109" styleType="traditional">
                <heading style="-uslm-dtd:header">special consideration of underrepresented and underserved populations </heading>
                <num style="-uslm-dtd:enum" value="109">Sec. 109. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s3919">20 U.S.C. 3919</ref><b>]</b> </editorialNote><content style="-uslm-dtd:text">In providing financial assistance under this title, the Foundation shall make every effort to ensure that consideration is given to proposals which contain provisions designed to meet the needs of underrepresented and underserved populations.</content>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tI/s110" styleType="traditional">
                <heading style="-uslm-dtd:header">availability of funds </heading>
                <num style="-uslm-dtd:enum" value="110">Sec. 110. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s3920">20 U.S.C. 3920</ref><b>]</b> </editorialNote><content style="-uslm-dtd:text">Funds to carry out this title for any fiscal year shall be made available from amounts appropriated pursuant to annual authorizations of appropriations for the National Science Foundation for Science and Engineering Education. For fiscal year 1986, funds to carry out this title shall be available from amounts authorized by section 102(a)(8) of the National Science Foundation Authorization Act for fiscal year 1986.</content>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tI/s111" styleType="traditional">
                <heading style="-uslm-dtd:header">prohibition against the federal control of education </heading>
                <num style="-uslm-dtd:enum" value="111">Sec. 111. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s3921">20 U.S.C. 3921</ref><b>]</b> </editorialNote><content style="-uslm-dtd:text">The provisions of section 432 of the General Education Provisions Act, relating to prohibition against Federal control of education, shall apply to each program and award authorized by this title.</content>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tI/s112" styleType="traditional">
                <heading style="-uslm-dtd:header">participation of teachers from private schools </heading>
                <num style="-uslm-dtd:enum" value="112">Sec. 112. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s3922">20 U.S.C. 3922</ref><b>]</b> </editorialNote><content style="-uslm-dtd:text">The Foundation shall, after consultation with appropriate private school representatives, make provision for the benefit of teachers in private elementary and secondary schools in the programs authorized by this title, in order to assure equitable participation of such teachers.</content>
            </section>

                    <heading style="-uslm-dtd:header">short title </heading>
                    <num style="-uslm-dtd:enum" value="301">Sec. 301. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s3981">20 U.S.C. 3981</ref>, note<b>]</b> </editorialNote><content style="-uslm-dtd:text">This part may be cited as the “<shortTitle style="-uslm-dtd:quote"><inline style="-uslm-dtd:short-title">Partnerships in Education for Mathematics, Science, and Engineering Act</inline></shortTitle>”.</content>

                    <num style="-uslm-dtd:enum" value="302">Sec. 302. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s3981">20 U.S.C. 3981</ref><b>]</b> </editorialNote><chapeau style="-uslm-dtd:text">It is the purpose of this part to supplement State and local resources to—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptA/s302/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">improve the quality of instruction in the fields of mathematics, science, and engineering in the State;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptA/s302/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">furnish additional resources and support for research, student scholarships, and faculty exchange programs in the fields of mathematics, science, and engineering; and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptA/s302/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">encourage partnerships in education between the business community, institutions of higher education, and elementary and secondary schools in the community.</content>
                    </paragraph>
                </section>
                <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tIII/ptA/s303" styleType="traditional" role="definitions">
                    <heading style="-uslm-dtd:header">definitions </heading>
                    <num style="-uslm-dtd:enum" value="303">Sec. 303. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s3982">20 U.S.C. 3982</ref><b>]</b> </editorialNote><chapeau style="-uslm-dtd:text">As used in this part—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptA/s303/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:term">applicant</term>” means with respect to activities described in section 305(a) an institution of higher education and the other participants described in paragraph (3) of section 305(a), and with respect to activities described in section 305(b) a local educational agency and the other participants described in paragraph (3) of section 305(b);</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptA/s303/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:term">equipment</term>” includes machinery, utilities, and built-in equipment and any necessary enclosures or structures to house them, and includes all other items necessary for the functioning of a particular facility as a facility for the provision of educational services, including items such as instructional equipment and necessary furniture, printed, published, and audio-visual instructional materials, and books, periodicals, documents, and other related materials; and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptA/s303/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:term">State agency for higher education</term>” means the State board of higher education or other agency or officer primarily responsible for the State supervision of higher education, or if there is no such officer or agency, an officer or agency designated by the Governor or by State law.</content>
                    </paragraph>
                </section>
                <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tIII/ptA/s304" styleType="traditional">
                    <heading style="-uslm-dtd:header">program authorized </heading>
                    <num style="-uslm-dtd:enum" value="304">Sec. 304. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s3983">20 U.S.C. 3983</ref><b>]</b> </editorialNote><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tIII/ptA/s304/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a) </num><content style="-uslm-dtd:text">The Secretary is authorized, in accordance with the provisions of this part, to make grants to applicants to pay the Federal share of the costs of the activities described in section 305.</content></subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tIII/ptA/s304/b" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><content style="-uslm-dtd:text">There are authorized to be appropriated $50,000,000 for each of the fiscal years 1986, and 1987. There are authorized to be appropriated to carry out the provisions  of this part $15,000,000 for fisal year 1989 and such sums as may be necessary for each of the fiscal years 1990, 1991, 1992, and 1993.</content>
                    </subsection>
                </section>
                <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tIII/ptA/s305" styleType="traditional">
                    <heading style="-uslm-dtd:header">authorized activities </heading>
                    <num style="-uslm-dtd:enum" value="305">Sec. 305. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s3984">20 U.S.C. 3984</ref><b>]</b> </editorialNote><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tIII/ptA/s305/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a)</num><paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptA/s305/a/1" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">An applicant may use payments received under this part in any fiscal year for higher education programs and activities described in this subsection.</content></paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptA/s305/a/2" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">Grants under this subsection may be used for partnership in education programs—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tIII/ptA/s305/a/2/A" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">for the improvement of instruction in mathematics, science, computer science, and engineering education at the postsecondary level;</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tIII/ptA/s305/a/2/B" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">for awarding scholarships to students at institutions of higher education in the fields of mathematics, science, computer science, and engineering;</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tIII/ptA/s305/a/2/C" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">for the operation of faculty exchange programs by the institutions of higher education and business concerns within the State;</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tIII/ptA/s305/a/2/D" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">for research in the fields of mathematics, science, computer science, and engineering;</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tIII/ptA/s305/a/2/E" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">for the acquisition, rehabilitation, and renovation of equipment and instrumentation for use in instruction in the fields of mathematics, science, computer science, and engineering; and</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tIII/ptA/s305/a/2/F" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">to promote public understanding of science, mathematics, and computer science.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptA/s305/a/3" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">Education partnerships under this subsection may include institutions of higher education, business concerns, nonprofit private organizations, local educational agencies, professional mathematic and scientific associations, museums, libraries, educational television stations, and if the State so desires, appropriate State agencies.</content>
                    </paragraph></subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tIII/ptA/s305/b" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b)</num><paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptA/s305/b/1" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">An applicant may use payments received under this part in any fiscal year for programs and activities described in this subsection.</content></paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptA/s305/b/2" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">A local educational agency may carry out an elementary and secondary school partnership in education program under which—</chapeau>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tIII/ptA/s305/b/2/A" styleType="OLC" class="leftIndentDecrease1">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">elementary and secondary school teachers in the schools of local educational agencies who teach mathematics, science, or computer science are made available to local business concerns and business concerns with establishments located in the community to serve in such concerns or establishments;</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tIII/ptA/s305/b/2/B" styleType="OLC" class="leftIndentDecrease1">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">personnel of local business concerns and business concerns with establishments located in the community serve as consultants, lecturers, teaching assistants, or teachers of mathematics, science, or computer science in the elementary and secondary schools within the State;</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tIII/ptA/s305/b/2/C" styleType="OLC" class="leftIndentDecrease1">
                                <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">training and retraining is furnished to elementary and secondary school teachers of mathematics, science, and computer science under a cooperative arrangement between the State or local educational agency and appropriate business concerns;</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tIII/ptA/s305/b/2/D" styleType="OLC" class="leftIndentDecrease1">
                                <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">secondary school students observe, participate, and work in local business concerns and business concerns with establishments located in the community; and</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tIII/ptA/s305/b/2/E" styleType="OLC" class="leftIndentDecrease1">
                                <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">computer clubs and extracurricular activities involving modern technologies are established in elementary and secondary schools.</content>
                            </subparagraph>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptA/s305/b/3" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">Partnerships under this subsection may include local educational agencies, business concerns, nonprofit private organizations, institutions of higher education, professional mathematic and scientific associations, museums, libraries, educational television stations, and, if the State so desires, appropriate State agencies.</content>
                        </paragraph>
                    </subsection>
                </section>
                <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tIII/ptA/s306" styleType="traditional">
                    <heading style="-uslm-dtd:header">application </heading>
                    <num style="-uslm-dtd:enum" value="306">Sec. 306. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s3985">20 U.S.C. 3985</ref><b>]</b> </editorialNote><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tIII/ptA/s306/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a) </num><chapeau style="-uslm-dtd:text">Any applicant which desires to receive a grant under this part shall submit an application approved under section 307 to the Secretary, at such time, in such manner, and accompanied by such additional information as the Secretary may reasonably require. Each such application shall—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptA/s306/a/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">describe the activities for which assistance under this part is sought;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptA/s306/a/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">provide assurances that not more than 5 per centum of the amount received by the applicant in any fiscal year may be expended on administrative expenses;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptA/s306/a/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><chapeau style="-uslm-dtd:text">with respect to each program for which assistance is sought, provide assurances that—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tIII/ptA/s306/a/3/A" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">30 per centum of the funds for each such project will be furnished by business concerns within the community;</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tIII/ptA/s306/a/3/B" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">20 per centum of the funds will be supplied by—</chapeau>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/98/377/tIII/ptA/s306/a/3/B/i" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the State,</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/98/377/tIII/ptA/s306/a/3/B/ii" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the institution of higher education or the local educational agency, as the case may be, participating in the program; and</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/98/377/tIII/ptA/s306/a/3/B/iii" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">the other parties participating in the program;</content>
                            </clause>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tIII/ptA/s306/a/3/C" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">no stipend will be paid directly to employees of a profitmaking business concern; and</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tIII/ptA/s306/a/3/D" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">teachers participating in the exchange program may not be employed by the participating business concern with which the teacher served within three years after the end of the exchange program unless the teacher repays the full cost of the exchange program to the State and local educational agency, as the case may be; and<ref style="-uslm-dtd:footnote-ref" idref="ID7AE71CE8447C48BFACEA63D94C10F6BC" class="footnoteRef">1</ref></content><footnote id="ID7AE71CE8447C48BFACEA63D94C10F6BC" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">1</sup><p style="-uslm-dtd:para; margin-left:1em">So in orginal.                         </subparagraph>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptA/s306/a/4" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">provide assurances that whenever the program for which assistance is sought includes scholarships, the scholarships be awarded to undergraduate students at institutions of higher education within the State who wish to pursue a course of study in mathematics or science, engineering or computer science, and that each student awarded a scholarship under this part will receive a stipend which shall not exceed the cost of tuition at the institution of higher education plus a stipend of not to exceed $750 for each academic year of study for which the scholarship is awarded;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptA/s306/a/5" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">set forth policies and procedures to assure that whenever the application includes a local educational agency, to the extent consistent with the number and location of children in the school district of such agency who are enrolled in private elementary and secondary schools, provision is made for the participation of such children in the program assisted under this part;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptA/s306/a/6" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">provide assurances that consideration is given to programs and activities designed to meet the needs of underrepresented and underserved populations;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptA/s306/a/7" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">provide assurances that in the consideration of applications submitted under section 307(a) that equitable consideration is given to applications submitted by private and public institutions of higher education; and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptA/s306/a/8" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="8">(8) </num><content style="-uslm-dtd:text">provide such additional assurances as the Secretary determines essential to ensure compliance with the requirements of this part.</content>
                    </paragraph></subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tIII/ptA/s306/b" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><content style="-uslm-dtd:text">A regional consortium of applicants in two or more States may file a joint application under the provisions of subsection (a) of this section.</content>
                    </subsection>
                </section>
                <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tIII/ptA/s307" styleType="traditional">
                    <heading style="-uslm-dtd:header">submission of applications </heading>
                    <num style="-uslm-dtd:enum" value="307">Sec. 307. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s3986">20 U.S.C. 3986</ref><b>]</b> </editorialNote><content style="-uslm-dtd:text">Each applicant within a State which desires to receive a grant under this part shall submit the application prepared in accordance with section 306 to the State agency on<ref style="-uslm-dtd:footnote-ref" idref="IDC620918D5915471F9D6D651B64D21160" class="footnoteRef">2</ref> higher education or the State educational agency, as the case may be, for approval and shall submit the approved application to the Foundation under section 306. Each such application shall be submitted jointly by the local educational agency in the case of activities described in section 305(a), or an institution of higher education in the case of activities described in section 305(b), and each business concern or other party that is to participate in the program for which assistance is sought.</content><footnote id="IDC620918D5915471F9D6D651B64D21160" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">2</sup><p style="-uslm-dtd:para; margin-left:1em">Probably should be “<quotedText style="-uslm-dtd:quote">for</quotedText>”.</p></footnote>
                </section>
                <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tIII/ptA/s308" styleType="traditional">
                    <heading style="-uslm-dtd:header">approval of applications </heading>
                    <num style="-uslm-dtd:enum" value="308">Sec. 308. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s3987">20 U.S.C. 3987</ref><b>]</b> </editorialNote><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tIII/ptA/s308/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a)</num><paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptA/s308/a/1" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">The Secretary shall establish criteria for approval of applications under this part.</content></paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptA/s308/a/2" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">No application may be approved by the Secretary unless the State educational agency or the State agency for higher education, as the case may be, determines that the application is consistent with State plans for elementary and secondary education or State plans for higher education, as the case may be, in the State.</content>
                    </paragraph></subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tIII/ptA/s308/b" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><content style="-uslm-dtd:text">The Secretary shall adopt approval procedures designed to assure that there is equitable distribution of grants among the States.</content>
                    </subsection>
                </section>
                <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tIII/ptA/s309" styleType="traditional">
                    <heading style="-uslm-dtd:header">payments; federal share; limitation </heading>
                    <num style="-uslm-dtd:enum" value="309">Sec. 309. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s3988">20 U.S.C. 3988</ref><b>]</b> </editorialNote><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tIII/ptA/s309/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a)</num><paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptA/s309/a/1" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">The Secretary shall pay, to each applicant having an application approved under section 308, the Federal share of the cost of the program described in the application.</content></paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptA/s309/a/2" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">The Federal share for each fiscal year shall be 50 per centum.</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptA/s309/a/3" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">The non-Federal share of payments under this part may be in cash or in kind, fairly evaluated, including plant, equipment, or services.</content>
                    </paragraph></subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tIII/ptA/s309/b" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><content style="-uslm-dtd:text">Not more than 15 per centum of the funds appropriated under this part in any fiscal year may be paid to applicants in any single State.</content>
                    </subsection>
                </section>
            </part>
            <part style="-uslm-dtd:part" identifier="/us/sComp/98/377/tIII/ptB" styleType="traditional">
                <num style="-uslm-dtd:enum" value="B">Part B—</num><heading style="-uslm-dtd:header">Elementary and Secondary Education Partnerships </heading>
                <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tIII/ptB/s321" styleType="traditional">
                    <heading style="-uslm-dtd:header">purpose </heading>
                    <num style="-uslm-dtd:enum" value="321">Sec. 321. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s3991">20 U.S.C. 3991</ref><b>]</b> </editorialNote><chapeau style="-uslm-dtd:text">It is the purpose of this part to supplement State and local resources to—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptB/s321/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">improve the quality of instruction in the fields of mathematics and science in elementary and secondary schools;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptB/s321/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">furnish additional resources and support for the acquisition of equipment, and instructional and reference materials and improvement of laboratory facilities in elementary and secondary schools; and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptB/s321/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">encourage partnerships in science and mathematics education between the business community, museums, libraries, professional mathematics and scientific associations, private nonprofit organizations, appropriate State agencies and elementary and secondary schools.</content>
                    </paragraph>
                </section>
                <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tIII/ptB/s322" styleType="traditional">
                    <heading style="-uslm-dtd:header">programs authorized </heading>
                    <num style="-uslm-dtd:enum" value="322">Sec. 322. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s3992">20 U.S.C. 3992</ref><b>]</b> </editorialNote><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tIII/ptB/s322/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Grants.—</heading><content style="-uslm-dtd:text">The Secretary may make grants to States to pay the Federal share of the cost of the programs described in section 324.</content></subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tIII/ptB/s322/b" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Authorization of Appropriations.—</heading><content style="-uslm-dtd:text">There are authorized to be appropriated for purposes of carrying out this chapter $20,000,000 for fiscal year 1988.</content>
                    </subsection>
                </section>
                <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tIII/ptB/s323" styleType="traditional">
                    <heading style="-uslm-dtd:header">amendment to state application </heading>
                    <num style="-uslm-dtd:enum" value="323">Sec. 323. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s3993">20 U.S.C. 3993</ref><b>]</b> </editorialNote><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tIII/ptB/s323/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Application.—</heading><chapeau style="-uslm-dtd:text">A State shall be eligible to receive a grant under this part if—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptB/s323/a/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the State submits to the Secretary as part of its application under section 209<ref style="-uslm-dtd:footnote-ref" idref="ID873EECD079AD4935991FBE87E21686EC" class="footnoteRef">3</ref> such information and assurances as the Secretary may require at such time as the Secretary shall establish; and</content><footnote id="ID873EECD079AD4935991FBE87E21686EC" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">3</sup><p style="-uslm-dtd:para; margin-left:1em">Title II of P.L. 98–377 entitled the “<quotedText style="-uslm-dtd:quote">Education for Economic Security Act</quotedText>” was repealed by section 2303 of P.L. 100–297 (102 Stat. 324).</p></footnote>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptB/s323/a/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the Secretary approves such application.</content>
                    </paragraph></subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tIII/ptB/s323/b" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Application Requirements.—</heading><chapeau style="-uslm-dtd:text">The Secretary shall require each application to include—</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptB/s323/b/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">a description of the State's procedures relating to the use of funds from grants received under this part, including the approval process for local applications;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptB/s323/b/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">an assurance that not more than 1 percent of the amount received shall be used for administrative expenses; and</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptB/s323/b/3" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">an assurance that the State will, to the extent possible, assist local school districts in economically depressed areas to obtain matching funds from business concerns.</content>
                        </paragraph>
                    </subsection>
                </section>
                <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tIII/ptB/s324" styleType="traditional">
                    <heading style="-uslm-dtd:header">eligible programs </heading>
                    <num style="-uslm-dtd:enum" value="324">Sec. 324. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s3994">20 U.S.C. 3994</ref><b>]</b> </editorialNote><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tIII/ptB/s324/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">A State may use funds from grants received in any fiscal year under this part for elementary and secondary programs described in this section. The State educational agency shall administer such funds, which shall be awarded to such programs on a competitive basis.</content></subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tIII/ptB/s324/b" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Use of Funds.—</heading><chapeau style="-uslm-dtd:text">Funds from grants received under this part may be used for the following:</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptB/s324/b/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Improvement of elementary and secondary resources.—</heading><chapeau style="-uslm-dtd:text">Such funds may be used for acquisition of equipment, instructional and reference materials, and partnership in education programs designed to—</chapeau>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tIII/ptB/s324/b/1/A" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">improve instruction in mathematics and science education at the elementary and secondary level;</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tIII/ptB/s324/b/1/B" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">improve laboratory facilities, classroom and library resources in elementary and secondary mathematics and science education; and</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tIII/ptB/s324/b/1/C" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">attract matching dollars and in kind contributions of equipment, learning resources or shared time from business concerns, libraries, museums, nonprofit private organizations, professional mathematics and scientific associations, and appropriate State agencies.</content>
                            </subparagraph>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptB/s324/b/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Advanced placement programs.—</heading><subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tIII/ptB/s324/b/2/A" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">Such funds may be used for advanced placement programs operated by local educational agencies that are designed to allow qualified secondary students to attend college preparatory schools, colleges, or universities on a part-time or full-time basis with respect to science and mathematics instruction.</content></subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tIII/ptB/s324/b/2/B" styleType="OLC" class="leftIndentDecrease1">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">A local educational agency that receives funds from a grant under this part for an advanced placement program described in subparagraph (A) shall allocate to such program a percentage of funds received from the State on a per student basis according to—</chapeau>
                                <clause style="-uslm-dtd:clause" identifier="/us/sComp/98/377/tIII/ptB/s324/b/2/B/i" styleType="OLC" class="leftIndentDecrease1">
                                    <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the number of students participating in the program; and</content>
                                </clause>
                                <clause style="-uslm-dtd:clause" identifier="/us/sComp/98/377/tIII/ptB/s324/b/2/B/ii" styleType="OLC" class="leftIndentDecrease1">
                                    <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the instruction time such students receive under the program.</content>
                                </clause>
                            </subparagraph>
                        </paragraph>
                    </subsection>
                </section>
                <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tIII/ptB/s325" styleType="traditional">
                    <heading style="-uslm-dtd:header">local applications </heading>
                    <num style="-uslm-dtd:enum" value="325">Sec. 325. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s3995">20 U.S.C. 3995</ref><b>]</b> </editorialNote><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tIII/ptB/s325/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Eligibility.—</heading><content style="-uslm-dtd:text">An applicant that desires to receive a grant under this part shall submit an application to the State educational agency, at such time, and in such manner, as the State may require. Such application may take the form of an amendment to an assessment submitted by the local educational agency under section 210<ref style="-uslm-dtd:footnote-ref" idref="ID15E311712CA1417A88A520FC2DC776EE" class="footnoteRef">4</ref>, if appropriate.</content><footnote id="ID15E311712CA1417A88A520FC2DC776EE" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">4</sup><p style="-uslm-dtd:para; margin-left:1em">Title II of P.L. 98–377 entitled the “<quotedText style="-uslm-dtd:quote">Education for Economic Security Act</quotedText>” was repealed by section 2303 of P.L. 100–297 (102 Stat. 324).</p></footnote></subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tIII/ptB/s325/b" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Requirements for Application.—</heading><chapeau style="-uslm-dtd:text">The State shall require each application to include—</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptB/s325/b/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">a description of the activities for which assistance under this part is sought;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptB/s325/b/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">assurances that not more than 5 percent of the amount received by the applicant in any fiscal year shall be expended on administrative expenses;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptB/s325/b/3" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><chapeau style="-uslm-dtd:text">if the funds are to be used for improvement of elementary and secondary resources as described in subsection (b)(1)—</chapeau>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tIII/ptB/s325/b/3/A" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">an estimate of the amount to be spent on equipment, facilities improvement, library resources, and classroom instructional material;</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tIII/ptB/s325/b/3/B" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">an estimate of the number of elementary and secondary students who will be aided by activities and expenditures under the grant;</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tIII/ptB/s325/b/3/C" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="C">(C) </num><chapeau style="-uslm-dtd:text">assurances that—</chapeau>
                                <clause style="-uslm-dtd:clause" identifier="/us/sComp/98/377/tIII/ptB/s325/b/3/C/i" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">except as provided in subsection (c), a minimum of 25 percent of the funds for each project will be supplied by business concerns within the community;</content>
                                </clause>
                                <clause style="-uslm-dtd:clause" identifier="/us/sComp/98/377/tIII/ptB/s325/b/3/C/ii" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">no stipend shall be paid directly to employees of a profitmaking business concern;</content>
                                </clause>
                                <clause style="-uslm-dtd:clause" identifier="/us/sComp/98/377/tIII/ptB/s325/b/3/C/iii" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">provision shall be made for the equitable participation in the project of children who are enrolled in private elementary and secondary schools; and</content>
                                </clause>
                                <clause style="-uslm-dtd:clause" identifier="/us/sComp/98/377/tIII/ptB/s325/b/3/C/iv" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">consideration will be given to programs and activities designed to meet the needs of educationally disadvantaged and other traditionally underserved populations; and</content>
                                </clause>
                            </subparagraph>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptB/s325/b/4" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">if the funds are to be used for advanced placement programs as described in subsection (b)(2), a commitment as to the percentage of funds received from the State on a per student basis that shall be used by the local educational agency to defray costs of the advanced placement program.</content>
                        </paragraph>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tIII/ptB/s325/c" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Waiver.—</heading><chapeau style="-uslm-dtd:text">The State may waive or reduce the amount of matching funds required under subsection (b)(3)(C)(i) if the State determines that—</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptB/s325/c/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">substantial need exists in the area served by the applicant for a grant under this part; and</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptB/s325/c/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the required amount of matching funds cannot be made available.</content>
                        </paragraph>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tIII/ptB/s325/d" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Joint Applications.—</heading><content style="-uslm-dtd:text">A regional consortium of applicants in 2 or more local school districts may file a joint application under subsection (a).</content>
                    </subsection>
                </section>
                <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tIII/ptB/s326" styleType="traditional">
                    <heading style="-uslm-dtd:header">submission of applications </heading>
                    <num style="-uslm-dtd:enum" value="326">Sec. 326. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s3996">20 U.S.C. 3996</ref><b>]</b> </editorialNote><content style="-uslm-dtd:text">An applicant within a State that desires to receive a grant under this chapter shall submit an application prepared in accordance with section 325 to the State educational agency for approval. Each application with respect to funds for improvement of elementary and secondary resources under section 324(b)(1) shall be submitted jointly by the local educational agency and each business concern or other party that is to participate in the activities for which assistance is sought.</content>
                </section>
                <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tIII/ptB/s327" styleType="traditional">
                    <heading style="-uslm-dtd:header">approval of applications </heading>
                    <num style="-uslm-dtd:enum" value="327">Sec. 327. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s3997">20 U.S.C. 3997</ref><b>]</b> </editorialNote><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tIII/ptB/s327/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Criteria.—</heading><chapeau style="-uslm-dtd:text">The State shall establish criteria for approval of applications under this section. Such criteria shall include—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptB/s327/a/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">consideration of the local district's need for, and inability to locally provide for, the activities, equipment, library and instructional materials requested;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptB/s327/a/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the number and nature of elementary and secondary students who will benefit from the planned program; and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptB/s327/a/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">the expressed level of financial and in-kind commitment from other parties to the program.</content>
                    </paragraph></subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tIII/ptB/s327/b" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Approval Procedures.—</heading><chapeau style="-uslm-dtd:text">The State shall adopt approval procedures designed to ensure that grants are equitably distributed among—</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptB/s327/b/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">rural, urban, and suburban areas; and</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptB/s327/b/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">small, medium, and large local educational agencies.</content>
                        </paragraph>
                    </subsection>
                </section>
                <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tIII/ptB/s328" styleType="traditional">
                    <heading style="-uslm-dtd:header">computation of grant amounts </heading>
                    <num style="-uslm-dtd:enum" value="328">Sec. 328. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s3998">20 U.S.C. 3998</ref><b>]</b> </editorialNote><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tIII/ptB/s328/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Payments to Grantees.—</heading>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptB/s328/a/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Payment by state.—</heading><content style="-uslm-dtd:text">The State shall pay to the extent of amounts received by it from the Secretary under this part, to each applicant having an application approved under section 327, the Federal share of the cost of the program described in the application.</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptB/s328/a/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Amount.—</heading><subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tIII/ptB/s328/a/2/A" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">Except as provided in subparagraph (B), the Federal share for each fiscal year shall be 75 percent.</content></subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tIII/ptB/s328/a/2/B" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">In the case of an applicant that receives a waiver under section 325(c), the Federal share for each fiscal year may be as much as 100 percent.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptB/s328/a/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Non-federal share.—</heading><content style="-uslm-dtd:text">The non-Federal share of payments under this part may be in cash or in kind, fairly evaluated, including plant, equipment, or services.</content>
                    </paragraph></subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tIII/ptB/s328/b" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Payments to States.—</heading><chapeau style="-uslm-dtd:text">Except as provided in subsection (c), each State shall receive under this part the greater of—</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptB/s328/b/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">an amount equal to its share of funds appropriated under chapter 1 of the Education Consolidation and Improvement Act; or</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tIII/ptB/s328/b/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">$225,000.</content>
                        </paragraph>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tIII/ptB/s328/c" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Reduction for Insufficient Funding.—</heading><content style="-uslm-dtd:text">If sums appropriated to carry out this part are not sufficient to permit the Secretary to pay in full the grants which States may receive under subsection (b), the amount of such grants shall be ratably reduced.</content><editorialNote style="-uslm-dtd:legis-comment"><b>[</b>Section 2303 of P.L. 100–297 (102 Stat. 324) repealed title IV of this Act<b>]</b> </editorialNote>
                    </subsection>

            <num style="-uslm-dtd:enum" value="V">TITLE V—</num><heading style="-uslm-dtd:header">ASBESTOS SCHOOL HAZARD ABATEMENT<ref style="-uslm-dtd:footnote-ref" idref="IDCA19D69732884246857841AAA73A5396" class="footnoteRef">5</ref> </heading>
            <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tV/s501" styleType="traditional">
                <heading style="-uslm-dtd:header">SHORT TITLE. </heading>
                <num style="-uslm-dtd:enum" value="501">Sec. 501. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s4011">20 U.S.C. 4011 note</ref><b>]</b> </editorialNote><content style="-uslm-dtd:text">This title may be cited as the “<shortTitle style="-uslm-dtd:quote"><inline style="-uslm-dtd:short-title">Asbestos School Hazard Abatement Act of 1984</inline></shortTitle>”.</content><footnote id="IDCA19D69732884246857841AAA73A5396" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">5</sup><p style="-uslm-dtd:para; margin-left:1em">The Asbestos School Hazard Abatement Act of 1984 (20 U.S.C. 4011–4021) consists of title V of the Education for Economic Security Act (Public Law 98–377; Aug. 11, 1984; 98 Stat. 1267) and the amendments made by subsequent enactments.</p></footnote>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tV/s502" styleType="traditional">
                <heading style="-uslm-dtd:header">FINDINGS AND PURPOSES. </heading>
                <num style="-uslm-dtd:enum" value="502">Sec. 502. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s4011">20 U.S.C. 4011</ref><b>]</b> </editorialNote><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tV/s502/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Findings.—</heading><chapeau style="-uslm-dtd:text">The Congress finds that—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s502/a/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">exposure to asbestos fibers has been identified over a long period of time and by reputable medical and scientific evidence as significantly increasing the incidence of cancer and other severe or fatal diseases, such as asbestosis;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s502/a/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">medical evidence has suggested that children may be particularly vulnerable to environmentally induced cancers;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s502/a/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">medical science has not established any minimum level of exposure to asbestos fibers which is considered to be safe to individuals exposed to the fibers;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s502/a/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">substantial amounts of asbestos, particularly in sprayed form, have been used in school buildings, especially during the period 1946 through 1972;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s502/a/5" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">partial surveys in some States have indicated that (A) in a number of school buildings materials containing asbestos fibers have become damaged or friable, causing asbestos fibers to be dislodged into the air, and (B) asbestos concentration far exceeding normal ambient air levels have been found in school buildings containing such damaged materials;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s502/a/6" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">the presence in school buildings of friable or easily damaged asbestos creates an unwarranted hazard to the health of the school children and school employees who are exposed to such materials;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s502/a/7" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">the Department of Health and Human Services and the Environmental Protection Agency, as well as several States, have attempted to publicize the potential hazards to school children and employees from exposure to asbestos fibers, but there is no systematic program for remedying hazardous conditions in schools;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s502/a/8" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="8">(8) </num><content style="-uslm-dtd:text">because there is no Federal health standard regulating the concentration of asbestos fibers in noncommercial workplace environments such as schools, school employees and students may be exposed to hazardous concentrations of asbestos fibers in the school buildings which they use each day;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s502/a/9" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="9">(9) </num><content style="-uslm-dtd:text">without a program of information distribution, technical and scientific assistance, and financial support, many local educational agencies and States will not be able to mitigate the potential asbestos hazards in their schools; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s502/a/10" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="10">(10) </num><content style="-uslm-dtd:text">the effective regulation of interstate commerce for the protection of the public health requires the establishment of programs under this title to mitigate hazards from exposure to asbestos fibers and materials emitting such fibers.</content>
                </paragraph></subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tV/s502/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Purpose.—</heading><chapeau style="-uslm-dtd:text">It is the purpose of this title to—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s502/b/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">direct the Administrator of the Environmental Protection Agency to establish a program to assist States and local educational agencies to ascertain the extent of the danger to the health of school children and employees from asbestos materials in schools;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s502/b/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">provide continuing scientific and technical assistance to State and local agencies to enable them to identify and abate asbestos hazards in schools;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s502/b/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">provide financial assistance for the abatement of asbestos threats to the health and safety of school children or employees; and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s502/b/4" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">assure that no employee of any local educational agency suffers any disciplinary action as a result of calling attention to potential asbestos hazards which may exist in schools.</content>
                    </paragraph>
                </subsection>
            </section><section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tV/s503" styleType="traditional" class="inline"><heading style="-uslm-dtd:header">ASBESTOS HAZARD ABATEMENT PROGRAM. </heading>
            <num style="-uslm-dtd:enum" value="503">Sec. 503. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s4012">20 U.S.C. 4012</ref><b>]</b> </editorialNote><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tV/s503/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Abatement Program.—</heading><content style="-uslm-dtd:text">There is hereby established a program within the Environmental Protection Agency to be known as the Asbestos Hazards Abatement Program (hereinafter in this title referred to as “<quotedText style="-uslm-dtd:quote">Program</quotedText>”).</content></subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tV/s503/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Duties.—</heading><chapeau style="-uslm-dtd:text">The duties of the Administrator in implementing and effectuating the Program shall include—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s503/b/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">the compilation of medical, scientific, and technical information including, but not limited to—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s503/b/1/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the health and safety hazards associated with asbestos materials;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s503/b/1/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the means of identifying, sampling, and testing materials suspected of emitting asbestos fibers; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s503/b/1/C" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">the means of abating the threat posed by asbestos and asbestos containing materials;</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s503/b/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the distribution of the information described in paragraph (1) (in any appropriate form such as pamphlets, reports, or instructions) to State and local educational agencies and to other institutions, including parent and employee organizations, for the purpose of carrying out activities described in this title;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s503/b/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">not later than November 15 of each year for which this title is authorized, the development and distribution of applications, or notifications to all local educational agencies of the availability of application forms including information for obtaining such forms; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s503/b/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">the review of applications for financial assistance, and the approval or disapproval of such applications, in accordance with the provisions of section 505.</content>
                </paragraph>
            </subsection></section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tV/s504" styleType="traditional">
                <heading style="-uslm-dtd:header">STATE RECORDS AND PRIORITY LISTS. </heading>
                <num style="-uslm-dtd:enum" value="504">Sec. 504. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s4013">20 U.S.C. 4013</ref><b>]</b> </editorialNote><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tV/s504/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Records.—</heading><chapeau style="-uslm-dtd:text">The Governor of each State shall maintain records on—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s504/a/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the presence of asbestos materials in school buildings of local educational agencies;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s504/a/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the asbestos detection and abatement activities and other response actions conducted by local educational agencies (including activities relating to the replacement of the asbestos materials removed from school buildings with other appropriate building materials); and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s504/a/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">repairs made to restore school buildings to conditions comparable to those which existed before the abatement activities referred to in paragraph (2) were undertaken.</content>
                </paragraph></subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tV/s504/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Priority List.—</heading><paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s504/b/1" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">Each year, in accordance with procedures established by the Administrator, the Governor of each State shall—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s504/b/1/A" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">submit to the Administrator a priority list of all schools under the authority of a local educational agency within the State, without regard to the public or private nature of the school involved, that are candidates for abatement activities and other response actions; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s504/b/1/B" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">forward to the Administrator for each candidate for abatement activities and other response actions all applications for financial assistance prepared by the local educational agencies in accordance with the provisions of section 505;<ref style="-uslm-dtd:footnote-ref" idref="ID31400C66DA374C6BB08EE8FD787B95FE" class="footnoteRef">6</ref> and</content><footnote id="ID31400C66DA374C6BB08EE8FD787B95FE" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">6</sup><p style="-uslm-dtd:para; margin-left:1em">Subsection (b) of section 5 of Public Law 101–637 (104 Stat. 4590) struck out subparagraph (C) and should have amended subparagraph (B) by striking out “<quotedText style="-uslm-dtd:quote">; and</quotedText>” and inserting a period in lieu thereof.</p></footnote>
                    </subparagraph></paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s504/b/2" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">The priority list shall rank the potential candidates for abatement action based on the nature and magnitude of the existing and potential exposure presented by the asbestos materials.</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s504/b/3" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">For each school listed, the Governor shall certify that the statement of need contained in the application for assistance accurately reflects the financial resources available to the local educational agency for the asbestos abatement program.</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s504/b/4" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><chapeau style="-uslm-dtd:text">For the purpose of determining the adequacy of the financial resources available to a local educational agency for the abatement of asbestos threats the Governor shall, to the extent practicable, consider the following:</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s504/b/4/A" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">A measure of financial need used by the State in which the local educational agency is located.</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s504/b/4/B" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">The estimated per capita income of the locality of such agency or of those directly or indirectly providing financial support for such agency.</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s504/b/4/C" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">The extent to which the local school millage rate falls above or below (i) the millage rate average of the State and (ii) the millage rate of other local educational agencies with comparable enrollment, per capita income, and resource base.</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s504/b/4/D" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">The ratio, expressed as a percentage, of the estimated cost of the project to the total budget of the local educational agency.</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s504/b/4/E" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">The borrowing capacity of the local educational agency.</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s504/b/4/F" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="F">(F)<ref style="-uslm-dtd:footnote-ref" idref="ID472292EC42D8496B9566581E6F59A6A6" class="footnoteRef">7</ref> </num><content style="-uslm-dtd:text">Any additional costs to the local educational agency of meeting the special needs of disadvantaged students.</content><footnote id="ID472292EC42D8496B9566581E6F59A6A6" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">7</sup><p style="-uslm-dtd:para; margin-left:1em">So in original. Indentation is wrong.</p></footnote>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s504/b/4/G" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="G">(G) </num><content style="-uslm-dtd:text">Any other factor that demonstrates that the local educational agency has limited financial resources.</content>
                        </subparagraph>
                    </paragraph>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tV/s505" styleType="traditional">
                <heading style="-uslm-dtd:header">FINANCIAL ASSISTANCE. </heading>
                <num style="-uslm-dtd:enum" value="505">Sec. 505. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s4014">20 U.S.C. 4014</ref><b>]</b> </editorialNote><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tV/s505/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Assistance Program.—</heading><content style="-uslm-dtd:text">There is hereby established within the Environmental Protection Agency an Asbestos Hazards Abatement Assistance Program (hereinafter in this Act referred to as the “<quotedText style="-uslm-dtd:quote">Assistance Program</quotedText>”), which shall be administered in accordance with this section.</content></subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tV/s505/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Application Submission.—</heading><paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s505/b/1" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">Applications for financial assistance shall be submitted by a local educational agency to the Governor, or the Governor's designee, who shall establish a priority list based on the criteria of section 504(b)(2).</content></paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s505/b/2" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">Pursuant to section 504, the Governor shall submit applications, together with the Governor's report and priority list, to the Administrator who shall review and rank such applications pursuant to section 505(c)(2) and propose financing pursuant to the criteria of section 504(b)(4). The Administrator shall approve or disapprove applications for financial assistance no later than April 30 of each year.</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s505/b/3" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">Within sixty days of receipt of the information described in section 504(b)(1), the Secretary of the Department of Education shall review such information and, in the Secretary's discretion, provide to the Administrator comments and recommendations based upon the needs of local educational agencies for financial assistance. Within sixty days of receipt of the Secretary's report, or expiration of the time allowed for such report, the Administrator shall approve or disapprove applications for financial assistance.</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tV/s505/c" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Review of Application.—</heading><paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s505/c/1" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">The Administrator shall provide financial assistance on a school-by-school basis to local educational agencies in accordance with other provisions of this section to carry out projects for—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s505/c/1/A" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">abating the threat posed by materials containing asbestos to the health and safety of children or employees;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s505/c/1/B" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">replacing the asbestos materials removed from school buildings with other appropriate building materials; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s505/c/1/C" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">restoring school buildings to conditions comparable to those existing before abatement activities were undertaken pursuant to this section.</content>
                    </subparagraph></paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s505/c/2" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">The Administrator shall review and list in priority order applications for financial assistance. In ranking applications, the Administrator shall consider—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s505/c/2/A" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the priority assigned to the abatement program by the Governor pursuant to section 504(b)(2); and</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s505/c/2/B" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="B">(B)</num><clause style="-uslm-dtd:clause" identifier="/us/sComp/98/377/tV/s505/c/2/B/i" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the likelihood of release of asbestos fibers into a school environment;</content></clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/98/377/tV/s505/c/2/B/ii" styleType="OLC" class="leftIndentDecrease2">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">any other evidence of the risk caused by the presence of asbestos including, but not limited to, situations in which there is a substantial quantity of dry loose asbestos-containing material on horizontal surfaces or asbestos-containing material is substantially deteriorated or damaged, and there is asbestos-containing material in an air plenum or in a high traffic area, confined space, or within easy reach of a passerby;</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/98/377/tV/s505/c/2/B/iii" styleType="OLC" class="leftIndentDecrease2">
                                <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">the extent to which the corrective action proposed by the applicant will reduce the exposure of school children and school employees; and</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/98/377/tV/s505/c/2/B/iv" styleType="OLC" class="leftIndentDecrease2">
                                <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">the extent to which the corrective action proposed by the applicant uses the least burdensome methods which protect human health and the environment.</content>
                            </clause>
                        </subparagraph>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s505/c/3" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">In determining whether an applicant is eligible for assistance, and the nature and amount of financial assistance, the Administrator shall consider the financial resources available to the applicant as certified by the Governor pursuant to section 504(b)(4).</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tV/s505/d" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Limitation.—</heading><chapeau style="-uslm-dtd:text">In no event shall financial assistance be provided under this title to an applicant if—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s505/d/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the Administrator determines that such applicant has resources adequate to support an appropriate asbestos materials abatement program; or</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s505/d/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the applicant is not in compliance with title II of the Toxic Substances Control Act (15 U.S.C. 2641 et seq.).</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tV/s505/e" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Amount of Loan or Grant.—</heading><paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s505/e/1" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">An applicant for financial assistance may be granted a loan of up to 100 percent  of the costs of an abatement program or, if the Administrator determines the applicant is unable to undertake and complete an asbestos materials abatement program with a loan, such applicant may also receive a grant (alone or in combination with a loan) not to exceed 50 percent of the total costs of abatement, in the amount which the Administrator deems necessary.</content></paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s505/e/2" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">In approving any grant, the Administrator shall state with particularity the reasons why the applicant is unable to undertake and complete the abatement program with loan funds.</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tV/s505/f" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Loan Agreement.—</heading><chapeau style="-uslm-dtd:text">Loans under this section shall be made pursuant to agreements which shall provide for the following:</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s505/f/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the loan shall not bear interest;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s505/f/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the loan shall have a maturity period of not more than twenty years (as determined by the Administrator) and shall be repayable during such period at such times and in such amounts as the Administrator may specify in the loan agreement;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s505/f/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">repayment shall be made to the Secretary of the Treasury for deposit in the Asbestos Trust Fund established by section 5 of the Asbestos Hazard Emergency Response Act (Public Law 99–519; 20 U.S.C. 4022); and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s505/f/4" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">such other terms and conditions that the Administrator determines necessary to protect the financial interest of the United States.</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tV/s505/g" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Application Requirements.—</heading><paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s505/g/1" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">No financial assistance may be provided under this section unless an application has been submitted to the Administrator in accordance with such procedures as may be developed by the Administrator.</content></paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s505/g/2" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">The Administrator shall not approve an application unless—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s505/g/2/A" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><chapeau style="-uslm-dtd:text">the application contains such information as the Administrator may require, including but not limited to information describing—</chapeau>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/98/377/tV/s505/g/2/A/i" styleType="OLC" class="leftIndentDecrease1">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the nature and extent of the asbestos problem for which the assistance is sought;</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/98/377/tV/s505/g/2/A/ii" styleType="OLC" class="leftIndentDecrease1">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the asbestos content of the material to be abated;</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/98/377/tV/s505/g/2/A/iii" styleType="OLC" class="leftIndentDecrease1">
                                <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">the methods which will be used to abate the asbestos materials;</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/98/377/tV/s505/g/2/A/iv" styleType="OLC" class="leftIndentDecrease1">
                                <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">the amount and type of financial assistance requested;</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/98/377/tV/s505/g/2/A/v" styleType="OLC" class="leftIndentDecrease1">
                                <num style="-uslm-dtd:enum" value="v">(v) </num><content style="-uslm-dtd:text">a description of the financial resources of the local educational agency; and</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/98/377/tV/s505/g/2/A/vi" styleType="OLC" class="leftIndentDecrease1">
                                <num style="-uslm-dtd:enum" value="vi">(vi) </num><content style="-uslm-dtd:text">a justification for the type and amount of the financial assistance requested.</content>
                            </clause>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s505/g/2/B" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">the application contains a certification that—</chapeau>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/98/377/tV/s505/g/2/B/i" styleType="OLC" class="leftIndentDecrease1">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the local educational agency has prepared and is implementing an asbestos management plan, as required under title II of the Toxic Substances Control Act (15 U.S.C. 2641 et seq.); and</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/98/377/tV/s505/g/2/B/ii" styleType="OLC" class="leftIndentDecrease1">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">all activities to be conducted with the financial assistance will be performed by individuals trained and accredited in conformance with title II of the Toxic Substances Control Act (15 U.S.C. 2641 et seq.) and regulations promulgated under that title;</content>
                            </clause>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s505/g/2/C" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">the application contains assurances that the local educational agency will furnish such information as is necessary for the Administrator to make the report required by section 507 of this title.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s505/g/3" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">No financial assistance may be provided by the Administrator under this section for projects described in subsection (a)(2) on which abatement action was completed prior to January 1, 1984.</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s505/g/4" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">Except as provided in section 512(b)(1), in approving applications the Administrator shall provide assistance to the local educational agencies having the highest priority among applications being considered in order of ranking until the appropriated funds are expended.</content>
                    </paragraph>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tV/s506" styleType="traditional">
                <heading style="-uslm-dtd:header">ADMINISTRATIVE PROVISIONS. </heading>
                <num style="-uslm-dtd:enum" value="506">Sec. 506. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s4015">20 U.S.C. 4015</ref><b>]</b> </editorialNote><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tV/s506/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Regulations.—</heading><content style="-uslm-dtd:text">The Administrator shall promulgate rules and regulations as necessary to implement the authorities and requirements of this title.</content></subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tV/s506/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Procedures.—</heading><chapeau style="-uslm-dtd:text">The Administrator also shall establish procedures to be used by local educational agencies, in programs for which financial assistance is made available under section 505, for—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s506/b/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">abating asbestos materials in school buildings;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s506/b/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">replacing the asbestos materials removed from school buildings with other appropriate building materials; and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s506/b/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">restoring such school buildings to conditions comparable to those existing before asbestos containment or removal activities were undertaken.</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tV/s506/c" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Relationship to Other Laws.—</heading><content style="-uslm-dtd:text">Nothing contained in this title shall be construed, interpreted, or applied to diminish in any way the level of protection required under any other State or Federal worker protection or other applicable laws.</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tV/s506/d" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Other Authority.—</heading><chapeau style="-uslm-dtd:text">In order to effectuate the purposes of this title, the Administrator may also adopt such other procedures, standards, and regulations as the Administrator deems necessary, including—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s506/d/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">procedures for testing the level of asbestos fibers in schools, including safety measures to be followed in conducting such tests;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s506/d/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">standards for evaluating (on the basis of such tests) the likelihood of the leakage of asbestos fibers into the school environment; and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s506/d/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">periodic reporting with respect to the activities that have taken place using funds loaned or granted under this title.</content>
                    </paragraph>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tV/s507" styleType="traditional">
                <heading style="-uslm-dtd:header">ANNUAL REPORT. </heading>
                <num style="-uslm-dtd:enum" value="507">Sec. 507. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s4016">20 U.S.C. 4016</ref><b>]</b> </editorialNote><subsection style="-uslm-dtd:subsection" styleType="traditional" role="undesignated-level" class="inline"><heading style="-uslm-dtd:header">annual report<ref style="-uslm-dtd:footnote-ref" idref="IDF77B85B87C8E46938F491FC4BA918217" class="footnoteRef">8</ref> </heading><chapeau style="-uslm-dtd:text">During each calendar year until 1999, the Administrator shall prepare and submit, not later than June 1 of each year, to the Committee on Environment and Public Works of the Senate and to the Committee on Energy and Commerce of the House of Representatives a report on the loan and grant program authorized by section 505 of this title. The report shall—</chapeau><footnote id="IDF77B85B87C8E46938F491FC4BA918217" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">8</sup><p style="-uslm-dtd:para; margin-left:1em">Section 14(a)(7) of P.L. 101–637 amended the section heading of section 507 without striking out the old section heading.</p></footnote>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s507/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">describe the number of applications received;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s507/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">describe the number of loans and grants made in the preceding calendar year and specify each applicant for and recipient of a loan or grant;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s507/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">specify the number of loan or grant applications which were disapproved during the preceding calendar year and describe the reasons for such disapprovals;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s507/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">describe the types of programs for which loans or grants were made;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s507/5" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">specify the estimated total costs of such programs to the recipients of loans or grants and specify the amount of loans or grants made under the program authorized by this section; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s507/6" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">estimate the number of schools still in need of assistance and the amount of resources needed by such schools, categorized by State, to abate all remaining asbestos hazards.</content>
                </paragraph></subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tV/s508" styleType="traditional">
                <heading style="-uslm-dtd:header">RECOVERY OF COSTS. </heading>
                <num style="-uslm-dtd:enum" value="508">Sec. 508. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s4017">20 U.S.C. 4017</ref><b>]</b> </editorialNote><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tV/s508/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Loan Condition.—</heading><paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s508/a/1" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">As a condition of the award of any financial assistance under section 505, the recipient of any such loan or grant shall permit the United States to sue on behalf of such recipient any person determined by the Attorney General to be liable to the recipient for the costs of any activities undertaken by the recipient under such section.</content></paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s508/a/2" styleType="OLC" class="leftIndentDecrease1">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">The proceeds from any judgment recovered in any suit brought by the United States under paragraph (1) (or, if the recipient files a similar suit on its own behalf, the proceeds from a judgment recovered by the recipient in such suit) shall be used to repay to the United States, by deposit in the Asbestos Trust Fund established by section 5 of the Asbestos Hazard Emergency Response Act (20 U.S.C. 4022), to the extent that the proceeds are sufficient to provide for such repayment, an amount equal to the sum of—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s508/a/2/A" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the amount (i) outstanding on any loan and (ii) of any grant made to the recipient; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s508/a/2/B" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">an amount equal to the interest which would have been charged on such loan were the loan made by a commercial lender at prevailing interest rates (as determined by the Administrator).</content>
                    </subparagraph>
                </paragraph></subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tV/s508/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Expeditious Recovery.—</heading><content style="-uslm-dtd:text">The Attorney General shall, where appropriate, proceed in an expeditious manner to recover the amounts expended by the United States to carry out this title from the persons identified by the Attorney General as being liable for such costs.</content>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tV/s509" styleType="traditional">
                <heading style="-uslm-dtd:header">EMPLOYEE PROTECTION. </heading>
                <num style="-uslm-dtd:enum" value="509">Sec. 509. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s4018">20 U.S.C. 4018</ref><b>]</b> </editorialNote><content style="-uslm-dtd:text">No State or local educational agency receiving assistance under this title may discharge any employee or otherwise discriminate against any employee with respect to the employee's compensation, terms, conditions, or privileges of employment because the employee has brought to the attention of the public information concerning any asbestos problem in the school buildings within the jurisdiction of such agency.</content>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tV/s510" styleType="traditional">
                <heading style="-uslm-dtd:header" class="block">AFFECT ON RIGHTS UNDER OTHER LAWS. </heading>
                <num style="-uslm-dtd:enum" value="510">Sec. 510. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s4019">20 U.S.C. 4019</ref><b>]</b> </editorialNote><subsection style="-uslm-dtd:subsection" styleType="OLC" role="undesignated-level" class="inline"><chapeau style="-uslm-dtd:text">Except as otherwise provided in section 508, nothing in this title shall—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s510/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">affect the right of any party to seek legal redress in connection with the purchase or installation of asbestos materials in schools or any claim of disability or death related to exposure to asbestos in a school setting; or</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s510/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">affect the rights of any party under any other law.</content>
                </paragraph></subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tV/s511" styleType="traditional" role="definitions">
                <heading style="-uslm-dtd:header">DEFINITIONS. </heading>
                <num style="-uslm-dtd:enum" value="511">Sec. 511. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s4020">20 U.S.C. 4020</ref><b>]</b> </editorialNote><subsection style="-uslm-dtd:subsection" styleType="OLC" role="undesignated-level" class="inline"><chapeau style="-uslm-dtd:text">For purposes of this title:</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s511/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">asbestos</term>” means—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s511/1/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">chrysotile, amosite, or crocidolite; or</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s511/1/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">in fibrous form, tremolite, anthophyllite, or actinolite.</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s511/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Attorney General</term>” means the Attorney General of the United States.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s511/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">threat</term>” or “<term style="-uslm-dtd:quote">hazard</term>” means that an asbestos material is friable or easily damaged, or within reach of students or employees or otherwise susceptible to damage (including damage from water, vibration, or air circulation) which could result in the dispersal of asbestos fibers into the school environment.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s511/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">local educational agency</term>” means—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s511/4/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">any local educational agency as defined in section 8101 of the Elementary and Secondary Education Act of 1965; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s511/4/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the governing authority of any nonprofit elementary or secondary school.</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s511/5" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">nonprofit elementary or secondary school</term>” means—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s511/5/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">any elementary school or secondary school as defined in section 8101 of the Elementary and Secondary Education Act of 1965 owned and operated by one or more nonprofit corporations or associations no part of the net earnings of which inures, or may lawfully inure, to the benefit of any private shareholder or individual; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s511/5/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">any school of any agency of the United States.</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s511/6" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="6">(6) </num><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">school buildings</term>” means—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s511/6/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">structures suitable for use as classrooms, laboratories, libraries, school eating facilities, or facilities used for the preparation of food;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s511/6/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">any gymnasium or other facility which is specially designed for athletic or recreational activities for an academic course in physical education;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s511/6/C" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">other facilities used for the instruction of students, for research, or for the administration of educational or research programs; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s511/6/D" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">maintenance, storage, or utility facilities essential to the operation of the facilities described in subparagraphs (A) through (C) of this paragraph.</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s511/7" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Administrator</term>” means the Administrator of the Environmental Protection Agency, or the Administrator's designee.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s511/8" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="8">(8) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">State</term>” means each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the Virgin Islands, the Northern Mariana Islands, the Trust Territory of the Pacific Islands, and the Bureau of Indian Affairs.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s511/9" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="9">(9) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">response action</term>” has the meaning given such term by section 202(11) of the Toxic Substances Control Act (15 U.S.C. 2642(11).</content>
                </paragraph></subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tV/s512" styleType="traditional">
                <heading style="-uslm-dtd:header">AUTHORIZATION.<ref style="-uslm-dtd:footnote-ref" idref="ID9E3C7A23B07443EB9BCC22B669FCA46A" class="footnoteRef">9</ref> </heading>
                <num style="-uslm-dtd:enum" value="512">Sec. 512. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s4021">20 U.S.C. 4021</ref><b>]</b> </editorialNote><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tV/s512/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a)</num><paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s512/a/1" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">There are hereby authorized to be appropriated for the asbestos abatement program not more than $200,000,000 for each of fiscal years 1991, 1992, 1993, 1994, and 1995. In addition, for such purposes and for each of such fiscal  years there are authorized to be appropriated out of the Asbestos Trust Fund established by section 5 of the Asbestos Hazard Emergency Response Act of 1986 (20 U.S.C. 4022) such sums as are contained in such trust fund in each of such fiscal years.</content></paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s512/a/2" styleType="OLC" class="leftIndentDecrease1">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">The sums appropriated under this title shall remain available until expended.</content>
                </paragraph></subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tV/s512/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b)</num><paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s512/b/1" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">A State with qualified applicants shall receive no less than one-half of 1 per centum of the sums appropriated under this title or the total of the amounts requested by such applicants, whichever is less. Those amounts available in each fiscal year under this paragraph shall be obligated before the end of that fiscal year. For the purposes of this paragraph the term “<term style="-uslm-dtd:term">State</term>” means each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, the Bureau of Indian Affairs and, taken together, Guam, American Samoa, the Virgin Islands, the Northern Mariana Islands, and the Trust Territory of the Pacific Islands.</content></paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s512/b/2" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">Of those sums appropriated for the implementation of this title, not more than 5 percent may be reserved during each fiscal year for the administration of this title and for programs including (but not limited to) the following:</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s512/b/2/A" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">The establishment of training centers for contractors, engineers, school employees, parents, and other personnel to provide instruction, in accordance with title II of the Toxic Substances Control Act (15 U.S.C. 2641 et seq.), on asbestos assessment and abatement.</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s512/b/2/B" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">The development and dissemination of abatement guidance documents to assist in evaluation of potential hazards and the determination of proper abatement programs.</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s512/b/2/C" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">The development of rules and regulations regarding inspection, reporting, and recordkeeping.</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s512/b/2/D" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">The development of a comprehensive testing and technical assistance program.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tV/s512/b/3" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><chapeau style="-uslm-dtd:text">Of those sums appropriated for any fiscal year for the implementation of this title, the Administrator may use not more than 5 percent to provide grants to States for the following purposes:</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s512/b/3/A" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">Assisting local educational agencies in performing the periodic reinspections and training activities required under title II of the Toxic Substances Control Act (15 U.S.C. 2641 et seq.).</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/98/377/tV/s512/b/3/B" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">Establishing and maintaining programs to accredit personnel performing asbestos inspections and response actions.</content><editorialNote style="-uslm-dtd:legis-comment"><b>[</b>Section 2303 of P.L. 100–297 (102 Stat. 324) repealed titles VI and VII of this Act<b>]</b> </editorialNote>
                        </subparagraph>
                    </paragraph>
                </subsection><footnote id="ID9E3C7A23B07443EB9BCC22B669FCA46A" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">9</sup><content><p style="-uslm-dtd:para; margin-left:1em">Section 5 of the Asbestos Hazard Emergency Response Act of 1986 (Public Law 99–519; 20 U.S.C. 4022) provides:</p>
                <p style="-uslm-dtd:para">SEC. 5. ASBESTOS TRUST FUND.</p>
                <p style="-uslm-dtd:para; margin-left:1em">(a) <headingText style="-uslm-dtd:header-in-text">Creation of Trust Fund</headingText>.—There is established in the Treasury of the United States a trust fund to be known as the “<quotedText style="-uslm-dtd:quote">Asbestos Trust Fund</quotedText>”, consisting of such amounts as may be transferred or credited to such Trust Fund as provided in this section.</p>
                <p style="-uslm-dtd:para; margin-left:1em">(b) <headingText style="-uslm-dtd:header-in-text">Transfers to Trust Fund</headingText>.—</p>
                <p style="-uslm-dtd:para; margin-left:2em">(1) <headingText style="-uslm-dtd:header-in-text">Transfer</headingText>.—There are hereby transferred to the Asbestos Trust Fund amounts equivalent to—</p>
                <p style="-uslm-dtd:para; margin-left:4em">(A) amounts received in the Treasury on or after January 1, 1987, as repayments of loans made under section 505 of the Asbestos School Hazard Abatement Act of 1984 (Public Law 98–377; 20 U.S.C. 4011 et seq.),</p>
                <p style="-uslm-dtd:para; margin-left:4em">(B) amounts received as deposits from local educational agencies under section 207(a) of the Toxic Substances Control Act (as added by section 2 of this Act), and</p>
                <p style="-uslm-dtd:para; margin-left:4em">(C) amounts received as proceeds from any judgment recovered in any suit brought pursuant to section 508(a)(1) of the Asbestos School Hazard Abatement Act of 1984 (20 U.S.C. 4017(a)(1)).</p>
                <p style="-uslm-dtd:para; margin-left:2em">(2) <headingText style="-uslm-dtd:header-in-text">Monthly transfers</headingText>.—The amounts transferred by paragraph (1) shall be transferred at least monthly from the general fund of the Treasury to the Asbestos Trust Fund on the basis of estimates made by the Secretary of the Treasury of the amounts referred to in such paragraph. Adjustments shall be made in the amounts subsequently transferred to the extent prior estimates were more or less than the amounts required to be transferred.</p>
                <p style="-uslm-dtd:para; margin-left:1em">(c) <headingText style="-uslm-dtd:header-in-text">Management of Trust Fund</headingText>.—</p>
                <p style="-uslm-dtd:para; margin-left:2em">(1) <headingText style="-uslm-dtd:header-in-text">Investment</headingText>.—</p>
                <p style="-uslm-dtd:para; margin-left:4em">(A) <headingText style="-uslm-dtd:header-in-text">In general</headingText>.—The Secretary of the Treasury shall invest such portion of the Asbestos Trust Fund as is not, in his judgment, required to meet current withdrawals. Such investments may be made only in interest-bearing obligations of the United States and may be acquired—</p>
                <p style="-uslm-dtd:para; margin-left:6em">(i) on original issue at the issue price, or</p>
                <p style="-uslm-dtd:para; margin-left:6em">(ii) by purchase of outstanding obligations at the market price.</p>
                <p style="-uslm-dtd:para; margin-left:4em">(B) <headingText style="-uslm-dtd:header-in-text">Sale of obligations</headingText>.—Any obligation acquired by the Asbestos Trust Fund may be sold by the Secretary of the Treasury at the market price.</p>
                <p style="-uslm-dtd:para; margin-left:4em">(C) <headingText style="-uslm-dtd:header-in-text">Interest of certain proceeds</headingText>.—The interest on, and the proceeds from the sale or redemption of, any obligations held in the Asbestos Trust Fund shall be credited to and form a part of the Trust Fund.</p>
                <p style="-uslm-dtd:para; margin-left:2em">(2) <editorialNote style="-uslm-dtd:legis-comment"><b>[</b>Repealed by section 1131(c) of Public Law 104–66 (109 Stat. 725).<b>]</b></editorialNote></p>
                <p style="-uslm-dtd:para; margin-left:1em">(d) <headingText style="-uslm-dtd:header-in-text">Expenditures From Asbestos Trust Fund</headingText>.—Amounts in the Asbestos Trust Fund shall be available, as provided by appropriation Acts, only for purposes of carrying out the Asbestos Hazards Abatement Assistance Program under section 505 of the Asbestos School Hazard Abatement Act of 1984.</p>
                <p style="-uslm-dtd:para; margin-left:1em">(e) <headingText style="-uslm-dtd:header-in-text">Authority To Borrow</headingText>.—</p>
                <p style="-uslm-dtd:para; margin-left:2em">(1) <headingText style="-uslm-dtd:header-in-text">In general</headingText>.—There are authorized to be appropriated to the Asbestos Trust Fund, as repayable advances, $25,000,000 for each of fiscal years 1987, 1988, 1989, and 1990.</p>
                <p style="-uslm-dtd:para; margin-left:2em">(2) <headingText style="-uslm-dtd:header-in-text">Repayment of advances</headingText>.—</p>
                <p style="-uslm-dtd:para; margin-left:4em">(A) <headingText style="-uslm-dtd:header-in-text">In general</headingText>.—Advances made under this subsection shall be repaid, and interest on such advances shall be paid, to the general fund of the Treasury when the Secretary determines that moneys are available for such purposes in the Asbestos Trust Fund.</p>
                <p style="-uslm-dtd:para; margin-left:4em">(B) <headingText style="-uslm-dtd:header-in-text">Rate of interest</headingText>.—Interest on advances made under this subsection shall be at a rate determined by the Secretary (as of the close of the calendar month preceding the month in which the advance is made) to be equal to the current average market yield on outstanding marketable obligations of the United States with remaining periods to maturity comparable to the anticipated period during which the advance will be outstanding and shall be compounded annually.</p>
                <p style="-uslm-dtd:para; margin-left:1em">(f) <headingText style="-uslm-dtd:header-in-text">Effective Date</headingText>.—The amendments made by this section shall take effect on January 1, 1986.</p></content></footnote>

        </title>
        <title style="-uslm-dtd:title; -uslm-dtd-nonstandard:all-cap 10 no-bold" identifier="/us/sComp/98/377/tVIII" styleType="nonstandard">
            <num style="-uslm-dtd:enum" value="VIII">TITLE VIII—</num><heading style="-uslm-dtd:header">THE EQUAL ACCESS ACT </heading>
            <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tVIII/s801" styleType="traditional">
                <heading style="-uslm-dtd:header">short title </heading>
                <num style="-uslm-dtd:enum" value="801">Sec. 801. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s4071">20 U.S.C. 4071 note</ref><b>]</b> </editorialNote><content style="-uslm-dtd:text">This title may be cited as “<shortTitle style="-uslm-dtd:quote"><inline style="-uslm-dtd:short-title">The Equal Access Act</inline></shortTitle>”.</content>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tVIII/s802" styleType="traditional">
                <heading style="-uslm-dtd:header">denial of equal access prohibited </heading>
                <num style="-uslm-dtd:enum" value="802">Sec. 802. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s4071">20 U.S.C. 4071</ref><b>]</b> </editorialNote><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tVIII/s802/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a) </num><content style="-uslm-dtd:text">It shall be unlawful for any public secondary school which receives Federal financial assistance and which has a limited open forum to deny equal access or a fair opportunity to, or discriminate against, any students who wish to conduct a meeting within that limited open forum on the basis of the religious, political, philosophical, or other content of the speech at such meetings.</content></subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tVIII/s802/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><content style="-uslm-dtd:text">A public secondary school has a limited open forum whenever such school grants an offering to or opportunity for one or more noncurriculum related student groups to meet on school premises during noninstructional time.</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tVIII/s802/c" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><chapeau style="-uslm-dtd:text">Schools shall be deemed to offer a fair opportunity to students who wish to conduct a meeting within its limited open forum if such school uniformly provides that—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tVIII/s802/c/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the meeting is voluntary and student-initiated;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tVIII/s802/c/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">there is no sponsorship of the meeting by the school, the government, or its agents or employees;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tVIII/s802/c/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">employees or agents of the school or government are present at religious meetings only in a nonparticipatory capacity;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tVIII/s802/c/4" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">the meeting does not materially and substantially interfere with the orderly conduct of educational activities within the school; and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tVIII/s802/c/5" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">nonschool persons may not direct, conduct, control, or regularly attend activities of student groups.</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tVIII/s802/d" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><chapeau style="-uslm-dtd:text">Nothing in this title shall be construed to authorize the United States or any State or political subdivision thereof—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tVIII/s802/d/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">to influence the form or content of any prayer or other religious activity;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tVIII/s802/d/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">to require any person to participate in prayer or other religious activity;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tVIII/s802/d/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">to expend public funds beyond the incidental cost of providing the space for student-initiated meetings;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tVIII/s802/d/4" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">to compel any school agent or employee to attend a school meeting if the content of the speech at the meeting is contrary to the beliefs of the agent or employee;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tVIII/s802/d/5" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">to sanction meetings that are otherwise unlawful;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tVIII/s802/d/6" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">to limit the rights of groups of students which are not of a specified numerical size; or</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tVIII/s802/d/7" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">to abridge the constitutional rights of any person.</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tVIII/s802/e" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><content style="-uslm-dtd:text">Notwithstanding the availability of any other remedy under the Constitution or the laws of the United States, nothing in this title shall be construed to authorize the United States to deny or withhold Federal financial assistance to any school.</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/98/377/tVIII/s802/f" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="f">(f) </num><content style="-uslm-dtd:text">Nothing in this title shall be construed to limit the authority of the school, its agents or employees, to maintain order and discipline on school premises, to protect the well-being of students and faculty, and to assure that attendance of students at meetings is voluntary.</content>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tVIII/s803" styleType="traditional" role="definitions">
                <heading style="-uslm-dtd:header">definitions </heading>
                <num style="-uslm-dtd:enum" value="803">Sec. 803. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s4072">20 U.S.C. 4072</ref><b>]</b> </editorialNote><chapeau style="-uslm-dtd:text">As used in this title—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tVIII/s803/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">secondary school</term>” means a public school which provides secondary education as determined by State law.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tVIII/s803/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">sponsorship</term>” includes the act of promoting, leading, or participating in a meeting. The assignment of a teacher, administrator, or other school employee to a meeting for custodial purposes does not constitute sponsorship of the meeting.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tVIII/s803/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">meeting</term>” includes those activities of student groups which are permitted under a school's limited open forum and are not directly related to the school curriculum.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/98/377/tVIII/s803/4" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">noninstructional time</term>” means time set aside by the school before actual classroom instruction begins or after actual classroom instruction ends.</content>
                </paragraph>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/98/377/tVIII/s804" styleType="traditional">
                <heading style="-uslm-dtd:header">severability </heading>
                <num style="-uslm-dtd:enum" value="804">Sec. 804. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s4073">20 U.S.C. 4073</ref><b>]</b> </editorialNote><content style="-uslm-dtd:text">If any provision of this title or the application thereof to any person or circumstances is judicially determined to be invalid, the provisions of the remainder of the title and the application to other persons or circumstances shall not be affected thereby.</content>
            </section>
